---------- The Romanian Parliament adopts this law + Article 1 The honorary sign In the Service of the Fatherland is given to military foremen, petty officers and civil servants with special status, with professional degrees equivalent to the ranks of military and non-commissioned foremen, from the Ministry of National Defence, the Ministry of Administration and Interior, Ministry of Justice, Romanian Intelligence Service, Foreign Intelligence Service, Protection and Guard Service and Special Telecommunications Service, which have 15, 20 and 25 years of activity in the fields of defense, public order and national security. ---------- Article 1 has been amended by section 1. 1 1 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 2 (1) Honorary sign In the Homeland Service for military foremen, non-commissioned officers and for civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, shall be presented in two forms with hierarchical value equal: the mark and the baret. (2) The honorary sign in the Service of the Fatherland presents itself in the form of an oval piece, on which the outline of a cross of Malta is rendered. Marginally an open crown consisting of laurel and oak leaves is stamped. Central, in a medallion, are inscribed with Roman numerals the numbers: "XV", "XX" or "XXV". ---------- Alin. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 3 Regulation on the description and way of awarding the Honorary Sign In the Service of the Homeland for military foremen, non-commissioned officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and subofficers, for each category, as well as the drawn model of the honorary sign are provided in Annexes no. 1 and 2 which form an integral part of this law. + Article 4 (1) The honorary sign in the Service of the Fatherland shall be conferred by order or decision, as the case may be, by a) Minister of National Defence; b) Minister of Administration and Interior; c) Minister of Justice; d) director of the Romanian Intelligence Service; e) Director of the Foreign Intelligence Service; f) Director of the Protection and Guard Service; g) Director of the Special Telecommunications Service; h) the heads of other militarized or classified structures with civil servants with special status. (2) The order or decision shall be published in the Official Gazette of Romania, Part I, except for the annexes that, according to the law, are classified according to the category of personnel to which they refer. (3) The nominal proposals for conferring the Honorary Sign In the Service of the Fatherland shall be sent to the ministers, respectively to the heads of the autonomous central institutions 1 until August 31 of each year, and the number of those who will be decorated, until June 1 of the same year. ---------- Article 4 has been amended by section 4. 3 3 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 5 The honorary sign In the Homeland Service for military foremen, non-commissioned officers and for civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, can be conferred in unlimited numbers. + Article 6 The honorary sign In the Service of the Homeland for military foremen, non-commissioned officers and for civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, is conferred for: a) 15 years of activity in the fields of defence, public order and national security; b) 20 years of activity in the fields of defence, public order and national security; c) 25 years of activity in the fields of defence, public order and national security. + Article 7 (1) The accompanying document of the Honorary Sign In the Homeland Service is the attestation. (2) Attestations for the Honorary Sign In the Service of the Fatherland are validated by the signature or paraphernalia of the ministers or heads of the autonomous central institutions of the state ---------- Article 7 has been amended by section 7. 4 4 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 9 The amounts necessary to make the marks, ribbons, bars, attestations and boxes of the Honorary Sign In the Service of the Fatherland are provided, annually, by a chapter in the budget of the Ministry of National Defence, Internals, Ministry of Justice, Romanian Intelligence Service, Foreign Intelligence Service, Protection and Guard Service, Special Telecommunications Service, as well as other militarized or functionally framed structures public with special status. ---------- Article 9 has been amended by section 6.6. 6 6 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 10 The honorary sign In the Homeland Service for military foremen, non-commissioned officers and for civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, is established instead of the old Military Merit Order and of the Honorary Sign In the Army Service for military and non-commissioned foremen, in accordance with the provisions Law no. 29/2000 . + Article 11 The Military Merit Order, established in 1954 and which conferred on military foremen and subofficers prior to the entry into force of Law no. 29/2000 ,, is substituted with the following honorary signs: a) Order of the Third Class Military Merit, with the Honorary Sign In the Army Service for Military Maisters and Petty Officers who have 15 years of activity in the Army, until the entry into force of this Law, and with the Honorary Sign In the Service of the Fatherland for military masters, sub-officers and civil servants with special status, with professional degrees equivalent to the ranks of military and non-commissioned foremen, who have 15 years of activity in the fields of defence, public order and safety national, on the date of entry into force of this Law; b) Order of Military Merit Class II, Honorary Sign In the Army Service for Military Maisters and Petty Officers who have 20 years of activity in the Army, until the entry into force of this Law, and with the Honorary Sign In the Service of the Fatherland for military maisters, petty officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, who have 20 years of activity in the fields of defence, public order and safety national, on the date of entry into force of this Law; c) Order Military Merit Class I, with the Honorary Sign In the Army Service for Military Maisters and Petty Officers who have 25 years of activity in the Army, until the entry into force of this Law, and with the Honorary Sign In the Service of the Fatherland for military masters, petty officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, who have 25 years of activity in the fields of defence, public order and safety national, on the date of entry into force of this Law. + Article 12 Military masters, sub-officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, decorated with the Military Merit Order, established in 1954, with the Honorary Sign In the Army Service and with the Honorary Sign In the Homeland Service, benefit from the provisions Law no. 80/1995 on the status of military personnel, with subsequent amendments and completions. ---------- Article 12 has been amended by section 4.2. 7 7 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. + Article 13 The date of entry into force of this Law shall be repealed Government Ordinance no. 105/2000 on the Honorary Sign In the Army Service for Military and Petty Officers, published in the Official Gazette of Romania, Part I, no. 436 of 3 September 2000, approved with amendments by Law no. 651/2001 ,, as amended. This law was adopted by the Romanian Parliament, in compliance with the provisions of art. 75 75 and art. 76 76 para. (2) of the Romanian Constitution, republished. No. 574. + Annex 1 REGULATION on the description and the way of granting The Honorary Sign in the Homeland Service for military foremen, non-commissioned officers and civil servants with special status, with equivalent professional degrees with the ranks of military foremen and non-commissioned officers Article 1. -The honorary sign in the Homeland Service is granted for life. Article 2. -The honorary sign In the Service of the Fatherland can be granted to military foremen, sub-officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, for: a) 15 years of activity in the fields of defence, public order and national security; b) 20 years of activity in the fields of defence, public order and national security; c) 25 years of activity in the fields of defence, public order and national security. ---------- Article 2 of Annex 1 has been amended by section 2. 8 8 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. Article 3. -(1) The honorary sign in the Service of the Fatherland presents itself in the form of an oval piece, made of tombac, having the height of 35 mm and the width of 30 mm, with slightly reliefed border; marginally it is stamped, slightly embossed, an open crown made up of Laur leaves to the right and oak leaves to the left, 2 mm wide, tied at the bottom with a bow. ---------- Alin. ((1) of art. 3 3 of Annex 1 has been amended by section 6.6. 9 9 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. (2) The obverse, partially overlapping the crown, is rendered at the top a cross by Malta, with arms of 26 mm, having a central medallion with a diameter of 13 mm; in the medallion are applied the Roman numerals, high 9 mm, "XV", "XX" or "XXV", representing number of years of activity for which it is granted (3) On the reverse, at the top of the piece, an eagle is applied, 12 mm high and 8 mm wide, holding a Orthodox cross in the beak, in the right claw a sword, and in the left claw a mace and having applied on the chest the small shield of the Romanian coat of arms. At the bottom of the piece is inscribed "IN/SERVICES/FATHERLAND" with embossed letters, 2 mm high. (4) The mark is surmounted by a ring from which an open half-moon is started, consisting of two laurel branches, with a width of 31 mm and a height of 14 mm. Between the arms of the semicunsome is fixed a bar. (5) The ribbon, 35 mm wide and having an apparent height of 50 mm, is of yellow mored rips, crossed by 6 blue strips, 1 mm wide. On the back has a clamping system. ((6) Abrogat. ---------- Alin. ((6) of art. 3 3 of Annex 1 has been repealed by point (a) 18 18 of art. II of LAW no. 233 233 of 6 July 2007 published in MONITORUL OFFICIAL no. 490 490 of 23 July 2007. (7) The strap shall be presented in the form of a rectangular ribbon of rips, applied to a metal holder, 18 mm wide and 10 mm high and having the dimensions of the coloured bands of the ribbons reduced to 50%. On the baret is applied, with Roman numerals, 8 mm high, the number "XV", "XX" or "XXV", made of brown tombac. On the back has a clamping system. Article 4. -The difference between the categories is: a) for 15 years of activity, the mark is brared; b) for 20 years of activity, the mark is silver; c) for 25 years of activity, the mark is gilded. Article 5. -(1) The box in which the mark is kept is made of cardboard, dressed on the outside in blue pergamoid, has metal clasps and inside is lined with blue silk. ---------- Alin. (2) On the lid of the box are printed, with blue, Romanian coat of arms, name and category of honorary sign. Article 6. -(1) The honorary sign in the Homeland Service is usually carried out on the occasion of the National Day of Romania and the other national or religious holidays and in other situations established by specific regulations. (2) Honorary sign In the Service of the Fatherland is worn on the left side of the chest. ---------- Alin. ((2) of art. 6 6 of Annex 1 has been amended by section 6.6. 11 11 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. (3) The bar is worn daily only to the uniform, on the left side of the chest. The uniform is worn the bars of all the decorations received, in their descending order. Article 7. -For the conferment of the Honorary Sign In the Service of the Fatherland, military masters, sub-officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, must meet the following conditions: a) have a seniority in the fields of defence, public order and national security of 15, 20 or 25 years of activity; b) to have meritorious results in the performance of duties and in professional training, highlighted by qualifications of at least "good" in the assessments of service in the last 4 years before the year in which the Honorary Sign is to be given The Homeland Service. ---------- Article 7 of Annex 1 has been amended by section 1. 12 12 of art. V of LAW no. 189 189 of 24 October 2011 published in MONITORUL OFFICIAL no. 755 755 of 27 October 2011. Article 8. -For the conferment of the Honorary Sign In the Service of the Fatherland, the calculation a) to the seniority in activity, the time during which military maisters and subofficers in activity and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, were suspended suspended conditional on the execution of the sentence or were convicted with its execution, except in cases where, following the retrial of the case, the competent court handed down the acquittal; b) the years of the last 4 years prior to the year in which the Honorary Sign is to be given In the Service of the Fatherland for military masters, sub-officers and civil servants with special status, with professional degrees equivalent to the degrees of foremen military and non-commissioned officers, if during this period those concerned obtained annual qualifiers lower than the "good" rating. ---------- Lit. b) of art. 8 8 of Annex 1 has been amended by section 6.6. 13 13 of art. Article 9. -(1) Military Maistrii or sub-officers sanctioned for committing serious deviations from the provisions of the military regulations or from other legal provisions in the period from the last service appreciation until August 31 of the year when the The Honorary Sign in the Homeland Service is no longer proposed, and if the deviations were committed between August 31 and December 1, the ministers, respectively the heads of the autonomous central institutions of the state, have their deletion from the tables with proposals. ---------- Alin. ((1) applies only if the serious deviation committed would have as a result the granting of a lower rating to the "good" rating in the assessment of service for the current year. Article 10. -(1) For military masters, sub-officers and civil servants with special status, with professional degrees equivalent to the ranks of military foremen and non-commissioned officers, entitled to be given the Honorary Sign In the Service of the Fatherland, the duration of the activity in the army shall be calculated by 31 August of the year in which they are proposed to receive the mark.
