The Romanian Parliament adopts this law + Article 1 Approval Government Ordinance no. 104 104 of 30 August 1999 amending and supplementing the provisions Government Ordinance no. 20/1992 on metrology activity, adopted pursuant to art. 1 lit. G. 7 of Law no. 140/1999 on the empowerment of the Government to issue ordinances and published in the Official Gazette of Romania, Part I, no. 426 of 31 August 1999, with the following amendments and additions: 1. Point 1 shall read as follows: "" 1. Article 1 will read as follows: Lt; Art. 1. -This ordinance establishes the framework and the means by which the accuracy and uniformity of the measurements are ensured. gt; gt; ' 2. After point 1, points 1 ^ 1-1 ^ 8 are inserted as follows: "" 1 ^ 1. After Article 1, Article 1 ^ 1 is inserted as follows: Lt; Art. 1 1 ^ 1. -The specialized terms used in this ordinance are defined according to the provisions of Annex no. 1 which is an integral part of this ordinance. gt; gt; 1 1 ^ 2. Article 2 will read as follows: Lt; Art. 2. -In order to ensure the accuracy and uniformity of measurements, legal units and measuring means are used that have as national ethaloan references of Romania or other international countries or ethaloons, as the case may be. gt; gt; 1 1 ^ 3. Article 3 will read as follows: Lt; Art. 3. -Measuring means and measurements that are used in areas of public interest on population health and safety, public order, environmental protection, levying of taxes and rights, consumer protection or fairness commercial transactions are subject to legal metrological control, according to the provisions of this ordinance. The activities of economic agents, which have as their object the measuring means and the measurements provided in par. 1, are subject to legal metrological control, through authorization and metrological supervision, according to the provisions of this ordinance. gt; gt; 1 1 ^ 4. Article 4 is repealed. 1 1 ^ 5. Article 5 will read as follows: Lt; Art. 5. -The Romanian Bureau of Legal Metrology is the specialized body of the central public administration, competent body, responsible for ensuring metrological regulations, technical means and actions at the level of the entire country, necessary for achieving the credibility of the measurement results. The Romanian Bureau of Legal Metrology exercises, on behalf of the state, the legal metrological control of measuring instruments and measurements. gt; gt; 1 1 ^ 6. The title of Chapter II shall read as follows: T; Lt; LEGAL UNITS gt; gt; 1 1 ^ 7. Article 6 will read as follows: Lt; Art. 6. -The legal units are: a) units of measurement belonging to the International System of Units, symbolized AND, multiples and their decimal submultiples; b) units outside and used together with SI units; c) compound units. The legal units shall be approved by Government decisions establishing the names, symbols and definitions of legal units, the values of legal units that are not part of IS, expressed in SI units, and, as the case may be, areas where they can be used. gt; gt; 1 1 ^ 8. Article 7 will read as follows: Lt; Art. 7. -It is mandatory to use legal units in the measurements made in the areas of public interest provided in art. 3 3 para. 1. It is admitted the transient use of additional indications expressed in illegal units of measure, together with the legal units, only under the conditions established by Government decisions, provided in art. 6 6 para. 2. gt; gt; ' 3. Point 2 shall read as follows: "" Two. Articles 9 and 10 shall be repealed. ' 4. In point 3, Article 11 shall read as follows: "" Art. 11. -Depending on the purpose of use and independently of their construction or accuracy, the measuring instruments shall be divided into ethaloons and measuring instruments. ' 5. After point 3, point 3 ^ 1 is inserted as follows: "" 3 ^ 1. The title of Chapter IV is repealed. ' 6. In point 4, Article 12 shall read as follows: "" Art. 12. -National ecloons are recognized by Government decision, at the proposal of the Romanian Bureau of Legal Metrology. National standards are public property of the state, owned, perfected, preserved and used by organizations nominated by Government decision, which satisfy the requirements established according to the provisions of this ordinance. Expenditure on national standards of the Romanian Bureau of Legal Metrology and of the organizations provided in par. 2 is supported by the state budget. " 7. In point 5, Article 13 shall read as follows: "" Art. 13. -The traceability of the results of the measurements carried out with measuring means subject to legal metrological control is carried out through metrological checks, carried out by metrology laboratories under the conditions of this ordinance. For this purpose, traceable ethaloons are used at the national etaloons of Romania, other countries or international standards, as the case may be. " 8. After paragraph 5, points 5 ^ 1-5 ^ 3 are inserted with the following contents: "" 5 ^ 1. Article 14 will read as follows: Lt; Art. 14. -The testing, preservation and use of national standards, their comparison with the etaloons of other states and the connection to international standards are carried out according to the provisions of the legal metrology instructions, issued according to the provisions this ordinance. The legal metrology instructions provided in par. 1 will also establish the requirements that the organizations provided for in art. 12 12 para. 2 for their nomination. gt; gt; 5 5 ^ 2. The title of Chapter V shall read as follows: T; Lt; METROLOGICAL CONTROL LEGAL gt; gt; 5 5 ^ 3. The section 1 title will read as follows: T; Lt; LEGAL METROLOGICAL CONTROL OF MEASURING INSTRUMENTS gt; gt; " 9. In paragraph 6, Article 15 shall read as follows: "" Art. 15. -The means of working measurement intended to carry out the measurements in the fields of public interest provided in art. 3 3 para. 1, which are included in the Official List of measuring instruments subject to legal metrological control. Official list of measuring instruments subject to legal metrological control, provided in par. 1, will detail the measurements in areas of public interest provided in art. 3 3 para. 1 1, the categories and assortments of measuring instruments used in these measurements, the metrology control modalities applicable to each assortment, and the maximum permissible interval between two successive metrological checks; the list shall be establishes and is approved by the Director General of the Romanian Bureau of Legal Metrology and shall be published in the Official Gazette of Romania, Part I. For each of the categories of measuring instruments set out in the Official List of measuring instruments subject to legal metrological control, with the exception of non-automatic weighing instruments, rules of legal metrology shall be drawn up. and/or rules of legal metrology EEC, which determine the technical and metrological requirements specific to that category. " 10. In paragraph 7, Article 16 shall read as follows: "" Art. 16. -Before the placing on the market and the commissioning of the measuring instruments provided in art. 15 15 para. 1, with the exception of non-automatic weighing instruments, the legal metrological control shall be exercised in accordance with the provisions of the legal metrology instructions, by the following ways: a) model approval; b) EEC pattern approval; c) initial metrological verification; d) initial EEC verification e) metrological opinion. The conditions for placing on the market and putting into service of non-automatic weighing instruments and measuring instruments covered by the EEC legal metrology rules shall be laid down by specific technical regulations adopted by Government decisions. " 11. After paragraph 7, insert point 7 ^ 1 with the following contents: "" 7 ^ 1. After Article 16, Article 16 ^ 1 is inserted as follows: Lt; Art. 16 16 ^ 1. -The measuring means provided in art. 15 15 para. 1, under use, shall be subject, under the conditions established by legal metrology instructions, to the following ways of legal metrological control: a) periodic metrological verification; b) metrological verification after repair or modification; c) unannounced inspection and testing; d) metrological surveillance of use. gt; gt; ' 12. Point 8 shall read as follows: "" 8. Article 17 shall be repealed. ' 13. After paragraph 8, insert paragraph 8 ^ 1 with the following contents: " 8.1 Article 18 shall read as follows: Lt; Art. 18. -On the measuring instruments that corresponded to the legal metrological control provided for in art. 16 16 para. 1 1 and art. 16 16 ^ 1 lit. a) and b) the following metrological markings shall apply as appropriate: a) the marking of the model approval; b) the metrological verification mark; c) marking of EEC pattern approval; d) EEC initial verification mark. The measuring means provided in par. 1 are legal means of measurement. The graphic representation, the conditions of application and/or recognition of metrological markings shall be established by instructions of legal metrology. The metrological markings applied in the form of a seal shall also be subject to the legal provisions relating to the seals of the state and benefit from the same legal protection. gt; gt; ' 14. Point 9 shall read as follows: "" 9. Article 19 will read as follows: Lt; Art. 19. -The measuring instruments that did not comply with the legal metrological control or on which verification markings with outdated shelf life are applied do not have the quality of legal measuring means. It is forbidden to place on the market, commissioning or use for measurements in the fields of public interest provided in art. 3 3 para. 1 of the measuring means provided in par. 1. The holders of these measuring instruments shall be obliged, as appropriate, to withdraw them from the market or to remove them from their use. If the use of unlawful measuring means is found, they shall be sealed and, where appropriate, confiscated. In case of committing any crime, measures are taken not to disappear the traces of the crime, the crimes bodies and any other means of proof, according to the provisions of the Code of Criminal Procedure, and the prosecution bodies are notified. gt; gt; ' 15. In paragraph 10, Article 20 shall read as follows: "" Art. 20. -The Romanian Office of Legal Metrology can ensure the execution of the control activities provided in art. 16 16 para. 1 lit. c) and art. 16 16 ^ 1 lit. a) and b) by delegating the exercise of these control categories to laboratories authorized in accordance with the provisions of the legal metrology instructions. Authorized laboratories referred to in par. 1 1 shall draw up evidence of verified measuring instruments. '; 16. After paragraph 10, point 10 ^ 1 is inserted as follows: "" 10 ^ 1. The title of section 2 will read as follows: T; Lt; LEGAL METROLOGICAL CONTROL OF gt; gt; " 17. Paragraph 11 shall read as follows: " 11. Article 21 shall read as follows: Lt; Art. 21. -The measures falling under the following categories shall be subject to legal metrological control: a) measurements made in commercial transactions or measurements on the basis of which costs are established for public utilities, tariffs, taxes, damages, taxes and the like; b) measurements on some sizes affecting the interests of citizens, such as: sugar concentration and alcohol concentration in beverages, concentration of fats in milk and butter, hectolitric mass and grain humidity, speed motor vehicles, blood alcohol concentration and the like; c) measurements on some sizes affecting the health and safety of the population, as well as the environment, such as: organic and metallic pollutants from water, pesticides and other toxic substances, exhaust gas of motor vehicles, the content of noxes from the atmosphere and the like; d) measurements concerning products and goods which are delivered and sold prepacked, containing determined quantities, indicated by labelling or in other form, and products with declared grammage, without being prepacked; e) other measures in areas that may affect the health and safety of persons and environmental protection. For areas where these categories of measurement are used, the measurement methods shall be determined by the authorities as appropriate. gt; gt; ' 18. Paragraph 12 shall read as follows: "" 12. Article 22 will read as follows: Lt; Art. 22. -Legal metrological control over the measures provided for in art. 5 5 para. 2 2 is achieved by the following ways: a) sampling and carrying out comparative measurements and analyses to verify the accuracy of the declared results of the measurements; b) unannounced inspections and testing in the places where the measurements are carried out; c) approval of the measuring methods provided in art. 21 21 para. 2 2; d) metrological surveys. To carry out the legal metrological control provided in par. 1 The Romanian Bureau of Legal Metrology may request the collaboration of other bodies of the central or local public administration, as the case may be. gt; gt; ' 19. After paragraph 12, insert point 12 ^ 1 with the following contents: "" 12 ^ 1. The title of Chapter VI shall read as follows: Lt; OBLIGATIONS OF NATURAL AND LEGAL PERSONS IN THE FIELD OF LEGAL METROLOGY gt; gt; " 20. In paragraph 13, Article 23 shall read as follows: "" Art. 23. -Natural or legal persons who manufacture, import, repair, modify, verify, rent, sell or install means of measurement provided in art. 15 15 para. 1, except for non-automatic weighing machines, request the issuance by the Romanian Bureau of Legal Metrology, under the conditions provided by the specific regulations, of the following documents, as the case may be: a) opinions for the manufacture, import, repair/modification, rental, sale and installation of measuring instruments; b) certificates of model approval or, where applicable, EEC pattern approval certificates; c) authorizations for legal entities regarding the activity of verification of measuring instruments, as well as of the physical person metrologist verifier; d) metrological opinions. In special cases, provided in the specific regulations, the responsibility of obtaining the model approval lies with the holder Natural or legal persons who repair, modify, verify, rent and/or sell non-automatic weighing instruments, after they have been put into operation, request the issuance by the Romanian Bureau of Forensic Metrology, under the conditions provided by the specific regulations, the following documents, as applicable: a) notice for the repair/modification, rental, sale and installation of measuring instruments; b) authorizations for legal entities regarding the activity of verification of measuring instruments, as well as of the metrologist verifier individual. Natural and legal persons referred to in par. 1 and 2 must observe in the course of carrying out the initial requirements that formed the basis of the decision granting the authorizations and ensure the necessary conditions for the realization of metrological supervision, according to the provisions of the instructions Legal metrology. " 21. In paragraph 14, Article 24 shall read as follows: "" Art. 24. -Natural or legal persons who use or entrust to use, as owner, means of measurement subject to legal metrological control are obliged to ensure their legality and declare them, before putting in place. service/use, Romanian Bureau of Legal Metrology, to ensure metrological control. It shall be prohibited for natural or legal persons to hold in places intended for measurements in areas of public interest, provided for in art. 3 3 para. 1 1, measuring instruments specific to such measurements, if they are false or falsified, do not bear the mandatory metrological markings within the term of validity or have indications expressed only in units of unlawful measure. " 22. In paragraph 15, Article 25 shall read as follows: "" Art. 25. -The manufacturer of measuring instruments subject to legal metrological control by model approval or his authorized representative, legal person based in Romania, has the responsibility of applying the model approval marking, in conditions laid down by specific regulations. The manufacturer or his authorized representative, the importer or the holder of a measuring instrument shall be obliged to bring, in full, to the attention of the customers the conditionings imposed by the model approval certificate. " 23. In paragraph 16, Article 26 shall read as follows: "" Art. 26. -Manufacturers or their authorised representatives, importers and users shall bear the full responsibility for the quality of measuring instruments which are not subject to metrological control, from a metrological point of view. ' 24. In paragraph 17, Article 27 shall read as follows: "" Art. 27. -Economic agents legal entities that manufacture, import, repair, modify, verify, rent, sell or install the measuring means provided in art. 15 15 para. 1 will organize their activities subject to legal metrological control based on the requirements of the legal metrology instructions. The metrology activity will be coordinated by a technical officer of the activity, appointed by decision of the driver of the economic agent. " 25. Paragraph 18 shall read as follows: "" 18. Article 29 will read as follows: Lt; Art. 29. -It constitutes contraventions, if they have not been committed in such conditions that, according to the criminal law, they constitute crimes, the following facts and are sanctioned as follows: a) non-compliance with 7 7 para. 1, with contravention fine from 50,000,000 lei to 150,000,000 lei and sealing of the measuring instrument until the entry into law; b) non-compliance with 18 18 para. 1, with contravention fine from 10,000,000 lei to 50,000,000 lei and sealing of the measuring instrument; c) non-compliance with 19 19 para. 2, with contravention fine from 50,000,000 lei to 150,000,000 lei and sealing of the measuring instrument until the entry into law; d) non-compliance with 20 20 para. 2, with a contravention fine from 10,000,000 lei to 50,000,000 lei and/or the suspension of the authorization until a date established by the designated staff of the Romanian Bureau of Legal Metrology; e) the production and distribution of consumer and pre-packaged products that did not correspond to the legal metrological control methods provided in art. 22 22 para. 1 lit. a), b) and d), with contravention fine from 25,000,000 lei to 50,000,000 lei, as well as withdrawal from the market and/or prohibition of their placing on the market; f) non-compliance with 23 23 para. 1 and 2, with contravention fine from 100,000,000 lei to 200,000,000 lei; g) non-compliance with 23 23 para. 3, with contravention fine from 50,000,000 lei to 100,000,000 lei and restriction/suspension or withdrawal of authorization, as the case may be, according to the provisions of legal metrology instructions; h) non-compliance with 24 24 para. 1, with contravention fine from 50,000,000 lei to 100,000,000 lei; i) non-compliance with 24 24 para. 2, with contravention fine from 50,000,000 lei to 200.000,000 lei, sealing and/or confiscation of the measuring instrument, as the case may be; j) non-compliance with 25, with contravention fine from 25,000,000 lei to 75,000,000 lei and/or sealing of the measuring instrument; k) preventing, in any form, persons designated according to art. 36 to exercise the powers provided by law on legal metrological control, with contravention fine from 50,000,000 lei to 100,000,000 lei. gt; gt; ' 26 paragraphs 19 and 20 shall be repealed. 27. After paragraph 18, points 18 ^ 1 -18 ^ 4 with the following contents are inserted: "" 18 ^ 1. Article 30 will read as follows: Lt; Art. 30. -Contraventions provided for in art. 29 the provisions of Government Ordinance no. 2/2001 on the legal regime of contraventions, approved with amendments by Law no. 180/2002 ,, as amended. gt; gt; 18 18 ^ 2. Article 31 will read as follows: Lt; Art. 31. -If the fines provided for in art. 29 29 shall apply to natural persons, their minimum and maximum limits shall be reduced by half. gt; gt; 18 18 ^ 3. Article 32 will read as follows: Lt; Art. 32. -Against the minutes of finding the contravention and the application of the sanction can be made complaint by the natural or legal person, within 15 days from the date of its communication, at the court on whose territorial area the committed the contravention. gt; gt; 18 18 ^ 4. Article 33 will read as follows: Lt; Art. 33. -The finding of contraventions and the application of sanctions shall be made by the staff of the Romanian Bureau of Legal Metrology, designated for this purpose by the Director General. gt; gt; ' 28. Point 21 shall read as follows: "" 21. Article 34 shall be repealed. ' 29. After paragraph 21, insert paragraph 21 ^ 1 with the following contents: "" 21 ^ 1. Article 35 will read as follows: Lt; Art. 35. -For the services provided, in application of this ordinance, the Romanian Bureau of Legal Metrology has the right to establish and collect tariffs or the value of the estimates established on the basis of tariffs. The tariffs are proposed by the Romanian Bureau of Legal Metrology and approved by order of the Minister of Industry and Resources, which is published in the Official Gazette of Romania, Part I. gt; gt; " 30. In paragraph 22, Article 36 shall read as follows: "" Art. 36. -The staff of the Romanian Bureau of Legal Metrology designated to carry out the inspection, unannounced control and market surveillance activities has the right of access to all places where there is and use of measuring instruments, as well as in the places where are manufactured, repaired, modified, tried, checked, sold or rented means of measurement. Police bodies must grant, upon request, the necessary support to persons designated to carry out legal metrological control in the performance of their duties or to accompany them, as the case may be. " 31. Paragraph 23 shall read as follows: "" 23. Article 37 will read as follows: Lt; Art. 37. -In order to apply this ordinance, the Romanian Bureau of Legal Metrology elaborates instructions of legal metrology, norms of legal metrology and norms of legal metrology EEC. The instructions for legal metrology are approved by Government decisions; the rules of legal metrology and the rules of legal metrology EEC are approved by order of the Director General of the Romanian Bureau of Legal Metrology, respectively by order of the Minister of Industry and Resources, which is published in the Official Gazette of Romania, Part I. On the date of entry into force of this Ordinance, Metrology Law no. 27/1978 and Government Decision no. 225/1995 .. gt; gt; ' 32. Point 24 shall read as follows: "" 24. Annex no. 1 1 will have the following contents: Lt; the terms of specialty used in the ordinance are defined as follows: 1. model approval-decision with legal relevance based on an evaluation report, according to which a type of measuring instrument meets the requirements of applicable legal metrology regulations and is suitable for use in the regulated field, such that it is assumed that it achieves safe measurement results within a defined time period; 2. EEC pattern approval-model approval granted by reference to the requirements of the European Directives or the rules of legal metrology EEC; 3. EEC-the abbreviation of the European Economic Community, used in the codification of European directives from the old approach; 4. legal metrological control-assembly of legal metrology activities that contribute to metrological insurance; 5. standard-measuring instrument which is intended to define, achieve, preserve or reproduce a unit or one or more of a size of a size to serve as a reference; 6. calibration-assembly of operations which establish, under specified conditions, the relationship between the values of a size indicated by a measuring apparatus or a measuring system or between the values represented by a measure or a reference material; and the corresponding values made with ethaloons; calibration operations shall apply to both the standard and working methods; 7. international standard-standard recognized by an international agreement to serve internationally as a basis for assigning values to other milestones of the considered size; 8. national standard-standard recognised by a national decision to serve in a country as a basis for the attribution of values to other milestones of the size considered; 9. accuracy of measurement-degree of concordance between the result of a measurement and the true conventional value of the measured size; 10. accuracy of a means of measuring-property of a measuring instrument to give close answers of a true value; 11 11. metrological expertise-assembly of operations carried out in order to examine and demonstrate the state of a measuring instrument and determine its metrological characteristics, inter alia, by reference to the requirements of the applicable legal metrology regulations; 12. Legal metrology instruction-regulation of legal metrology that refers to the general principles and rules specific to legal metrological control activities; 13. placing on the market a measuring instrument-the action to make available a measuring instrument for the first time, for a fee or free of charge, for distribution and/or use; 14. marking of the model approval or marking of EEC pattern approval-distinguishing mark which, applied on a measuring instrument, attests its conformity with the approved model; 15. the metrological verification marking or the initial EEC verification marking-a distinctive sign which, applied on a measuring instrument subject to legal metrological control, confirms that the metrological verification, namely the initial EEC verification, has been performed with appropriate results; 16. reference material-material or substance whose one or more values of its property (s) are sufficiently homogeneous and well established for use in the calibration of a measuring apparatus, the evaluation of a method of measuring or assigning values to materials or substances; 17. measurement-assembly of operations aimed at determining a value of a size; 18. metrology-measurement science; 19. Legal metrology-part of metrology relating to activities that are carried out in accordance with the requirements regulated by competent bodies and that apply to measurements, measuring units, measuring instruments and methods measuring; 20. measuring instrument-measure, measuring apparatus, reference material or transducer, device, equipment, installations, as well as reference materials providing measurement information, alone or associated with one or more additional devices; 21. means of measuring work-means of measurement used in usual measurements; a working measuring instrument cannot be used for calibration or metrological verification of another measuring instrument of the same category; 22. the norm of legal metrology-regulation of legal metrology, specific to a certain category of measuring means, which contains the technical and metrological requirements that a measuring instrument in that category must meet, when subject to legal metrological control; 23. the norm of legal metrology EEC-the norm of legal metrology that transposes into Romanian legislation the provisions of the European directives regarding a category of measuring instruments subject to legal metrological control; 24. commissioning of a measuring instrument-the first use of a measuring instrument, for the purpose for which it was designed, by a final user; 25. authorized representative of the manufacturer-the legal person empowered by the manufacturer to act on his behalf; 26.
