+ Chapter 1 National system for improving the professional training of workers in socialist units + Article 1 In the Socialist Republic of Romania, the improvement of professional training is a primary duty of all workers and, at the same time, a permanent obligation of collective management bodies in socialist units. The leaders of the socialist units must ensure the conditions for each worker to follow, periodically, forms of improvement of professional training, corresponding to the duties of service he has to perform. In order to systematically carry out this activity, starting with 1971, the national system of perfecting the professional training of all workers is organized. + Article 2 The professional training of workers shall be aimed at: a) the systematic refreshment and enrichment of professional knowledge, the deepening of a certain field of basic specialty, the appropriation of new achievements of science, technique and culture of that specialty or of related ones (recycling); b) obtaining an additional qualification under the basic profession (polyalification); c) the change of qualification, in cases where the basic profession no longer meets the requirements of the modern technique and the structure of the economy, or can no longer be exercised due to changes in the work capacity (retraining); d) the acquisition of modern methods and procedures in the field of scientific management and organization of production and work, as well as of the economic knowledge necessary for the execution of service tasks. + Article 3 The improvement of the professional training of workers is carried out in enterprises, units with central status, ministries, other central bodies of the state administration, refresher centers, research and design institutes, education, as well as in other institutions and is carried out by the following forms: a) training at work, under the control of the direct chief; b) courses organized within the unit, in other units, as well as in centers of perfecting the training of cadres; c) personal refresher programs with regular verification of assimilated knowledge; d) internships and specialization in their own unit or in other units in the country or abroad; e) graduation, after assignment, of a educational institution, including postgraduate education; f) PhD. Other forms will be organized as required. The improvement of vocational training is based primarily on the individual study of workers. + Article 4 The work to improve the professional training of workers is carried out on the basis of annual and prospective plans that are part of the own plans of socialist organizations. + Article 5 The projects of the plans to improve the professional training of workers are elaborated by each socialist organization, from the basic units to the ministries and the other central bodies. Based on the proposals of the ministries, the other central bodies, as well as the executive committees of the county folk councils and the city of Bucharest, the Ministry of Education, the Ministry of Labour and the State Planning Committee elaborate the project of the centralized plan to improve the professional training of workers, which is an integral part of the general staff training programme. + Article 6 The improvement of the professional training of workers is organized by the ministries, the other central bodies, the executive committees of the county folk councils and the city of Bucharest and the subordinate units for the specialties and the professions in their activity profile as follows: A. In industry, construction, transport, movement of goods and services: -by Ministries for Deputy Ministers, Secretaries-General, Directors-General and other workers in the Ministry's apparatus, Directors-General and Directors of Central and Main Business Units, and for some specialist staff in that field; -by the units with central status for heads of service and execution personnel from their own apparatus, directors from enterprises other than those provided for in the previous paragraph, management staff, some categories of specialists, technicians and foremen from subordinate units; -by enterprises and other economic units for workers, foremen, technicians and other workers who are not included in the above-mentioned categories. B. In the field of agriculture, food industry, forestry and water management: -by the Ministry of Agriculture, Food Industry, Forestry and Water for Deputy Minister, Secretaries-General, Directors-General, Directors and other workers on their own apparatus, for directors of units with the status of central, enterprises, county general directions of agriculture, food industry, forestry and subordinate territorial waters and organizations, as well as for all higher education specialists working in agriculture, forestry and in the field of water management and for some staff specialty from the food industry; -by the county general directorates of agriculture, food industry, forestry and water for technicians, foremen and medium-trained personnel from subordinate units; --by plants, undertakings and other units for workers and other categories of unforeseen workers in the preceding paragraphs. C. In the activity of economic synthesis bodies: -by the respective central bodies for their own apparatus and that of the subordinate organisations. D. In the Ministry of Foreign Affairs: -by the Ministry of Foreign Affairs for Deputy Minister, Secretaries-General, Directors and the entire diplomatic and technical-administrative staff working in the system of this ministry. E. In education: -by the Ministry of Education for Deputy Minister, Secretaries-General, Directors-General, Directors and other workers of their own apparatus, rectors and vice-rectors of higher education institutions, directors of institutes and the ministry's research centres, inspectors general and chief inspectors from the county inspectorates; -by the Ministry of Education, through its own refresher units and higher education institutions for teaching staff, leadership and guidance from the general, professional and technical culture education, according to State of teaching staff; -by institutions of higher education for deans, vice-deans, teaching and research staff in the respective units. The improvement of teaching staff in higher education is mainly achieved through internships and specialization in production, research and design units; -by the units in education and research for other workers in their own apparatus who are not provided for in the preceding paragraphs. In the field of scientific research: -for the cadre of researchers of the institutes of the academies of sciences, by these academies; -for the cadre of researchers in the institutes subordinated to the ministries, by those ministries. The improvement of the researchers ' training is done in collaboration with the National Council of Scientific Research and the Ministry of Education. [CONTINUING ART. 6 IN CAP. 5] Ministry of Health for Deputy Minister, Secretaries-General, Directors-General, Directors and other workers in their own apparatus, management staff from medical research institutes, hospital and polyclinic units, directors of county health departments and other management staff in the health sector; -by the Ministry of Health. + Article 7 The work to improve the training of professionals in the common professions of several branches shall be ensured by the ministries, other central bodies of the state administration and their subordinate units, as well as by the executive committees of the councils. The county and the city of Bucharest, in collaboration with the central specialized bodies: -for workers in the planning work, together with the State Planning Committee; -for workers in the field of accounting, finance and financial control, together with the Ministry of Finance; -for foreign trade workers, together with the Ministry of Foreign Trade; -for workers in the field of salarization, organization, norsea and labor protection, together with the Ministry of Labor; -for construction workers, together with the Ministry of Industrial Construction; -for the price workers, together with the State Prices Committee; -for workers in the field of statistics, together with the Central Statistics Directorate; -for workers in the activity of quality technical control and metrology, together with the General Inspectorate of State for Quality Control of Products; -for jurisconsults, State Arbitration workers and departmental arbitrations, together with the Ministry of Justice. The State Committee for Nuclear Energy organises forms of preparation, specialization and improvement within the meaning of Article 3, in the nuclear field, for the needs of its own or other ministries and central state bodies. For other professions common to several branches, the Council of Ministers will determine, on a case-by-case basis, the specialized bodies that will work with the ministries to improve the training of workers in those professions. In the activity of perfecting the training of the workers referred to in the previous paragraphs, the central specialized bodies collaborate with the ministries and executive committees of the county folk councils and of the city of Bucharest program topics, providing teaching material and training staff. + Article 8 The Ministry of Labour, through the Central Institute of Studies for the problems of the management of the economy, the organization of work and the improvement of frameworks, ensures the improvement of the training of leading and specialized staff in ministries, other central state, executive committees of the county folk councils and the city of Bucharest, units with central status and main enterprises, in the field of management and scientific organization of production and work. The Ministry of Labour also exercises the methodological coordination and guidance of the improvement of the training of workers on management and organisation issues, which are carried out in ministries, units with central status, enterprises and institutions. + Article 9 The improvement of the professional training of workers through postgraduate and doctoral education is organized by the Ministry of Education, according to the legal provisions in force; for this purpose, the Ministry of Education collaborates with ministries and other interested bodies. Through the postgraduate education, the improvement of specialists with higher training from different fields of science, technique and culture is carried out. It is organized in specialized departments or faculties within the research and design institutions established with the approval of the Ministry of Education. + Article 10 Ministries and other central bodies of the state administration, as required, set up special refresher centers. + Article 11 The programmes to improve the professional training of workers, organised in businesses and institutions, are usually carried out without removal from work. The organization of improvement actions that require the removal from the workplace of the participants is done with the approval of the ministries, the other central bodies and the executive committees of the county folk councils and the city of Bucharest for the units in their subordination. + Article 12 The improvement activity is organized distinctly on levels of training and specialties, taking into account the needs of the units, the basic qualification of the workers, the requirements of the posts they occupy and their prospects promotion. Also, depending on the needs, refresher programs will be organized in the languages of the co-resident nationalities. + Article 13 The completion of the forms of improvement is made, as the case may be, on the basis of theoretical and practical evidence, works, exams, attestations, in accordance with the conditions set by the ministries and the other central organs of the state administration, according to the the form of preparation and activity of each branch and socialist unit. The graduation is certified by documents issued by the socialist units or the refresher centers in which the forms of improvement of the professional training of workers have been carried out. + Chapter 2 Rights and obligations of socialist and workers in these establishments + Article 14 The colleges of ministries and other central bodies of the state administration, the boards of the units with the status of central, the executive committees of the county folk councils and the city of Bucharest, the committees of direction from enterprises and institutions and other collective management bodies of socialist units shall be responsible for the organization, pursuit and smooth conduct of the work to improve the professional training of workers. + Article 15 The ministries and other central bodies of the state administration, as well as the executive committees of the county folk councils and the city of Bucharest, establish the forms of improvement, their duration and the frequency of recycling by category of workers, foremen, technicians, officials, specialist staff and management staff. + Article 16 Within each socialist organization there are collective of specialists who provide support to the management bodies in the units in the elaboration of the annual and prospective plan for the improvement of the professional training of workers, in establishing the forms, topics and methodology of conducting the programs organized for this purpose. The composition of these collectives is approved by the collective management body of each socialist unit. + Article 17 Ministries, other central state bodies and local bodies of the state administration, as well as their subordinate units, have the obligation to provide the necessary material means to carry out the work of perfecting the professional training of workers within the funds allocated to them through the plan. At economic units, the expenses necessary for the functioning of the training system for the professional training of workers shall be included, as the case may be, in the cost price of the production or in the investment funds; is supported by the budget. The expenses related to the functioning of the postgraduate education are covered by the contributions of the units that send the students to this form of improvement of the professional training. + Article 18 The collective management bodies of the socialist organizations are obliged to provide the teaching and training staff necessary for the training forms that are organized in their own units. The teaching and training staff shall be selected from among the specialists from enterprises, plants, ministries, research and design units, educational institutions, academies, scientific societies and professional associations. The teaching and training staff, used in various forms of perfecting the professional training of workers, provide this activity as a duty of service and as citizen's duty, obsteasca. + Article 19 If the improvement of professional training is carried out through programs or internships abroad, the collective management bodies must ensure: -establishing the concrete objectives of improvement; -selection of participants on the basis of professional training, knowledge of foreign languages, as well as according to their ability to assimilate new knowledge and apply them in concrete activity; -tracking how workers apply the appropriated knowledge in practice. + Article 20 The collective management bodies of the socialist units have the obligation to periodically analyze the stage of the realization of the plan of improvement of the professional training of workers, the way of carrying out and the efficiency of this activity, necessary for improvement. + Article 21 The continuous improvement of professional training is an obligation of service of all workers in socialist units. To this end, the following main duties shall be assigned to workers: a) to constantly concern himself with the knowledge of the latest conquests of science, technique and culture in their field of specialty; b) to participate in the forms of improvement in which they were assigned and to thoroughly acquire the knowledge taught; c) to use in practice the knowledge, methods, techniques and experience gained and to apply in their activity the principles of the science of management and organization of production and work. + Article 22 Workers who hold management positions, including foremen, are obliged to deal permanently with the improvement of the professional training of personnel in subordination by: -their direct guidance, at work; -participation in the establishment and implementation of plans to improve the training of workers; -the pursuit of the way in which each worker applies in practice the knowledge obtained through the various forms of improvement of professional training. + Article 23 In order to promote or maintain the position, the award of the salary gradations and steps, the granting of pardons, will be taken into account both the results obtained in the work and the way in which the workers carry out their tasks regarding the improvement professional training. + Article 24 Given that the forms of improvement of training are carried out with the removal from work on a single period or staggered over several periods, the students receive during their studies, from the socialist units to which they are employed, the tariff salary at work and the increase of seniority. If the duration of removal from work does not exceed one month, the driving staff shall also receive the driving allowance. + Chapter 3 The role of educational establishments, scientific institutions, professional associations and public organizations + Article 25 The Ministry of Education has the task of guiding and coordinating the work of improving the professional training of workers. The educational units have the obligation to support the socialist organizations in the elaboration of the refresher programs, in the organization and proper conduct of this activity. The material basis of schools of general culture, technical and vocational schools, specialized high schools and higher education institutions will be put, during when no teaching activities are carried out, at the disposal of ministries and other central bodies, local bodies of the state administration, plants, enterprises and other socialist units, in order to carry out the programs to improve the professional training of workers. Teachers from the education network will provide teaching and training hours in the forms of perfecting the professional training of workers from socialist units; these hours will be included in the mandatory teaching norm. + Article 26 In perfecting the training of workers, foremen, technicians, engineers and other staff with higher training, the material base and specialists from institutes, centers and research laboratories, from design units, as well as from territorial offices for the organization of production and work. + Article 27 Academy of the Socialist Republic of Romania, Academy of Social and Political Sciences, Academy of Agricultural and Forestry Sciences, Academy of Medical Sciences, National Council of Engineers and Technicians, Union of Architects, Association of Jurists, The society of economic sciences, as well as the other scientific institutions and professional associations have the obligation to participate, with the material basis and the specialists available to them, to the elaboration and realization of the training programs workers, foremen, technicians, engineers, doctors, staff teachers, other specialists in the field of economy, science and culture. + Article 28 The central institute of technical documentation, institutes and centres of technical, economic and scientific documentation in ministries, central and local bodies, units with central status, enterprises and other socialist organizations will provide materials documentaries and informative on the new conquests of science and technique, modern methods and forms of production and organization of production and work, necessary for teaching staff and learners from all forms of improvement of preparation professional workers. + Article 29 It is recommended to the General Union of Trade Unions in Romania to participate in the elaboration and implementation of all measures to raise the qualification of workers, bringing their contribution to the preparation and implementation of training programs professional, to organize the actions of technical and economic propaganda, to popularize the technical-scientific knowledge among the broad masses of working people. + Article 30 It is recommended to the Communist Youth Union to act systematically for the inclusion of young people from economic units, social-cultural and administrative institutions in the forms of improvement of professional training, for the thorough appropriation of to them of theoretical and practical knowledge and their valorisation in the concrete activity; with the support of ministries, of the leaders of socialist units, the organizations of the Communist Youth Union will carry out activities aimed at stimulating interest of young people for the full dominion of the chosen profession, for raising their cultural-scientific level. + Article 31 It is recommended that the central and local press, radio, television and other media outlets act systematically in support of the work to improve the professional training of workers in socialist units. + Chapter 4 Final provisions + Article 32 The provisions of this law shall apply, accordingly, in the organization of own systems for the improvement of the professional training of workers of the Ministry of Armed Forces, the Ministry of Internal Affairs and the Security Council The state in accordance with the rules to be determined by these bodies. + Article 33 Art. 21 21 of Law no. 1/1970 on the organization and discipline of labor in the state socialist units applies to workers who follow the professional improvement course with the removal from production for a minimum duration of 3 months, and for those who are sent to specialization abroad, regardless of duration. + Article 34 It is recommended to cooperative organizations and other public organizations that, starting from the objectives and provisions of this law, to establish appropriate regulations on the improvement of the professional training of workers in own units. + Article 35 This law repeals all provisions contrary to its provisions. + Chapter 5 + Article 36 G. In the field of health protection: -by the Ministry of Health for Deputy Minister, Secretaries-General, Directors-General, Directors and other workers in their own apparatus, management staff from medical research institutes, hospital units and polyclinics, directors of county health departments and other management staff in the health sector; -by the Ministry of Health for all doctors on the problems of medical specialties; -by the county health departments and pharmaceutical offices for chief doctors of sanitary and dispensing constituencies, the average health personnel with technical management positions, pharmacy supervisors, management staff Technical-administrative units of the technical-sanitary units; -by health facilities for other workers in their own apparatus who are not provided for in the preceding paragraphs. In the field of justice: -by the Supreme Court, the Prosecutor's Office of the Socialist Republic of Romania and the Ministry of Justice for Vice-Presidents and Judges of the Supreme Tribunal, Deputy Prosecutor General and Prosecutors of the Prosecutor General's Office and for the deputies of the minister, directors and other workers of his own apparatus, presidents of the county courts, the court of Bucharest and of the courts, as well as chief prosecutors and notaries; -by the courts, prosecutors and notaries of the county and of the city of Bucharest for judges, prosecutors, notaries and other justice workers. I. In the field of culture -by the State Committee on Culture and Art for Vice-Presidents, Secretaries-General, Directors and Other Workers of its own apparatus, Presidents and Vice-Presidents of County Culture and Art Committees, Directors-General and Directors of the the economic plants subordinated to the committee, directors from the main institutions of culture and art; -by plants and cultural institutions for their own apparatus of subordinate units; -by the county culture and art committees, for frames from cultural hostels, culture houses, communal and municipal libraries, museums. J. In local government: -by the State Committee on the Economy and Local Government for Vice-Presidents, Secretaries-General, Directors and Other Workers of its own apparatus, as well as for secretaries of the Executive Committees of the County People's Councils and of the city of Bucharest and directors in the own apparatus of these executive committees, for the secretaries of the executive committees of the municipal and city folk councils, as well as for the vice-presidents and secretaries of the executive committees of the common communal councils; -by the executive committees of the county folk councils and the city of Bucharest, of the municipal and city folk councils, for workers from their own apparatus, as well as for leading and specialized staff from the units subordinate; -by the executive committees of the higher hierarchical folk councils, for workers of the executive committees of the communal folk councils; -by undertakings and other units subordinated to workers, foremen, technicians and other workers not included in the categories referred to in the preceding paragraphs. The improvement of the professional training of workers in dual subordination units is organized by the executive committees of the county folk councils and the city of Bucharest, in collaboration with the specialized central bodies. -----------
