In order to improve the activity of canteens-restaurant for serving employees, pensioners and their family members with high quality preparations, in various assortments and at appropriate prices, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 Establishment, organization and operation of canteens-restaurant + Article 1 The canteens-restaurant are established and organized, at the request and besides the state socialist organizations, by decisions of the executive committees of the city, municipal or county folk councils, in consultation with the local union bodies. The establishment and organization of canteens-restaurant are made in cases where there are an appropriate number of consumers who dine at these units, so that they ensure the full use of their capacity to prepare and serve meals, as well as their operation on effective economic bases. + Article 2 Canteens-restaurant are subordinated to local commercial organizations, have economic management, keep track of the activity and conclude their own balance sheet. The executive committees of the county folk councils and the city of Bucharest can establish that the commercial directions have in direct subordination certain cantine-restaurant; in such cases, the canteens-restaurant have legal personality. + Article 3 The venues of the canteens-a restaurant that are built in the future are carried out by the socialist state socialist organizations of investment plan together with the executive committees of the popular councils and are located outside the premises of the units. + Article 4 The existing canteens are reorganized in canteens-restaurant by the units besides which operate, together with the executive committees of the popular councils, according to the provisions of this law. The management of the units under which the existing canteens operate are obliged to take measures to separate them from the premises of the units and to ensure direct access from outside to their premises, so that the employees of other units can also take the meal in the cafeteria. + Article 5 For the full use of the material base of the canteens-restaurant and for the realization of additional incomes intended to improve the quality of the meal and to make it cheaper, the executive committees of the popular councils are obliged take measures that, in addition to the lunch, canteens-restaurant serve breakfast and evening meal, and depending on the request to function as a restaurant after hours and on holidays. Dietary menus can also be served at these tables. The canteens-restaurant organizes buffets, kiosks and other mobile units in the premises of state socialist organizations for serving employees during the lunch break. Canteens-restaurant can also provide protection nutrition for workers. At the cafeteria-restaurant can also serve meals and family members of employees, employees in delegation, pensioners and their family members, as well as other people, based on the approval of the management committee of the restaurant-restaurant. It can also be organized the service of menus at the consumer's home, on the basis of subscription or prior orders, as well as the undoing of semi-prepared household type. + Article 6 As the necessary material base is created, the self-service system is introduced in the canteens-restaurant. For this purpose, the Ministry of Internal Trade and the other central and local bodies that have in subordination commercial equipment manufacturing units shall take measures to increase the production of self-service lines, refrigeration, thermal and work mechanization intended for the operation of cantinelor-restaurant. + Article 7 In order to ensure its proper functioning, the cafeteria-restaurant has a management committee consisting of: the delegate of the leadership of the state socialist organization whose employees are subscribed; the delegate of the union; the delegate of the Union organization Communist Youth; delegate of the commission of women; representatives of the subscribed employees chosen by them according to their number; head of the restaurant-restaurant. In the case when the cafeteria-restaurant serves the salaried mass of several state socialist organizations, the canteen-restaurant management committee can also include delegates from these state socialist organizations, according to the paragraph. The members of the management committee of the canteen-restaurant choose, from their turn, a president of this committee, who cannot be the head of the restaurant-restaurant. + Article 8 The management committee of the cafeteria shall exercise the following tasks: -adopt decisions on the development of the activity of the canteen-restaurant and establish the necessary measures for its proper functioning; -decides, with the agreement of the leadership of the socialist state organization, according to needs, the establishment of buffets, kiosks, tonettes in its premises; -takes measures for the permanent improvement of the quality of fixed menus and preparations, diversification of assortments according to the requirements of employees and ensures compliance with hygienic-sanitary norms in cantina-restaurant; -pursues the efficient use of the canteen-restaurant goods, preserving the integrity of its heritage and the management of the commodity fund; -approves the opening hours of the restaurant, after consulting the management of the respective state socialist organizations; -lays down fixed menus and other preparations, including dietary menus, which may be served at the cantine-restaurant as well as their prices; -analyzes and endorses the reports presented by the head of the restaurant-restaurant. The decisions of the management committee of the canteen-restaurant are taken with the vote of half plus one of the number of committee members. The management committee of the canteen-restaurant and its members respond to the measures taken and the activity carried out both to the executive committee of the popular council, as well as to the employees, the leaders of the enterprises and the public organizations which they represent. + Article 9 The head of the canteen-restaurant is called and is released from office by the executive board of the popular council with the agreement of the canteen-restaurant management committee. For the completion of the commodity fund, the canteens-restaurant have the right to buy food products, including live animals, from agricultural production cooperatives, from individual producers and from the unorganized market or from shops with retail, under the same conditions as food establishments. The canteens-restaurant can organize annexes, especially livestock and poultry farmers, where there are proper conditions and where forage is provided. Where there are conditions, state socialist organizations provide the canteen-restaurant, for use, the place necessary for operation. If the cafeteria-restaurant takes the salaried mass of several state socialist organizations, the expenses shown in this article are paid monthly by them, in relation to the number of subscribers and the number of meals served. For pensioners who serve fixed menus on the basis of subscription to the canteens-restaurant of the state socialist organizations where they come from, they shall bear the expenses provided for in paragraph 1. + Article 21 Economic organizations, with the approval of the general meeting of employees *, can allocate-of the remaining benefits at their disposal for prizes and non-centralized investments-an amount intended for the development of the restaurant-restaurant, as well as for the meals served to employees The amount of the amount referred to in the preceding paragraph shall be determined by the general meeting of the annual employees, with the debate on the activity presented by the steering committee * of the economic organization. Also, state socialist organizations whose employees dine at the cafeteria-restaurant support, through their technical-administrative employees, keeping records, making inventories and calculating prices at the cantine-restaurant; these employees are responsible for the quality of works + Article 22 Local trade organizations cannot charge quotas for administration and management expenses from canteens-restaurant in subordination. + Article 23 Employees and pensioners of their own who serve fixed menus at the cafeteria-restaurant on a subscription basis bear the price of the meal: the cost of food, calculated on the basis of purchase prices; the salary fund and the other money rights due the staff of the canteen-restaurant, including the contribution for social security; the expenses of directing the restaurant-restaurant, outside those provided for in art. 20. + Article 24 The prices shall be determined by the management committee of the canteen-restaurant, as follows: a) prices for fixed menus served to employees and pensioners of their own, on a subscription basis, in the morning, at noon and in the evening, are calculated without benefits, according to the provisions of art. 23 23; b) prices for other preparations and products, and as well as for fixed menus served without subscription in the cafeteria-restaurant is formed from the cost of food calculated on the basis of purchase prices and total overhead expenses, to which it is add a certain benefit. The price thus formed must be lower than the price with which the preparations and products are opened in the commercial food establishments of category III. If local conditions allow, the executive committees of the popular councils can also take action to take them over. + Article 30 The provisions of this Law shall not apply to a) the popotes of the personnel of the Ministry of Armed Forces, the Ministry of Internal Affairs and b) school canteens of any kind, including student ones, as well as those of hospitals, nurseries and children's homes.
