The Romanian Parliament adopts this law + Article UNIC Protocol no. 13 to the Convention for the Protection of Human Rights and Fundamental Freedoms on the abolition of the death penalty, concluded in Vilnius on 3 May 2002. This law was adopted by the Senate at the meeting of 21 November 2002, in compliance with the provisions of art. 74 74 para. (2) of the Romanian Constitution. p. PROTOCOL No 13 to the Convention for the Protection of Human Rights fundamental freedoms for the abolition of the death penalty *) --------- Note * *) Translation. Member States of the Council of Europe, signatories to this Protocol, convinced that the right of everyone to life represents a fundamental value in a democratic society and that the abolition of the death penalty is essential for the defense of this right and for the full recognition of the innate dignity of all beings human, wishing to strengthen the defence of the right to life guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms, signed in Rome on 4 November 1950 (hereinafter referred to as the Convention), considering that Protocol no. 6 to the Convention on the abolition of the death penalty, signed in Strasbourg on 28 April 1983, does not preclude the death penalty relating to acts committed in time of war or imminent danger of war, being determined to finally act to abolish the death penalty in all circumstances, have agreed on the following: + Article 1 Abolition of the death penalty The death penalty is abolished. No one can be sentenced to such punishment nor executed. + Article 2 Prohibition of derogations No derogation from the provisions of this Protocol pursuant to art. 15 of the Convention is not allowed. + Article 3 Reserve prohibition No reservation to the provisions of this Protocol pursuant to art. 57 of the Convention is not admitted. + Article 4 Territorial application 1. Any State may, at the time of signature or at the time of deposit of its instrument of ratification, acceptance or approval, designate the territory or territories as to which this Protocol will apply. 2. Any State may, at any time thereafter, by a declaration addressed to the Secretary-General of the Council of Europe, extend the application of this Protocol to any other territory designated in the declaration. The Protocol will enter into force on this territory on the first day of the month following the expiry of the three-month period from the date of receipt of the declaration by the Secretary-General 3. Any declaration made by virtue of the two preceding paragraphs may be withdrawn or amended, in respect of any territory designated in this declaration, by notification addressed to the Secretary-General of the Council of Europe. Withdrawal or amendment shall take effect from the first day of the month following the expiry of the period of three months from the date of receipt of the notification by the Secretary + Article 5 Reporting to the Convention States Parties consider art. 1-4 of this Protocol as additional articles to the Convention and all the provisions of the Convention shall apply accordingly. + Article 6 Signing and ratification This Protocol shall be open to the signing of the Member States of the Council of Europe, signatories He will be subject to ratification, acceptance or approval. A Member State of the Council of Europe will not be able to ratify, accept or approve this Protocol without having ratified the Convention simultaneously or previously. Instruments of ratification, acceptance or approval will be deposited with the Secretary-General of the Council of Europe. + Article 7 Entry into force 1. This Protocol will enter into force on the first day of the month following the expiration of the three-month period from the date on which ten member states of the Council of Europe will have expressed their consent to be bound by the Protocol in accordance with the provisions of art. 6. 2. For any Member State which will subsequently express its consent to be bound by the Protocol, it shall enter into force on the first day of the month following the expiry of the period of three months from the date of deposit of the instrument of ratification, of acceptance or approval. + Article 8 Functions of Depositary The Secretary-General of the Council of Europe will notify the Council of a) any signing; b) the deposit of any instrument of ratification, acceptance or approval; c) any date of entry into force of this Protocol, according to art. 4 4 and 7; d) any other act, notification or communication having a connection with this Protocol. In consideration of the above, the undersigned, having full powers for this purpose, have signed this Protocol. Concluded in Vilnius on 3 May 2002, in French and English, both texts being equally authentic, in a single copy, which will be deposited in the archives of the Council of Europe.
