AGREEMENT between the Romanian Government and Council of Europe establishment and operation of the Information Office Council of Europe in Bucharest Romanian Government and Council of Europe, Referring to the Resolution (99) 9 of the Committee of Ministers of the Council of Europe on the establishment of the Council of Europe Information Offices to replace the current information and documentation centres of the Council of Europe, Whereas the Council of Europe Information Office is an institution of the Council of Europe, Considering that Romania is a party to the General Agreement on the Privileges and Immunities of the Council of Europe, concluded in Paris on 2 September 1949, considering the provisions art. 6 lit. b) of Government Ordinance no. 7/2001 , adopted on 19 July 2001 by the Romanian Government, considering that it is necessary to conclude an agreement regulating certain aspects related to the establishment and functioning of the Information Office of the Council of Europe in Bucharest, have agreed the following: 1. The Information Office of the Council of Europe is established in Bucharest, hereinafter referred to as the Office. 2. In its work, the Bureau will have the following objectives: a) support the implementation of cooperation programmes and other projects of the Council of Europe; b) translating, publishing and spreading the texts of the Council of Europe and developing new publications; c) promotion of activities, in cooperation with local partners, to strengthen the knowledge of the standards promoted by the Council of Europe; d) ensuring logistic, informational and media support for the meetings of the Council of Europe that take place in Romania; e) participation, on behalf of the Council of Europe Secretariat, at internal events organized in Romania, which are of European interest. 3. The Romanian Government, through the Ministry of Foreign Affairs, provides, without rent, a local for the functioning of the Bureau. The operational costs of the Bureau are entirely covered by the Council of Europe. 4. As an institution of the Council of Europe, the Bureau benefits from the provisions of the General Agreement on the privileges and immunities of the Council of Europe, concluded in Paris on The office has legal personality. The offices and buildings of the Bureau are inviolable. His assets and assets, wherever they are and anyone who is their holder, are exempted from search, requisition, confiscation, expropriation or any other form of administrative, judicial or legislative coercion. 8. The archives of the Bureau and, in general, all documents belonging to him or which he holds are inviolable wherever they are found. 9. The Office shall, for its official communications, benefit from the treatment at least as favourable as that granted to the diplomatic mission of any government, with regard to priorities, tariffs or postal charges, cable communications, telegrams, telephone, telegraph, telex, other means of communication and also press and radio information services. The government ensures the inviolability of official communications of the Bureau and correspondence, including electronic communications (e.g. e-mail, web site, etc.) and will not censor its communications or correspondence. This inviolability, unlimited at the previous enumeration, also applies to publications, photographs, slides, films and sound recordings. 10. The office has permission to display the emblem of the Council of Europe on its buildings and premises. 11. Bureau staff (director and members) shall include staff of the Council of Europe and staff recruited locally. 12. The Secretary-General of the Council of Europe will communicate to the Government of Romania the names of the members of the staff of the Bureau who benefit from 18 of the General Agreement on privileges and immunities of the Council of Europe With regard to the lifting of the immunity of the members of the staff of the Office, 19 of the General Agreement on privileges and immunities of the Council of Europe 13. The staff members of the Bureau recruited locally and having Romanian citizenship or permanent residence in Romania remain subject to the laws and regulations in force in Romania. However, the Romanian authorities will exercise their jurisdiction over such persons so as not to unduly embarrass the performance of the Office's functions. 14. The Office shall benefit from all resources, equipment and documentation previously available to the Information and Documentation Centre of the Council of Europe in Bucharest. 15. This Agreement shall enter into force on the date of notification by the Romanian side to the Council of Europe of the completion of internal procedures for its entry into force and shall remain valid for a period of 3 years, with the possibility of Signed in Strasbourg on 23 April 2002, in two original copies, in Romanian and English, both texts being equally authentic.
