Law No. 6 of 14 March 1969 concerning the status of teachers from the Socialist Republic of Romania ISSUING NATIONAL ASSEMBLY and published in Official Gazette No. 33 of 14 March 1969, Chapter 1, Article 1 teaching staff from the Socialist Republic of Romania has a noble mission and high social responsibility and patriotic to achieve education goals, contributing to the formation of harmonious personality and versatile, the flowering orinduirii our nation and Socialist.
Teaching staff carries out the policy of the Communist Party and the Romanian State in the field of education; It ensures young generations the preparation of literacy and specialized active integration into social life, they formed the scientific conception of the nature and society, we cultivate the love towards the motherland and netarmurita people, dedication to the cause of socialism, for the ideals of peace and understanding between peoples and social betterment.
In carrying out its tasks, the teaching staff is required to demonstrate a high consciousness of citizen and professional demeanor, be worthy in the school, in the family and in society, to focus on raising the standing of its preparation, pedagogical and ideological.


Article 2 this Statute lays down the functions of educational institutions and regulates their employment, transfer, separation, and dismissal, rights and duties of teachers, improving salary criteria, the distinctions and awards, disciplinary and material, as well as its passage.


Article 3 of the Statute applies to face teachers teaching teachers teachers, self management and teaching staff of the guidance and control in pre-school, compulsory school, upper secondary school literacy, vocational and technical school education, and the teaching staff of the departments and teaching staff from higher education leadership.


Chapter 2 article 4 For educational-educational activity from pre-school, compulsory school, upper secondary school literacy, vocational and technical education school, drew up the following functions: teaching functions of teaching);

d) functions for the guidance and control of educational activity and education.
  


Article 5 teaching teaching Functions are performed by the following:-staff in pre-school, MMPC performing instructional and educational in kindergartens and in addition to kindergartens organized homes;
compulsory education-literacy, from grades 1-4 teachers and teacher; at these classes and teaching can be done by teachers, subjects;
compulsory education-literacy, at grades 5-10, Lycee, vocational and technical education school, the teachers and trainees, instructors who teach or instruct subjects according to specialty.


Article 6 helpful teaching Functions in school units are fulfilled:-school teachers, to support the work of training and educating students in the homes of students;
-librarians, libraries for organizing the activity and supporting the work of reading guidance for private pupils;
-laboratory assistants, to support the work done in the laboratories of the disciplines of general culture;
-technicians, for supporting the work done in the laboratories of specialized disciplines, workshops, farms, in school for children with sensory or physical deficiencies.


Article 7 Education For leadership and education establishments are established functions of teaching director and assistant director.


Article 8 For the guidance and control of educational activity and education, the school inspectorates are established functions of the inspector general school, school inspector and chief inspector school.
The Ministry of education and other ministries or other central organs that were responsible for the schools, the functions of guidance and control of education shall be determined according to the rules regarding expert staff from the central organs.


Chapter 3 Article 9 to fill teaching positions require the following studies: a) for Harley Davidsons, graduating with diploma exam, a vetrinarian pedagogical high school or a post-secondary pedagogical schools;

(c)) for the position of student, teacher and studies required for graduation with diploma, examination of a university or an Institute teacher training;
  

d) for the post of teacher in compulsory education: literacy, graduating with diploma exam of a university or an Institute teacher training;
  

f) for the Office of Icehockey, graduating with a diploma, exam school for foremen or graduation from a school of specialization in high or high school; for commanders of MDT-instructor is required and a three year stint as foreman or 5 years as technician;

g) for the post of school teacher, graduating with a diploma, examination of a pedagogic high school or a post-secondary pedagogical schools; exceptionally they may be appointed in this function and graduates of a high school literacy. In professional education and technical education may be appointed and graduates of the school of specialization in high or a high school;
  

h) for the position of sales associate, graduating from a school of specialization in post high school, completion of a high school with the appropriate profile or a high school literacy, followed by a course of laboratory technician;
  

I) for the position of librarian, graduating from an institution of higher learning or a high-school baccalaureat examination;
  

j) for the post of technician, graduation School of specialisation in earthquake engineering, a specialized high school or a school for instructors.
  

Can handle functions useful for teaching or teaching functions, and people who have training equivalent to those set out in this article; a-j, according to the rules laid down by the Ministry of Education.
At schools or departments in which the teaching is done in the language of the naţionalitatilor inhabiting teaching staff teaching and teaching staff must be aware of self the language of teaching.

Article 12 teaching teaching Posts cannot be filled by appointment, transferring from one school to another unit, detachment or refilling.


Article 13 the Appointment of teachers education teaching is done by the Ministry of Education in the vacancies reported by the competent organs to make employment, as follows: a) on the basis of the apportionment in the education of the graduates of higher educational institutions, lyceums and ai pedagogical pedagogical schools colleges;
  

b) at the request of employment or transfer to other sectors of activity of the persons concerned;
  

c) based on the transfer of other business sectors in the interest of education.
  

Appointment to the posts for which it constitutes the competition is done on the basis of the results of the competition.
Employment in workstations for the staff is made by executive committees of councils and popular of the municipality of Bucharest, through school inspectorates, or ministries and other central bodies of State administration, bodies of cooperative organizations, which were responsible for the schools.


Article 14 for the purpose of distribution of graduates education referred to in art. 13 lit. the Ministry of Education provides for the allocation committees each year till June 1, lists of posts vacant upon completion of transfer and appointment on request, be communicated to the authorities responsible for the schools.
Based on these lists, choose their graduates in which stations will be appointed, under the conditions laid down in the laws concerning the distribution of graduates.


Article 15 For the appointment of persons as referred to in art. 13 lit. b applications shall be submitted by those persons, as follows:

-the school inspectorates in whose radius of activity functioning educational institutions where the vacancies for the posts of the kindergarten teachers, teachers (teacher) or professors in the fields of general culture;
-the school inspectorates or ministries, other central bodies of State administration central bodies or co-operative organisations under which school units where vacancies for teachers in specialized disciplines and for instructors-instructors.
For submission of applications shall be established the following limits:-up to 1 March, by people who have worked in education and were forced, for serious reasons, discontinue benefitting having the approval of school inspectorates or the central bodies responsible for the schools, as well as to persons who, after graduation, have been distributed in another sector of activity. These requests to resolve at the same time with requests for transferring from one school to another unit, according to the provisions of article 3. 20 paragraph 1. 2 and art. 22-27;
-august 15, by persons who have interrupted benefitting without reasonable grounds. These applications are divided into educational resolve alumni, school inspectorates, making proposals for the appointment of the remaining vacant posts after the distribution of graduates.


Article 16 Appointment within the educational system, as a result of the transfer of the interest of the education of individuals from another area of activity is done in accordance with art. 13, at the proposal of the executive committees of the District Councils and the popular Bucharest, through school inspectorates, or of other central bodies of the ministries times under whom works full-time unit that stood vacant.


Article 17 Appointments can be made only in specialties for which the applicants possessed the requisite studies education appointment or in specialties for which have been authorised according to Council of Ministers Decision No. 1390/1954.

Article 19 teaching staff appointed under art education. 13 is personal.
Until the completion of the education, pursuant to article. 83, the teaching staff appointed under art. 13 lit. He, as well as teaching staff appointed under art. 13 lit. b and c, who have not obtained the completion within the educational system, is considered to be a trainee.

Vacancies are published every year, until February 1, the Bulletin of the Ministry of Education.


Article 21 may request transfer of the teaching staff teaching that, on 1 September of the year in requesting the transfer, has at least three years of teaching activity in the post.
It also can ask for transfer and teaching staff, teaching that does not satisfy the condition laid down in the preceding paragraph, if he/she:-work in a village forbidden for his health condition or does not have the possibility of being suffering-to care for health;
-works in another locality than that in which they are domiciled spouse (wife);
-works in another locality than that in which they reside and parents require transferring rural locality where the parents reside.


Article 22 requests for transfer, shall be submitted until 1st March, the school inspectorate or the central body to which the unit can be found at the school which the applicant works. These bodies shall forward to the Commission's requests for transfer advising school inspectorate or the central body to which the school is located at unit listed vacancy, according to their competence set out in art. 15. Article 23 examination of applications for transfer and the appointment shall be made by specific committees set up, having the following composition:-the school inspectorates, from a school inspector in Chief, as Chairman, three school inspectors and trade union representative from the education and culture institutions, as members;
-the ministries and other central organs, Chief delegate from the Directorate of education (educational or Service Bureau), as Chairman, and the Chief of personnel Division delegate (or Service Bureau) and the Trade Union representative from the appropriate branch, as members.


Article 24 settlement of transfer shall be granted according to the following order preference, persons requesting transfer: a) proximity to the husband (wife) in a permanent activity and residing in the locality where the transfer is requested, given priority to the proximity of husband (wife) who works in the educational system.
  

b) for proximity to parents residing in common;
  

c) for health reasons, according to the finding, the applicant body competent sanitary needs a lengthy medical treatment, although it may follow in the place of work, or is it necessary to change the locality or geographical area in which it lives;
  

d) for close to parents living in cities;
  

e) for other reasons.

Settlements and posts for establishing competition, as well as the date of holding the contest will be set annually by the Ministry of education and published in the Bulletin of this Ministry.
The settlement of appointing and transferring based contest will precede resolution of other requests for appointing and transferring.


Article 26 the competition can apply definitive teaching staff holder, on 1 September of the year in requesting the transfer of a contest, at least 3 years of teaching activity in the post.

Applications for enrolment shall be submitted to the bodies referred to in article 1. 22, within 15 days from publication of the contest. Applications shall be accompanied by a statement of work and specification drawn up, where appropriate, by the management of the establishment to which the applicant operates or has operated up to teaching activity, approved by the County School Inspectorate of Bucharest or the Socialist leadership of the organization which functioned.
The contest consisted of a sample written and from the appreciation of the candidate's activity.
In the assessment of candidates who participate in the contest, will you account commissions environments who obtained grades, results of scientific-educational and methodical, specialized work completed, and work was carried out.


Article 27 committees appointed by the competition inspectorate are comprised of an inspector delegated as Chairman, an inspector and three teachers, according to the specialty for which you you contest and having at least the same degree with those enrolled in the contest, as members. These committees work to the competitions from pre-school, compulsory school and upper secondary school literacy of the general culture.
For filling from the disciplines of general upper secondary education culture, professional education and technical education, the contest is completed by a delegate of the Ministry or the central body to which the school-unity lies.

The contest committees appointed by the ministries and other central organs are composed of Division Chief delegate (Bureau of educational or service) as Chairman, and two professors, according to the specialty for which you you contest and having at least the same degree with teaching those who enrolled in the contest, as members. These committees work for the employment of specialized disciplines, professional education and technical education.
The contest committees referred to in this article may make hand and university professors or lecturers.


Article 28 transfer of staff from one unit to another in the interest of school education can be done to improve the management of some schools or restringere of activity, with the consent of those to be transferred.
The transfer referred to in the preceding paragraph shall decide, where appropriate, the executive committees of the District Councils and the popular Bucharest, through school inspectorates, or ministries or other central organs that have their subordinate units, taking into account 6-considering the level of training of those concerned and the results of the activity.

Article 29 the results produced by the committees referred to in article 1. 27 shall be communicated to the person concerned.


Article 30 Complaints concerning the settlement of claims for appointing and transferring in education is addressed to the bodies that have filed applications within 10 working days of the notification provided for in article 10. 29. The Complaints Commission shall judge having the following composition:-the school inspectorates: the County inspector general school, as its Chairman, the representative of the Trade Union from educational institutions and culture, and a school inspector, as members;
-the ministries and other central organs: head of education (educational or Service Bureau), as its Chairman, the representative of the Trade Union Branch and an inspector of education within the Directorate, as members.
In the committees for prosecuting complaints disqualified persons who participate in committees for the settlement of transfer and appointment.
The decisions through which to resolve appeals are final.


Article 31 on the basis of decisions of the boards of appointments and transfers, and, after the event, he decisions of the boards of appeal, the executive committees of councils and popular of Bucharest, school inspectorates, i.e. through the ministries and other central organs to find out which school units from which you want to transfer, transfer documents issued.
Proposals for appointment shall be submitted to the Ministry of Education for approval.


Article 32 the appointing and transferring Operations from one school to another establishment shall be carried out only during the period specified by the Ministry of Education, and appointing and transferring acts shall enter into force on 1 September of the year in which these operations were carried out. Article 35 Appointment suplinitorilor is made, where appropriate, by the school inspectorates or by law enforcement who responsible for schools, for a period of not more than one school year in case of vacancies, or until the holder's presentation, in the other cases referred to in article 1. 33. Article 36 where some posts of teachers teaching teachers, instructors or leaders could not be filled by appointment, transferring from one school to another unit, detachment or replenishment, the activities of these items may be carried out by persons who studies required by this Statute, notably remuneration shall be in accordance with the law.

The high schools that work with classes I-IV of the general school, one of the Deputy Directors may be called between the teacher or teachers.
At high schools and schools with special program, as well as at schools and pedagogical director will be appointed, in particular, professors who teach specialized subjects corresponding to the profile of the school unit.


Article 44 the directors and Deputy Directors of specialty high schools, with the exception of pedagogical high schools, as well as those of the school of professional education units and technical education shall be appointed with the agreement of the Ministry of Education, where appropriate, the central authorities who organise scholastic establishments, school inspectorates, or of teachers who meet the requirements to teach in these units and who have obtained degrees in teaching, or at least a finalisation and at least 5 years in education.
Director will be appointed, in particular, teachers who teach specialized subjects.
Exceptionally, when there is no possibility of dealing with posts with personally fulfilling the conditions laid down in paragraph 1, these posts will be appointed specialists with higher education who have not obtained the completion, but also an experience in education or in the production of at least 5 years.


Article 45 dismissal of teaching staff of school units is done by law enforcement agencies and with the procedure laid down for the appointment.


Article 46


In guidance and control functions can be called teaching staff and teaching staff, teaching that stands out in the professional activities, give proof of organizational qualities and satisfies the conditions laid down in this section.

School inspectors of the school inspectorates are appointed by school inspector-general, with the agreement of the Ministry of education, educatoarele, trainers, teachers or teachers having the highest teacher's degree or at least completion of an activity and education of at least 8 years.


Article 48 teaching staff promoted into positions of guidance and control of education to the Ministry of education and other ministries and central organs that were responsible for the schools, it is subjected to during exercise as well as other functions, rules and regulations concerning the staff of the specialized central bodies.

Chapter 5 Article 50 teaching staff shall enjoy the rights provided for in this Statute, as well as the rights of decurgind as the employee, provided for in labour legislation.


Article 51 In order to carry out the tasks incumbent on them, teaching staff shall have the following rights:-to pursue an activity in the field of education, according to his professional preparation;
-to use in order to prepare and conduct the activity of teaching or scientific research, materials, equipment and libraries of educational institutions;
-to publish textbooks, treatises, and other works;
-to benefit from organised forms of professional training, as well as the benefits that the law granted as a consequence of this processing;
-to be part of professional organizations and cultural associations, national and international, whose concerns are related to the development of education, "activities in accordance with the statutes of these organizations;
-to use the physical basis of the county houses of teachers, in view of scientific documentation and the keeping up to date with news from the pedagogical science or for the development of exchanges of experience and conducting research.


Article 52 The aim of enhancing scientific and methodical research, lifting the level of the scientific and professional and of the results of research work, teaching staff may be in scientific societies, branches of science.
Scientific societies are organized and operate as legal entities on the basis of their own statutes enacted in the country conferences of teachers. They are part of the scientific societies of Union teachers.
Scientific societies may cooperate with other similar companies abroad; also, scientific societies may be right, according to the law, international organizations, and their members can be part of these organizations.


Article 53 teaching staff with meritorious results in work didactics scientific, educational or artistic may be delegated by the Ministry of Education to participate in congresses, meetings or other events-scientific cultural national or international.


Article 54 teaching staff shall be entitled to obtain the transfer from one school to another unit, under the conditions and pursuant to the procedure provided for in this title.


Article 55 teaching staff teaching and teaching staff of the school establishments benefiting from annual paid leave, the duration of which is 62 calendar days and shall, as a rule, from 1 July to 31 august.
The leave provided for in the preceding paragraph shall be granted to teachers who functioned throughout the school year. Where the appointment was made after the commencement of the school year, sick leave will be proportional to the actual time served in education that year, reckoning it as there are 5 working days for each month of activity.


Article 56 teaching staff who couldn't perform in full annual leave during the period referred to in the previous article, being detained in the course of their work, nor could fill in other periods of interruption of school courses, you will be able to perform in the next school year, during periods of interruption of school courses. Likewise, if the annual leave could not be carried out during a school year, good reasons, such as: temporary incapacity for work, maternity leave, or to care for sick children less than 2 years, programming courses professional development, satisfaction of military obligations, except for military service, sick leave will be carried out in the next school year in periods of non-school courses and, exceptionally, even in class.
Compensation in money month resting period of parental leave will be able to do only in the cases and conditions stipulated by laws regarding annual leave of employees.


Article 57 teaching staff for guidance and control benefits from an annual leave annual 31 calendar days.
Self teaching staff are entitled to annual leave under the conditions laid down in the law on the annual leave of the employee.


Article 58 according to the rules laid down by the Ministry of Education, for personal interests, and if it is not prejudicial to the proper conduct of education, teaching staff can obtain leave without pay, on time (without being able to exceed one school year) with approval, if applicable, the school inspectorates or ministries and other central organs that were responsible for the schools. For leave without pay for a period of up to 6 days in a school year, approval may be given by the Director of the unit.
Periods of leave without pay for personal purposes provided for in this article, that exceed 60 calendar days in a school year, don't consider seniority within the educational system.
Pursuant to the provisions of the preceding paragraph, the number of days that race 30 multiple is neglect.

Article 61 in carrying out its social mission in accordance with the provisions of art. 1, teaching staff and teaching has the following main functions relating to didactic-educational activity and the activity of the processing: to train and educate students through lessons and practical work in laboratories or workshops, according to the tasks contained in the didactic teaching norm, as well as through the Organization of activities in class or out, in collaboration with the children's and youth organizations; to enhance training in the specialty field of pedagogy, and participation in various forms of organized for that purpose; to pick up permanently the level of ideological preparation and for carrying out the policy of the party and rule; to be an example of moral in school, society and family, and to have an outfit in all respects worthy, civilized.


Article 62


In fulfilment of his job, teaching staff provides on average eight hours a day. Under these obligations work, teaching staff carries out the activities referred to in article 1. 63-66 in school (kindergarten) and in the cultural and educational institutions, and besides them.

-gathering of data and material in relation to professions that can be oriented towards students, taking into consideration the specificity of the local economy and their inclinations and aptitudes;
-organizing and conducting site supervision hours working with students ' families (parents ' meetings, home visits, lectureship);
-organizing and conducting educational activities with children in Pioneers Organization and supporting organizations of the Union of Communist Youth in preparing and conducting extracurricular class apart and (informing policy students, competitions, Olympiads, public benefit work, preparing to defend the fatherland, cultural-artistic actions, sports, visits, excursions, camps, colonies);
-guidance of the work of the pupils circles;
-supervision of pupils during recreation.


Article 64 Hours of instruction for teaching staff shall be determined in relation to the function to be fulfilled and taught discipline, as follows:-for Harley Davidsons, 6 hours per day of activity with a group of children;
-for teachers and teacher, 4-5 hours lecture per day, according to the educational plan, and teachers of the school for children with deficiencies organized, 6 hours per day;
-for teachers, 18-20 hours of lecture per week, except for teachers who teach music, physical education, drawing and calligraphy, for which the norm is 20-21 hours of lecture per week. For teachers who teach these subjects in high schools and pedagogical specialization in teaching high school, and for those who teach the same subjects as objects, in schools with special program shall be 18-20 hours of lecture per week;
-for teachers who have special tasks in school and professional orientation of students shall be determined 18-20 hours per week of instruction, assistance to lessons and activity with students in order to direct their knowledge and preparation of material safety data sheets to the Assembly the necessary orientation of students;
-for leaders-instructors, 24-30 hours of practice training workshops-school.
The school of professional education units and technical education, in which, according to the educational plan, students practice in production takes place only at certain times of the school year, teaching will be able to be completed, up to a maximum of half of the total number of hours, with hours of guidance and control of production practice, under the conditions laid down by the Ministry of Education with the agreement of the Ministry of labour.
In establishing the teaching obligations at school units referred to in the preceding paragraph, the number of hours each week can be provided throughout the school year to achieve an average of 18-20 hours.


Article 65 In the teaching staff professional development, teaching, in addition to participation in organized forms for this purpose, to prepare and to submit to examinations for completion within the educational system, according to art. 83. Article 66 teaching staff teaching contributes according to its preparation and skills at spreading scientific knowledge and the promotion of cultural and artistic movement in reaching the masses.


Article 67 teaching staff carries out the following main activities self-help's instructor school headmaster and teaching staff in the work of training and educating students, participation alongside the teaching staff and Union of Communist youth organizations and school pioneers to form a collective of students educated in the spirit of conscious discipline; indrumeaza and help students in dorms to prepare lessons, cares for the regular participation of pupils in lessons and to all the other activities scheduled in the school; supports the Union of Communist youth organizations and young pioneers in organizing the leisure of students (reading, watching shows, sporting events and the like);
laborantul-help in preparing and conducting teacher experiences and practical laboratory work, technical support circles of students;
-school librarian organizes the work of the library and ensure its operation under the programme established by the School Board; help teachers and students in the reading guidance in the choice of material for the work of circles;
-the technician assist teacher in the use of appliances, tools and machinery from offices, workshops or didactic farms and is responsible for their maintenance.


Article 68 the Director responsible for the entire educational-educational activity in school and out of school, activity of gospodareasca, as well as administrative and record keeping and judicious use of school property. The Director represents the school in dealing with any person or organization.
The Director shall work under the direction of the School Inspectorate, enforcement of the Ministry of education or the central body to which it is subordinated to the school, and the organs of the Ministry of Education.


Article 69 In its entire activity, the Director shall drive on the principle of collective work. For the proper organization of the work of the school and carrying out the tasks incumbent upon them, the Director is assisted by Faculty Council, collaborating with the trade union organization, as well as with organizations of the Union of Communist Youth and pioneers from the school.


Article 70 in the communes with a larger number of general schools, the Director of one of these schools may receive from the County School Inspectorate, the powers of coordination of activities in the framework of other schools.


Article 71 Deputy Director helping headmaster in the Organization and direction of activity instructive-educational and administrative-household, fulfilling the tasks that have been delegated by the director.


Article 72 the obligations of Directors and Deputy Directors of the educational establishments, as well as didactic and educational activities and leadership carried out, are laid down in the regulations on the organisation and operation of schools.
In the context of work obligations, directors and Deputy Directors will teach a weekly number of hours established by the Ministry of Education in relation to the size of the units.


Article 73 of the Staff guidance and control has the following main functions to control and guide the work of the educational-educational establishments of education and upbringing, to propose or to take appropriate measures for the proper organisation and conduct of educational process and activities in and out of school; to guide teaching staff to improve the educational process. Findings and assessments made on the occasion of control in school units will be recorded in the minutes of the inspection, which shall be submitted in hard copy to the personal status of the case.

Perfecting the teaching staff is carried out and activities within the framework of scientific societies, and through the voyages of studies and documentation. In the case of trainers and teachers, improvement can be achieved also through his system, under conditions provided by law.


Article 78 Improvement through the forms referred to in the previous article, lit. (b) and (c) ensure the school inspectorates.


Article 79 regular Courses of specialized scientific information is organized in institutions of higher learning that prepare staff and subsidiaries of the central Institute for professional development of teachers, under the conditions established by the Ministry of Education.
Teaching staff will be scheduled to participate in the continual scientific information, up to the age of fulfillment for 25 years in education. Participation of teachers in these classes is mandatory.
For teaching staff with a work experience of over 25 years in educational participation in these courses is optional.


Article 80 the annual plan coverage of teachers in continual scientific information shall be drawn up by the Ministry of education and school inspectorates are communicated and education institutions to which it organises these courses.
Continual scientific information is conducted on the basis of the educational plans and programmes being developed by the Ministry of Education.


Article 81 besides the continual scientific information specialist, can be organized by the Ministry of Education after the necessities, and other special courses for retraining of teachers.

Article 86 Degree is obtained, upon request, on the basis of an inspection and a special colloquium in matters of the Department by the teaching staff who has a good professional and pedagogical preparation, smooth in educational-educational work, and a length of at least 5 years in education.
The Colloquium referred to in the preceding paragraph is carried out on the basis of a thematic bibliographies and approved by the Ministry of Education in the following disciplines:-for children's literature: the kindergarten teachers and methodology of educational-educational activity in pre-school education;
-for teachers: language Romanian (mother tongue), arithmetic and methodology of teaching of these disciplines;
-to teachers: specialist subject and methodology of teaching of that object.


Article 87 degree is obtained upon request on the basis of special inspection and personal medical and scientific papers by the teaching staff who by great results in educational-educational work, proving a particular expertise and specialist teaching and research pursuits in the field of education or the Department and which has a length of education for at least 5 years after the awarding of the degree.
Teaching staff who has obtained the title of doctor scientific be awarded the law degree.


Article 88 Special Inspections in order to obtain academic degrees can be carried out by specialized staff of the central Institute for professional development of teachers and of its subsidiaries, school inspectors, as well as teaching staff delegated for this purpose.
School inspectors and teaching staff delegated to carry out special inspections must have a teaching degree at least equal to that covered by the inspection.


Article 89 the deadlines referred to in article. 86 and 87 shall be reduced to 4 years for teaching staff who has achieved the completion of education or degree with mean 10.
Benefits from reducing the time limits from 5 to 3 years, in order to obtain the degree or grade I, educatoarele, teachers, trainers from schools (kindergartens) application of pedagogical colleges, if they work at these schools for at least three years.


Article 90 Teachers and educatoarele who have obtained degrees in teaching, or I and have completed the diploma examination, an institution of higher learning, being appointed to posts of teachers can apply for obtaining degrees in teaching, without to wax more seniority condition laid down for these degrees.
Teachers who have obtained degrees in teaching enjoys them and after their appointment as University Professor.


Article 91 the Organization and conduct of activities relating to education and obtaining the completion of teacher's degrees shall be laid down in a regulation issued by the Ministry of Education.


Article 92 in order to improve professional teaching staff can be scheduled at the courses organized in the country or sent to courses for studies and documentation, as well as for specialization in the country or abroad, for a period of 1-2 years, acordindu him to this end, studies leave according to special legal provisions.

Also, in order to improve professional teaching staff may obtain, upon request, in particular, and subject to the conditions laid down in article 21. 58, leave without pay.

Article 94 Perfecting the form referred to in article 1. 93 lit. (b) is carried out through debate main problems of educational-educational activity, in order to improve this activity in school workshops and in production.

Article 98 refresher courses and instructajele. 93 lit. e and f shall be organised by the Ministry of Education through pedagogic research and staff training in professional education and technical education.


Article 99 to obtain education for finalising and perfecting scientific and methodology by obtaining teacher's degrees or doctorates, the provisions of art. 83-87, art. 89, art. 91 and article. 92, with the distinctions laid down in this article.
Special inspections may be carried out by specialized staff of the Center for teaching and research staff training in professional education and technical education, as well as teaching staff or other specialists, delegated for that purpose by the Ministry of Education.

Article 113 persons wishing to participate in the contest application for enrollment to record higher educational establishments where you contest, within 30 days from the date of publication.
Application shall be accompanied by the candidate's scientific works and laws established by the instructions of the Ministry of Education.


Article 114 the contest consists of checking by the Commission of competition of didactic-educational activity, scientific and practical of candidates.

Article 116 the Rector of this institution of higher education shall, where appropriate, the date of holding public lectures. 114 para. 3. The decision by the Senate (the Faculty Council of the institution of higher learning) of the outcome of the contest to fill the post of rector shall be submitted to the Ministry of education. Article 118 Posts of Lecturer (Assistant Professor) can be occupied by tenured staff, through advancement or competition.


Article 119 can be proposed for improvement as heads of works (lecturers) titular assistants who scientific title doctor and have obtained good results in the methodical-didactic activity, educational and scientific.
The proposal of the Chair, who shall submit the Faculty of Faculty of teaching characterization, educational and scientific publications of the person proposed for advancement.

The appointment of persons in positions of Chiefs of works (lecturers) holders shall be made by the Provost, in case of confirmation of the decision reached by the Senate and by the Ministry of Education, in all other cases. Appointment is made on the date of closure of advancement.


Article 120 vacant posts of Chiefs of works (lecturers), which does not apply to the procedure of advancement are put up for contest.


Article 121 the Rector appoints a Committee to contest the Dean or a representative thereof, as Chairman, the Chief of the Chair and a professor or an associate professor from the station's specialty for which opens the contest as members.


Article 122 the posting Procedure and entering the competition shall be that provided for the employment of Professor and associate professor.

Article 127 Assistant posts cannot be filled with personnel, through advancement or competition.


Article 128 may be proposed for promotion as Assistant, trainee assistants who in legal internship have obtained good results in the methodical-didactic activity, educational and scientific.
The procedure of advancement is that provided for in art. 119. Article 129 of the assistants vacancies which shall not apply to the procedure of advancement are put up for contest.
The Rector has the publication and called the contest Commission under art. 121. Article 130


In the contest for the vacancy of Assistant may participate in people who work in the post of Assistant; trainee assistants, upon completion of the internship; people who work in the Lycee, professional education or technical education, the institute of scientific research or design, in production or in the State apparatus, with higher education in the speciality of lent the contest and after the probationary legal distribution.
In higher education, candidates in the contest for the employment of assistants must have at least the title of specialist.
The provisions of the preceding paragraph shall not apply in the case of contests that do not have corresponding sanitary network.

Article 133 on the basis of confirmation by the Senate (Faculty Council of the institution of higher learning), the Rector appoints the candidate failed in his post as Assistant, on the beginning of the next semester.


Article 134 Posts of Assistant intern handles by appointment, based on the distributions of graduates of higher educational institutions to carry out legal traineeship or a contest, with the procedure laid down in article 21. 129, art. 131, art. 132. Article 143 Dean is Chairman of the Faculty and staff of the President of the Office of this Council.
The Dean of the Faculty ensure operatively, rezolvind issues related to current activity, educational and scientific didactics.
Election procedure, appointment and duties of counsel Deans are established by law.


Article 144 the Vice-Dean to assist the performance of its Dean in stock leadership faculty.

Article 145 of the Scientific Secretary is elected for 4 years, where appropriate, by the Senate (Faculty Council of the institution of higher learning) or the Faculty Council of the faculty, from reaching the members of the Council.
The Scientific Secretary is part of Senate Office (staff of the Council of the institution of higher learning) or the Faculty Council Office of the faculty.
Tasks of the Scientific Secretary shall be determined by the Ministry of Education.


Article 146 head of Department organizes the work of the Department and is responsible for the development of its staff of personnel of educational discipline or disciplines that are part of the Department, as well as performing the duties of the Chair concerning teaching, educational activity and scientific research.
The delegation as Chief of Department is made, for a period of 4 years by the Senate (Faculty Council of the institution of higher learning), on the proposal of the Council of the Faculty's teaching staff, teaching staff from reaching the holder of the Chair, with the approval of the Ministry of Education.
The criteria on the basis of which it makes the delegation as Chief of the Department are: didactic function, experience teaching, scientific, educational and organizational qualities and mentoring, scientific title, duration of activity in higher education.
The delegation of the head of Department may be withdrawn by the Senate (Faculty Council of the institution of higher learning), before the expiry of four years pursuant to the procedure provided for in paragraph 1. 2. Chapter 9 Article 147 teaching staff shall receive, in addition to the rights provided for in this Statute, any rights provided to the employee, as provided by labour legislation.


Article 148 teaching staff shall have the right to:-all the tasks of teaching in which the function is employed;
-to use the equipment, materials, scientific libraries of higher educational institutions, to carry out scientific or artistic didactics and methodology;
-to publish the results of scientific and methodological activity in 1984, institutions of higher learning in other periodicals and volume;
-to publish textbooks, treatises, and other works;
-to carry out refresher training and specialization in the country and abroad, in accordance with the provisions laid down by law and with the improvement plans laid down by the Ministry of Education.


Article 149


Teaching staff have the right to join professional associations, scientific societies and cultural organizations, national and international, whose concerns are related to the development of education, science and art "activities in accordance with the statutes of these organizations.


Article 150 professors and conferentiarii may be appointed from the Faculty Council or elected Senate (Faculty Council of the institution of higher learning).


Article 151 teaching staff with meritorious results in work didactics, educational, scientific or artistic may be delegated by the Ministry of Education to participate in congresses, meetings or other cultural and scientific events, national or international.


Article 152 teaching staff transferred under the conditions laid down in article 21. 246 retains the rights acquired in the position held previously by transferring.


Article 153 teaching staff seconded under the terms of art. 247 retains the rights acquired in the position held as the controller and the deployment of rights established for employees to detach.


Article 154 teaching staff shall receive an annual paid leave, the duration of which is 62 calendar days and shall, as a rule, in the University holidays, from 1 July to 31 august.


Article 155 For personal interests, teaching staff can obtain leave without pay for a limited time, up to a maximum of 1 year, if it is not prejudicial to the proper conduct of education. Leave without pay for a period up to 30 days, if the entire teaching staff, as well as more than 30 sick leave days required by the chiefs of works (lecturers), appointed by the rector, assistants and trainee assistants are approved by the rector. Leave more than 30 days required by professors, lecturers, heads of works (lecturers), appointed by the Ministry of Education, Vice Rectors, deans and Vice-Deans, and University Presidents is requesting sick leave shall be approved by the Ministry of Education.


Article 156 articles 55 paragraph 1. 2, art. and article 56. 58 para. 2 and 3, apply properly and teaching staff from higher education.

The Ministry of Education may approve derogations from the provisions of paragraph 2 in the case of disciplines with a reduced number of hours of educational plans or subjects studied by a small number of students, and will establish, in addition to other tasks, methodological or scientific.
Teaching staff who has not secured through the education plan, the number of weekly hours of teaching activity in this article i shall be distributed in completing tasks of scientific research.


Article 160 teachers and conferentiarilor shall be responsible for teaching tasks and educational publications: the development and exposure of course) within the lectures or lessons of education without the frequency synthesis;
  

b) seminars and leadership of some practical work, guidance and examination work and projects of the year;
  

c) for preparation of didactic activities referred to in a and b;
  

d) examination and assessment of the preparedness of students in exams sessions;
  

e) guidance directly from the point of view of the professional, scientific and educational group of students by helping them throughout their work;
  

f) giving advice to students;
  

g) directing and reviewing (advising) diploma works or projects;
  

h) guiding and controlling the pedagogical practice of students;
  

I) verification of the students ' works from school without frequency;
  

j) guiding the student scientific circles;
  

k) organizing and directing documentary trips;
  

l) guidance to students at school without frequency, through hoops, bibliographies and other forms of support;
  

m) guiding and controlling activities of chiefs, assistants and trainee assistants;
  

n) participation in educational actions for students.
  

Teachers and conferentiarii can also receive the task leaders for preparing scientific teaching, tasks relating to the improvement of teachers of compulsory education, secondary general school culture, professional education and technical education, as well as to participate in the task of tasting competition for admission to the higher education committees for admission to doctoral studies, doctoral exam and for obtaining scientific in competition or commissions for advancement under the procedure for filling stations, as well as in other committees of specialists.

f) guidance directly from the point of view of the professional, scientific and educational group of students by helping them throughout their work;
  

g) giving advice to students;
  

h) guidance and control practice in production and pedagogical practice;
  

I) verification of the students ' works from school without frequency;
  

j) guidance to interns and assistants "in preparing and keeping the seminars and practical work;
  

k) participation in educational actions for students;

Heads of works (lecturers) who have more than 6 years in higher education may allocate the tasks of leadership and review the (endorsement) or diploma, as well as projects and tasks relating to the improvement of teachers of compulsory education, secondary general school culture, professional education and technical education.


Article 162 Workers shall be responsible to the methodical-educational tasks: a) leadership seminars and practical works; the direction of the work and projects of the year;
  

b) preparing for leadership seminars and practical works;
  

c) attending classes, teachers and heads of conferentiarilor works (lecturers) to leading seminars or practical work, as well as the practical seminars and conducted by them;
  

d) attending students with exams that have worked within the framework of the seminars;
  

e) control of checking the work of students from the school without frequency;
  

f) participation in educational actions for students.
  

Assistants may also receive tasks relating to:-the direction of production and practice of pedagogical practice;

-student guidance during excursions of documentation;
-laboratory work and leadership seminars for students at school without frequency;
Workers who have the title of PhD scientific may assign tasks and reviewing the (endorsement) or diploma projects.


Article 163 trainee Assistants shall be responsible for teaching assignments and publications-educational leadership: a) seminars and practical works;
  

b) preparing for leadership seminars and practical work;
  

c) attending classes, teachers, heads of conferentiarilor works (lecturers) to leading seminars or practical work;
  

d) attending students with exams that have worked within the framework of the seminars;
  

e) participation in educational actions for students;
  

Trainee assistants will be able to carry out other tasks entrusted to it and by the head of Department, in connection with the work of the Department. Also in the first year of traineeship, trainee students can be trusted with the leadership of seminars and practical work, up to a maximum of 6 hours weekly.


Article 164 scientific research Tasks incumbent teachers shall consist of: a) scientific works entered in the annual research plans and the prospect of the Chair;
  

(b) compilation of works on) based on agreements and contracts with the enterprises or institutions;
  

(c) elaboration of recommendations and) permits for production, due to the results of scientific research;
  

d) participation in the analysis and elaboration of scientific papers on the Organization of production and labour in enterprises;
  

(e) elaboration of recommendations) Organization of the teaching and learning process in school practice workshops from professional education units and technical education;
  

f) elaborating studies, courses, and monographs;
  

g) designing and organizing laboratories, pilot plants and stations to higher education;
  

h) elaboration and presentation of works of scientific events in the country and abroad.
  

Scientific activity is established according to the tasks listed in the scientific research of the Department.
Teaching staff has the duty to carry out the tasks provided for in the plan of scientific research, to present the results of Department staff and to follow its application.


Article 165 of the teaching Activities which are not listed in the States for functions and activities educational publications shall be determined for each item and include individual employment plans which shall be approved by the Dean.


Article 166 Annual, in justified cases, the Ministry of Education may approve as teaching staff to carry out scientific research only. In this case, the obligations of teachers consist in the performance of assigned homework.


Article 167 teachers and conferentiarilor receiving the task leaders scientific doctoral students shall be reduced by up to 40% of the teaching and scientific obligations in relation to the number of PhD students that guides them.
The provisions of the preceding paragraph shall apply to the staff of the departments which has loads of teaching, seminars or practical work classes relating to the improvement of teachers of compulsory education, secondary general school culture, professional education, technical education, due account of the volume of these tasks.
