+ Chapter 1 + Article 1 The teaching staff of the Socialist Republic of Romania has the noble and high social and patriotic mission to realize the goals of education, contributing to the multilateral and harmonious formation of the human personality, to the flourishing to our socialist and our socialist nation. The teaching staff performs the policy of the Romanian Communist Party and the Romanian state in the field of education; it ensures the young generations the preparation of general and specialized culture in order to integrate assets into social life, the scientific conception of nature and society, cultivates their unvarnished love for the homeland and the people, the devotion to the cause of socialism, to the ideals of peace, understanding between peoples and social progress. In carrying out his duties, the teaching staff is called upon to show a high citizen and professional conscience, to have a dignified behavior in school, in the family and in society, to be permanently concerned with raising the level His specialized training, pedagogical and ideological. + Article 2 This statute provides for the teaching positions in educational institutions and regulates their occupation, transfer, posting and dismissal, rights and duties of teaching staff, improvement, salary criteria, distinctions and awards, disciplinary and material liability, as well as its passage into retirement. + Article 3 The provisions of the present status apply to teaching staff, to the teaching staff, to the leading teaching staff and to the teaching staff of guidance and control in the preschool education, the compulsory education of culture general, high school education, vocational education and technical education, as well as teaching staff of the chairs and leading teaching staff in the higher education. + Chapter 2 + Article 4 In order to carry out the instructive-educational activity of the preschool education, compulsory education of general culture, high school education, vocational education and technical education, the following didactic functions are established: a) teaching positions; b) helpful teaching positions; c) leading teaching positions; d) teaching positions for the guidance and control of education and education. + Article 5 Teaching positions are performed by the following teaching staff: -in the preschool education, of educators who carry out instructive and educational activities in children's kindergartens and in dormitories organized by kindergartens; -in the compulsory education of general culture, in classes 1-4 of teachers and institutes; in these classes teaching can also be done by teachers, on disciplines; -in the compulsory education of general culture, in grades 5-10, high school education, vocational education and technical education, teachers and maistri-instructors, who teach or train on disciplines, according to the specialty of each. + Article 6 Helpful teaching positions in school facilities are met by: -school teachers, to support the work of training and educating students in student dormitories; -librarians, for organizing the work of libraries and supporting the work of mentoring the particular reading of students; -laboratories, to support the activity carried out in the laboratories of general culture disciplines; -technicians, to support the activity carried out in the laboratories of specialized disciplines, in workshops, at didactic farms, in school facilities organized for children with sensory or physical impairments. + Article 7 For the management of educational and education units, the teaching positions of director and deputy director are established. + Article 8 For the guidance and control of the educational and education activity, the positions of general school inspector, chief school inspector and school inspector are established at the school inspectorates. At the Ministry of Education and other ministries or other central bodies that subordinate schools, the guidance and control functions of the education shall be established according to the norms regarding the specialized personnel of the central bodies. + Chapter 3 + Article 9 The following studies are required to fill the teaching positions: a) for the position of educator, graduation, with diploma examination, of a pedagogical high school of educators or a post-secondary pedagogical school; b) for the position of teacher, graduation, with diploma examination, of a pedagogical high school of teachers or of a post-secondary pedagogical school; c) for the function of institute, studies required for the teacher and graduation, with diploma examination, of a university or a pedagogical institute; d) for the position of teacher in compulsory education of general culture, graduation, with diploma examination of a university or a pedagogical institute; f) for the position of instructor foreman, graduation, with diploma examination, of a school of foremen or graduation of a post-secondary specialization school or of a specialized high school; for the position of foreman-instructor is also required an internship for 3 years as a foreman or 5 years as a technician; g) for the position of school teacher, graduation, with diploma examination, of a pedagogical high school or of a post-secondary pedagogical school; exceptionally they will be able to be appointed to this position and graduates of a high school of general culture. In the professional education and in the technical education can be also called graduates of a post-secondary school or a specialized high school; h) for the function of laboratory, graduation of a school of post-secondary specialization, graduation of a specialized high school with adequate profile or of a high school of general culture, followed by a qualification course as a laboratory; i) for the position of librarian, graduation of a higher education institution or a high school with baccalaureate exam; j) for the position of technician, graduation of a post-secondary school of specialization, a specialized high school or a school of foremen. They can occupy teaching positions or helpful teaching positions and persons who have training equivalent to those indicated in this article at lit. a-j, according to the norms established by the Ministry of Education. At schools or wards where teaching is done in languages of conhabiting nationalities, teaching staff and helpful teaching staff must know the language in which teaching is done. + Article 10 For the teaching of teaching positions from the units in the preschool education, the school units in the compulsory education of general culture, the high school education and the professional education, organized for children and young people with sensory, physical or intellectual deficiencies, it is required to complete, with a diploma examination, a faculties (wards) of defectology, psychology, pedagogy or, as the case may be, of one of the educational institutions provided for in the previous article lit. a-f and a special psychology or pedagogy course, the provisions of art. 9 9 para. 2 2 being applicable. + Article 11 I cannot occupy teaching positions persons deprived of this right, for the duration established by a final decision of criminal conviction, those suffering from contagious diseases established by anti-epidemic sanitary norms, as well as those who, due to some mental illness or infirmities, are unfit for instructive-educational activity. They also cannot occupy teaching positions people who, through their behavior in school, family and society, prove inadequate for training and educating students. + Article 12 Teaching positions can be filled by appointment, transfer from one school unit to another, secondment or replenishment. + Article 13 The appointment of teaching staff in education is made by the Ministry of Education in the vacancies communicated by the competent bodies to do the framing, as follows: a) based on the education distribution of graduates of higher education institutions, pedagogical high schools and post-secondary pedagogical schools; b) at the request for employment or transfer from other sectors of activity of the persons concerned; c) on the basis of transfer from other sectors of activity in the interest of education. The appointment to the positions for which the competition is constituted is based on the results of the competition The staff positions are made by the executive committees of the county folk councils and the city of Bucharest, through the school inspectorates, or by the ministries and other central bodies of the state administration, or the central bodies of the cooperative organisations, which are subordinate to schools. + Article 14 In order to distribute the graduates referred to in art. 13 letter a, the Ministry of Education shall make available to the distribution commissions, every year, until June 1, lists of posts remaining vacant after the transfer of operations and appointment on request, communicated by the bodies that have subordinate schools. On the basis of these lists, the graduates choose the posts in which they will be appointed, under the conditions provided by the legal provisions regarding the distribution of graduates. + Article 15 For the appointment of persons referred to in 13 (b), the applications shall be submitted by those persons, as follows: -at the school inspectorates in whose range the educational institutions operate where the vacancies are located, for the posts of educators, teachers (institutes) or teachers in the disciplines of general culture; -at the school inspectorates or at the ministries, the other central bodies of the state administration or the central bodies of the cooperative organizations under which the school units where the vacancies are located, for the posts of teachers in the specialized disciplines and for the positions of maistri-instructors. The following deadlines shall be laid down for lodging -until March 1, by the persons who worked in education and were forced, for thorough reasons, to interrupt the teaching activity having the approval of school inspectorates or central bodies that subordinate schools, as well as by persons who, after completing their studies, have been assigned to another sector of activity. These requests are resolved at the same time as requests for transfer from one school unit to another, according to the provisions of art. 20 20 para. 2 2 and art. 22-27 22-27; -until August 15, by people who interrupted teaching without thorough reasons. These applications are solved after the education distribution of graduates, the school inspectorates making the appointment proposals in the remaining vacancies after the distribution of graduates. + Article 16 The appointment in education, as a result of the transfer in the interest of the education of some people from another sector of activity, is done, according to art. 13, on the proposal of the executive committees of the county folk councils and the city of Bucharest, through the school inspectorates, or the ministries or other central bodies subordinated to which the school unit is located vacancy. + Article 17 Appointments may be made only in the specialties for which the applicants possess the studies required for the appointment in the education or in the specialties for which they were attested according to the Decision of the Council of Ministers no. 1390/1954 1390/1954. + Article 18 Those appointed in education under the conditions of art. 13 become employees of legal entities under which school facilities operate, namely: -of the counties or the city of Bucharest, of the ministries, of the other central bodies of the cooperative central administration, of enterprises or other socialist organizations. In the case of school units with legal personality, those appointed in education become the employees of these units. The governing bodies of the legal entities, whose employees are those appointed, are entitled to perform all the acts in relation to the employment relationships of the teaching staff, apart from the appointment and release from education, as well as of cases in which by law it is ordered otherwise. + Article 19 The teaching staff appointed in education according to art. 13 is the titular staff. Until the completion in education, under the conditions of art. 83, teaching staff appointed according to art. 13 letter a, as well as the teaching staff appointed according to art. 13 lit. b and c, which did not achieve the finalization in education, is considered trainee. The titular teaching staff who do not obtain the definition in education lose the status of holder and, as a result, his employment contract is opened, applying the provisions of the labor code, regarding the dissolution of the contract for You're not working. + Article 20 The teaching staff of the tenured teaching staff may be transferred, upon request, from one school unit to another, in the vacancies published or which become vacant to the transfer operations. The transfer from one school unit to another, in the positions for which the competition is established, is based on the results of the competition. The vacancies are published every year, until February 1, in the Bulletin of the Ministry of Education. + Article 21 It may require the transfer of teaching staff who, on September 1 of the year in which they request transfer, have at least 3 years of teaching activity in the post in which they operate. It may also require the transfer and teaching staff of the tenured teaching staff who do not fulfil the condition laid down in the preceding paragraph if: -works in a locality contraindicated for the state of his health or in which he does not have the possibility-being suffering-to care for his health; -works in another locality than that in which the husband (wife) resides; -operates in another locality than that in which the parents reside and request transfer to the rural locality where the parents reside. + Article 22 Requests for transfer, shall be submitted, until 1 March, to the school inspectorate or to the central body under which the school unit to which the applicant operates is found. These organs transmit the requests for transfer to the commission from the school inspectorate or the central body under which the school unit is located at which the vacancy is listed, according to the competence established in art. 15. + Article 23 The examination of the requests for transfer and appointment shall be made by the committees established, having the following composition: -at school inspectorates, from a chief school inspector, as president, three school inspectors and the representative of the Union of trade unions in educational institutions and culture, as members; -at ministries and other central bodies, from the delegate of the head of the education directorate (service or office of education), as president, and from the delegate of the head of the personnel department (service or personnel office) and the representative union unions of the corresponding branch, as members. + Article 24 In resolving the requests for transfer, preference is given, according to the following order, to people asking for transfer: a) for the proximity to the husband (wife) in permanent activity and residing in the locality where the transfer is requested, having priority the proximity to the husband (wife) working in education; b) for the proximity of parents domiciled in the communes; c) for health reasons, when, according to the finding of the competent health body, the applicant needs a long medical treatment, which he cannot follow in the locality where it works, or it is necessary to change the locality or to the geographical area in which it lives d) for the proximity of parents domiciled in cities; e) for other reasons. If in the application of the order of preference provided for in this Article, two or more persons have entitlement to transfer, in order to resolve the application will take into account, in order, the teaching degree and the results obtained in the activity instructive-educational, duration of activity in education, material situation and state of health of applicants. + Article 25 Appointment and transfer of educators, teachers and teachers to vacancies from some school facilities in certain cities and crowded centers, from pedagogical high schools, from the schools and application kindergartens of these high schools and from the schools. They can also register for the competition, to be called in education, and the persons who functioned in education as permanent tenured teaching staff and were forced, for thorough reasons, to interrupt the teaching activity, as well as specialists assigned to other sectors of activity, with the legal internship carried out. Applications for registration shall be submitted to the bodies provided in art. 22, within 15 days of the publication of the contest. The applications will be accompanied by a statement of activity, as well as a characterization drawn up, as the case may be, by the management of the teaching unit to which the interested one operates or worked until the interruption of the teaching activity, endorsed by the county school inspectorate or Bucharest municipality or at the helm of the socialist organization to which it worked. The contest consists of a written test and the candidate's activity. In assessing the candidates participating in the competition, the commissions will take into account the environments with which they obtained the teaching degrees, the results of the didactic-educational and methodical activity, the specialized works carried out, as well as the activity Deployed obsto. + Article 27 The competition commissions appointed by the inspectorate are composed of a delegate inspector, as president, an inspector and three specialized teachers, according to the specialty for which the contest is held and having at least the same degree as those enrolled to the competition, as members. In order to fill the posts from the general culture disciplines of the specialized high school education, professional education and technical education, the competition commission shall also be completed with a delegate of the ministry or the central body in the subordination of the school unit. The competition committees appointed by the ministries and other central bodies are composed of the delegate of the head of the directorate (of the service or office of education), as president, and of two specialized teachers, according to the specialty for which he holds the contest and having at least the same teaching degree with those registered for the competition, as members. These commissions work to fill positions in the specialized disciplines, professional education and technical education. The competition committees provided for in this article may also include teachers or specialist university lecturers. + Article 28 The transfer of teaching staff from one school unit to another in the interest of education can be done to improve the management of some schools or in case of restriction of activity, with the agreement of those to be transferred. The transfer provided for in the previous paragraph shall be decided, as the case may be, by the executive committees of the county folk councils and the city of Bucharest, by the school inspectorates, or by the ministries or other central bodies that have subordinated their school facilities, taking into account the level of training of those concerned and the results obtained in the activity. In case of restriction of activity will also be considered the teaching degree, seniority in education and in the school unit, as well as the family situation. + Article 29 The results of the works prepared by the commissions provided in 27 are communicated to those interested. + Article 30 Appeals on how to settle applications for appointment and transfer in education are addressed to the bodies to which the applications were submitted within 10 days of the communication provided for in art. 29. The appeals shall be judged by the committees having the following composition: -at school inspectorates: the county general school inspector, as president, the representative of the Union of trade unions in educational institutions and culture and a school inspector, as members; -at the ministries and other central bodies: the head of the education department (service or office of education), as president, representative of the union of trade unions of the corresponding branch and a teacher of education within the direction, as members. The composition of the commissions for the trial of appeals cannot include the persons who participated in the commissions for the settlement of requests for transfer and appointment. The decisions by which appeals are resolved are final. + Article 31 Based on the decisions of the appointments and transfer commissions and, dupe case, the decisions of the appeals commissions, the executive committees of the county folk councils and the city of Bucharest, through the school inspectorates, respectively the ministries and the other central bodies subordinated to the school facilities from which the transfer is made, shall issue the transfer documents. The nomination proposals shall be submitted to the Ministry of Education for approval. + Article 32 The appointment and transfer operations from one school unit to another shall be carried out only in the period established by the Ministry of Education, and the appointment and transfer papers shall enter into force on 1 September of the year in which these operations. Except for the transfers provided in art. 28. + Article 33 The posts remaining vacant after the appointment of the appointment and transfer operations from one school unit to another, the reserved posts, as well as the posts of the holders whose employment relationship is suspended (leave for incapacity temporary work, removal from production, etc.), can be occupied by posting. The posting of the titular teaching staff can be carried out at another school unit, from the same or other locality, for no more than 6 months or with the consent of the one concerned, during a school year, in both cases with the granting of rights Legal posting. + Article 34 The posts provided in art. 33 that have not been occupied by posting, as well as the posts become vacant during the school year, can be filled by replenishment by persons who have the studies required for appointment. + Article 35 The appointment of the substitutes is made, as the case may be, by the school inspectorates or by the bodies that subordinate schools, for a period of no more than one school year in the case of vacancies, or, until the presentation of the holder of the post, in the other cases referred to in art. 33. For the appointment of substitutes to general culture disciplines, ministries and other central organs will obtain, in advance, the consent of the school inspectorate who, according to the law, directs and controls the activity of the school unit to which they make the appointment The replenishment for a duration not exceeding 30 days is approved by the director of the school unit. The titular teaching staff on unpaid leave cannot be appointed as a substitute in another teaching position. Persons who, without thorough reasons, interrupted the teaching activity cannot be named as substitutes except with the approval of the Ministry of Education. + Article 36 If some teaching positions of teachers, teachers or instructors could not be filled by appointment in education, transfer from one school unit to another, secondment or replenishment, the activities of these posts may be fulfilled by persons who have the studies required by this Statute, the remuneration being made under the law. + Article 37 The dismissal of the teaching staff of the titular teaching staff, in case of transfer to another sector of activity, as well as in case of dissolution of the employment contract, is made by the Ministry of Education to the complaint of the bodies that ordered the employment of those concerned, in compliance with the provisions of the labour code and the other provisions of the labour law. The bodies that ordered the assignment to the posts also issue the documents of transfer to another sector of activity or to open the employment contract of those released from education. + Article 38 The appointment of the assisting teaching staff to the school units with legal personality is made by the director of the unit, and at the school units without legal personality, as the case may be, by the school inspectorates or the central bodies to which the school units are located, in compliance with the conditions provided in 9 lit. g-j and art. 11. + Article 39 The transfer and dismissal of the assisting teaching staff shall be made in compliance with the provisions laid down in the labor code, by those who appointed it. + Chapter 4 + Article 40 In the positions of director and deputy director can be appointed the teaching staff of the holder, which is distinguished in the professional activity, proves organizational skills and meets the conditions set out in this section. At schools or departments with the teaching in languages of conhabiting nationalities, in the positions of director or deputy director it is called teaching staff from the respective nationalities or who knows the language of those nationalities. + Article 41 The directories of kindergartens of children are called by school inspectorates, among the educators who obtained teaching degrees or at least the completion in education. At kindergartens with a single teaching position, the educator is also the director of the unit. + Article 42 The directors of the general schools are appointed by the school inspectorates between the teachers who have obtained teaching degrees or at least the completion in education and are at least 5 years old. At school facilities operating only with grades I to IV, one of the institutes or teachers is also appointed principal of the school. Deputy directors of general schools are appointed by school inspectorates between teachers, institutes or teachers, in compliance with the other conditions provided for the position of director. + Article 43 The directors and deputy directors of general high schools and pedagogical high schools are appointed by the county school inspectorates or the city of Bucharest, with the consent of the Ministry of Education, among the teachers who meet the conditions to teach in high school education and has at least the teaching degree II, for the position of director and at least the completion and at least 5 years old in education for the position of deputy director. At the high schools operating and with the I-IV classes of the general school, one of the deputy directors can be appointed from the institutes or teachers. At high schools and general schools with special program, as well as at pedagogical high schools as director will be appointed, especially, teachers who teach the specialized disciplines corresponding to the profile of the school unit. + Article 44 Directors and deputy directors of specialized high schools, with the exception of pedagogical high schools, as well as those of the school units in the professional education and technical education are appointed, with the consent of the Ministry of Education, as the case may be, central bodies that organize school facilities, or school inspectorates, of teachers who meet the conditions to teach at these establishments and who have obtained teaching degrees or at least the completion and a minimum of 5 years in Education. School inspectors from school inspectorates are appointed by the general school inspector, with the consent of the Ministry of Education, between educators, institutes, teachers or teachers having the teaching degree II or at least the completion and a educational activity of at least 8 years. + Article 48 The teaching staff promoted to the positions of guidance and control of the education at the Ministry of Education, as well as to the other ministries and central bodies that subordinate schools, is subject, while exercising other functions, regulations on specialist staff in central bodies. + Article 49 The release from the guidance and control functions shall be made by the bodies and with the procedure provided for the appointment. + Chapter 5 + Article 50 The teaching staff benefits from the rights provided for in this Statute, as well as the rights arising from its employee quality, provided by the labor law. + Article 51 For the purpose of carrying out its tasks, the teaching staff has the following main rights -to carry out a specialized activity in the field of education, according to his professional training; -to use, for the preparation and conduct of teaching and scientific activity, materials, machinery and libraries of educational institutions; -publish manuals, treaties and other works; -to benefit from the forms organized by professional improvement, as well as the advantages that the law grants as a consequence of this improvement; -to be part of professional organizations and cultural associations, national and international, whose concerns are related to the development of education, carrying out activities in accordance with the statutes of these organizations; -to use the material basis of the county houses of the teaching staff, in order to document specialized scientific and young people up to date with the novelties in the field of pedagogical science or for the realization of experience exchanges and for conducting scientific research. + Article 52 In order to stimulate scientific and methodical research, to raise the scientific and professional level and to capitalize on the results of research work, the teaching staff can be constituted in scientific societies, on the branches of science. Scientific societies shall be organized and operated as legal entities on the basis of their own statutes adopted in the country conferences of the specialized teaching staff. They are part of the Union of scientific societies of teaching staff. Scientific societies can work with other similar societies abroad; scientific societies can also, under the law, be able to join international specialist organisations and their members can be part of these. Organizations. + Article 53 Teaching staff with meritorious results in teaching, scientific or artistic education can be delegated by the Ministry of Education to participate in congresses, specialized meetings or other national cultural-scientific events or international. + Article 54 The teaching staff has the right to obtain the transfer from one school unit to another, under the conditions and with the procedure provided for in this title. + Article 55 Teaching staff and teaching staff of school units benefit from an annual paid rest leave, the duration of which is 62 calendar days and which is carried out, as a rule, from July 1 to August 31. The leave provided for in the previous paragraph shall be granted to the teaching staff who operated throughout the school year If the appointment was made after the beginning of the school year, the duration of the leave will be proportional to the time actually served in education that year, counting 5 working days for each month of activity. + Article 56 The teaching staff who could not fully perform the rest leave during the period provided for in the previous article, being detained for work, nor could they complete the leave in other periods of interruption of school courses, will be able to make the leave during the next school year, during periods of interruption of school courses. Also, if annual holiday leave could not be carried out during a school year, for thorough reasons, such as: temporary incapacity for work, maternity leave or for the care of sick children less than 2 years old, appointment at professional refresher courses, satisfaction of military obligations, except military service within the period, the leave will be able to be carried out in the next school year, during the periods of interruption of school courses and, in the exceptional, even during the courses. The cash compensation of the unpaid holiday will be possible only in the cases and conditions provided by the legal provisions on employee rest leave. + Article 57 The teaching and control staff benefit from an annual holiday of 31 calendar days. The helping teaching staff benefit from the right to rest leave under the conditions established by the Employee Rest Leave Act. + Article 58 According to the norms established by the Ministry of Education, for special personal interests and if there is no damage to the proper conduct of education, the teaching staff can obtain holidays without payment, in limited time (without being able to overcome a school year), with the approval, as the case may be, of school inspectorates or ministries and other central bodies that have schools in their subordination. For unpaid leave with a duration of up to 6 days in a school year, the approval can be given by the director of the school unit. The periods of leave without payment in the personal interest provided for in this Article, which exceed 60 calendar days in a school year, shall not be regarded as seniority in education. For teachers who teach these disciplines in pedagogical high schools and in post-secondary pedagogical specialization schools, as well as for those who teach the same disciplines, as specialized objects, in special program schools, they settle 18-20 class hours per week; -for teachers who have special tasks in the school and professional orientation of students are established 18-20 hours per week of teaching, assistance in lessons and activity with students in order to direct them and the assembly the material necessary to draw up the student orientation sheets; -for teacher-instructors, 24-30 hours of practical training in school-workshops. The improvement of the teaching staff is also carried out through the activity within the scientific societies, as well as through study and documentation trips. In the case of institutes and teachers, improvement can also be achieved through the doctoral system, under the conditions provided by law. + Article 78 Improvement by the forms provided for in the previous article, lit. b and c are provided by school inspectorates. + Article 79 The regular specialized scientific information courses are organized at higher education institutions that prepare teaching staff and at the branches of the Central Institute for the improvement of teaching staff, under the conditions established by Ministry of Education. The teaching staff will be scheduled to participate in the regular scientific information courses, until the age of 25 years in education. The participation of teaching staff in these courses is mandatory. For the teaching staff of the units in the preschool education and the compulsory education of general culture, the courses and the training provided in art. 77 letter f, as well as the training and consfatuations for the supervising teachers, provided in lett. e, shall be organized through the branches of the Central Institute for the improvement of the teaching staff. + Article 83 The completion in education is obtained, based on a special inspection and an examination, by the teaching staff who meet the conditions of studies provided in art. 9 and has an effective internship of 3 years in teaching teaching. The presentation to the exam for completion in education is mandatory at the expiry of the 3-year internship. The teaching staff can present themselves at this exam in three consecutive sessions. The improvement of teaching staff with higher education can also be achieved through the doctoral system, as well as through study and documentation trips. + Article 94 Perfecting by the form provided in art. 93 lit. b is carried out by debating the main problems of the instructive-educational activity, in order to improve this activity in school, workshops and in production.
