The Romanian Parliament adopts this law + Article 1 The financing contract between Romania and the European Investment Bank and the National Road Administration (AND) for the financing of the Road Rehabilitation Project, stage IV, signed in Bucharest on 6 November 2000, is ratified. + Article 2 The implementation of the financing contract will be carried out by the National Road Administration, reorganized in the National Highway and National Roads Company of Romania-S.A., according to Government Emergency Ordinance no. 84/2003 for the establishment of the National Highway and National Roads Company of Romania-S.A. by reorganizing the Autonomous Regia "National Road Administration of Romania", approved with amendments and completions by Law no. 47/2004 , with subsequent amendments and completions. ----------- Article 2 has been amended by section 2. 1 1 of art. 22 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 3 Between the Ministry of Public Finance, on the one hand, and the Ministry of Public Works, Transport and Housing and the National Road Administration (AND), on the other hand, a subsidiary loan agreement will be concluded by which they will delegate. The National Road Administration (AND) the entire authority and responsibility for the use of the loan, the realization of the project and the compliance with the obligations assumed by the + Article 3 ^ 1 As of January 1, 2009, the subsidiary loan agreement provided for in art. 3 is amended as a subsidiary agreement and includes the rights and obligations of the parties in the application of the financing contract, according to the provisions art. 14 to Emergency Ordinance no. 64/2007 on public debt, approved with amendments and additions by Law no. 109/2008 ,, as amended. ----------- Art. 3 ^ 1 was introduced by item 1. 2 2 of art. 22 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 4 (1) The funds necessary for the repayment of the loan, the interest payment and other costs related to the loan will be provided from the state budget through the budget of the Ministry of Public Works, Transport and Housing. ... (2) The contribution of the Romanian Government to the implementation of the investments financed by the loan of the European Investment Bank 1, including for the payment of taxes and fees charged on the territory of the country, as well as the consideration of other local costs that cannot be paid from the external loan, will be provided from own sources of the National Road Administration (AND), from other sources attracted (ISPA, PHARE) and, in addition, from the state budget through the budget of the Ministry of Public Works, Transport and Housing. ... ((3) As of January 1, 2009, the expenses equivalent to the amount of the remaining amounts to be used and drawn from the loan and the amounts related to the contribution of the Romanian Government to the financing of the project, which shall be ensured state, according to para. (2), will be cumulated in the budget of the Ministry of Transport, within the amounts allocated annually with this destination from the state budget. ... ------------ Alin. ((3) of art. 4 4 has been introduced by section 3 3 of art. 22 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 5 The Romanian Government is authorized that, through the Ministry of Public Finance, in agreement with the European Investment Bank and the National Road Administration (AND), to introduce during the use of the loan, in relation to the concrete conditions of The financing contract referred to in art. 1, amendments to its content concerning reallocations of funds, changes of deadlines, as well as any other changes that are not likely to increase Romania's financial obligations to the European Investment Bank or to determine new economic conditionings compared to those originally agreed between the parties. This law was adopted by the Chamber of Deputies at the meeting of August 27, 2001, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution.
