The Romanian Parliament adopts this law + Article 1 Approval Government Emergency Ordinance no. 236 236 of 24 November 2000 on the regime of protected natural areas, the conservation of natural habitats, flora and wildlife, published in the Official Gazette of Romania, Part I, no. 625 of 4 December 2000, with the following amendments and additions: 1. In Article 4, letters p), t), u), v) and x) shall read as follows: " p) conservation-as a whole of measures to be implemented for the maintenance or restoration of natural habitats and populations of wild fauna and flora, in a favourable state, in the meaning of point (a). s) and t); ............................................................... t) favourable conservation status of a species-is considered when: ((i) the species shall remain and are likely to remain in the long term as a viable component of its natural habitat; (ii) the species ' natural distribution area is not reduced and there is no risk of reduction in the future; (iii) there is a rather vast habitat for species populations to maintain in the long term; u) threatened species-endangered species, vulnerable or rare; v) priority species-endangered species and/or endemic species, for which urgent measures are required; x) species of Community interest-species within the European Union are endangered, vulnerable, rare or endemic: ((i) endangered, except those whose natural areal is marginal in the territory and which are neither endangered nor vulnerable in the western region; ((ii) vulnerable, i.e. whose passage in the category of endangered species is likely in the near future, in case of persistence of causal factors; ((iii) rare, i.e. whose populations are small and which, even if at present are not endangered or vulnerable, risk becoming; these species are located in restricted geographical areas or are rarely dispersed on wide areas; (iv) endemic and require particular attention due to the specific nature of their habitat and/or the potential impact of their exploitation on their conservation status. " 2. In Article 6, the introductory part of paragraph 3 shall read as follows: "(3) The establishment of the protected natural area regime and the protection zone of natural heritage assets, according to the provisions of this emergency ordinance, is a priority in relation to any other objectives, except those concerning:" 3. In Article 6, paragraph 4 shall read as follows: " (4) The size of the land area that is subject to the special protection, preservation and use regime, in accordance with the provisions of art. 5 5, shall be established on the basis of scientific substantiation studies. " 4. Article 8 (5) and (7) shall be repealed. 5. in Article 14, after paragraph 2, paragraph 3 is inserted as follows: "" (3) The authorization of activities in the perimeter of protected natural areas and in their vicinity shall be done with the agreement of the protected natural area management structures. " 6. Article 15 shall read as follows: "" Art. 15. -The ecological corridors established by the central public authority for environmental protection, with the opinion of the county council and the Romanian Academy, are prohibited and preserved any work and action that affects integrity. " 7. In Article 17, letter a) shall read as follows: "a) the central public authority for environmental protection, together with the Romanian Academy, for protected natural areas declared by laws or decisions of the Government;" 8. In Article 18, the introductory part of paragraph 1 shall read as follows: "" Art. 18. -(1) The methods of administration of protected natural areas and other goods of natural heritage, put under special protection and conservation regime, shall be established, in consultation with the county and/or local councils, taking into account: " 9. In Article 18, paragraphs 6, 7, 8, 10 and 11 shall read as follows: " (6) The management advisory councils shall be organized at the proposal of the protected area administration, with the approval of the central public authority for environmental protection (7) The management structures specially constituted for the protection of natural areas, according to par. (4), will be guided and supervised by a scientific council. (8) The composition of scientific councils is proposed by the administration of protected areas, with the opinion of the Romanian Academy, and is approved by the central public authority for environmental protection. ............................................................... (10) In the cases of scientific reserves, nature reserves, monuments of nature, special conservation areas, special protection areas avifaunistic and other natural heritage assets subject to a special regime of protection, which are not included in the perimeters of the biosphere reserves, national parks and natural parks, the administration can be ensured by one of the modalities provided in par. ((2) lit. b), c) and d), on the basis of conventions concluded, as the case may be, with the central authority for environmental protection, the Romanian Academy and the local public administration authorities. (11) In situations where in the same area there are protected natural areas and other natural heritage property, subject to a special protection regime, their administration may be provided by a single organ of administration, in direct coordination of the county environmental protection inspectorate. " 10. Article 19 shall read as follows: "" Art. 19. -(1) The management plans and the regulations of the protected natural areas shall be developed by the administrators of the protected natural areas and approved by the central authority for environmental protection, with the opinion of the (2) Compliance with management plans and regulations is mandatory for protected natural areas managers, as well as for individuals and legal entities who own or manage land and other property and/or carry out activities in the perimeter of protected natural area. " 11. In Article 20, paragraphs 1, 2 and 4 shall read as follows: "" Art. 20. -(1) For the supervision of protected natural areas and goods of natural heritage, under special protection and conservation regime, which do not require or which do not have specially constituted administration structures, the quality of custodian. ((2) Custodian may be natural or legal persons who have the qualification, training and means necessary to apply the measures of protection and preservation of the goods entrusted, attested by the central public authority for environmental protection. ............................................................... (4) For protected natural areas that are part of the National Network of Natural Areas protected by the conclusion of the conventions and the issuance of the custodian cards are within the competence of the central and local authorities for environmental protection, with the opinion of the Romanian Academy " 12. Article 20 (6) shall be repealed. 13. In Article 22, paragraph 3 shall read as follows: " (3) In protected natural areas, in which ecotourism is allowed: constructions, facilities and facilities mentioned in par. ((1) may also be intended for this purpose, as well as the activities of education and environmental training that are organized in cooperation with local authorities, educational institutions and non-governmental organizations engaged in protection activities and environmental education. " 14. In Article 23, paragraphs 1, 3 and 4 shall read as follows: "" Art. 23. --(1) In order to complete the financial resources necessary for the proper administration of protected natural areas according to management plans and regulations, their administrators may establish a system of tariffs approved by the central authority. for the protection of the environment or, where appropriate, local public administration authorities. ............................................................... ((3) Amounts from the tariffs established according to par. (1) shall be used by the managers of the protected natural areas, exclusively for the administration and protection of the goods of the natural heritage subject to this emergency ordinance. (4) The amount of tariffs established by the central public authority for environmental protection shall be published in the Official Gazette of Romania, Part I. " 15. Article 24 shall read as follows: "" Art. 24. -For some floristic and faunistic goods of natural heritage, existing in gardens and recreational parks, zoos, as well as in museum collections, as goods of the natural floristic heritage, faunistic, geological, paleontological, mineralogical and other nature, the necessary protective and conservation measures will be taken by the administrators or their holders. " 16. Article 28 shall read as follows: "" Art. 28. -By exception to the provisions of art. 26 and 27 the central public authority for environmental protection subject to approval by law, with the prior opinion of the Romanian Academy, derogations, provided that there is no acceptable alternative, and the derogatory measures are not to the detriment maintaining the populations of those species in a favourable conservation status in their natural area and only in the following situations: a) in the interest of protecting wildlife and the conservation of natural habitats; b) to prevent the occurrence of damage, in particular to crops, domestic animals, forests, fisheries, waters and other goods; c) in the interest of public health and security d) for scientific research and education; e) for the purpose of repopulation and reintroduction of these species. " 17. In Article 30, paragraph 2 shall read as follows: "(2) For caves the protection zone may refer to a restricted area around the entrance to the cave and to an area whose perimeter at the surface of the land fully covers the underground structures of the cave." 18. in Article 30, after paragraph 2, paragraphs 3 and 4 are inserted as follows: " (3) The owners or managers of the land comprising entries into the caves are required to provide access to these entries. (4) The beneficiary of an investment work has the obligation to announce the discovery of any cave in the front of a mining work or a career of the nearest competent institution (environmental protection agency or representatives of local public administration). " 19. Article 31 shall read as follows: "" Art. 31. -(1) The goods of the geological and speleological heritage, as natural goods of the subsoil, are, under the law, public property. (2) The cave represents any natural underground cavity with a development of more than 5 meters and large enough in the section to allow human access. (3) The cave resources are represented by objects, materials, substances and life forms, which exist or are formed naturally in caves: mineral formations, rocks, sediments, paleontological deposits, archaeological sites, plant species and animals, accumulations of groundwater. (. Caves shall be classified as follows: a) Class A-caves of exceptional value which, through scientific interest or the uniqueness of resources, are representative of national and international speleological heritage; b) Class B-caves of national importance that are distinguished by size, scarcity of resources and by tourist potential; c) class C-caves of local importance, protected for their geological, landscape, hydrological, historical significance or for their dimensions; d) Class D-caves that do not meet the conditions for inclusion in grades A, B and C. (5) The fall of caves in grades A, B and C is the competence of the Romanian Academy, which will draw up their catalogue taking into account the proposals made by natural or legal persons on the basis of specialized references. (6) Class A caves may not be subject to any arrangement or alteration of natural factors. They can be subject to speleological explorations, scientific research or documentation activities, based on authorizations issued by the Romanian Academy, within the limits established by the regulations and management plans. (7) Class A caves shall be constituted as scientific reserves. (8) Class B caves may be subject to speleological explorations, scientific research or ecological tourism, based on the authorizations issued by the Romanian Academy. (9) Class B caves are constituted as monuments of nature or nature reserves, as the case may be. (10) Caves in Class C may be subject to speleological explorations, scientific research, tourist arrangements or other forms of valorisation, such as: speotherapy or groundwater abstraction, on the basis of authorisations issued by the local authority responsible. " 20. Article 32 shall read as follows: "" Art. 32. -In order to avoid the negative effects on the assets of the speleological heritage, a) destruction or degradation of cave resources and unauthorised excavation or derocation; b) collections of fauna, fossils or objects of archaeological interest, carried out without authorization in caves; c) the penetration, by forcing the entrance, into a protected cave closed and signposted as such; d) unauthorized use of caves and carrying out activities that may endanger the integrity or natural balance of caves; e) dislocation, sale, purchase, collection of speleotems or other resources of caves; f) degradation by inscription or pollution of caves by storage within them or in relief elements, with which they communicate directly, of objects, waste of any kind, corpses, toxic and dangerous substances, fuels of any nature; g) the destruction or degradation of the markings or of the indicator panels outside or inside the caves; h) unauthorised performance, in the perimeter on the surface or near the entrance of a protected cave, of works such as: derocations, deforestation, dams, explosions, constructions; i) restricting the access of authorized persons to the entrances of caves; j) popularization, media coverage of the precise identification and location data of Class A caves, which by their nature may lead to the endangerment of the speleological heritage in this category. " 21. Article 33 shall read as follows: "" Art. 33. -(1) The Romanian Academy has the competence to issue permits for: a) scientific activities, exploration, in caves of Class A; b) scientific, exploratory and ecological tourism activities, of a limiting nature, in caves of class B; c) excavations, derocations and collections from caves. (. The authorization shall be issued on the basis of a written request, which shall contain details of the purpose, means, duration, proportions, guarantees of the action, and shall withdraw if the conditions laid down in its release have not been complied with. " 22. In Article 36, the introductory part shall read as follows: "" Art. 36. -Within the operating sites their managers will designate specialized persons or custodians, as the case may be, to ensure that the geological goods in the working fronts are protected, thus ensuring: " 23. In Article 38, letter a) shall read as follows: "" a) the central public authority for environmental protection with responsibilities for coordination, regulation, supervision and control; " 24. Article 39 (1), points a), b), j), r), t) and t) shall be repealed. 25. In Article 39 (1), letters g) and k) shall read as follows: " g) approve management plans and regulations of protected natural areas of the national network, with the opinion of the Romanian Academy; ............................................................... k) promotes programs and studies for the knowledge and assessment of the state of natural habitats, species of wild flora and fauna and other assets of the existing natural heritage on the territory of the country, to be financed from the budget of state and other sources, according to the law. " 26. Article 39 (2) shall be repealed. 27. Article 40 shall read as follows: "" Art. 40. -The tasks of the central public authority for environmental protection shall be carried out by the territorial authority for environmental protection, through the specific services for the conservation of nature and biological diversity, in cooperation with the administrations of protected natural areas, with forestry inspectorates and territorial kinetic offices, as well as with local public administration authorities. " 28. In Article 41 (1), the introductory part shall read as follows: "" Art. 41. -(1) The responsibilities of expertise, approval, supervision and scientific control, in application of the provisions of this emergency ordinance, shall be returned to the Romanian Academy, with the opinion of the Commission for the Protection of Natural Monuments, for which purpose: " 29. Article 41, point (m) of paragraph 1 shall be repealed. 30. in Article 41 (1), the following shall be inserted after point (1): "p) exercise powers of expertise, endorsement, supervision and scientific control, including on protected areas, declared at local level." 31. In Article 44, paragraphs 1 and 2 shall read as follows: "" Art. 44. -(1) The control over compliance with the provisions of this emergency ordinance shall be organized by the central public authority for the protection of the environment and shall be exercised by specially empowered persons within: a) its central apparatus, with control powers throughout the territory of the country; b) the county authorities of environmental protection, with control powers on the territory of the administrative-terrestrial units of which they operate; c) the staff of the administrations or administrators and custodians of the protected d) forestry inspectorates and territorial kinetic offices, with powers of control on their territory of competence. (2) The control over compliance with the provisions of this emergency ordinance on protected natural areas, declared by decisions of the county or local councils, shall also be exercised by the special staff empowered thereof. " 32. Article 47 shall read as follows: "" Art. 47. -The violation of the provisions of this emergency ordinance attracts civil, material, contravention or criminal liability, as the case may be. " 33. Article 48 shall read as follows: "" Art. 48. -Failure to comply with the provisions of this emergency ordinance constitutes contravention, if according to the criminal law does not constitute a crime, and is sanctioned with contravention fine as follows: a) from 500,000 lei to 5,000,000 lei for individuals and from 5,000,000 lei to 25,000,000 lei for legal entities, for violation of the provisions of art. 24 24, of art. 32 lit. g), i) and j), of art. 35 lit. c) and art. 36 lit. a) and b); b) from 5,000,000 lei to 20,000,000 lei for individuals and from 10,000,000 lei to 50,000,000 lei for legal entities, depending on the gravity of the facts, for violation of the provisions of art. 12 12, of art. 14 14 para. (1), of art. 15 15, of art. 27 lit. a)-c), of art. 32 lit. a)-e), of art. 36 lit. c) and d) and art. 43 43; c) from 500,000 lei to 20,000,000 lei for individuals and from 20,000,000 lei to 75,000,000 lei for legal entities, for violation of the provisions of art. 7 7, of art. 14 14 para. (2), of art. 19 19 para. (2), of art. 26 lit. a)-f), of art. 32 lit. f) and h), of art. 35 lit. a), b) and d) and art. 37 37 para. ((2). ' 34. Article 49 shall read as follows: "" Art. 49. -The finding of the facts constituting the contraventions and the application of sanctions shall be made by the persons empowered for this purpose by the central public authority for environmental protection, respectively by the members of the Commission for the Protection Monuments of Nature of the Romanian Academy, personnel of territorial environmental protection inspectorates, territorial forestry inspectorates, kinetic territorial offices, personnel of administrations or administrators and custodians protected natural areas, as well as by police officers and sub-officers, by persons empowered by the county and local public administration. " 35. Article 53 shall be repealed. 36. Article 54 shall read as follows: "" Art. 54. -The central public authority for environmental protection will undertake the necessary measures to strengthen institutional capacities, both at the central and local levels, ensuring the qualified staff needed to meet the responsibilities established by this Emergency Ordinance, in accordance with the requirements for integration into the European Union. '; 37. Annexes no. 2 2-5 will have the following contents: "" ANNEX No 2 TYPES of natural habitats whose conservation requires the declaration of special conservation areas An asterisk (*) before the name of the habitat signifies that it is a priority habitat. 1. Coastal, marine and dune habitats Sand banks permanently covered with a small layer of marine water; Lagoons and bays with sandbanks; Perennial vegetation of rocky shores; Annual vegetation with Salicornia or other species in mud and sand areas; Atlantic salt meadows (Glauco-Puccinellietalia maritimae); * Continental salt meadows; Stepe and panonic salt marshes; Dry psamophilic vegetation with Calluna and Genista; Dry psamophilic vegetation with Calluna and Empetrum nigrum; Continental dunes with open pastures with Corynephorus and Agrostis; * Panonic continental dunes; Embryonic mobile dunes; Mobile dunes along the shores (white dunes); * Fixed coastal dunes with herbaceous vegetation (grey dunes); * Fixed dune decals with Empetrum nigrum; Dune with Hippophae rhamnoides; Forested dunes of Atlantic, continental and boreal regions; Intrudal wet depressions; Permanent wet dunes. 2. Habitats of sweet waters Oligotrophic waters with very low mineral content; Standing waters, oligotrophs to mesotrophs with the vegetation of Littorelletea uniflorae and/or from Isoeto-Nanojuncetea; Highly oligomezotrophic waters with the bentica vegetation of Chara spp.; Natural eutrophous lakes with vegetation type of Magnopotamion or Hydrocharition; Natural distrophic lakes and helestei; Alpine rivers and benches along them with herbaceous vegetation; Alpine rivers and their woody vegetation with Germanic Myricaria; Water courses from the mountain plains with the vegetation of Ranunculion fluitantis and Callitricho-Batrachian; Rivers with mud banks with vegetation by Chenopodian rubri and Bidentian p.p. 3. Habits of meadows and scrubs Alpine and boreal meadows; Wet meadows with Erica tetralix; Dried meadows; * Tucracks with Pinus mugo and Rhododendron hirsutum (MugoRhododendretum hirsuti); Formations with Juniperus communis in calcareous areas or meadows; * Limestone ripping meadows or basophils with white Alysso-Sedion; * Limestone meadows on dry sands; Boreal and alpine meadows on siliceous substrate; Alpine and subalpine limestone meadows; Semi-natural dry meadows and cover facieswith bushes on calcareous substrate (* important sites for orchids); * Pseudostepe with grass and annual plants of Thero-Brachypodietea; * Meadows rich in Nardus species, on the siliceous substrates of the mountainous areas; * Subpanonic steppe meadows; * Pannic steppe meadows on loess; * Sandy panonic meadows; Meadows with Molinia on calcareous, turbocharged or clay-woody soils (Molinion caeruleae); Wet meadows with high herbs; Liziera associations with high hydrophilic herbs from the plains to the mountain and alpine; Alluvial meadows of river valleys with Cnidion dubii; North-boreal alluvial meadows; Low altitude meadows (Alopecurus pratensis, Sangiusorba officinalis); Mountain bands; Wooded fanettes. 4. Habits from peatlands and swamps * Active Turbars; Degraded peatland still capable of a natural regeneration; Cover turbages (* if the peatter is active); Depressions on turbocharged substrates; Marshes with sources of waters rich in mineral salts; * Calcareous marshes with the Mariscus Building; * Petrified springs with travertine formation (Cratoneurion); Alkaline shoots; * Alpine pioneer vegetation with Caricion bicoloris-atrofuscae. 5. Habits of stanching and caves Rocky grohotis of the mountain floor (Androsacetalia alpinae and Galeopsitalia ladani); Calcareous grohotis and calcareous shale of mountain floors to the alpine ones (Thlaspietea rotundifolii); Silica medioEuropean grocuses of the high regions; * Calcareous medioEuropean Grohoths of mountain floors; Calcareous rocky slopes with chasmophytic vegetation; Siliceous rocky slopes with chasmophytic vegetation; Siliceous cliffs with pioneering vegetation of Sedo-Scleranthion or Sedo albi-Veronicion dillenii; Grohotis and calcareous lespans; Unexploited touristic groves; Lava fields and natural excavations. 6. Forest habitat Old forests natural hemiboreal caducifoliate rich in epiphytes; Wooded pastures; * Caducifoliate marsh forests; Forests type Luzulo-Fagetum; Forests type Asperulo-Fagetum; MedioEuropean subalpine forests with Acer; MedioEuropean forests type Cephalanthero-Fagion; Forests with pedunculated oak or subatlantic and medioEuropean oak and with concrete Carpinion; Stejaris with Galio-Carpinetum; * Forests of slope, grohotis or ravines with Tilio-Acerion; Stejaris elder acidofil of the sandy fields with Quercus sturr; Frasin forest thermophilic with Fraxinus angustifolia; * wooded turbars; * Alluvial forests with Alnus glutinosa and Fraxinus excelsior (Alno-Padion, Alnion nicanae, Salicion albae); Mixed forests with Quercus sturr, Ulmus laevis, Fraxinus excelsior or Fraxinus angustifolia, riparian of the great rivers (Ulmenion minaris); * Panonic forests with Quercus petrae and Carpinus betulus; * Panonic forests with Quercus pubescens; * Steppic Eurosiberian forests with Quercus sturr; Acidophilic forests with Picea from mountain alpine floors; Alpine forests with Larix decidua and/or Pinus cembra; Forests with Castanea sativa; Woods with Quercus frainetto; Galleries with white Salix and Populus alba; Forests of Pinus sylvestris on limestone substrate. ANNEX No 3 SPECIES of plants and animals the conservation of which requires the designation of special areas of conservation and special protection areas avifaunistic Interpretation a) Annex no. 3 3 is a continuation of Annex no. 2 2 for the establishment of a network of special conservation areas. b) The species listed in the Annex are indicated: ● by the name of the species or subspecies; or ● by all species belonging to a higher taxon or part of that taxon. c) Symbols An asterisk (*) before the species name signifies that it is a priority species.
