Romanian Parliament adopts this law.


Article 1 shall approve the plan the national landscaping-section IV-the network of settlements, according to annexes II nr. I-VIII, which form an integral part of this law.

Article 2 (1) National Network of towns and villages is composed of urban localities and from rural areas ranked according to annexes on ranks No. II-IV.
  

(2) according to this law, the hierarchy of ranks is the following localities: a) rank 0-Romanian capital municipality of European importance;
  

b) I rank the importance of the national team-municipalities with a potential influence at european level;
  

c) rank II-municipalities of interjudeteana, County or with the steady role in the network of settlements;
  

d) rank III-cities;
  

tier IV-e) villages resident of the commune;
  

f) rank 5th villages of communes and villages belonging to municipalities and cities.
  


Article 3 (1) Switching from localities a rank to another is done by law, upon the proposal of the local councils, in consultation with the population and the institutions concerned, in accordance with the law, while respecting the main quantitative and qualitative indicators set out in annex 4 to the minimal. For urban areas, and in the annex. IV, for rural areas.
  

(1 ^ 1) Substantiation documentation relating to the passage of a city from rank to rank II III-municipality of the County of interjudeteana, or as a balance in the network of settlements-will feature the city proposed to be Fisa declared municipality, established in accordance with the model set out in annex 4. (1 ^ 3) The data in the data sheets referred to in paragraph 1. (1 ^ 1 and ^ 2-1), which is subject to official records in conjunction with the Census of population and housing, will be registered with the appropriate values census, whose confirmation is done through an advisory opinion issued by the National Institute of statistics, and with updated values from the date on the coin. In the latter case, the opinion of the National Institute of statistics relate only to the registered population on 1 July of the year preceding that in which the coin is made out.

(2) the main macroeconomic indicators, items, and levels of equipment provided by law for the ranking of urban and rural settlements will be the basis of the criteria for determining the taxes and fees.
  


Article 4 (1) the Government supports the Declaration of new cities, mostly in areas devoid of towns within a radius of 25-30 km-contained in the tables in section 3.7 and 3.8 of annex. And marked on the map in annex 4. III, through the unification of the commune which has the greatest possibilities of development and a favorable position within the range with one or more municipalities neighboring on the basis of decisions taken in this respect by the local councils involved, following the agreement of the population in the municipalities concerned, expressed through local referenda conducted in accordance with the law. In the same circumstances, the Government may grant support for the Declaration of new municipalities, through the unification of a city with one or more municipalities located in the immediate vicinity.
  

(2) in order to allow access to the structural funds provided by the European Union in the House of Commons that there have been declines exacerbated by population, contained in the tables in points 3.1 and 3.2 of the annex. IV and located in areas marked on the map in annex 4. V, the Government encourages the administrative unification of two or more of these municipalities that are adjacent, on the initiative of the local authorities and as a result of the referendum will be expressed by the population of the municipalities concerned.
  

(2 ^ 1) The Government supports the Declaration of the new municipalities, if economic and social situation of the zone will be encouraged, through the unification of one or more municipalities with one or more cities and/or multiple municipalities located in the immediate vicinity, within the same County, on the basis of decisions taken in this respect by the local councils involved, following the agreement of the population of the respective administrative-territorial units expressed through local referenda conducted in accordance with the law.

(3) pursuant to the provisions of paragraph 1. (1), (2) and (2 ^ 1), the Government ensures: (a) the drawing up, approval and) promotion by the Ministry of administration and interior projects, regulations for the Declaration of the cities through the unification of the administration of two or more municipalities or, where appropriate, Declaration of municipalities, by incorporating under a city of many common or by uniting one or more municipalities with one or more cities and/or multiple communes in the vicinity based on the joint letter of intent public administration authorities from administrative-territorial units concerned and corresponding documentation;
  

b) monies from the State budget, for the co-financing of investment projects of the administrative-territorial units newly established, benefiting from grants provided by the European Union for the development of local infrastructure.

(4) Bills aimed at declaring the towns or municipalities under the terms of paragraph 1. (1), (2) and (2 ^ 1) may be made and promoted other initiators, referred to by the Constitution on the basis of decisions taken in this respect by the local councils involved, following the agreement of the respective population administrativteritoriale, expressed through local referenda conducted according to the law, being applicable in such a case the provisions of paragraphs 1 and 2. (3) (a). b).

Article 5 (1) the Organization of new municipalities shall be made by law, on a proposal from the City Council, in consultation with the local population in administrative-territorial unit to take over rural areas and population in the territorial-administrative units that rural areas in the case, on the basis of the documentation by attesting fulfilment of the minimum requirements contained in the annex. IV. (2) the documentation referred to in paragraph 1. (1) shall be the commune proposed Fisa established, drawn up in accordance with the specimen in the annex. VIII. — — — — — — — — — — — —-. Article 5 ^ 1 (1) the administrative-territorial Units that are reinfiinteaza are delineated and marked on the basis of the old territorial borders existing at the time of their liberation and a cadastral plan drawn up after the founder and countersigned by the County Office of cadastre and real estate advertising. Cadastral plan endorsed is subject to public consultation, referendum, and after approval will be part and parcel of the law approving the establishment of the new administrative-territorial units.
  

(2) in the case of administrative-territorial units, marking the newly established administrative and territorial borders and the limits of intravilanelor is based on the cadastral plan drawn up by initiatori and endorsed by the County Office of cadastre and real estate advertising.
  

(3) where they appear in the delimitation process diverging area has two or more territorial-administrative units, the prefect mediate the conflict.
  

(4) If as a result of the mediation process, the parties do not reach an agreement, the cadastral plan is drawn up according to the solution proposed by the initiator.
  

(5) local councils be subject to consultation, referendum, along with the decisions of the administrative-territorial units referred to in paragraph 1. (1) and (2), cadastral plans and territorial delimitation.
  

(6) the costs of preparing and advising the cadastral plans are part of the expenses incurred in organizing the referendum.

Article 7 (1) for the balanced development of the territory in the area of the Romanian Capital and tier I or municipalities of the county municipalities, administrative-territorial units in these areas may be associated in a partnership for the purpose of establishing voluntary metropolitan areas related to urban space. The Association contributes to the strengthening of interventions between these units and policy-makers interested in territorial development.

(2) metropolitan areas referred to in paragraph 1. (1) operates as independent entities without legal personality.

Article 8 the Association of metropolitan area, in agreement with the local Council and in consultation with the population in accordance with the law, in whose territorial RADIUS was established, to adopt the program of development of the area.


Article 9 with a view to optimizing the evolution of major urban strong motion, by law can be set up within their areas. The law will provide for the perimeter, the duration of operation, management, institutional framework as well as fringe benefits.


Article 10 with a view to protecting the natural framework elements, to prevent uncontrolled expansion of urban settlements and ensuring of recreational spaces and recreation in urban plans developed and approved according to the law will provide for the establishment of the green belt and areas around the capital of Romania and of the municipalities of tier I.


Article 11 national development plans, including those of cross-border regional development and integration in the european space, as well as sectoral ones will be developed on the basis of the provisions of sections landscaping plan national communication Horses, water, protected areas, a network of towns and villages, natural risk Zones, as well as other sections of the landscaping plan approved under national law.


Failure to comply with the provisions of article 12 of this law leads to cancellation of acts, including the measures and provisions listed in article development. 11. Article 13 central public administration authorities and local Government will work cooperatively to ensure the application of the provisions of this law.

Commune of shape stable population settlement in the territory, having more than a kernel of human life, with structures and variable sizes, differentiated depending on the specifics of the production activities of the inhabitants, the dominant characteristics of the administrative-territorial organization, the number of inhabitants, the Fund built, the degree of socio-cultural equipment and technical equipment-land.
Depending on the specifics and the dominant share of economic activity, the number of inhabitants, the Fund built, density of population and housing, the level of social and cultural equipment and technical equipment are divided into the towns of two major groups: urban and rural localities.

4. Administrative-territorial unit-according to the law of administrative-territorial units are municipalities, cities and counties.
Administrative-territorial units are cities and townships that comprise one or more localities.
5. City-administrative-territorial unit base made from either a single urban commune, or from several localities, of which at least one is an urban commune. As an administrative-territorial unit and that the socio-economic system and geographically the city has two components: a territorial component)-which represents the surface area of land occupied or intended for construction and interior decoration (housing, social-cultural, industrial, storage, production, traffic, Commerce, recreation, etc.) and which represent the rest of the territory near the city;
  

b) demographic component, which consists in socioeconomica groups of population and economic activities, social and political-administrative action that takes place in the territory of the village.
  

Sizes, character and functions of the town shows great variations, its development being closely correlated with that of the territory which belongs to him.
Cities that have a special meaning in economic life, social-and cultural-scientific policy of the country, or who have conditions in these directions are declared municipalities.
6. The commune

Law No. 83 of 5 April 2004, published in Official Gazette No. 310 of 7 April 2004: "Art. 1 (1) shall be subject to approval of some cities declaring as communes in Arad, Arges, Dolj, Gorj, Constanta, Ialomita, Olt, Maramures, Satu Mare, Sibiu, Suceava and Timiş.

1.9. Elements and equipment level of the rural localities of rank Rank is assigned to V V components of villages communes and villages belonging to the municipalities or cities. The existence of public and commercial facilities and their size is determined by the number of inhabitants and the specifics of the settlement. Minimum facilities in villages with more than 200 inhabitants are: primary school;

-Shop for food and non-food trade.
These facilities are necessary, in the case of villages having a population of up to 200 people, when their respective villages are isolated, located at distances of over 3-5 km from the nearest village that features such amenities.
