The Romanian Parliament adopts this law + Article UNIC Approval Government Emergency Ordinance no. 71 71 of 24 May 1999 on the reorganization of plant protection and phytosanitary quarantine activity, published in the Official Gazette of Romania, Part I, no. 232 of 25 May 1999, with the following amendments and additions: 1. Article 2 shall read as follows: "" Art. 2. -The Ministry of Agriculture, Food and Forestry is the regulator in the field of plant protection, phytosanitary quarantine and phytosanitary products, which coordinates and controls the application of specific legal provisions through the Phytosanitary Directorate. 2. After Article 2, Article 2 ^ 1 is inserted as follows: "" Art. 2 2 ^ 1. -The phytosanitary Directorate has the following a) organization of plant protection and phytosanitary quarantine activity throughout the territory of the country, after a unified conception, to ensure the health of cultivated plants, forests, pastures and natural fanettes and other forms of useful vegetation and stored agricultural products; b) coordination, technical guidance and control of the activity in the field of phytosanitary and of the approval and use of plant protection products; c) establishment of phytosanitary, unique and binding rules for all natural or legal persons holding agricultural crops and other forms of useful vegetation, as well as for those who store, transport and capitalize vegetables and products vegetable; d) elaboration of the phytosanitary strategy on the protection of plant health, the prevention of the introduction and dissemination on the territory of the country e) elaboration of draft laws, decisions, orders and other normative acts concerning the plant protection and phytosanitary quarantine activity and the regime of plant protection products, in order to improve and improve the legislation national and harmonising it with Community legislation, organisation, endowment and functioning of national phytosanitary services; f) elaboration or, as the case may be, the updating of the regulation of organization and functioning of the county phytosanitary departments, respectively of the city of Bucharest, as well as of other regulations concerning the activity of plant protection, quarantine phytosanitary and phytosanitary products; g) control of the application and compliance of all legal provisions, technical rules in the field of phytosanitary and plant protection products; h) the organization and pursuit of the technical and material endowment of the county phytosanitary departments, respectively of the city of Bucharest, the Central Laboratory for Phytosanitary Quarantine and the customs phytosanitary control points; i) the organization of a unique information system for the monitoring of plant and plant products that are exported, imported or transited through Romania; j) establishing the need for personnel and elaboration, under the law and regulations in force, of the technical criteria regarding the classification and insurance of specialized personnel for the county phytosanitary departments, respectively of the municipality Bucharest, Central Laboratory for Phytosanitary Quarantine and customs phytosanitary control points; k) participation in the approval of plant protection products and the periodic development of Codex with plant protection products approved for use in Romania; l) the national organization of the phytosanitary police; m) participation in the organization of competitions for obtaining professional degrees; n) the empowerment of economic agents for the import of plant protection products, under the law; o) substantiates and makes proposals annually on the need for funds for plant protection and phytosanitary quarantine actions, financed from the state budget; p) represents Romania at the international bodies O.E.P.P., F.A.O., O.M.S., I.U.P.A.C. and others. " 3. in Article 4, point e) shall be repealed. 4. In Article 4, letters f) and m) shall read as follows: " f) the empowerment of economic agents for marketing actions and the provision of services with plant protection products under the law; ............................................................ m) the issuance of import authorizations for plant and plant products subject to the phytosanitary quarantine regime, phytosanitary passports, phytosanitary certificates and other documents provided by law; " 5. Article 9 shall read as follows: "" Art. 9. -Within 30 days from the date of entry into force of this emergency ordinance the Government, at the proposal of the Ministry of Agriculture, Food and Forestry and the Ministry of Public Administration, will establish the patrimony related to the activities provided in art. 5 5 para. (1), which will be given in the administration of public services for the protection of county plants, respectively of the city of Bucharest. " 6. Article 10 shall read as follows: "" Art. 10. -The county councils and the General Council of Bucharest will set tariffs for the activities provided in art. 5 5 para. ((1). ' 7. Throughout the emergency ordinance the Ministry of Agriculture and Food, the National Phytosanitary Agency and the Minister of Agriculture and Food are replaced by the phrases Ministry of Agriculture, Food and Forestry, Directorate phytosanitary from the Ministry of Agriculture, Food and Forestry and the Minister of Agriculture, Food and Forestry. This law was adopted by the Chamber of Deputies at its meeting on March 26, 2001, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution. p.
