Law No. 87 of 20 March 2001 on approval of the Government Ordinance. 94/1999 concerning the participation of Romania in the procedures to the European Court of human rights and to the Committee of Ministers of the Council of Europe and the State as a result of regression of judgments and conventions to resolve amicably the ISSUER published in PARLIAMENT OFFICIAL GAZETTE nr. 145 of 23 March 2001, the Romanian Parliament adopts this law.


The sole article approving Ordinance No. 94 of 30 august 1999 concerning the participation of Romania in the procedures in the European Court of human rights and to the Committee of Ministers of the Council of Europe and the State as a result of regression of judgments and conventions to resolve amicably, issued pursuant to art. and (b). C paragraph 4 of law No. 140/1999 on empowering the Government to issue decrees and published in the Official Gazette of Romania, part I, no. 424 of 31 august 1999, with the following amendments and supplements: 1. Title of the Ordinance shall read as follows: "ORDINANCE concerning the participation of Romania in the procedures in the European Court of human rights and to the Committee of Ministers of the Council of Europe and the exercise of the right of recourse of the State following the decisions and conventions to resolve amicably" 2. In article 5, paragraph (1) shall read as follows: Art. 5.-(1) the appointment of candidates on behalf of Romania for the post of judge of the Court may be punished by the Government, upon the proposal of the Superior Council of Magistrates, following the hearing of persons proposed by its members from among lawyers with high moral and civic power, reputable professional advice legal Committee, discipline and immunities, of the Commission on human rights, religious affairs and national minority issues of the Chamber of Deputies and of the legal Commission , appointments, discipline, immunities and effectuates the Commission, human rights and minorities of the Senate. Committees meeting will hear proposed candidates sitting in the commune. The convening of the Superior Council of Magistracy shall be made by the Minister of Justice, who will preside over the work of the latter, without participating in the vote. "
3. In article 7, paragraphs (2) and (3) shall read as follows: "(2) the expertise of the tribunal through closing, public meeting, with the attendance of the parties, within five working days of receipt of the request.

(3) the conclusion referred to in paragraph 1. (2) the appeal may be contested within 48 hours of delivery. Application for appeal shall be lodged with the Court of Appeal jurisdiction and deciding the public meeting, with the attendance of the parties, within five working days following receipt of the appeal. "
  

This law was adopted by the Chamber of deputies at its meeting on 23 October 2000, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
