Law No. 48 of 28 February 1948 for the rehabilitation of criminals who fought on the Western front of the ISSUING NATIONAL ASSEMBLY and published in Official Gazette No. 49 dated 28 February 1948 the sole article the criminal proceedings for any offence, in addition to those falling within the provisions of law No. 312 on 24 April 1945 and law No. 291 of 18 August 1947, shall be declared extinguished if offenders, after committing the crime, have distinguished themselves in the battles on the Western front, by acts of bravura, established by the order of the day given by the unit commanders or were ranked as of R2 invalids.
If, in the above cases, criminals have been convicted by final judgment, before the publication of law on the face, the courts will decide the rehabilitation procedure laid down by the code of criminal procedure and the code of military justice, with the completion of the relief of the other conditions required for rehabilitation, or will be able to decide special rehabilitation provided by the code of military justice.
Investigation bodies or instruction and courts will verify, at the request of the parties concerned, the performance of the above shown condiţiunilor and, where appropriate, will reject the application or has to be classified, under tracking, termination or prosecution shall decide on rehabilitation.
