National decorations: -orders, crosses and medals; B. decorations on fields of activity: a) civil orders and medals; b) military orders and medals: --of peace; --of war. + Article 3 ((1) The decorations are conferred on Romanian citizens for exceptional services to the Romanian state and people, for acts of heroism committed in military service and for outstanding merits in activity. (2) The decorations may also be conferred on military units for special acts committed in peacetime and for acts of heroism in time of war. ((3) The decorations can also be conferred on foreign citizens for the special contribution to the progress of humanity, to the promotion of peace and democracy in the world, to the development of collaboration and friendship relations with Romania or for facts and services outstanding to the Romanian state and people. + Article 4 (1) The decorations are conferred by the President of Romania, by decree, on the basis of individual decoration proposals. (2) The decoration proposals shall be made by: a) the President of the Senate or the President of the Chamber of Deputies, for the President of Romania, Prime Minister, Senators b) Prime Minister, for members of the Government; c) ministers and heads of autonomous central institutions and organizations, for persons in their field of activity. (3) The President of Romania may confer decorations and from his own initiative, in the proportion of 1% of the total number established by law for each degree or class of each decoration, except for the grades of Grand Officer, Grand Cross and Colan. (4) For Romanian citizens the decoration takes place once a year, on the occasion of the National Day of Romania. (5) In special cases the decorations may also be conferred during the calendar year. + Article 5 The nominal proposals for the conferral of decorations are endorsed by the Chancellery of Orders, which is established within the Presidential Administration. + Chapter II The decoration system + Article 6 National decorations are as follows: A. Orders: I. Order Star of Romania; II. Order Faithful Service; III. Order For Merit. B. Cross and medals: I. Cross Faithful Service; II. Medal Faithful Service; III. The Medal For Merit. C. Commemorative crosses: I. The Commemorative Cross of Anti-Communist Resistance; II. Commemorative Cross of the Anticommunist Revolution of December 1989; III. Commemorative Cross of World War II, 1941-1945. + Article 7 (1) Civil decorations on fields of activity are as follows: A. Orders: -The Order Of Agricultural Merit; -Order of Cultural Merit; -Order of Industrial and Commercial Merit; -Order of Merit for Education; -Order of Health Merit; -The Sporting Merit Order; -The Diplomatic Merit Order. B. Medals: -The Agricultural Merit Medal; -The Cultural Merit Medal; -Industrial and Commercial Merit Medal; -The Merit Medal for Education; -The Sanitary Merit Medal; -The Sports Merit Medal; -The Diplomatic Merit Medal. + Article 8 The military peace decorations are as follows: A. Orders: -Military Virtue Order; -The Aeronautical Virtue Order; -The Maritime Virtue Order; --Order of Manhood and Faith. B. Medals: -Military Virtue Medal; -The Aeronautical Virtue Medal; -Maritime Virtue Medal; -The Manhood and Faith Medal. + Article 9 Military war decorations are the following: A. Orders: I. Order Mihai Viteazul; II. The Order of Romania; III. Order Faithful Service; IV. Order For Merit; V.-Military Virtue Order; -The Aeronautical Virtue Order; -The Maritime Virtue Order; VI. The Sanitary Merit Order. B. Medals: I.-Military Virtue Medal; -The Aeronautical Virtue Medal; -Maritime Virtue Medal; II. Cross Faithful Service; III. Medal Faithful Service; IV. Medal For Merit; V. The Manhood and Faith Medal; VI. The Sanitary Merit Medal. + Chapter III Hierarchy of decorations + Article 10 (1) The hierarchy of each decoration, in descending order, is as follows: I. National orders: 1. Romanian Star Order, established by Government Emergency Ordinance no. 11/1998 for the reestablishment of the National Order Star of Romania, republished, as amended, includes 6 degrees: a) Colan; b) Grand Cross; c) Grand Officer; d) Commander; e) Officer; f) Knight. 2. The Order of the Faith Service comprises 5 degrees: a) Great Cross; b) Grand Officer; c) Commander; d) Officer; e) Knight. 3. Order For Merit comprises 5 degrees: a) Great Cross; b) Grand Officer; c) Commander; d) Officer; e) Knight. II. Civil order, by area of activity: 1. The Order of Agricultural Merit includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 2. The Order of Cultural Merit includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 3. The Order of Industrial and Commercial Merit comprises 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 4. The Order of Merit for Education includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 5. The Order of Health Merit includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 6. The Order of Sports Merit includes 3 classes: a) Class I; b) Class II; c) Third grade. 7. The Order of Diplomatic Merit includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. III. Military order of peace: 1. The Military Virtue Order comprises 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 2. The Aeronautical Virtue Order comprises 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 3. The Order of Maritime Virtue includes 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. 4. The Order of Manhood and Faith comprises 4 degrees: a) Great Officer; b) Commander; c) Officer; d) Knight. IV. Military Order of War: -The Order of Michael the Brave includes 3 classes: a) Class I; b) Class II; c) Third grade. (2) The national and military orders, as well as the Sanitary Merit Order, conferred as war decorations, have special means and keep each their own hierarchy, their hierarchical order being the one provided for in art. 9 lit. A. V. Cross and national medals: 1. The Commemorative Cross of the Anti-Communist Resistance comprises 3 classes: a) Class I; b) Class II; c) Third grade. 2. The Commemorative Cross of the Anticommunist Revolution of December 1989 includes 3 classes: a) Class I; b) Class II; c) Third grade. 3. Commemorative Cross of the Second World War, 1941-1945, without classes. 4. The Cross Faithful Service includes 3 classes: a) Class I; b) Class II; c) Third grade. 5. The faithful service medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 6. Medal For Merit includes 3 classes: a) Class I; b) Class II; c) Third grade. VI. Civil medals, on fields of activity: 1. The Agricultural Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 2. The Cultural Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 3. The Industrial and Commercial Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 4. The Merit for Education Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 5. The Health Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 6. The Sports Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 7. The Diplomatic Merit Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. VII. Military Peace Medals: 1. Military Virtue Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 2. The Aeronautical Virtue Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 3. The Maritime Virtue Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. 4. The Barbation and Faith Medal includes 3 classes: a) Class I; b) Class II; c) Third grade. VIII. Military War Medals: -The Military Virtue Medal of War includes two classes: a) Class I; b) 2nd grade. (3) The Military Virtue Medal of War is the highest war decoration that can be given to the military foremen, the subofficers and the band from all weapons and military specialties, equivalent as important to the Order of Michael the Brave for Officers. (4) The other national and military medals, as well as the Sanitary Merit Medal, conferred as war decorations, have special meaning and keep each their own hierarchy, their hierarchical order being provided in art. 9 lit. B. + Chapter IV Conferral of national orders + Article 11 The conferment of national orders to Romanian citizens is made starting with the rank of Knight, which determines the admission in the respective national order. + Article 12 (1) The conferral of the higher ranks within a national order shall be made according to the regulations contained in the laws establishing them. (2) Persons decorated with an order, regardless of the degree they have, are knights of that order. + Article 13 (1) The proposals for decoration with national orders must be thoroughly motivated, and the essence of these motivations will be entered in the patents accompanying the insignia. (2) The proposals provided in par. (1) shall be made by the authorities mentioned in art. 4 4 para. (2), for persons in the respective sphere of activity, within the limits of vacant places for each degree of each order established for the annual promotion of the Chancellery of Orders. + Article 14 The performance of the internship for each order and degree does not automatically give the right to the conferral of an order or higher degree, but constitutes only the time limit after which new decoration proposals can be made, in case of new merits of the same people. + Article 15 Foreign citizens are not subject to the rules of granting established for Romanian citizens. + Chapter V Conferring national crosses and medals + Article 16 (1) Romanian citizens are given a national cross or medal starting with the smallest class. (2) The Commemorative Cross of the Anti-Communist Resistance shall be granted in accordance with the provisions of Decree-Law no. 118/1990 on the granting of rights to persecuted persons for political reasons of dictatorship established with effect from March 6, 1945, as well as those deported abroad or constituted in prisoners, republished, with subsequent additions. (3) The commemorative cross of the Anticommunist Revolution of December 1989 is granted in accordance with the provisions of Law no. 42/1990 *) for honoring the heroes-martyrs and granting rights to their descendants, the wounded, as well as the fighters for the victory of the Revolution of December 1989. ---------- Note * *) Law no. 42/1990 was repealed by the Law of gratitude to the heroes-martyrs and the fighters who contributed to the victory of the Romanian Revolution of December 1989, as well as to the people who sacrificed their lives or suffered as a result of the labor revolt anticommunist from Brasov in November 1987 No. 341/2004 , published in the Official Gazette of Romania, Part I, no. 654 of 20 July 2004, with subsequent amendments and completions. + Article 17 (1) The proposals shall be made by the institutions provided in art. 4 4 para. (2) for their fields of activity, within the limits of vacant places, for each class of each cross or medals established for the annual promotion of the Chancellery of Orders. (2) The proposals for decoration in all classes of national crosses and medals will be motivated, and the essence of the motivation must be entered in the patents accompanying the insignia. + Article 18 The performance of the internship in the lower classes of national crosses and medals does not automatically give the right to the conferral of higher classes, but constitutes only the time limit after which the new decoration proposal can be made, in case of new merits. + Article 19 Foreign citizens who are given Romanian crosses and national medals are not subject to the rules established for Romanian citizens. + Chapter VI Conferring orders and medals on fields of activity + Article 20 Romanian citizens are given an order or a medal for a field of activity, starting with the lowest degree or class. + Article 21 The conferment of civil medals on fields of activity is a factor in favour of promotion in that order, but it is not mandatory for the granting of the order to be preceded by the awarding of medals. + Article 22 The performance of the internship provided for each degree or class of civil orders and medals, by fields of activity, does not automatically give the right to the conferral of degrees or higher classes, but constitutes only the time limit after which we can be made decoration proposals, in case of new merits of the same person. + Chapter VII Patents + Article 23 The patent is the official document certifying the conferral of decorations. + Article 24 The patent has printed on its surface the coat of arms of the country and has data on: the name of the decoration, its grade or class, the number and date of the conferral decree, as well as the name and surname of the owner, with the initial father, and the merits for which is awarded the decoration. For military and military units the name of the military unit also passes. + Article 25 The patents are validated by signature and seal, as follows: a) for national orders, with the autograph signature or with the paraphernalia of the President of Romania and with the counter-nature of the Chancellor b) for orders on fields of activity, with the autograph signature or with the paraphernalia of the President of Romania, with the countermeasures of the relevant ministers and the chancellor of the orders. + Article 26 In time of war, the patents for the Order of Mihai Viteazul and the Military Virtue Medal are signed autographed by the President of Romania and countersigned by the Minister of National Defence and the Chancellor of the Orders. + Article 27 The medal patents are validated by the signature or paraphernalia of the minister in whose field the proposals and the chancellor of the orders were made. + Article 28 The patent bears two numbers: a) the number of orders within the hierarchy of the respective decoration; b) the registration number in the records of the Chancellery + Article 29 In the event of death, the patent along with the mark of the decoration remain legal heirs. + Chapter VIII The way of wearing decorations + Article 30 The port of Romanian peace decorations, in order of hierarchical importance, is as follows: 1. Colan of the Order of the Star of Romania; 2. the Grand Cross of the Order of the Star of Romania; 3. the Grand Cross degree of the Order of the Faithful Service; 4. the Grand Cross degree of the Order For Merit is equal to the rank of Grand Officer of the Order of the Star of Romania; 5. degree of Grand Officer of the Order of the Faithful Service 6. the rank of Grand Officer of the Order For Merit is equal to the rank of Commander of the Order of the Star of Romania, equal to the rank of Grand Officer of the orders: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, The Sanitary Merit, the Manhood and the Faith, the Diplomatic Merit, The Military Virtue of Peace, the Aeronautical Virtue of Peace, the Maritime Virtue of Peace and the First Class of the Order of the Sports Merit; 7. degree of Commander of the Order of the Faithful Service; 8. The order of the Order for Merit is equal to the rank of Commander of the Orders: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Sanitary Merit, Manhood and Faith, Diplomatic Merit, The Military Virtue of Peace, the Aeronautical Virtue of Peace, the Maritime Virtue of Peace and the Second Class of the Order of Sports Merit; 9. degree of Officer of the Order of the Romanian Star 10. degree of Officer of the Order of the Faithful Service 11. the rank of Officer of the Order For Merit is equal to the rank of Officer of the Orders: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Sanitary Merit, Manhood and Faith, Diplomatic Merit, Virtue The Peace Military, the Aeronautical Virtue of Peace and the Maritime Virtue of Peace; 12. the Knight of the Order of the Star of Romania; 13. degree of Knight of the Order of the Faithful Service; 14. The rank of Knight of the Order For Merit is equal to the rank of Knight of the Orders: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Sanitary Merit, Manhood and Faith, Diplomatic Merit, Virtue Military of Peace, Virtue Aeronautics of Peace, Maritime Virtue of Peace and Class III of the Order of Sports Merit; 15. Commemorative Cross of Anti-Communist Resistance; 16. Commemorative Cross of the Anticommunist Revolution of December 1989; 17. Commemorative Cross of World War II, 1941-1945; 18. Cross of the Class I Faithful Service; 19. Medal of Faithful Service Class I; 20. Cross of the Faithful Service Class II is equal to the Medal for Merit Class I; 21. Medal Faithful Service second class is equal to medals: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Health Merit, Diplomatic Merit, Military Virtue of Peace, Aeronautical Virtue of peace, the Maritime Virtue of Peace and Manhood and the Faith of Peace Class I; 22. Cross of the Faithful Service class III is equal to the Medal for Merit class II; 23. Medal Faithful Service class III is equal to medals: Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Sanitary Merit, Diplomatic Merit, Military Virtue of Peace, Aeronautical Virtue of peace, the Maritime Virtue of Peace and Manhood and the Faith of Peace Class II; 24. Medal for Merit Class III; 25. Medals of Agricultural Merit, Cultural Merit, Industrial and Commercial Merit, Merit for Education, Sanitary Merit, Diplomatic Merit, Military Virtue of Peace, Aeronautical Virtue of Peace, Maritime Virtue of Peace and Manhood and Faith of Third class peace. + Article 31 The port of Romanian war decorations, in order of hierarchical importance, is as follows: I. Orders: 1. Order Mihai Viteazul class I; 2. The Cross of the Order of the Romanian Star of War; 3. The Cross of the Order of the Faithful Service of War; 4. The Cross of the Order for Merit of War is equal to the rank of Grand Officer of the Order of the Star of Romania of War; 5. The Order of Michael the Brave Class II is equal to the rank of Grand Officer of the Order of the Faithful War Service; 6. the rank of Grand Officer of the Order For Merit of War is equal to the rank of Grand Officer of the Orders: Military Virtue, Aeronautical Virtue and Maritime Virtue of War and the Sanitary Merit of War; 7. The Order of Michael the Brave Class III is equal to the rank of Commander of the Order of the Romanian Star of War; 8. degree of Commander of the Order of the Faithful Service; 9. the rank of Commander of the Order for Merit; 10. the rank of Officer of the Order of the Star of Romania 11. degree of Officer of the Order of the Faithful War Service; 12. the rank of Officer of the Order for Merit of War is equal to the rank of Officer of the Orders: Military Virtue, Aeronautical Virtue and Maritime Virtue of War and Order of the Sanitary Merit of War; 13. The Knight of the Order of the Star of Romania of War; 14. the rank of Knight of the Order of the Faithful Service of War; 15. The rank of Knight of the Order For Merit of War is equal to the rank of Knight of the Orders: Military Virtue, Aeronautical Virtue, Maritime Virtue of War and the Sanitary Merit of War. II. Crosses and medals: 1. Medal of Military Virtue of Class I War; 2. Cross Service Faithful Service Class I; 3. Medal of the Faithful Service of Class I War; 4. Medal of Military Virtue of Class II War; 5. Medal For Merit of War I class is equal to medals: Manhood and Faith, Aeronautical Virtue, Maritime Virtue and the Sanitary Merit of Class I warfare; 6. Cross Service Faithful Service Class II; 7. Medal of the Faithful Service of War II; 8. Medal For Merit of War II class is equal to medals: Manhood and Faith, Aeronautical Virtue, Maritime Virtue and Sanitary Merit class II; 9. Cross Service Faithful Service Class III; 10. Medal of the faithful service of class III-a; 11. Medal For Merit of War III class is equal to medals: Manhood and Faith, Aeronautical Virtue, Maritime Virtue and the Third Class War Sanitary Merit. + Article 32 The decorations of war are carried before the peace, by categories of distinctions, regardless of the hierarchical step or the degree or class of the decoration of war towards those of peace. + Article 33 The orders are carried as follows: on the left side of the chest, in the ranks of Knight and Officer, as well as classes III and II; at the neck, for the ranks of Commander or Class I; with the insignia at the neck and with the plaque of the degree on the left side of chest, for the rank of Grand Officer; with slow spent over the bust-from the right shoulder to the left hip, where the insignia is caught-and with the plaque of the degree on the left side of the chest, for the degree of Great Cross; He's wearing the chain he's + Article 34 All crosses and medals, regardless of class, are worn on the left side of the chest. + Article 35 Holders of one or two decorations-orders, crosses, medals-wear them separately and joined on the same row. + Article 36 (1) The order in which the decorations are worn is the one given by the hierarchy provided in art. 30 30-35 and in the respective decorations regulations. (2) If a person is distinguished with two or more different decorations, but hierarchically equal, the succession is given by the chronological order in which they were granted, the oldest having precedence. + Article 37 (1) Romanian citizens distinguished with foreign decorations can wear these decorations according to the legislation of the state that conferred them, with the agreement of the President of Romania. (2) When the foreign decorations are placed on the bar, together with the Romanian decorations, they are placed after the similar Romanian decorations in the rank or class. + Article 38 (1) The decorations shall be worn, as a rule, on the occasion of the National Day of Romania and the other holidays, national or religious, at festivities of an official nature and in different activities of a scientific, anniversary or commemorative character. (2) The port of decorations obliges a sober and decent clothing outfit. (3) The military shall bear the decorations in accordance with the specific regulations. (4) The marks of the distinctions conferred on military units shall be marked on their flags. + Article 39 National orders, on fields of activity, and military ones, in all grades, are presented in three forms, with equal hierarchical value: the insignia, rosette for civilians and the barge for the military. + Article 40 (1) The rosettes of decorations can be worn daily, by civilians, only at an attire appropriate to the moment and importance of decorations. (2) The decorations of the decorations shall be worn by military personnel at the uniform. + Chapter IX Rights of people + Article 41 Persons decorated with national orders or on fields of activity, whose patent was signed autographed by the President of Romania, have the right to be received in the audience to please personally, if that decoration was not handed directly by him. + Article 42 The knights of the national orders who visibly bear the insignia of the order receive the salute or the proper military honor + Article 43 The Knights of the Order are assimilated to military ranks and benefit from military honors, as follows: a) Order Star of Romania: -the rank of Knight of the order is assimilated to the rank of captain; -the rank of officer of the order is assimilated to the rank of -the rank of Commander of the order is assimilated to the rank of brigadier general, general of aerial flotilla or rear Admiral; -the rank of Grand Officer of the order is assimilated to the rank of division general, air division general or vice-Admiral; -the degree of Grand Cross of the order is assimilated to the rank of general army corps, general aviation commander or vice Admiral commander; -the Colan rank of the order is assimilated to the rank of army general, general aviation inspector or admiral. b) Order of the Credit Service: -the rank of Knight of the order is assimilated to the rank of lieutenant; -the rank of officer of the order is assimilated to the rank of -the rank of Commander of the order is assimilated to the rank of colonel; -the rank of Grand Officer of the order is assimilated to the rank of brigadier general, general of aerial flotilla or rear Admiral; -The degree of Grand Cross of the order is assimilated to the rank of division general, general of air division or vice-admiral. c) Order For Merit: -the rank of Knight of the order is assimilated to the rank of ensign; -the rank of officer of the order is assimilated to the rank of -the rank of Commander of the order is assimilated to the rank of Major; -the rank of Grand Officer of the order is assimilated to the rank of colonel -The degree of Grand Cross of the order is assimilated to the rank of brigadier general, general of aerial flotilla or rear Admiral. + Article 44 Military honors shall also be given to civilian members of national orders, deceased, in accordance with the assimilations with the military degrees provided in art. 43. + Article 45 (1) The Knights of the Orders will be invited to participate in the public events occasioned by the National Day of Romania or to various other anniversaries and commemorations, assuring them by the organizers places of honor. (2) The prefectures and mayoralties will consider the invention especially of decorated persons, domiciled in their area of competence, at various commemorative, cultural, scientific or sports events, which they organize on different occasions. + Article 46 (1) The Great Officers, Great Cross and Colan of the Order of the Star of Romania and the Great Cross Knights of the Orders Faithful Service and For Merit are invited, through the care of the Chancellery of Orders, to the receptions offered by the President of Romania with The National Day of Romania and the New Year. (2) Knights referred to in par. (1), together with knights of other higher degrees of orders on fields of activity may be invited to participate in other receptions or manifestations organized by the Presidential Administration and Parliament, also through the care of the Chancellery of Orders. + Article 47 By the laws establishing the orders a day of its own will be established, related to the date of the first institution of each order. + Article 48 On the occasion of the day of each national order, as well as on the occasion of the day the National Military Order Mihai Viteazul The President of Romania organizes, through the care of the Chancellery of Orders, a Te Deum, followed by a reception Romania, the chancellor of the orders, the knights of the respective national order in higher degrees (Colan, Mare Cruce, Grand Officer and Commander), as well as the last two promotions of the ranks of Officer and Knight. + Article 49 On the occasion of each of the other orders the ministries and the other autonomous institutions, empowered to make decoration proposals in that field, organize, with the support of the Chancellery of Orders, meetings with the members of the order, chaired by the relevant minister. + Article 50 (1) In order to honor the memory of the knights of the national orders, in the existing cemeteries in the municipalities and cities will be reserved, through the care of the local authorities, a special place for the burial of those decorated from (2) The cost of the respective plots will be borne from the budgets of the municipalities The final resting places will be made available to the legal heirs free of charge. (3) On the occasion of national and religious holidays, through the care of the local authorities, there will be organized events of homage to the graves of the Knights of the deceased national orders. + Chapter X Withdrawal of decorations + Article 51 The membership of an order may be lost in the following situations: a) conviction, by final court decision, to the custodial sentence; b) for dishonourable acts other than those referred to in lett. a), which cause moral damage to members of the order. + Article 52 For the adjudication of dishonorable acts that cause moral damage to the members of the order, other than those provided in 51 lit. a), an honorary council is constituted for each order. + Article 53 (1) The Board of Honor shall consist of 7 members, in the case of national orders, and of 5 members in the case of the other orders. (2) The members of the honorary councils shall be elected for 5 years by the Knights of the respective order, one of the three lower degrees and two each of the Grand Officer and Grand Cross grades. The Presidency of the Honorary Council is provided by the oldest member of the upper class or class. + Article 54 (1) The Board of Honor of each order also judges the dishonourable facts of the persons decorated with the medals corresponding to the orders. In this case the Board of Honors are co-opted, for the cause in the present case, and two holders of the medal, who will have the right to vote deliberatively. (2) Persons subject to judgment are invited to attend the judgment of the Board of Honor. + Article 55 The decorations awarded for the acts committed in the service of national defense, in times of war, shall be withdrawn only in the case of a conviction for treason in time of war. + Article 56 Persons who have been withdrawn as a member of the order are required to refund the patent and the insignia. + Article 57 (1) The decorations conferred on foreign citizens may be withdrawn in the case of committing acts incompatible with the quality of the person to whom a distinction of Romania was conferred. (2) The withdrawal of the decorations is made by decree, at the proposal of the Chancellery of Orders, based on the complaint of the Ministry + Article 58 The radiance from the record of a decorated person is made only after the President of Romania signed the decree to withdraw the decoration. + Article 59 (1) The loss or destruction of the marks or patents will be published by the holder in the Official Gazette of Romania. (2) The release of a duplicate from the attestation document or, as the case may be, of a new insignia shall be made at the proposal of the Chancellery of the Orders, based on the holder's request, after the publication ((1). + Chapter XI Chancellery Orders + Article 60 The administration of the decorations is entrusted to the Chancellery of Orders, which will function as a compartment within the Presidential Administration. + Article 61 (1) The Chancellery of Orders will be led by a chancellor with the rank of state counselor, appointed by the President of Romania. (2) The position of State Counsellor of the Chancellor of the Orders will be added to the existing functions at the + Article 62 The Chancellery of the Orders has a) organize the activities of awarding the decorations; b) keep records of the decorated persons and the radiations therefrom; c) care for the manufacture of the marks, patents and other materials necessary for the activity, as well as their management; d) keep records of foreign persons who have been awarded Romanian decorations; e) keep records of Romanian citizens who have been conferred foreign decorations; f) organizes the celebrations for the delivery of national decorations; g) check the correct classification of the decoration proposals; h) other duties provided by law. + Article 63 The Chancellery of Orders prepares and keeps up to date the following records: a) the entry and exit of correspondence, according to legal provisions; b) the database of decorated persons, on distinctions and classes; c) the situation regarding the insignia and their annexes d) the situation regarding the holiday of decorations (forwards, radiations). + Article 64 (1) The Chancellery of Orders shall elaborate and transmit to the authorities referred to in 4 4 para. (2) the necessary methodology for drawing up the decoration proposals. (2) The Chancellery of Orders informs by July 1 the authorities referred to in art. 4 4 para. (2) about the limits of the annual quotas for each grade or class of each decoration. (3) The Chancellery of Orders communicates to the Ministry of Internal Affairs the identity data of the decorated persons; the Ministry of Internal Affairs will transmit to the Ordinary Chancellery the information about the + Article 65 (1) The decoration proposals shall be sent to the Chancellery of Orders within 60 days from the date provided for in art. 64 64 para. ((2). For each person will be mentioned: name and surname, date and place of birth, domicile, state, function, decorations previously received and date of their conferral, degree, seniority in grade or class, name of decoration and degree for which is proposed as well as the motivation of the proposal. (2) For persons entitled to receive distinctions according to the number of years served, the calculation of time will be made by the deadline of submission of proposals. + Article 66 The tables containing the annual decoration proposals shall be submitted to the Chancellery of Orders until August 31 of that year, under the signature of the heads of the institutions provided in art. 4 4 para. ((2). + Article 67 The deletion from the records, as a result of death, is based on the communication sent to the Chancellery of the Orders by the Ministry of Internal Affairs, through the Directorate for the Records of Persons and Database Administration. + Article 68 The Chancellery of Orders works with the honorary councils of the orders and forwards their decisions to the President of Romania. + Article 69 With the support of the organs of the Ministry of Internal Affairs the Chancellery of the Orders will recover the insignia and patents from the persons who have been withdrawn + Article 70 The Ordinary Chancellery publishes an annual bulletin, in which lists including decorated persons, data on vacant places, information about honorary councils, deaths of ordinary knights, people who have been withdrawn from quality, are published. Member. + Article 71 The amounts necessary for the manufacture of marks, patents, rosettes, bars and boxes of decorations, as well as for all activities of the Chancellery of Orders are allocated, through a distinct chapter, in the budget of the Presidential Administration. + Chapter XII Transitional and final provisions + Article 72 From the empowerment of the President of Romania the delivery of decorations can be made by the Prime Minister, ministers or leaders of other central bodies, commanders of large military units and heads of diplomatic missions of Romania abroad. + Article 73 Patents and insignia of decorations remain, after death, in the possession of legal heirs, but without the right to wear them or make use, in any way, by the prerogatives conferred by them. + Article 74 In the event of a posthumous decoration the patent and its insignia are handed over to the preservation of legal heirs. + Article 75 The description, the material from which it is carried out, the dimensions, the drawn model of each decoration, the maximum number for each degree or class, as well as the reasons for its conferment will be specified in the regulation of that distinction. + Article 76 (1) War decorations may also be conferred on peacetime to Romanian military or military units participating in missions under the jurisdiction of international bodies to which the Romanian state is a party. The special weapons deeds of these soldiers can be rewarded with military orders and medals, with war insignia. (2) In exceptional cases, for large-scale actions and with high risk quota, the President of Romania may confer to the persons referred to in par. ((1) and national decorations with war insignia. + Article 77 In the case of international military actions, attended by Romanian subunits or units, the President of Romania can give Romanian war decorations to foreign soldiers who, through their actions, helped the Romanian troops to the fulfillment of missions or saved the lives of Romanian soldiers. + Article 78 The present framework law will be developed through a law and regulation for each decoration. + Article 79 The establishment of any new decoration is made by law, on the proposal of a special commission established according to the parliamentary regulations. + Article 80 At the establishment of this system of decorations, any degree or class may be awarded, within a maximum of 15% of the legal number provided for each decoration. + Article 81 Through the care of the Chancellery of Orders will be delivered to the National Museum of History and the National Military Museum one copy of each decoration. + Article 82 (1) It constitutes contraventions and is sanctioned with a fine of 500 lei to 5,000 lei the following facts: a) making without right the insignia of decorations; b) the port without right of the marks of the decorations. (2) Finding and sanctioning the contraventions provided in par. (1) shall be made by the police bodies. (3) Contraventions provided in par. (1) their provisions are applicable Government Ordinance no. 2/2001 on the legal regime of contraventions, approved with amendments and additions by Law no. 180/2002 , with subsequent amendments and completions. + Article 83 On the obverse or on the reverse of the wafers cannot be printed elements of the marks in the national decoration system of Romania. + Article 84 From the funds of the state budget for 1999 the Government will ensure, from the budgetary reserve at its disposal, the necessary funds for the activities provided in art. 62 62, 63 and 70. + Article 85 (1) On the date of entry into force of this Law, the previous regulations regarding decorations and titles of honor shall be repealed, except: Decree-Law no. 118/1990 * *) regarding the granting of rights to persons persecuted for political reasons of dictatorship established with effect from March 6, 1945, as well as those deported abroad or constituted in prisoners, republished, as amended; Law no. 44/1994 ** **) on war veterans, as well as some rights of invalids and war widows, as amended; Law no. 68/1994 *** ***) on the establishment of the Medal "Commemorative Cross of the Second World War, 1941-1945", republished; Law no. 1/1996 establishing the Order "Victory of the Romanian Revolution of December 1989"; Government Emergency Ordinance no. 11/1998 ****) for the reinstatement of the National Order Star of Romania, Government Emergency Ordinance no. 194/1999 *****) on the establishment of the commemorative medal "150 years since the birth of Mihai Eminescu". -------------- Note * *) Decree-Law no. 118/1990 was republished in the Official Gazette of Romania, Part I, no. 631 of 23 September 2009, and subsequently completed. ((3). + Article 86 (1) The first honorary councils of all orders will be appointed by decree of the President of Romania for a period of 3 years, between the knights of each order. (2) The presidency of each honorary council is provided by the oldest knight, member of the council. (3) In case of vacancy of the membership in the honorary council, the other members of the honorary council will choose from among the Knights of the respective order another person. ------
