The Romanian Parliament adopts this law + Article 1 (1) The paternal leave is granted under the conditions laid down by this law, in order to ensure the effective participation of the father in the care of the born-born. (2) The father of the newborn child has the right to a paternal leave of 5 working days, under the conditions provided by this law. + Article 2 (1) If the holder of the right to paternal leave is insured under the state social insurance system, he is entitled to a paid paternal leave of 5 working days. (2) The paternal leave is granted upon request, within the first 8 weeks after the birth of the child, justified with his birth certificate, resulting from the status of father of the petitioner. (3) The allowance for paternal leave is paid from the unit's salary fund and is equal to the salary corresponding to that period. + Article 3 (1) The father who satisfies the compulsory military service has the right, at the birth of his own child, to a leave of 7 calendar days, granted under the conditions provided in art. 2 2 para. ((2). (2) Permission provided in par. (1) is also granted to the father who satisfies the compulsory military service, in order to recognize paternity, under the law. The requested permission will be justified with the birth certificate of the born-born, showing the status of father of the military, respectively with the declaration of recognition of paternity, drawn up under the law. + Article 4 (1) If the father of the newborn child obtained the attestation of graduation of the puericulture course, the duration of the paternal leave, granted under the conditions of art. 2, shall be increased by 10 working days. (2) The father may benefit from the provision contained in par. ((1) only once. + Article 5 (1) In the event of the death of the mother of the child during the birth or during the period of the lauzia leave, the child's father benefits from the rest of the unpaid leave (2) During the period of leave granted under par. (1) the father of the child shall receive an allowance equal to the aid for pregnancy and to his mother's income from an allowance calculated according to the basic salary and his length of service, granted by the unit to which the father carries out activity, of choice. + Article 6 Within 30 days from the date of publication in the Official Gazette of Romania of the present law, the Government will approve by decision the methodological norms of application, at the joint proposal of the Ministry of Health and the Ministry of Labour and Protection Social. + Article 7 This law shall enter into force 45 days after its publication in the Official Gazette of Romania. This law was adopted by the Chamber of Deputies and the Senate in the joint meeting of 15 December 1999, in compliance with the provisions of art. 76 76 para. ((2) and 74 para.
