The Romanian Parliament adopts this law + Article 1 Approval Government Ordinance no. 128 128 of 29 August 1998 for the regulation of the manner and conditions for the valorisation of legally confiscated or entered property, according to the law, in private property of the State, issued under art. 1 1 section 15 lit. d) of Law no. 148/1998 on the empowerment of the Government to issue ordinances and published in the Official Gazette of Romania, Part I, no. 328 of 29 August 1998, with the following amendments and additions: 1. In Article 3, paragraph 1 shall read as follows: "" Art. 3. -(1) The declaration of goods passed into the private property of the state, as well as their surrender shall be made at the general directions of the public finances and the county state financial control or of the city of Bucharest, within 10 days from the date of receipt by the holder of the document constituting the title of state ownership of them. " 2. In Article 5, paragraph 2 shall read as follows: " (2) They shall be considered as the recovery bodies and the customs regional directorates of the customs authority, for the goods held by the customs offices under them. The exploitation of these goods will be carried out through the commodity exchanges, through public auction, on consignment or by own management services, as the case may be, in accordance with the provisions of this ordinance and the methodology on the introduction into the economic circuit of goods and goods that meet the conditions of recovery, according to the law, approved by Government decision. " 3. In Article 6, paragraph 2 shall read as follows: "(2) After taking over the goods entered into the private property of the state, an evaluation committee will proceed with their evaluation within 10 days of the takeover." 4. In Article 7, paragraph 2 shall read as follows: " (2) The destruction commission shall be established on the basis of the decision of the General Director of the General Directorate of Public Finance and County Financial Control or of the Municipality of Bucharest and shall consist of representatives of the following institutions: a) the general direction of public finances and financial control of the county state or of the city of Bucharest, 2 members; b) the county police inspectorate or the General Police Department of Bucharest, 2 members; c) the environmental protection agency, a member and a representative of the owner of the goods to be destroyed. " 5. Article 7 (2) shall be inserted after paragraph 2. the following contents: "" (2 ^ 1) In the case of goods whose recovery falls within the competence of the customs authority, the destruction commission shall be constituted on the basis of the decision of the Director of the Customs Regional Directorate and its composition shall be determined by the methodology 5 5 para. ((2). ' 6. Article 8 shall read as follows: "" Art. 8. -The travel and accommodation expenses will be paid to the members of the destruction commission by the public institution that designated them. " 7. In Article 9, paragraph 1 shall read as follows: "" Art. 9. -(1) The valorization of goods passed into the private property of the state shall be made by the recovery bodies, through the stock exchanges, through their own stores, public auction or consignment, as the case may be. " 8. Article 11 (2) shall be repealed. 9. Article 11 (2) (2) shall be inserted after paragraph 2. the following contents: "" (2 ^ 1) In the case of goods whose recovery falls within the competence of the customs authority, the evaluation committee shall be established on the basis of the decision of the Director of the Customs Regional Directorate and its composition shall be determined by the methodology 5 5 para. ((2). ' 10. In Article 13 (1), letter c) shall read as follows: "c) natural or legal persons who may prove that they are the recipient of documentary, informational, educational, scientific and other materials, at their request." + Article 2 Government Ordinance no. 128/1998 , as amended and with those brought by this law, will be republished in the Official Gazette of Romania, Part I, giving the texts a new numbering. This law was adopted by the Chamber of Deputies at its meeting on April 26, 1999, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution.
