The Romanian Parliament adopts this law + Article 1 The I.O.V.R. pensions that are granted to invalids and war injuries, to the descendants of the dead or missing in the war, as well as to the descendants of former disabled and war-injured pensioners shall be established according to the provisions of this law. + Article 2 *) (1) Invalizers and war-injured persons, whether or not they were employed before becoming disabled, are granted pensions in fixed amounts, differentiated according to the degree of invalidity, as follows: ----------------------------------------------------------------- Degree of invalidity The monthly amount of pension ----------------------------------------------------------------- Large mutilated and grade I 2.000.000 lei Grade II 1.800,000 lei Grade III 1.200,000 lei ----------------------------------------------------------------- (2) The war permits have the right to pension I.O.V.R. in the amount of 1,000,000 lei. ------------ * *) art. 1 1 of JUDGMENT no. 294 294 of 8 March 2001 , published in MONITORUL OFFICIAL no. 124 of March 13, 2001, in March 2001, the I.O.V.R. pensions are indexed, with the percentage of 5.0%; According art. 6 6 of JUDGMENT no. 523 523 of 31 May 2001 , published in MONITORUL OFFICIAL no. 304 of June 8, 2001, starting with June 2001, is indexed with the percentage of 6,0% pensions I.O.V. According art. 8 8 of JUDGMENT no. 808 808 of 27 May 2004 , published in MONITORUL OFFICIAL no. 480 of May 28, 2004, starting with June 2004, the I.O.V.R. pensions are indexed by 2%; According art. 6 6 of JUDGMENT no. 1.297 1.297 of 19 August 2004 , published in MONITORUL OFFICIAL no. 792 of August 27, 2004, starting with September 2004, the I.O.V.R. pensions are indexed by 4%; According art. 1 1 of JUDGMENT no. 1.765 1.765 of 22 December 2005 , published in MONITORUL OFFICIAL no. 1.182 of December 28, 2005, starting with January 2006, the I.O.V.R. pensions are indexed by 5.5%. + Article 3 *) (1) Invalizations and war injuries, large mutilated and those assigned to the first degree of invalidity receive, in addition to the I.O.V.R. pension, a fixed amount for care of 2.800,000 lei monthly. (2) Fixed amount for care provided in par. (1) shall be updated periodically, by Government decision, depending on the financial resources allocated from the state budget. ------------ Article 3 was amended by the single article of EMERGENCY ORDINANCE no. 65 65 of 30 May 2002 , published in MONITORUL OFFICIAL no. 398 398 of 11 June 2002. Article 3 has been amended by section 3. 3 3 of the single article of LAW no. 579 579 of 23 October 2002 , published in MONITORUL OFFICIAL no. 787 787 of 30 October 2002. Article 3 was amended by the single article of LAW no. 88 88 of 5 April 2004 , published in MONITORUL OFFICIAL no. 316 316 of 9 April 2004. * *) art. 1 1 of JUDGMENT no. 1.765 1.765 of 22 December 2005 , published in MONITORUL OFFICIAL no. 1.182 of 28 December 2005, as of January 2006, shall be indexed by 5,5% fixed amount for the care provided, pursuant to Law no. 49/1999 invalids and war-injured, large mutilated and those assigned to the first degree of invalidity. + Article 4 (1) Invalizers and war injuries have the right to receive during the period in which both the I.O.V.R. pension and the salary are employed. Upon termination of the activity they are entitled to receive, in addition to the I.O.V.R. pension, the social security pension to which they are entitled according to the law. (2) The war wills entitled to the I.O.V.R. pension receive, in addition to this pension, the social security pension. + Article 5 (1) The children of the dead or missing in the war, as well as of those who at the time of death were retired I.O.V.R. are entitled to survivor's pension as they are granted, according to the law, the survivors ' pensions within the state social insurance. (2) The war vaduvae are entitled to survivor's pension regardless of the duration of the marriage with the deceased spouse. (3) The wives of those who at the time of death were pensioners I.O.V.R. are entitled to survivor's pension under the conditions under which they are granted, according to the law, the survivors ' pensions within the state social insurance. (4) If at the time of death the supporter received pension I.O.V.R. and social insurance pension, the survivor's pension is established from the most advantageous pension. + Article 5 ^ 1 (1) In the event of the death of pensioners who benefit only from pension I.O.V.R. a death benefit is granted to a single person, which may be, as the case may be: the surviving spouse, the child, the parent, the curator, the heir under the conditions of common law or, in its absence, to the person who proves that he incurred the expenses occasioned by the death (2) The death benefit provided in par. ((1) shall be granted only if death benefit from other social security systems is not provided for the deceased person. (3) The death benefit provided in par. (1) is awarded in the amount equal to the death benefit granted to pensioners in the state social insurance system. ------------ Article 5 ^ 1 has been introduced by item 1. 4 4 of the single article of LAW no. 579 579 of 23 October 2002 , published in MONITORUL OFFICIAL no. 787 787 of 30 October 2002. + Article 5 ^ 2 (1) Pensioners who benefit only from pension I.O.V.R. are granted a death benefit in the event of the death of a family member in their maintenance and who does not have a social security right. (2) The death benefit provided in par. (1) represents half of the amount of death aid granted to pensioners in the state social insurance system. ------------ Article 5 ^ 2 was introduced by the section 4 4 of the single article of LAW no. 579 579 of 23 October 2002 , published in MONITORUL OFFICIAL no. 787 787 of 30 October 2002. + Article 6 ((1) The non-service-ordered war accents shall be entitled to 50% of the amounts provided for war invalids, differentiated according to the degree of invalidity in which they are assigned. (2) The rights of war injured outside the ordered service, established according to par. ((1), may be cumulated with another social security pension and may be the basis for the granting of the survivor's pension. (3) Accusers of war outside the ordered, blind service can cumulate the pension with the salary during the period in which they work. + Article 7 Pensioners of I.O.V.R. are entitled, free of charge, to medical assistance in hospitals and outpatients, to maintenance and medicines during admission, under the law. It also benefits, according to the law, referring to treatment in spa resorts. + Article 8 The I.O.V.R. pensions and the other related rights, established until the date of entry into force of this Law, shall continue to be granted according to its provisions. + Article 9 The funds necessary to pay the rights provided for in this law shall be borne from the state budget + Article 10 Provisions of Law no. 19/2000 on the public pension system and other social security rights, with subsequent amendments and completions, relating to the establishment and payment of pensions and death benefits, to the challenge of decisions, and to the expertise and review medical applies, appropriately, to the retirees of the I.O.V.R., as well as to the injured of war outside the tidy service. ------------ Article 10 has been amended by section 10. 4 4 of the single article of LAW no. 579 579 of 23 October 2002 , published in MONITORUL OFFICIAL no. 787 787 of 30 October 2002. + Article 11 The date of entry into force of this Law shall be repealed Decree no. 245 245 of 28 July 1977 on pensions I.O.V.R., published in the Official Bulletin, Part I, no. 77 77 of 29 July 1977, as amended, and any other provisions to the contrary.
