This law was adopted by the Senate at the meeting of 24 November 1998, in compliance with the provisions of art. 74 74 para. (2) of the Romanian Constitution. p. ---------- + PREAMBUL The Czech Republic, the Republic of Hungary, the Republic of Poland, Romania, the Slovak Republic and the Republic of Slovenia, of the one part, and the Republic of Bulgaria, of the other part, reaffirming their attachment to the principles of the market economy, which forms the basis of relations between them, taking into account the positive development of mutual economic cooperation between the Parties, wishing to contribute to the integration process in Europe by extending the Central European Free Trade Agreement, Having regard to the statements of the Prime Ministers made on 25 November 1995 in Poznan, on 11 September 1995 in Brno, on 13 September 1996 in Jasna and on 12 September 1997 in Portoroz, evoking the official request of the Republic of Bulgaria of 30 May 1996 to accede to the Central European Free Trade Agreement, Having regard to the Agreement on the Amending of the Central European Free Trade Agreement, signed in Brno on 11 September 1995, according to the provisions of art. 39 39 a) of the Central European Free Trade Agreement, agreed the following: + Article 1 The Republic of Bulgaria will join the Central European Free Trade Agreement. + Article 2 The Republic of Bulgaria will accept the Central European Free Trade Agreement with all its amendments and amendments, signed before the end of this accession agreement, and shall apply it in accordance with the provisions of this Agreement. + Article 3 References in the Central European Free Trade Agreement to its parts and where all States are explicitly mentioned will be understood as including the Republic of Bulgaria. + Article 4 The basic fee referred to in paragraph 1 of art. 4 of the Central European Free Trade Agreement will, in the case of the Republic of Bulgaria, be the most favoured nation-wide customs duty applicable on 1 January 1993. + Article 5 1. For the implementation of the provisions of paragraph 2 of art. 3 3 of the Central European Free Trade Agreement, Protocols 22, 23, 24, 25 and 26 of the Central European Free Trade Agreement are also set out in the Annexes to this Agreement. 2. The provisions on the elimination of customs duties on imports between: -The Czech Republic and the Slovak Republic, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 22; -The Republic of Hungary, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 23; -The Republic of Poland, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 24; -Romania, on the one hand, and the Republic of Bulgaria, of the other part, are covered by Protocol 25; -The Republic of Slovenia, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 26. + Article 6 1. For the implementation of the provisions of paragraph 1 of art. 12 12 of the Central European Free Trade Agreement, Protocols 27, 28, 29, 30 and 31 to the Central European Free Trade Agreement are also set out in the Annexes to this Agreement. 2. Provisions regarding the granting of mutual agricultural concessions between: -The Czech Republic and the Slovak Republic, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 27; -The Republic of Hungary, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 28; -The Republic of Poland, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 29; -Romania, on the one hand, and the Republic of Bulgaria, of the other part, are covered by Protocol 30; -The Republic of Slovenia, of the one part, and the Republic of Bulgaria, of the other part, are contained in Protocol 31. + Article 7 Quantitative restrictions on imports or measures having equivalent effect, to which paragraph 2 of art. 8 8 of the Central European Free Trade Agreement and which are referred to in Annexes no. III/a), III/b) and III/c) to the Central European Free Trade Agreement, shall also be applied to imports of products originating in the Republic of Bulgaria, subject to the provisions of the Annex to art. 7 7 of this agreement. + Article 8 In order to achieve the objectives of this Agreement, it is understood that Protocol 7 to the Central European Free Trade Agreement on the definition of the concept of originating products and methods of administrative cooperation will also apply to products originating in Republic of Bulgaria, subject to the provisions of the Annex to 8 8 of this Agreement. + Article 9 1 1. References to cooperation in the field of customs administration in paragraph 2 of art. 16 of the Central European Free Trade Agreement will be understood as mutual assistance between the customs administrative authorities of the Czech Republic and the Slovak Republic, on the one hand, and the Republic of Bulgaria, on the other, will take place in compliance with Annex no. I to art. 9 9 of this agreement. 2 2. References to cooperation in the field of customs administration in paragraph 2 of art. 16 of the Central European Free Trade Agreement will be understood as the mutual assistance between the customs administrative authorities of the Republic of Slovenia and the Republic of Bulgaria will take place in accordance with the provisions of Annex no. II to art. 9 9 of this agreement. + Article 10 1. References to government procurement in art. 24 24 of the Central European Free Trade Agreement will be understood, in relations between the Czech Republic and the Slovak Republic, of the one part, and the Republic of Bulgaria, of the other part, as public procurement, and the period referred to in paragraph 2 of art. 24 will be concluded at the latest by the end of 1998. 2. References to government procurement in art. 24 24 of the Central European Free Trade Agreement will be understood, in relations between the Republic of Slovenia and the Republic of Bulgaria, as public procurement, and the period referred to in paragraph 2 of art. 24 will be concluded by the end of 1999 at the latest. 3. It was agreed that, in accordance with paragraph 3 of art. 24 24 of the Central European Free Trade Agreement, in the Joint Committee, consultations on the extension to other parts of the treatment referred to in paragraphs 1 and 2 shall take place. + Article 11 This agreement will form an integral part of the Central European Free Trade Agreement. + Article 12 1. This Agreement shall enter into force on the 30th day following receipt by the depositary of the last notification of the Parties to the Central European Free Trade Agreement and of the Republic of Bulgaria on the conclusion of the necessary procedures for that purpose. 2. The depositary shall notify, without any delay, to all parties the conclusion of the necessary procedures for the entry into force of this agreement. 3. Until the entry into force of this Agreement, pursuant to paragraph 1 of this Article, the Czech Republic, the Republic of Hungary, the Republic of Poland, the Slovak Republic, the Republic of Slovenia and the Republic of Bulgaria will provisionally apply this Agreement from 1 January 1999, provided that Romania notifies the other parties before 1 December 1998 that its internal legal procedures for the entry into force of this Agreement have been fulfilled and that Romania will apply this Agreement from 1 January 1999. 4. As from the date of entry into force of this Agreement, the free trade agreements concluded between: -The Czech Republic and the Republic of Bulgaria, signed in Prague on 15 December 1995; -The Slovak Republic and the Republic of Bulgaria, signed in Sofia on 8 December 1995, will cease their validity and the free trade agreement concluded between: -The Republic of Slovenia and the Republic of Bulgaria, signed in Sofia on 22 November 1996, will not enter into force, by mutual consent of the interested parties, expressed in this Agreement. From the date of provisional application of this Agreement, the free trade agreements referred to in paragraph 4 of this Article shall no longer apply between those Parties. As a testimony, the undersigned plenipotentiaries, being fully authorized for this purpose, have signed this Agreement. Signed in Sofia on July 17, 1998, in a single original copy in English, which will be submitted to the Government of the Republic of Poland. The depositary will transmit authenticated copies to all parties Czech Republic Republic of Hungary Poland Romania Slovak Republic Slovenia Republic Bulgaria Republic + Annex to art. 7 This Annex refers to the abolition of quantitative restrictions between the Czech Republic and the Slovak Republic and the opening by the Hungarian Republic of an annual ceiling for products originating in the Republic of Bulgaria. + Annex to art. 8 It refers to the amendments made to art. 4 4, 18, 19 and Annex no. IV to Protocol 7, with a view to implementing the provisions of Protocol 7 to the Central European Free Trade Agreement. + Annex I to art. 9 It concerns mutual assistance in customs matters between the customs authorities of the Republic of Bulgaria, the Czech Republic and the Slovak Republic. + Annex II to art. 9 It concerns mutual assistance in customs matters between the customs authorities of the Republic of Bulgaria and the Republic of Slovenia + PROTOCOL 22 (to which paragraph 2 of art. 3 3) It concerns the abolition of customs duties between the Czech Republic and the Slovak Republic, on the one hand, and the Republic of Bulgaria, on the other. + PROTOCOL 23 (to which paragraph 2 of art. 3 3) It refers to the abolition of customs duties between the Hungarian Republic, on the one hand, and the Republic of Bulgaria, on the other. + PROTOCOL 24 (to which paragraph 2 of art. 3 3) It concerns the abolition of customs duties between the Republic of Poland, on the one hand, and the Republic of Bulgaria, on the other. + PROTOCOL 25 (to which paragraph 2 of art. 3 3) The abolition of customs duties between Romania, on the one hand, and the Republic of Bulgaria, on the other. 1. The import customs duties applicable in Romania to products originating in Bulgaria, contained in Annex A to this Protocol, shall be progressively reduced according to the following timetable: -on the date of application of the agreement-25% of the basic fee; -on January 1, 2000-the remaining charges will be removed. 2. The import customs duties applicable in Romania to products originating in the Republic of Bulgaria, contained in Annex B to this Protocol, shall be progressively reduced according to the following timetable: -on the date of application-60% of the basic fee; -on 1 January 2000-40% of the basic fee; -on 1 January 2001-at 20% of the basic fee; -on 1 January 2002-the remaining charges will be abolished. 3. The import customs duties applicable in Romania to products originating in the Republic of Bulgaria and not included in Annexes A and B to this Protocol shall be removed from the date of application of this Agreement. 4. The import customs duties applicable in the Republic of Bulgaria to products originating in Romania, contained in Annex C to this Protocol, shall be progressively reduced, according to the following timetable: -on the date of application of the agreement-25% of the basic fee; -on January 1, 2000-the remaining charges will be removed. 5. The import customs duties applicable in the Republic of Bulgaria to products originating in Romania, contained in Annex D to this Protocol, shall be phased out, according to the following timetable: -on the date of application of the agreement-45% of the basic fee; -on 1 January 2000-30% of the basic fee; -on 1 January 2001-at 15% of the basic fee; -on 1 January 2002-the remaining charges will be abolished. 6. The import customs duties applicable in the Republic of Bulgaria to products originating in Romania, contained in Annex E to this Protocol, shall be progressively reduced, according to the following calendar: -on the date of application of the agreement-10% of the basic fee; -on January 1, 2000-the remaining charges will be removed. 7. The import duties applicable in the Republic of Bulgaria to products originating in Romania and not included in Annexes C, D and E to this Protocol shall be deleted from the date of application of this Agreement, imports originating in Romania shall be liberalised immediately for certain products falling within the abovementioned tariff headings. the ones for which the national production
