Law No. 193 of 21 October 1998 relating to the reimbursement of amounts withheld by way of guarantee of 10% of the value of machinery, equipment, and construction equipment supplied for metal mining enrichment Factory of mineral acid iron content from Kryvyi Rih-Pray-Ukraine and offset these amounts of payment obligations of supplier companies to the State budget, the PARLIAMENT published in ISSUING the OFFICIAL GAZETTE nr. 405 of 23 October 1998 Parliament adopts this law.


Article 1 shall approve the refund from the State budget guarantees of 10% of the value of machinery, equipment, and construction equipment supplied for metal mining enrichment Factory of mineral acid iron content from Kryvyi Rih-Pray-Ukraine, detained on the basis of art. 15 of Decree No. 156/87, through necreditare.


Article 2 the amounts withheld by way of guarantee of 10% shall be updated by using the exchange rate of the currency market, the Romanian National Bank, in force at the date of settlement, and ancillary machinery, equipment, metal constructions and equipment that are out of the warranty period provided for by the internal delivery contracts.


Article 3 is approved for partial or full compensation, where appropriate, by the obligations of payment to State budget, State social insurance budget, the budget of health insurance and local budgets, as at 31 December 1997, of the companies supplying equipment, switchgear and metal construction, with the amounts deducted by way of guarantee of 10% discounted according to art. 2. In Article 4 the obligation to compensation payment to the State budget, with the amounts deducted by way of guarantee of 10%, will not be covered by the supplier companies that are in the procedure of dissolution-liquidation or bankruptcy, as appropriate.


Article 5 the operation of set-off shall be effected by the General Directorates of public finance and financial control of the County and State, respectively, of the municipality of Bucharest, on the basis of supporting documents drawn up by the supplier companies and approved by the Minister of industry and commerce, as authorising officer, in compliance with the legal provisions in force.


Article 6 companies Amounts withheld under article 4. 4, and the remaining amounts refunded after clearing to be included, was scheduled in the State budget, with this destination, up to 31 December 1999.


Article 7 shall be exempted from the payment of increases the delay calculated from the date of March 31, 1997 for payment obligations to the State budget of companies supplying equipment, switchgear and metal construction Factory for enriching of ore mining, acid-containing iron from Kryvyi Rih, Ukraine-Pray-related amounts reimbursed pursuant to article. 3. In article 8 the operation of clearing of payment obligations by the State budget, as well as exemption from payment of penalties of delay will be provided in advance of the conclusion of each supplier of machinery, equipment, apparatus and metal construction, an addendum to the internal delivery contracts, which stipulate that it, at his own expense , to bring in a uniform delivered new warranty that expires once the external guarantee.
The addendum will be countersigned by the Minister of industry and trade, as the originator of the main credits.


Article 9 within 15 days from the date of entry into force of this law, the Ministry of finance and Ministry of industry and commerce will issue guidelines for its application.
This law was adopted by the Senate at its meeting on 9 July 1998, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
