---------- The Romanian Parliament adopts this law + Chapter I General provisions + Article 1 This law creates the legislative framework for: a) the development of a system for the foundation of wage policies in the budgetary sector and monitoring of their application; b) the development of a system of distribution of budgetary resources allocated for personnel expenses, by establishing, between limits, basic salaries in the budgetary sector, in order to promote individual performance; c) remuneration of persons occupying positions of public dignity. + Article 2 The provisions of this law shall apply to persons occupying positions of public dignity, as well as to persons employed on the basis of individual employment contract in the budgetary sector + Article 3 For the purposes of this law, the function of public dignity is that public office that deals through the mandate obtained directly, through organized elections, or indirectly, by appointment, according to the law. + Article 4 (1) The management of the basic salary establishment system shall be ensured by the principal authorising officer, within the financial resources allocated annually and in the number of posts established by the laws on the state budget, budget state insurance, local budgets and special fund budgets. (2) The establishment of individual basic salaries shall be made according to the rules for assessing individual performance. + Chapter II The system for determining basic salaries in the budgetary sector + Article 5 (. The basic salaries in the budgetary sector shall be determined on the basis of the following: a) the universal reference value, which is expressed in lei and which is the unique basis for determining the reference value, own to each sector of budgetary activity; b) cross-sectoral priority indicators, expressed in percentages, differentiated by fields of activity; c) sectoral reference values, expressed in lei, resulting from the multiplication of the universal reference value with the cross-sectoral priority indicators, used as: -the calculation basis for the configuration of the respective sector specific intervals scales; -the basis of calculation for basic salaries corresponding to specific pay scales; -the basis for calculating the amount of the monthly allowance; d) grid of intervals for the establishment of basic salaries, for the functions specific to each sector of activity. (. The universal reference value, cross-sectoral priority indicators and sectoral reference values are set out in Annex no. I. + Article 6 ((1) The scale of intervals for the establishment of basic salaries for a sector of budgetary activity shall be composed of the ranges of values provided for each execution function, professional grade or professional stage. (. A range shall be defined by the multiplication coefficients which, multiplied by the specific sectoral reference value, shall be the limits between which the basic salaries are established. + Article 7 The scales of intervals for determining the basic salaries specific to each field of activity are set out in Annexes no. IV-VIII. + Article 8 (1) The basic salary for the staff with management positions shall be the one corresponding to the function of execution, degree or professional step, plus a driving allowance, differentiated in relation to the complexity and liability of the the management function, which is part of the basic salary. (2) The driving allowances shall be determined in percentage of the basic salary of the execution function and are set out in Annex no. IX. (3) The driving allowances shall be granted within the ceilings provided by this law, for the management positions approved according to the organizational structure, according to the rules in force of organization of the institutions to which they refer. (4) The driving allowance shall also be granted to persons who run or coordinate programs/projects during their period, provided for in the activity program of the respective institution. + Chapter III Mechanism for adjusting the basic wage setting system + Article 9 The state budget law establishes: the universal reference value and its evolution in relation to the estimated increase in consumer prices, cross-sectoral priority indicators and sectoral reference values, taking into account the the priorities resulting from the objectives, projects, programmes proposed by the main authorising officers, as well as the evolution of salaries in other sectors of activity than the budgetary ones. + Chapter IV How to establish basic salaries + Article 10 The principal authorising officers shall calculate the basic salary levels corresponding to the ranges of intervals set out in Annexes no. IV-VIII of this law and the sector reference value resulting according to art. 9, rounded out of a thousand in a thousand lei in favor of the employee. + Article 11 The budgetary authorising officers shall determine the basic salaries of the staff in the respective units, on the basis of the methodology for the application of the criteria for determining the basic salaries, in compliance with the basic salary limits corresponding to the specific intervals of the sector of activity to which they belong, transmitted by the principal authorising officers. + Article 12 (1) The criteria for determining the basic salaries between the limits, the rules for the evaluation of individual professional performance and the methodologies for their application, drawn up in consultation with trade unions or employee representatives, shall be approved by decision of the Permanent Bureau of each Chamber of Parliament or by Government decision, as the case may be, on the proposal of the main authorising officers of the budget, within 60 days from the entry into force of this Law. (2) For the structures of the local public administration, the methodologies provided in par. (1) shall be proposed by the Department for Local Public Administration, in consultation with county councils and local councils. (3) The period during which the persons referred to art. 19 have occupied positions of public dignity constitute seniority in work and in specialty. + Article 13 The basic salary of an employee shall be reassessed annually by the employer, in compliance with the limits provided for the professional degree or professional stage in which he is assigned. + Article 14 (1) The driving allowance shall be established, at the appointment, by the head of the public institution, in relation to the complexity of the activity carried out within it. (2) The driving allowance can be reassessed annually, in relation to the results obtained by the structure led in the achievement of the objectives, programs and projects, after the approval of the budget of the respective public institution + Article 15 Basic salaries and driving allowances are established so that, together with the other elements of the payroll system, they fall within the funds allocated from the state budget, the state social insurance budget, local budgets and the budgets of special funds for salaries, in order to achieve the objectives, programmes and projects established. + Chapter V How to distribute budget funds for spending on salaries in the budget sector + Article 16 Budget funds for salaries shall be allocated to each principal authorising officer, on the basis of objectives, projects or programmes, as appropriate, corresponding to the budgetary planning period. + Article 17 ((1) In the foundation of budgetary funds for salaries, necessary for the achievement of objectives, projects or programs, as the case may be, the principal authorising officers shall forecast the workload, the periods of achievement, the number of staff and related individual salaries, corresponding to tasks. ((2) For the current activities of the tasks provided for the respective public institutions and not included in the projects or programs, the budget funds for salaries shall be based on the number of employees established for their realization and salaries made in the previous period, corrected with the evolution scheduled for the next period. + Article 18 Within the budgetary funds allocated by the state budget, the state social insurance budget, the local budgets and the budgets of the special funds, the main authorising officers breakdown, for the own apparatus and for the subordinate units, the amounts for salary expenses, in order to carry out scheduled tasks. + Chapter VI Allowances for persons in office of public dignity + Article 19 Persons who occupy positions of public dignity have the right, for the activity carried out, to a monthly allowance, established in accordance with the provisions of Annex no. II. + Article 20 (1) The monthly allowance, provided for in art. 19, is the only form of remuneration of the activity corresponding to the function and represents the basis for the calculation of the rights and obligations that are determined in relation to the salary income (. The amount of the monthly allowance shall be determined on the basis of the sectoral reference value multiplied by the multiplication coefficient set out in Annex no. II, rounded out of a thousand in a thousand lei in favor of that person. The sectoral reference value shall be that set out in Annex no. I. (3) Monthly allowances calculated according to par. (2) are in gross amount and are taxable, according to the law. + Chapter VII Categories of personnel with specific payroll systems + Article 21 Persons who occupy positions assimilated with public dignity functions have the right, for the activity carried out, to a monthly basic salary, established in accordance with the provisions of Annex no. III. + Article 22 (1) The monthly basic salary, provided in art. 21, is a fixed amount that also includes the driving allowance; monthly salary income for the persons referred to in art. 21 consists of the monthly basic salary and the other salary rights granted to staff in public institutions, according to the law. (2) The amount of the monthly basic salary shall be determined by multiplying the sectoral reference value set out in Annex no. I, with the multiplication coefficient, set out in Annex no. III, rounded out of a thousand in a thousand lei in favor of that person. (3) Salary income calculated according to par. (1) and (2) is in gross amount and is taxable, according to the law. + Article 23 Repealed. ------------ Article 23 has been repealed by art. 5 of EMERGENCY ORDINANCE no. 8 8 of 23 February 2000 , published in MONITORUL OFFICIAL no. 83 83 of 23 February 2000. + Chapter VIII Transitional provisions + Article 24 (1) On the date of entry into force of this Law, the compensation granted by the Government decisions for indexation of salaries shall be included in the basic salary. Each employee will be kept the basic salary had, including the compensation granted, except those who are below the minimum level of function and professional degree or professional step, which will be assigned to the minimum level. of that range. (2) After the approval of the methodology provided in art. 12 of this law and in compliance with the provisions of para. (1), the basic salary of each employee shall be reassessed for the first year of application of the law. (3) Legal provisions relating to other salary rights, such as bonuses for working conditions, spore for seniority, other bonuses, as well as prizes and incentives, granted to persons whose basic salaries are established according to the salary scales set out in Annexes no. III-VIII, remain in force. (4) The universal reference value set out in Annex no. It is set for June 1998, to be corrected monthly with salary increases approved by the Government for the coming months, in relation to the evolution of consumer prices in 1998. + Article 25 The pursuit of the application of this law is ensured by the Ministry of Labour and Social Protection and the Ministry of Finance, according to their competences + Article 26 (1) In application of the provisions of this Law, the Ministry of Labour and Social a) elaborates the framework methodology for the management of human resources in the central public administration, within 30 days from the date of entry into force of the law; the framework methodology is the basis for the elaboration of the methodologies provided in art. 12 12; b) monitors compliance with the provisions of this law and proposes to the Government measures to improve the efficiency of the use of public sector (2) In application of the provisions of the present law, the a) establish the necessary measures to implement the provisions of art. 9 9; b) elaborates the methodology for the foundation of the revenue and expenditure budgets of the principal authorising officers, based on objectives, projects or programs, as the case may be, including on the norms related to the use of human resources; c) control, in ministries and other central and local institutions of public administration and in budgetary institutions subordinated to them, execution of approved revenue and expenditure budgets; in case of finding of overspending with salaries for a given period, it may order the cessation of the opening of budgetary appropriations for the next period, respectively it may order the imputation of the amounts unduly spent, to + Article 27 The provisions of this law also apply to civil personnel assigned to the structures of ministries with powers of defense, public order and national security. + Chapter IX Final provisions + Article 28 This Law shall not apply to: a) the legal specialist staff provided for in Law no. 303/2004 on the status of judges and prosecutors, with subsequent amendments and completions, with the exception of public dignity functions appointed, other than those occupied by seconded judges and prosecutors; --------------- Lit. a) of art. 28 28 has been amended by art. The salarization of military personnel and some civil personnel salary rights are established by special law. + Article 29 On the date of entry into force of this Law, the provisions of the normative acts contained in Annex no. X, as well as any other provisions to the contrary with regard to the salary of staff in the budget sector. + Article 30 Annexes no. I-X are an integral part of this law.
