Law No. 76 of 8 April 1998 for Romania's accession to the International Convention for the protection of performers, producers of Phonograms and broadcasting organizations, done at Rome on 26 October 1961, published in PARLIAMENT ISSUING the OFFICIAL GAZETTE nr. 148 of 14 April 1998, the Romanian Parliament adopts this law.


The sole article Romania accede to the International Convention for the protection of performers, producers of Phonograms and broadcasting organizations, done at Rome on 26 October 1961.
Deposit the instrument of accession will be accompanied by the following declarations: 1. With regard to paragraph 3 of article 7. 5: Romania will not apply the criterion of fixing.
2. As regards paragraph 2 of article 4. 6: Romania will not protect radio and television broadcasts only if the headquarters of the broadcaster is situated in another Contracting State and if the show has been broadcast by a transmitter located on the territory of the same Contracting State.
3. As regards item (iii) and (iv) of paragraph 1. paragraph 1 of) of art. 16: (iii) Romania will not apply any of the provisions of art. 12 in respect of phonograms the producer of which is not a national of a Contracting State.
(iv) for phonogram producers, the directive in another Contracting State, the extent and duration of the protection provided for in this article shall be limited to the protection which the latter Contracting State provide phonograms first fixed by a national of Romania.
This law was adopted by the Senate at its meeting on 10 February 1998, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
