Law No. 52 of 2 March 1998 on approval of the Government Ordinance. 16/1997 on the granting of aid for the purchase of medical devices intended for correction and recovery of organic or functional deficiencies times correcting certain physical deficiencies in PARLIAMENT Published the ISSUING the OFFICIAL GAZETTE nr. 104 of 6 March 1998 Parliament adopts this law.


Article 1 shall be subject to approval of the Government Ordinance No. 16 of 15 august 1997 concerning the granting of aid for the purchase of medical devices intended for correction and recovery of organic or functional deficiencies times correcting certain physical deficiencies, issued pursuant to art. and (b). j) of law No. 134/97 for empowering the Government to issue decrees and published in the Official Gazette of Romania, part I, no. 198 of 19 august 1997, with the following modifications: 1. In article 1, paragraph (2) shall read as follows: "(2) medical devices within the meaning of this Ordinance, include some parts of the orthotics, orthopedic appliances, instruments and devices and adaptation of means of transport, as well as equipment and materials useful for compensatory, gestualitate and for the correction of deficiencies, hearing and sight."
2. In article 2, letter a) shall read as follows: "in keeping children) aged up to 18 years of age, and those who are students or students in the educational institutions provided by law, until their completion, without exceeding the age of 26 years;"
3. In article 2, subparagraph (c)) shall read as follows: "(c)), martyrs wounded heroes followers and people who have lost all or part of working capacity as a result of participation in the struggle for the victory of the revolution in December 1989, and the beneficiaries of the rights granted under Decree-Law No. 118/1990; "
4. In article 2, letter j) shall read as follows: "j) beneficiaries of unemployment aid, aid for vocational integration or support allowance, as well as members of the family learn of them;"
5. In article 3, paragraph 1 shall read as follows: Art. 3.-(1) aid for the purchase and repair of medical devices, under this Ordinance, shall be carried out at the request of the person entitled, under the provisions of art. 2, accompanied by documents proving this medical recommendation issued by the doctor's specialty, and the proof of its monthly net income, as appropriate. "
6. Article 4 shall read as follows: Art. 4.-the amount of aid for purchasing and repair medical devices, which are granted to persons referred to in art. 2 shall be fixed in relation to the net monthly income of their own, as follows: (a)) in the standard price of medical devices, for the categories of persons referred to in subparagraph (a). a)-(f)), and for persons referred to in subparagraph (a). n), where the invalidity occurred during, and duties related to military service or missions within the framework of the international forces, regardless of the monetary income of their own;
  

b) at standard price of medical devices, for the categories of persons referred to in subparagraph (a). g)-n), which have their own monthly net income of up to twice the level of monthly net income for a single person to be taken into account in calculating the aid;
  

(c) 75% of the price) medical devices, standard for categories of persons referred to in subparagraph (a). g)-n), which have their own monthly net income of two to four times the level of monthly net income for a single person to be taken into account in calculating the aid;
  

d) 50% of the standard price of medical devices, for the categories of persons referred to in subparagraph (a). g)-n), which have their own monthly net income of four to six times the level of monthly net income for a single person to be taken into account in calculating the aid. "
  

7. Article 7 shall read as follows: Art. 7.-(1)-standard Price of medical devices is based on the basis of proposals from suppliers of these products, endorsed and is adjusted by the Competition Office, after acquiring him by the Ministry of health, Ministry of labour and social protection, the State Secretariat for disabled persons and the Ministry of finance.

(2) the production or marketing of medical devices under the provisions of this Ordinance, may be performed by specialized companies, the most important of the Ministry of health in terms of completion of medical-sanitary conditions and quality needed. "
  

8. Article 12 shall read as follows: Art. 12.-the date of entry into force of the detailed procedures for the application of this Ordinance are hereby repealed: 12(3). (1) from No. H.C.M. 454/1957 on the support elderly retirees and nepensionari, published in the collection of decisions and provision of the Council of Ministers No. 34 of 6 April 1957, as amended by art. VII of the Decree-Law nr. 70/90 concerning the modification and completion of some regulations relating to pensions, social security and social ocrotiri, published in the Official Gazette of Romania, part I, no. 24 of 9 February 1990; art. 12 of H.C.M. nr. 880/1965 concerning the granting of material assistance under social security, published in the collection of decisions and provision of the Council of Ministers No. 33 of 21 august 1965; art. 9 of Government decision No. 219/1992 concerning pensions indexation and compensation for State social insurance, military, I.O.V.R. and other income of the population with effect from May 1, 1992, published in the Official Gazette of Romania, part I, no. 89 of 11 May 1992, as well as any other provisions to the contrary. "


Article 2 throughout the Government Ordinance. 16/1997, the disabled shall be replaced by the phrase disabled.
This law was adopted by the Chamber of deputies at its meeting on 16 February 1998, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
