Law no. 15/1998 was published in the Official Gazette of Romania, Part I, no. 13 13 of 16 January 1998. ---------- + Article 1 (1) Ministry of National Defence, Ministry of Interior, Romanian Intelligence Service, Foreign Intelligence Service, Protection and Guard Service, Special Telecommunications Service and Ministry of Justice-General Directorate of Prisons may conclude contracts for the optional insurance of goods for damage, destruction or other events. (2) The Ministry of National Defence, the Ministry of the Interior, the Romanian Intelligence Service, the Foreign Intelligence Service, the Protection and Guard Service and the Special Telecommunications Service may contract optional persons and civil liability, for the benefit of personnel with operative or informative duties, for cases of invalidity or death, caused by accidents, catastrophes or other such events during and due to operative missions, informative, pyrotechnic, anti-terrorist, special telecommunications, protection of dignitaries or correspondence, missions executed in the country or abroad. (3) The Ministry of Justice, for the staff of the General Directorate of Prisons, may contract voluntary insurance of persons and civil liability for cases of invalidity or death, produced by accidents, catastrophes and other such events occurred during and due to the performance of specific missions, characterized by high risk. + Article 2 The insurance provided in art. 1 ends at one of the insurance companies based in Romania, under the law. The categories of goods and persons that may be provided on a voluntary basis are those set out in the Annex which forms an integral part of this Law. + Article 3 (1) The amounts necessary for the payment of insurance premiums shall be borne from the funds approved with this destination, through the budget of the Ministry of National Defence, the Ministry of Administration and Interior, the Romanian Intelligence Service, the Foreign Intelligence, Protection and Guard Service, Special Telecommunications Service and Ministry of Justice. ((2) The amounts representing the allowances due for the cases of the insured risks to the goods, in case of execution of repairs thereto, shall be paid by the insurer directly to the repair unit, under the terms of the contract ended. (3) If the production of the insured risks to the goods caused the impossibility of repairing them, the due allowances shall be paid by the insurer to the unit holding the insured property. (4) The amounts referred to in par. (3) shall be transferred as income to the state budget, within 3 working days from the date of their collection. ---------- Article 3 has been amended by section 3. 1 1 of art. unique of EMERGENCY ORDINANCE no. 100 100 of 14 October 2003 published in MONITORUL OFFICIAL no. 747 747 of 26 October 2003. + Article 4 Repealed. ---------- Article 4 has been repealed by point (a). 2 2 of art. unique of EMERGENCY ORDINANCE no. 100 100 of 14 October 2003 published in MONITORUL OFFICIAL no. 747 747 of 26 October 2003. + Article 5 This Law shall enter into force from 1 January 1998. II of Law no. 43/2001 " The methodological norms provided for art. 4 4 of Law no. 15/1998 will also be elaborated by the Romanian Intelligence Service, the Foreign Intelligence Service, the Protection and Guard Service and the Special Telecommunications Service within 45 days from the date of entry into force of the Law no. 43/2001 "".
+ Annex 1 CATEGORIES of goods and persons who may be made optional A. Insurance of goods: --------------------- 1 1. aircraft and ships; 2. armored, automobile and tractor; 3. Artillery technique; 4. the technique of genius and railways; 5. High value equipment and means of communications; 6. means, materials and buildings used in the activity of penitentiaries. B. Insurance of persons: ----------------------- 1 1. personnel participating in missions in the framework of international forces intended to maintain peace or constituted for humanitarian purposes; 2. personnel participating in other international military missions; 3. personnel from the Rapid Response Force structures; 4. personnel from the military navy and the border guard navy; 5. Aeronautical personnel from military aviation; 6. personnel participating in experiments, approvals of weapons, technique and ammunition, as well as at the asanation and marking of fire in polygons; 7. personnel carrying out pyrotechnic missions; 8. personnel participating in missions to maintain or restore public order, fire fighting, guard and surveillance of the state border, combat organized crime, guard and ensure values, to detain people given in stalking or armed defectors; 9. personnel carrying out informative, operative, special telecommunications or anti-terrorist missions, in the country or abroad; 10. personnel serving security and surveillance missions of places of detention, detention and working points for detainees; 11. personnel participating in security and protection missions of Romanian or foreign dignitaries, as well as protection of magistrates; 12. personnel participating in mission security missions; 13. personnel who perform maintenance, repair, scrapping and storage of ammunition; 14. personnel working with radioactive sources, chemicals and explosives; 15. drivers; 16. conductors mechanics on the technique of armored, artillery tractors and genius machinery; 17. Pressure boiler supervisors; 18. aeronautical and naval personnel within the national security system. C. Civil liability insurance: -------------------------------- 1. Aeronautical personnel from military aviation; 2. personnel boarded on submarines; 3. personal seafarers of the military navy and the border guard navy; 4. divers; 5. personnel working with radioactive, chemical and explosive sources; 6. drivers; 7. personnel carrying out informative, operative, pyrotechnic, anti-terrorist, special telecommunications, security and protection missions within the national security system, in the country or abroad; 8. aeronautical and naval personnel within the national security system. ------
