The Romanian Parliament adopts this law + Article 1 (1) The social assistance canteens are public social assistance units, with legal personality, which operate under the local councils and operate according to the provisions of this law. (2) Social aid canteens provide free or paid social services to persons in special economic and social or medical situations. + Article 2 (1) The following categories of persons may benefit from the services of social assistance canteens: a) children up to 18 years of age, dependent on the maintenance of those families whose average monthly net income per person in maintenance is below the level of monthly net income, for a single person, taken into account in the establishment of social assistance; b) young people who attend day courses at educational institutions operating under the law, until their termination, but without exceeding the age of 25 and 26 years respectively in the case of those who follow higher education with a longer duration years old, which is in the situation referred to in lett. a); c) persons who benefit from social assistance or other money aids granted under the law and whose income is up to the level of monthly net income for a single person, taken into account when establishing social assistance; d) pensioners; e) persons who have reached the retirement age, in one of the following situations: are socially isolated, have no legal supporters, are deprived of income; f) invalids and chronically ill; g) any person who, temporarily, does not realize income. (2) Persons referred to in par. ((1) lit. g) benefit from the services of social assistance canteens, under the conditions provided by this law, for a period of no more than 90 days per year. (3) Do not benefit from the services provided by the social assistance canteens the persons to whom the provisions apply art. 6 6 para. ((1) lit. a) and c) of Law no. 1/1991 on the social protection of the unemployed and their professional reintegration, republished in the Official Gazette of Romania, Part I, no. 257 257 of 14 September 1994. + Article 3 The social assistance canteens provide, as the case may be, the following social services to persons entitled according to art. 1 1: a) preparing and serving two meals, daily, per person, lunch and dinner, within the food allowance provided by the legal regulations; b) supply, for a fee, from the premises of the canteen with basic agri-food products, at the prices to which they were purchased; c) free transport only for people who benefit from the distribution of food at home; d) preparation and distribution of food through mobile centers, for special situations. + Article 4 (1) The social services provided in art. 3 lit. a) is provided free of charge for the persons established in art. 2 2, which do not have income or whose income is below the level of monthly net income, for a single person, taken into account when establishing social aid. (2) Persons entitled to benefit from the services of the social assistance canteen, established in art. 2, and who realize incomes above the level of monthly net income, for a single person, taken into account when establishing social assistance, can benefit from the services of the social aid canteen, with the payment of a contribution of 30% of income per person, without exceeding the cost of meals served, calculated over the same period. (3) The beneficiaries of social assistance are entitled to the services of the social assistance canteen on the basis of social investigation, according to the mayor's provision. + Article 5 (1) The food for the two meals is distributed, as a rule, once a day, at the canteen's headquarters or through the service points organized for this purpose. (2) Persons who, for objective reasons, resulting from the social survey, cannot travel to the canteen's premises, are given food for the two daily meals at home, once a day, the free transport of which is approved by the director the social aid canteen. + Article 6 ((. Applications for the provision of social assistance services by the canteens of social assistance shall be approved by the mayor or by a person empowered by him. (2) In cases of emergency, dining at the social aid canteen can be approved, for no more than 7 days, by the director of the canteen. + Article 7 The Ministry of Labour and Social Protection verifies the legality of the rights established according to this law and ensures, through decentralized public services, specialized assistance, methodological support and guidance. + Article 8 (1) The material basis necessary for the functioning of the social assistance canteens and the control of their activity shall be ensured by the (2) The financing of social aid canteens is made from local budgets. + Article 9 In localities where social aid canteens do not operate or where applications exceed the existing capacity, local public administration authorities may agree with social assistance units, autonomous regions, companies and public institutions that have their own canteens, as well as with food establishments providing the social services provided for in art. 3 lit. a) and c), with appropriate application of the provisions of art. 2 2 and art. 6 6 para. ((1). + Article 10 The social assistance canteens can organize, with the approval of the local council, depending on the conditions available to them, the household-annex with agri-food and zootechnical profile, with self-funded activities, to improve the food of the assisted persons. + Article 11 Sponsorships and donations in money and in kind, made by natural and legal persons, Romanian and foreign, social assistance canteens can be used only for the purpose of developing and improving the quality of the services they provide. + Article 12 Local councils can grant subsidies from their own budgets to associations and foundations endorsed by the Ministry of Labour and Social Protection and which have as their object of activity the organization of social aid canteens. + Article 13 (1) For the proper functioning of the social assistance canteens, the beneficiaries of the social services offered by them have the obligation to observe the schedule established for dining, keeping the cleaning of the premises and the goods of the unit, as well as the measures of hygiene. (2) By decision of the local council under which the social aid canteen operates can be established the participation of persons who benefit from the services of the social assistance canteen to some household activities. + Article 14 The organization, operation and personnel framing of the social aid canteen shall be established by decision of the local council, at the proposal of the mayor. + Article 15 The amount of the daily food allowance per person for social assistance canteens shall be established and indexed by Government decision. + Article 16 Contributions due by beneficiary persons of the services of social assistance canteens and collected, according to the provisions of art. 4, are made income to the local budget, and the receipts from other activities, under the conditions of art. 10, remain at the disposal of the social aid canteen, to improve the food of assisted persons. + Article 17 On the date of entry into force of this Law, the Government Decision no. 290/1992 on social aid canteens, published in the Official Gazette of Romania, Part I, no. 135 135 of 19 June 1992, as well as any other provisions to the contrary. This law was adopted by the Senate at the meeting of December 2, 1997, in compliance with the provisions of art 74 74 para. (1) of the Romanian Constitution. p.
