II From the date of entry into force of this law, in the elaboration of the documentation of spatial planning and urbanism: a) the rules related to "water quality" set out in Annex no. 1 1 to Government Decision no. 100/2002 for the approval of the quality standards to be fulfilled by the surface waters used for the potability and of the Normative on the measurement methods and the sampling frequency and analysis of the surface water samples intended the production of drinking water, as amended; b) consider the delimitation of the areas of human agglomerations on the surface of which the urban waste water from the treatment plants of the municipalities, towns and rural localities, as well as those from the systems individual treatment, according to the provisions Government Decision no. 188/2002 for the approval of certain rules on discharge conditions in the aquatic environment, as amended and supplemented; c) the volumes of total fresh water resources, as well as water for the population, water for industry, water for irrigation, communicated by the institutions that centralize the water management data are taken into account. " The Romanian Parliament adopts this law + Article 1 The National Territory Planning Plan-Section II Water is approved, according to annexes no. 1-8, which are an integral part of this law. + Article 2 The works provided for in this Law for the National Territory Planning Plan-Section II Water are of national interest and constitute the cause of public utility. + Article 3 (1) The provisions of the National Territory Planning Plan-Section II Water are mandatory for public administration authorities. (2) Depending on the requirements and possibilities of financing through the annual state budget, these works can extend and diversify, to the proposals of the county, municipal, city or communal public administration authorities. (3) Delimitation of land necessary for water works, subject to this law, shall be established by urban planning and/or spatial planning documentation, specialized studies and feasibility studies, prepared according to the law. (4) The occupation of the necessary land and their removal from agricultural and forestry production shall be made according to the law. + Article 4 Public administration authorities will cooperate in applying the provisions of this law, taking measures to: a) ensuring the protection of water resources against their depletion, pollution and degradation, through sustainable use; b) linking resources with water requirements for the population, industry, irrigation and other uses, as well as the integration of these actions in spatial planning, in the short, medium and long term. + Article 5 ((1) The works of the National Territory Planning Plan-Section II Water shall be included in the investment lists, the annex to the budgets of the principal authorising officers, based on technical-economic documentation elaborated and approved according to legal provisions, and shall be financed, in addition, within the limits of the approved funds, with this destination, by the annual budgetary laws. ((2) The works may be financed, in whole or in part, and by other investors, under the conditions established by law. + Article 6 The establishment of water priorities is done by the Ministry of Water, Forestry and Environmental Protection, in correlation with programs of national interest. + Article 7 Delimitation of the areas contained in the annexes to this law, with large malfunctions in the supply of drinking water and/or sewerage of municipalities and cities, areas with rural localities with reduced water resources, areas with polluted water resources of industry, as well as of the areas necessary for irrigation works and/or desecations, which require priority rehabilitation measures, is established by urban planning and/or spatial planning documentation, approved according to the law. + Article 8 The violation by natural or legal persons of measures on conservation and protection of water attracts civil, contravention or criminal liability, according to the law. No. 171. + Annex 1 NATIONAL TERRITORY PLANNING PLAN -SECTION II WATER Definition of the main terms used For the application of this law, the terms and expressions below signify, as follows: 1. Surface waters-inland waters, with the exception of transitional waters and coastal waters; 2. groundwater-all waters that are under the topographic surface of the bark in the saturation area and in direct contact with the soil or the basement; 3. wastewater-waters from domestic, social or economic activities, containing polluting substances or residues that alter its original physical, chemical and bacteriological characteristics, as well as rain waters flowing on polluted land; 4. water intended for human consumption-water from natural or anthropogenic sources, used as such or treated, and intended for different categories of human consumption, supplied by distribution network or in containers; 5. water for irrigation-fresh water necessary for irrigation of agricultural crops, mainly provided from surface water sources; 6. drainage-drainage water-excess water from drainage-drainage facilities, evacuated to the hydrographic network; 7. hydrographic basin-the area of land on which a process of gravitational evacuation of surface waters is carried out, by means of a collector river and its tributaries; 8. polluted water-water whose physical, chemical, biological and bacteriological characteristics have been modified and whose new characteristics are no longer suitable for the environment; 9. river-body of inner water that flows mostly to the surface of the land, but which can flow and underground in a certain part of its course; 10. freshwater resources-surface waters made up of water courses, freshwater lakes, as well as groundwater on the territory of the country; 11. stations and water quality processing plants-treatment plants for obtaining drinking or industrial water; resorts/wastewater treatment plants/wastewater treatment plants; 12. Domestic waste water-category of degraded waters, as an effect of the evacuation of physical-chemical and organic residues, resulting from activities carried out in households and public institutions or service providers; 13. industrial waste water-any kind of waste water resulting from industrial and/or commercial activities, other than domestic wastewater and meteoric waters; 14. human agglomeration-an area where there are a minimum number of 2,000 equivalent inhabitants served by a single treatment plant or connected to a single end point of evacuation; 15. refurbished/upgraded treatment plants-treatment plants that, through the improvements and completions made, allow to obtain the quality conditions established by the water management notices and permits; 16. public network of water supply or sewerage part of the water supply system, respectively of sewerage, made up of the network of pipes, fittings and construction-annexes that ensure the distribution of drinking water, namely the takeover, evacuation and transport of sewage; 17. primary treatment-wastewater treatment by a physical and/or chemical process involving the decanting of suspended matter or other processes in which biochemical oxygen consumption at 5, CBO 5, of the influential wastewater is reduced by at least 20 20% and the suspended matter at least 50%; 18. secondary treatment-wastewater treatment by a biological process with secondary decantation or by another procedure that allows compliance with the conditions provided in the current technical norms; 19. proper treatment-the process by which the water is brought to the quality established by the rules in force; 20. vulnerability-the sensitivity of an underground water system to human and/or natural impact; 21. public drinking water supply system assembly and land, technological installations, functional equipment and specific facilities through which the public drinking water supply service is carried out, with the following components: catchments, adductions, raw water treatment plants, pumping stations with or without hydrophore, tanks for the storage of drinking water, distribution network, connections to the delimitation point. 22. public sewerage system-construction and related land assembly, technological installations, functional equipment and specific facilities, through which the public sewerage service is carried out, with the following components: connections sewerage from the delimitation point, sewerage networks, wastewater pumping stations, treatment plants, evacuation collectors to the emissary, mouths of shedding in the emissary, dehydrated sludge deposits. --------- Annex 1 has been replaced by Annex 1 LAW no. 20 20 of 11 January 2006 , published in MONITORUL OFFICIAL no. 62 62 of 24 January 2006, according to section 1 1 of art.
