Law No. 120 of 9 July 1997 on paid leave to care for children aged up to 2 years published in PARLIAMENT ISSUING the OFFICIAL GAZETTE nr. 149 of 11 July 1997, the Romanian Parliament adopts this law.


Article 1 Women insured under the State social insurance system, social insurance system for farmers and women cadres in military activity are entitled, under the conditions laid down in this law, to a paid leave for child care, in addition to the holiday pay for pregnancy and refusal of 112 days, prescribed by the regulations in force.


Article 2 paid leave for child care shall be provided, upon request, in continuation of leave for pregnancy and refusal to pay or anytime up to the fulfillment of the child to the age of 2 years.


Article 3 (1) women insured under the social security system of the State and military activity women cadre benefits, sick leave for the care of the child, an allowance representing 85% of the basic wage and other wage income on the basis of which shall be determined by the social security contribution, i.e. the insurance income.
  

(2) women insured under the pension system and other social insurance rights of farmers receive sick leave for the care of the child, an allowance representing 80% of the average monthly insured income of the last 6 months for which he was paid the contribution provided by the regulations in force.
  


Article 4 the period of leave for childcare up to the age of 2 years constitute the work.


Article 5 the provisions of this law shall also benefit women, as referred to in art. 1, who adopted were called guardian, were entrusted with children towards growth and education or in family placement, in accordance with the law.


Article 6 the provisions of this law may be given as an option, any of the child's parents.


Article 7 the allowances referred to in article 1. 3 it supports from the State social insurance budget, the budget of the Fund for the payment of pensions and other social insurance rights of farmers and the State budget, according to the social security system in which the woman.


Article 8 shall recommend independent social security systems other than the national social security system and the pension system and other social insurance rights of farmers, to apply the measures provided for in this law.


Article 9 entry into force of the present law shall repeal the Decree-Law nr. 31/1990 on paid leave to care for children aged up to one year, published in the Official Gazette of Romania, part I, no. 12 of 19 January 1990, and any other provisions contrary to the provisions of this law.
This law was adopted by the Chamber of deputies at its meeting of 23 June 1997, in compliance with the provisions of art. 74 para. (1) of the Constitution of Romania.
