The Romanian Parliament adopts this law + Article 1 Women insured under the state social insurance system, social insurance system for farmers and women military personnel in activity have the right, under the conditions provided by this law, to a paid leave for care the child, outside the paid leave for the pregnancy and the 112-day lauzia, provided by the regulations in force. + Article 2 Paid leave for child care is granted, upon request, in continuation of the leave for pregnancy and lauzia or anytime until the child's fulfillment of the age of 2 years. + Article 3 ((1) Women insured under the state social insurance system and women military personnel in activity benefit, during the parental leave, from an allowance representing 85% of the basic salary and the other income salary on the basis of which the social security contribution, respectively of the insurance income, is established. (2) Women insured under the pension scheme and other social security rights of farmers benefit, during the period of parental leave, from an allowance representing 80% of the monthly average of insured income from the last 6 months for which the contribution provided by the regulations in force has been paid. + Article 4 The period of parental leave aged up to 2 years is seniority. + Article 5 The provisions of this law also benefit women insured, provided in art. 1, who adopted, were appointed guardian, were entrusted with children for growth and education or in family placement, under the law. + Article 6 The provisions of this law can optionally benefit any of the child's parents. + Article 7 Allowances provided for in art. 3 is borne from the state social insurance budget, from the budget of the Fund for the payment of pensions and other social insurance rights of farmers and, respectively, from the state budget, depending on the social insurance system in which it is Contained woman. + Article 8 It is recommended that independent social security systems, other than the state social insurance system and pension system and other social insurance rights of farmers, apply the measures provided for by this law. + Article 9 On the date of entry into force of this Law, the Decree-Law no. 31/1990 on paid leave for the care of children up to one year of age, published in the Official Gazette of Romania, Part I, no. 12 of 19 January 1990, as well as any other provisions contrary to the provisions of this Law. This law was adopted by the Chamber of Deputies at the meeting of June 23, 1997, in compliance with the provisions of 74 74 para. (1) of the Romanian Constitution. p.
