Law No. 96 of 10 June 1997 approving Ordinance No. 27/1996 on the granting of facilities to persons residing or working in some localities of the Apuseni Mountains and the Biosphere Reserve "Danube Delta" issuer PARLIAMENT Published in MONITORUL OFICIAL nr. 118 of 10 June 1997, the Romanian Parliament adopts this law.


Article 1 shall be subject to approval of the Government Ordinance No. 27 from 5 august 1996 concerning the granting of facilities to persons residing or working in some localities of the Apuseni Mountains and the Biosphere Reserve "Danube Delta", issued in accordance with art. and (b). b) of law No. 65/1996 for empowering the Government to issue decrees and published in the Official Gazette of Romania, part I, no. 183 of 8 august 1996, with the following modifications: 1. Article 1 shall read as follows: Art. 1. — (1) the staff of public institutions and establishments, employed on the functions that require highly educated and specialized environments, with the work in rural areas, in the Apuseni Mountains set out in the annex. 1 the Government decision nr. 323/1996, and that it establishes in these localities, be entitled to timber, for construction of a dwelling, the extension or repair of existing housing and household annexes, with the obligation of paying 50% of the equivalent value of the material.

(2) the persons entitled to benefit from the grant building timbers, under the present law, as follows: a) up to 30 cm/family, building a home, once;
  

b) up to 20 m3/family, for the expansion of existing housing, once;
  

c) up to 10 m3/family, for the repair of existing housing and household annexes.
  

(3) the provisions of paragraphs 1 and 2. (1) benefits from people who haven't owned forests to harvest timber for construction. "
  

2. Article 1 shall be inserted After article 1 ^ 1, which shall read as follows: Art. 1 ^ 1. -(1) stocktaking as referred to in art. 1 shall be made available upon request, which is submitted to the Mayor of the municipality in whose territory the applicant is domiciled.

(2) applications will be forwarded by the town councils of localities, forestry directorates of the national forest, which, through the local forest in the area, have the obligation to honor them.
  

(3) Municipalities must ensure that timber thus obtained to be used exclusively for granted and only for rural areas where individuals establish domicile. "
  

3. paragraph 4 of article 1, which becomes article 1 ^ 2, shall read as follows: Art. 1 ^ 2. -The volume of timber, which is granted under the terms of art. 1 and art. 1 ^ 1, shall be established within the framework of the annual volume of timber approved according to legal regulations for annual cuts from the forests of the country. "
4. In paragraph 5 of article 1, which becomes article 1 ^ 3, shall read as follows: Art. 1 ^ 3. -Price difference compared to the full cost will incur from the State budget and will be paid to the national forest through the Ministry of waters, Forests and environmental protection. "
5. Article 2 shall read as follows: Art. 2.-(1) the staff of public institutions and establishments, employed on the functions that require highly educated and specialized environments, with the work of the Biosphere Reserve "Danube Delta", referred to in the annex to the Government decision nr. 395/96, as well as individuals who occupy positions eligible benefits from a spore isolation of up to 60% of base salary.

(2) increased Differentiation of isolation settlements shall be made by the County Council, with an opinion of the prefecture.
  

(3) personnel referred to in paragraph 1. (1) does not apply to the provisions of other laws relating to the environment.
  

(4) the increase for staff employed in the units, according to para. (1) calculate the minimum gross salary per country and it supports the budget of the State Secretariat for religious affairs. "
  

6. Article 8, paragraph a) shall read as follows: ' a) fishing, gathering, management and exploitation of forest fund forest vegetation and outsiders; "
7. Article 10 shall read as follows: Art. 10.-Ministry of public works and town and country planning, the Ministry of labour and social security, the Ministry of finance and the Ministry of waters, Forests and environmental protection will approve, within 60 days, the necessary amendments to the existing detailed rules relating to the granting, using and controlling of costs resulting from application of the provisions of this Ordinance, which will be developed together with ministries and with the county councils concerned. "


Article 2 of the Government Ordinance No. 27/1996 on the granting of facilities to persons residing or working in some localities of the Apuseni Mountains and the Biosphere Reserve "Danube Delta", published in the Official Gazette of Romania, part I, no. 183 of 8 august 1996, as amended by this law, shall be in the Official Gazette of the Republic of Romania, Rosca articles and a new numbering paragraphs.
This law was adopted by the Senate at its meeting on 22 May 1997, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
