The Romanian Parliament adopts this law + Article 1 The International Code of Management for the Safe Operation of Ships and for the Prevention of Pollution (International Safety Management Code-I.S.M. Code), adopted by the International Maritime Organization by Resolution A 741 741 (18) of 4 November 1993, contained in the Annex to the resolution and which forms an integral part of this Law. + Article 2 The Ministry of Transport, on behalf of the Romanian Government, is empowered to bring to fruition the provisions of the International Code of Management for the safe operation of ships and to prevent pollution, releasing, through its direction of speciality, Sailing Company Compliance Document, Ship Safety Management Certificate, Licences and Authorizations to Natural and Legal Persons conducting Auditing on Safe Operation of Ships and Prevention pollution or technical verification of ships according to international conventions. + Article 3 All navigation companies registered in Romania and all ships flying the Romanian flag are obliged to obtain from the Ministry of Transport the compliance documents and safety management certificates. + Article 4 The compliance documents and safety management certificates shall be issued on the basis of the presentation of a documentation established by the Ministry of Transport and the favorable reports prepared by the Romanian auditors, individuals and legal entities or foreign, authorized by the Ministry of Transport The remuneration and expenses, carried out by the auditors, on the preparation of the inspection report of companies and ships will be borne by navigation, on the basis of contractual relations. + Article 5 Fees for the issuance of the Compliance Document and the Safety Management Certificate are hereby established. These taxes are revenue of the state budget. The amount of taxes is established, at the proposal of the Ministry of Transport, of the Ministry of Water, Forestry and Environmental Protection and the Ministry of Finance, by Government decision. + Article 6 Within 60 days from the publication of this law in the Official Gazette of Romania, the Ministry of Transport will draw up and submit to the Government's approval the methodological norms on the procedure for issuing certificates, authorization and the licensing of Romanian or foreign natural and legal persons carrying out audits, checks and control at the shipping companies and on board the vessels, as well as the method of fixing the fees. + Article 7 All previous legal provisions, which contravene the provisions of this law, are repealed. This law was adopted by the Senate at its meeting of 18 March 1997, in compliance with the provisions of art. 74 74 para. (2) of the Romanian Constitution.
