Law No. 85 of 28 May 1997 concerning the acceptance by the Romania international management code for the safe operation of ships and for pollution prevention (international safety management code I.S.M.), adopted by the International Maritime Organization by resolution 741 (18) of 4 November 1993 PARLIAMENT ISSUING published in MONITORUL OFICIAL nr. 107 of 30 May 1997, the Romanian Parliament adopts this law.


Article 1 shall accept the international code of safety management for the operation of ships and for pollution prevention (international safety management code I.S.M.), adopted by the International Maritime Organization by resolution 741 (18) of 4 November 1993, contained in the annex to the resolution and which forms an integral part of this law.


Article 2 Is the Ministry of transport, empowers the Government of Romania, to comply with the provisions of the international management Code for the safe operation of ships and for pollution prevention, releasing its direction through specialized companies ' document of compliance, the safety management Certificate of vessels, licenses and permits to individuals and legal entities carrying out audits relating to the operation of the safety of ships and pollution prevention or checking technique of ships in accordance with international conventions.


Article 3 All shipping companies registered in Romania and all ships that fly the flag English arboreaza are required to obtain from the Ministry of transportation documents of compliance and safety management certificates.


Article 4 the documents of compliance and safety management certificates are issued on the basis of the submission of a documentation set by the Ministry of transportation and favorable reports drawn up by the Auditors, individuals and legal entities, Romanian or foreign authorized by Ministry of transport.
The remuneration of and expenses incurred by auditors, concerning the establishment of the inspection report of companies and vessels will be charged, on the basis of contractual relations.


Article 5 shall establish fees for issuing the document of compliance and safety management certificate. These fees are revenues of the State budget. Amount of the fees shall be established, on a proposal from the Ministry of transportation, Ministry of Waters, forests and environmental protection and the Ministry of Finance of the Government.


Article 6 within 60 days of the publication of this law in the Official Gazette of Romania, the Transport Ministry will be prepared and will be subject to the approval of the Government the detailed rules on the procedure for issuing type-certificates, approval and licensing of the Romanian natural and legal persons who carry out or foreign audits, verifications and controls navigation companies and ships as well as the manner of determining the fees.


Article 7 All laws that contravene the provisions of the previous, this law is repealed.
This law was adopted by the Senate at its meeting on 18 March 1997, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
