The Romanian Parliament adopts this law + Article 1 (1) In order to cover the additional expenses determined by the liberalization of the bread price, during April-September 1997, a monthly monetary compensation of 13,500 lei is granted to the following categories of persons: a) employees with an individual employment contract, whose gross earnings are up to 600,000 lei per month; b) beneficiaries of unemployment benefits, support allowance or professional integration aid; c) pensioners for the work done and the age limit and invalidity pensioners from the state and military social insurance system, whose amount of the basic pension is up to 450,000 lei monthly; d) to every pensioner who benefits from the survivor's pension from the state and military social insurance system; e) pensioners I.O.V.R., beneficiaries of social assistance established on the basis of pension legislation, persons who benefit from money rights established on the basis Law no. 42/1990 to honor the heroes-martyrs and grant rights to their descendants, to the wounded, as well as to the fighters for the victory of the Revolution of December 1989, republished; f) beneficiaries of social assistance established on the basis Law no. 67/1995 on social assistance, as well as persons benefiting from money rights established on the basis of art. 7 7 para. ((2) lit. a) and art. 8 8 para. ((1) and (2) of Law no. 53/1992 on the special protection of handicapped persons; g) students and students, beneficiaries of social assistance scholarships. (2) In order to cover the additional expenses determined by the liberalization of the bread price, in the period April-September 1997, a monthly monetary compensation of 9,000 lei is granted to the following categories of persons: a) pensioners for the work done and the age limit and invalidity pensioners in the social insurance system for farmers; b) to every pensioner farmer who does not benefit from another pension category in the social insurance system for farmers. (3) The provisions of par. ((1) lit. c) and d) shall also apply to pensioners from other systems than those mentioned in par. ((1) and (2). + Article 2 (1) Persons referred to in art. 1 1 para. ((1) lit. a), which cumulates the salary with a pension among those provided in art. 1, benefit from a single monthly monetary compensation, under the conditions provided in art. 1, for the respective pension category. (2) Pensioners referred to in art. 1 1 para. ((1) lit. c) and d), which also benefit from pensions from other systems, receive a single monthly compensation, under the conditions provided in art. 1 1 para. ((1) lit. c), respectively lit. d). + Article 3 (1) From the date of entry into force of this Law, the amounts of food allowances for collective consumption in budgetary units and in autonomous regions with particular specific, set out in Annexes no. 1 1 a) and 1 b) Government Decision no. 28/1997 , is supplemented by 450 lei/day and 13,500 lei/month. (2) The cost of the hot meal and the food allowance granted, according to the regulations in force, to the employees of some autonomous kings and commercial companies with majority state capital, which are borne from the operating expenses, can be increased with 450 lei/day, respectively 13,500 lei/month. With the same amount can be increased the cost of the hot meal and the food allowance that is granted, according to the law, to the employees in some budget units. + Article 4 The monetary compensation provided for in art. 1 is non-taxable, stands out separately from the other rights and is not taken into account when establishing other rights and obligations provided by the legal norms in force. + Article 5 (1) Establishment of rights for beneficiaries referred to in art. 1 is made ex officio by the legal entities that manage and manage the funds from which the basic rights are paid. (2) The monthly cash compensation shall be paid, with the basic rights, to the persons in payment on the first of each month from April to September 1997. + Article 6 The monetary compensation provided for in art. 1 1 and 2, as well as the related transmission expenses shall be borne from the same funds as the basic rights constituting the legal basis for granting them. + Article 7 Expenses that are made for the payment of monetary compensation, due to the persons referred to in art. 1 1 para. ((1) lit. a), will be deducted from the amount due, by the employing legal entities, to the state social insurance budget. + Article 8 (1) The expenses that are made for the payment of monetary compensations, due to persons whose basic rights are borne from the state social insurance budget, including those provided in art. 7, from the social insurance budget for farmers, from the budget of the Fund for the payment of unemployment benefits, from the budget of the Risk and Accident Fund, from the local budgets, from the budgets of other main authorising officers of the state budget, such as and from the budgets of independent pension systems, plus the related transmission expenses, will be covered, during the IV/1997 quarter, from the amounts provided with this destination in the budget of the Ministry of Labor and Protection Social, from the state budget. (2) The distribution of the amount, with the destination of covering the expenses for the payment of monetary compensation, established according to this law, provided to be allocated in the budget of the Ministry of Labor and Social Protection from the state budget, on the budgets of par. (1), is made by Government decision. + Article 9 The amounts paid without legal basis, as a monetary compensation to cover the increase in the price of bread, are recovered, according to the law, from which those who received them. + Article 10 The Government, at the proposal of the Ministry of Labour and Social Protection and the Ministry of Finance, will approve methodological norms of application, within 15 days from the date of entry into force of this law.
