The Romanian Parliament adopts this law + Chapter 1 General provisions + Article 1 Civil protection is a component of national defence and includes all measures adopted and activities carried out in order to ensure the protection of the population, material goods, cultural values and environmental factors, in case of war or disaster. + Article 2 Civil protection duties are: a) preventing the population from attacks of the enemy in the air or disasters; b) protection of the population against the effects of mass and conventional destruction weapons or disasters; c) ensuring the protection of material goods and cultural values; d) participation in the actions of limitation and removal of the consequences of attacks of the enemy or of disasters; e) the asanarea of the remaining unexploded ordnance territory; f) preparing the population to ensure protection; g) participation with specific forces and means in the preparation of the national economy and the territory for defence. The activities of civil protection are planned, organized and carried out in accordance with the regulations existing in the documents on international humanitarian law to which Romania is a party. + Article 3 The organizational and training measures for civil protection shall be established, in peacetime, and intensify to the proclamation of the curfew, emergency, declaration of mobilization or state of war. The organization and unitary coordination of activities to intensify civil protection measures in exceptional situations shall be decided by the Supreme Council of National Defence. + Article 4 Ministries, central specialized public administration authorities, local public administration, public institutions and economic agents, regardless of their form of ownership, are responsible for the execution of civil protection measures, established by this law, each in its field of activity. Whenever the provisions of this law refer to counties, municipalities, sectors, cities and communes, the local public administration authorities at the respective level are understood. + Article 5 Romanian citizens have the right and obligation to participate in the training activity in order to know and apply civil protection rules and measures. + Article 6 Measures to protect the population and material goods shall be organized in relation to the classification for civil protection of localities, public administration authorities, public institutions and economic agents, established by norms technical elaborated by the Civil Protection Command. + Chapter 2 Civil protection organisation + Article 7 Civil protection is organized, from time of peace, to ministries and other specialized bodies of the central public administration, to counties, localities, public institutions and economic agents, on the administrative-territorial principle and of the place Work. + Article 8 The organizational structure of civil protection includes: civil protection chiefs, Civil Protection Command, inspectorates, commissions, units, subunits and formations. The structures provided in par. 1 are part of the protection forces and are not included in the armed forces. + Article 9 The head of civil protection in Romania is Prime Minister. It leads the civil protection work through the Minister of National Defence. The general coordination of civil protection throughout the country and the exercise of control shall be carried out by the Civil Protection Command which functions as the specialized body of the Minister of National Defence. The Civil Protection Command includes the county inspectorates, the city of Bucharest and its sectors, the units, subunits and military civil protection formations existing in peacetime or that are completed and completed. set up mobilisation. + Article 10 Civil protection chiefs from public administration authorities, public institutions and economic agents are their leaders. The organization, operation, and their structure are approved by the Minister of National Defence, at the proposal of the Commander of the Civil Protection Command. + Article 12 Ministries, other specialized bodies of the central public administration, municipalities, cities, public institutions and economic agents with more than 500 employees, as well as economic agents classified in terms of civil protection, are obliged to provide in the states of functions and to frame civil protection inspectors, with the opinion of the Civil Protection Command, the county civil protection inspectorates, the city of Bucharest and its sectors. At the county seat municipalities, the position of civil protection inspector falls with the specialized active officer. In municipalities, cities, as well as economic agents with more than 3,000 employees, for civil protection activity falls personally technical specialist help, salarized by the respective unit. To communes, public institutions and economic agents not found in par. 1, the position of civil protection inspector shall be ensured by the cumulation of functions. The function of civil protection inspector shall be included in the trades nomenclature. + Article 13 The specialized civil protection commissions are organized at the county, municipal and sector public authorities. Their staff, in addition to their duties according to their duties, also performs civil protection tasks. The specialized civil protection commissions are constituted on the following areas: evacuation, transmission-alarm, protection-sheltering, unlock-rescue, energy, antique, medical, environmental, veterinary, roads and bridges, computer science, agriculture and food, logistics, transport and others. The heads of the specialized civil protection commissions are part of the county commission, namely the commission of the city of Bucharest, of defense against disasters. In order to maintain the order and ensure the security, prevention and extinguishing of fires, in the situations provided by this law, will cooperate with the specialized bodies of the Ministry of Interior. + Article 14 The units, subunits and civil protection formations shall be constituted, from time of peace, to: nuclear-electronic plants, chemical plants or other economic objectives constituting potential sources of nuclear, chemical or biological risk, in report with their importance. The units, subunits and civil protection parties shall be established and completed with the mobilisation, in relation to the plans drawn up for this purpose. + Article 15 Civil protection formations are specialized intervention forces that participate in the limitation and removal of the consequences of terrorist, enemy or disaster attacks. Civil protection parties shall be organized by public administration authorities, public institutions and economic agents, with persons without military obligations, as follows: a) to the central specialized public administration authorities, with employees operating in these units; b) to counties, municipalities, sectors and cities, with employees of public institutions from the respective administrative-territorial units; c) in neighborhoods, on streets and groups of blocks, with citizens who do not have the obligation to participate in civil protection actions at work; d) to the communes, with inhabitants of their territory; e) at public institutions and economic agents with over 100 employees, with staff within them. + Article 16 Civil protection formations can be constituted, in relation to the needs of civil protection, on specialties: observation-research, transmission-alarm, energy, protection-housing, rescue, installations, roads and bridges, protection antique and environmental, medical, veterinary, pyrotechnic, logistics, transport and others. + Article 17 Civil protection parties fall with able-bodied persons, men aged from 18 to 60 years and women, from 18 to 55 years, persons without military obligations and persons with military obligations, mobilized at work. + Article 18 The management of civil protection activities is carried out by the Civil Protection Command, through the network of command points, which ensure, from time of peace, at the level of the central specialized public administration authorities, at the county, municipal, sector, city, other important localities, as well as public institutions and economic agents. CAP.3 Preparation for civil protection + Article 19 Training for civil protection is carried out by categories of personnel and functions. The plans, programs, forms and duration of training are established by the Civil Protection Command and approved by the head of civil protection in Romania. Civil protection chiefs, inspectorates, commissions, units and civil protection formations, sanitary-voluntary Red Cross formations, civil fire formations, other parties, employees participate in civil protection training. from public institutions and economic agents, students, students, other categories of citizens, as well as civilian personnel of the armed forces. + Article 20 Civil protection command and civil protection inspectorates organise, periodically, exercises and applications for civil protection and disaster interventions. The forces and means of civil protection, as well as the disaster defence committees, participate in these activities. + Article 21 Civil protection chiefs, personnel from inspectorates, commissions and commanders of civil protection parties execute, once every 2-4 years or whenever necessary, training courses or meetings, with removal from production, with a duration of 5-25 working days, organized by the Civil Protection Command or by the county civil protection inspectorates and the city of Bucharest. These courses will take place in the Center for the improvement of the training of civil protection personnel, as well as in the training centers in the field of civil protection area, county and Bucharest. + Article 22 Students and students perform the preparation for civil protection through specific topics contained in the curricula, established by the Civil Protection Command together with the Ministry of Education. + Article 23 Training of personnel employed in civil protection, in other organizational forms than those provided in art. 21, is mandatory and is carried out during or, as the case may be, outside the working hours, according to the ruling of the head of the units whose employees are. + Chapter 4 Protection of the population and material goods + Article 24 Preventing the population and its protection and material goods against the effects of conventional, nuclear, biological, chemical or disaster weapons shall be ensured by a set of measures, consisting of: notice and alarm, evacuation, sheltering, antique and biological protection, masking, camouflage and other specific technical and organizational measures. + Article 25 The notice is the activity of transmitting messages about the danger of attacks from the air, radioactive, chemical or biological contamination and disasters, to public administration authorities and civil protection inspectorates, in order to avoiding surprise, alarm, shelter of the population and protection of some material goods. The notice is provided by the Civil Protection Command and the county civil protection inspectorates, the city of Bucharest and its sectors, based on the data received from the General Staff of Aviation and Anti-Air Defence, the State Major of the Military Navy, major units and units subordinated to them, as well as from other sources of information. + Article 26 The alarm is the activity warning the population about the imminent danger of attacks in the air, radioactive, chemical, biological, and disaster contamination, for the purpose of moving immediately and in an organized manner to the application of the measures protection and intervention. + Article 27 Notice and alarm are carried out by special means of notification and alarm, through the territorial telecommunications system, through radio stations and radio telephones, through the studios and broadcasting stations and television stations, regardless of the form of their property and other means. The specific means of alarsea shall be installed in the places established by the civil protection inspectorates. + Article 28 In the event of an imminent air strike, when no state of war has been declared, the first messages of pre-weapon and alarm shall be transmitted with the approval of the Minister of National Defence. + Article 29 In order to verify the notification and alarm system in localities, public institutions and economic agents, public alarm exercises are periodically executed. For the warning of the population, the use of means of alarm in case of disasters is executed only with the approval of the heads of civil protection from the localities, public institutions or affected economic agents. + Article 30 In the case of attacks or disasters, the evacuation shall be carried out on the basis of the plans drawn up for + Article 31 The central evacuation commission, headed by the Secretary-General of the Government, including state secretaries and heads of public administration authorities involved, is set up for the organization and management of the evacuation actions. The Commission shall be a permanent technical secretariat headed by the Commander of the Civil Protection Command. Civil protection shelters may be public, economic agents or individuals, according to the source of financing of that investment. Civil protection shelters, under the administration of local public administration bodies, are public shelters managed by local councils. + Article 33 Central and local public administration authorities, public institutions, economic agents, as well as owners of residential buildings, have the obligation to provide for new investments under construction or extensions of existing buildings Civil protection shelters, according to the instructions and technical norms approved by the Minister of National Defence. The expenses for these works shall be borne by the owners of the respective investment and may not exceed 5% of their construction-assembly value. Economic agents with sources of nuclear, chemical or biological danger have the obligation to periodically assess risk areas, to establish the necessary prevention and protection measures, to ensure the notification of public authorities, alarm and protection affected population. + Chapter 5 Limiting and removing the consequences of air or disaster attacks + Article 38 In actions to limit and remove the consequences of attacks or disasters participate military units and civil protection formations existing in peacetime or that can mobilize in short time, military units and formations. The Ministry of National Defence and the Ministry of Interior, depending on their missions and situation, civil fire formations, sanitary-voluntary formations, other parties, employees, students, students and other able-bodied citizens. + Article 39 Organization, management, principles of use of inspectorates, commissions, military units and civil protection formations, in the action of limiting and removing the consequences of attacks or disasters, as well as operational plans. prepared for this purpose, are established by regulations and specialized instructions, developed by the Civil Protection Command and approved by the head of civil protection in Romania. + Article 40 The asanarea of the land and the neutralization of munitions left unexploded shall be executed by the specialized subunits and specialists of the Civil Protection Command and the county civil protection inspectorates or of the city of Bucharest. + Article 41 The ministries, the other central and local public administration authorities, public institutions and economic agents, as well as citizens who are aware of the existence of the remaining unexploded munitions have the obligation to announce, immediately, the the nearest police or the civil protection inspectorate, in order to execute the work of asanating the land from the remaining unexploded munitions. + Article 42 The munitions shall be destroyed in polygons of the Ministry of National Defence or on land provided by the local public administration authorities, on whose administrative-territorial range is carried out asanation works. The land set for the destruction of the ammunition is arranged according to the specific instructions and technical norms, developed by the Civil Protection Command, in strict compliance with environmental factors. The local public administration authorities or, as the case may be, the public institutions and economic agents shall ensure the military subunit, which executes the land of the remaining unexploded munitions, the access to the land, the auxiliary working mine, means of transport, materials, health assistance, as well as accommodation and feeding of the necessary herds. + Article 43 The explosive materials and the means of ignition necessary for the destruction of the remaining unexploded ordnance shall be made available to pyrotechnic specialists, at the request of the Civil Protection Command and the county civil protection inspectorates and of Bucharest, by the Ministry of National Defence and by the territorial police bodies, as the case may be. The value of explosive materials and ignition means shall be borne by the Ministry of National Defence. + Chapter 6 Tasks of public administration authorities, public institutions, economic agents and citizens, to carry out protection measures Civil + Section 1 Joint tasks of central public administration authorities and local, public institutions and economic operators + Article 44 Local public administration authorities, public institutions and economic agents are obliged to ensure the protection of the population, employees and material goods in case of disasters or during war, in which purpose they meet the following common tasks: a) organize and provide the necessary personnel for the framing of the inspectorates, commissions and civil protection formations of their own, as well as their preparation on the basis of civil protection plans drawn up in time of peace; b) organize and execute, with actual and technical means, the limitation and removal of the consequences of attacks from air or disasters; c) informs the Civil Protection Command, the county civil protection inspectorates, the city of Bucharest and its sectors about exceeding the allowed values of the quality of environmental factors and the occurrence of disasters, as well as entry into the country, transit or storage on the territory of Romania of toxic or radioactive substances; d) establish specific methods and procedures for the protection of the population; e) ensure and carry out, on the basis of the plans drawn up in peacetime, the necessary means and measures for the notification, alarm, protection and preparation of the management bodies, employees, population, as well as the protection of the collectives of animals and material goods, in the case of air or disaster attacks, according to the rules established by the Civil Protection Command; f) establish the possibilities of use for housing, by using the galleries, tunnels, mines, other underground constructions specific to their own activity, as well as the natural properties of the land and draw up the technical documentation for their arrangement as housing for civil protection in times of war or disaster; g) provides the general plans with the construction sites, facilities and access to the subsoils of their own constructions, which they provide to the civil protection inspectorates, the police and the fire brigade; h) organizes and ensures the evacuation of the population, employees, collectives of animals and some material goods in special situations, in accordance with the provisions of the plans drawn up for this purpose and in relation to the situation created; i) execute, based on the topics established with the agreement of the Civil Protection Command, studies, scientific research, manufacturing documentation, projects and experiments, in order to improve and improve the measures and means of protection Civil; j) submit proposals on the classification of economic agents, based on the criteria established by the Civil Protection Command; k) provides the material and financial means necessary to build, arrange, modernize and maintain the command points, shelters, notification and alarm system, means of protection and intervention, preparation process, as well as the other civil protection measures of their own and subordinate units; l) study and determine how to use and adapt technical means and equipment for civil protection needs; m) ensures the technical and material endowment of civil protection formations, according to the norms developed by the Civil Protection Command; n) organize and ensure the storage, preservation, maintenance and record of technical means and materials intended for civil protection; o) provide teaching materials and spaces necessary to prepare for civil protection; p) ensure the application of masking measures, as well as the camouflage of light and caloric sources; r) ensures periodically, through the written press and local audiovisual means, the training with elementary notions of citizens, on the main measures that they must take in case of disaster; s) constitute, in the field of disaster defense, disaster defense commissions, according to the law; t) perform any other duties related to civil protection, according to the law. The Department for Local Public Administration, together with the Civil Protection Command, coordinates the activity of applying civil protection measures locally and organizes the preparation of personnel categories with duties in the field of civil protection, established by Government decision. + Section 2 Specific tasks of central public administration authorities + Article 45 The Ministry of National Defence in collaboration with the authorities of the central specialized public administration shall carry out the civil protection measures, through the Civil Protection Command, for which purpose: a) develop regulations, instructions and norms on the organization, endowment and use of inspectorates, commissions, units and civil protection formations, execution of missions and duties of the authorities public administration, public institutions and economic operators; b) organizes, directs and controls the civil protection training of personnel assigned to civil protection, as well as of the population; c) periodically analyze, together with the public administration authorities, the stage of implementation of civil protection measures; d) submit reports and proposals to the Supreme Council of National Defence, on the implementation of civil protection measures; e) organize and ensure the notification of the management bodies from some central specialized public administration authorities, from counties and localities, about the danger of air attacks, radioactive, chemical and biological contamination, such as alarming the population; sets air alarm signals, disaster alarm, chemical alarm and alarm cessation; f) ensure the endowment of materials in time of peace and war of the Civil Protection Command, inspectorates, subunits and military units of civil protection, based on the norms established by the Civil Protection Command; g) leads and coordinates, through the Civil Protection Command, the county civil protection inspectorates, the city of Bucharest and its sectors, the actions to limit and eliminate the consequences of attacks or disasters; h) participate with units and subunits of their own structure when carrying out the control of radioactive, chemical or biological contamination, as well as decontamination of the land, population and material goods in the affected areas; i) verify the application of civil protection measures to subordinate units and formations; j) ensure the preparation of the population and employees in civil protection issues through the use of mass media; k) endorses the projects of the material, technical and financial insurance plans, for civil protection, of public administration authorities; l) control the activity of radioactive and chemical surveillance of the environment and the realization of measures to protect the population, large animal collectives, material goods, as well as natural flora and fauna; m) participates through its institutes specialized in the execution of scientific studies and research on the implementation and application of civil protection measures; n) establishes the degree of protection for the command points intended for the Presidency, the Parliament and the Government of Romania and ensures, through the specialized bodies of civil protection, their state of operativeness, with the material means and financial resources made available by the beneficiary institutions; o) draw up the plans and thematic of education for the preparation of military units from military units, in the field of civil protection. + Article 46 The State Office for Special Issues shall exercise the following tasks: a) includes in the plan to mobilize the national economy the proposals for the implementation of civil protection measures, developed and coordinated by the Civil Protection Command, based on the requests of the public administration authorities, as well as the public institutions and economic operators; b) establish the civil protection measures to the subordinate bodies and units and ensure their realization, on the basis of this law, of their own regulations and instructions; c) organize and keep records of the population who are evicted in situations of war, as well as in case of disasters; d) ensure the security of the remaining unexploded ordnance and land in the process of asanation; e) organize the intervention of own specialized formations to prevent and extinguish fires, during civil protection actions; f) reorganizes the general security systems in the localities, establishes the measures to ensure the security of public institutions and important economic agents and verifies the operation of their security; g) controls, directs and directs the movement of motor vehicles and pedestrians, depending on the situation created, and participates in ensuring the measures established at central and local level on the civil protection line; h) participate in the verification of the application of measures to cloak the lights in the localities, as well as the means of transport + Article 48 Ministry of Industries exercises the following tasks: a) establish through economic agents, which produce, process, manipulate, store, use or transport industrial toxic substances, chemical accident prevention measures, chemical risk areas, degree of danger for employees, population and animals, intervention measures in the event of chemical accident, methods, procedures and means of protection of employees, population, animals, crops and material goods; b) collaborates, through the Civil Protection Command, with the Ministry of National Defence and other interested ministries, in establishing methods, procedures and means of masking, protection, chemical research, decontamination, detention of radioactive substances and biological agents; c) ensure the realization, from time of peace and at war, of the needs of: medicines, radioactive substances and preparations and antidotes; substances and mixtures of chemical, radioactive and biological decontamination; materials and apparatus for protection the skin, the airways and the retention of harmful agents; d) ensure the stability and uninterrupted functioning of the national energy system in conditions of war or disaster; e) establish the floodplains for hydrotechnical dams; ensure the notification and alarm of the population downstream of them; f) provides, by contract, the electricity supply of the civil protection command points; g) coordinate, in special situations, the application by the subordinate units of the measures of camouflage of public lighting; h) establishes and ensures the application of all nuclear safety measures, drawing up and implementing civil protection and intervention plans for power plants; i) participate, with the specialized staff and technique, from subordinate units, to interventions to remove the consequences of attacks or disasters; j) ensures, on a contract basis, the permanent operation, verification, maintenance and repair of electric sirens through the county, municipal and city branches. + Article 49 The Ministry of Agriculture and Food exercises the following tasks: a) establish, together with the Civil Protection Command, the measures for the protection of animals, crops, cereals, fodder, raw materials and agri-food products and ensure that they are carried out in time of war or disasters; b) establish rules on the use of soil, animal and plant products, raw materials, contaminated agri-food products, depending on the nature and extent of contamination; c) provide equipment and personnel for the control of radioactive, chemical or biological contamination of soil, crops, raw materials and agri-food products; d) ensure the stocks of medicinal products and biopreparations for the conduct of veterinary and phytosanitary actions; e) participate in the decontamination actions of animals, raw materials, agri-food products and other goods from agricultural units with majority state or private capital of the food industry, using the personnel and technique in the units subordinate. + Article 50 The Ministry of Health exercises the following a) coordinate and provide medical-health assistance in times of war or disaster; b) ensures the radioactive, chemical and biological control of the environment, food and population; pursues and ensures the strict application and observance of sanitary-hygienic and anti-epidemic norms; c) issue, with the agreement of the Ministry of National Defence, instructions on the organization, endowment and functioning of medical-sanitary formations, intended for emergency medical assistance of victims of the population, in time of war or of disasters; d) check together with the Civil Protection Command, through training and exercises, the preparation for intervention of medical-sanitary formations and ensure, together with the county and local councils, their technical-material basis; e) provide the necessary stocks for equipping medical-sanitary units with the necessary equipment for investigations in case of radioactive, chemical, biological contamination and supply of the necessary equipment and quantities of equipment and instrumentation medical, blood and substitutes, medicines, biopreparations and other means necessary for the provision of healthcare; f) organizes the training of medical-health professionals in the specific problems of providing medical assistance in times of war or disaster. + Article 51 The Ministry of Transport shall: a) establishes, together with the Civil Protection Command, the collective protection measures of travelers located in railway stations, metro, bus stations, airports, ports and locks and ensures, through the economic agents in the field, the realization their civil protection measures, according to the international regulations to which Romania is a party; b) establishes on the basis of a joint plan, with the Ministry of Health and public administration authorities, the necessary means of transport to be provided by the economic agents in the field, for the actions of evacuation, intervention and transport the injured; c) participate with their own health facilities, together with the territorial emergency services of the Ministry of Health, on the basis of a joint plan, to provide emergency medical assistance to victims within the area of responsibility; d) establish and ensure, together with the Ministry of National Defence and the Ministry of Health, the technical means necessary for the control of radioactive and chemical contamination and the execution of decontamination operations of means of transport in the responsibility; e) execute civil protection works on the subway, financed from the state budget, and ensure their exploitation and maintenance. + Article 52 The Ministry of Public Works and Spatial Planning exercises the following tasks: a) participate, together with the Ministry of National Defence, in the elaboration of the instructions for the design and execution of the command points, the civil protection shelters, as well as the access routes to them; b) develop options for the use of means provided for interventions to objectives of vital importance, damaged, in order to restore their capacities; c) aims to achieve in peacetime the objectives of landscaping and preparation of the territory, intended for the protection of the population and material goods in times of war or disaster. + Article 53 The Ministry of Communications exercises the following tasks a) perform studies and research, in collaboration with the Civil Protection Command, for the development and modernization of the means of transmission, notification and alarm for civil protection; b) execute with priority the installation, verification, maintenance and repair of means of transmissions for civil protection, on the basis of contracts concluded with the beneficiaries; c) ensure the stability of permanent functioning of central and local radio and television stations and other means of telecommunications, in order to notify and alarm the population, to declare mobilization, state of war and in case of disasters, as well as the links necessary for the implementation of civil protection measures. + Article 54 The Ministry of Education exercises the following tasks a) establish and ensure from time of peace, together with the public administration authorities, the measures on the organization and functioning of education of all grades, in time of war; b) draw up together with the Civil Protection Command, the curriculum and the educational topic for the training of students and students in the field of civil protection; provide the staff and the teaching material necessary for these activities. + Article 55 The National Audiovisual Council, in the exercise of its legal powers, establishes binding rules on: a) ensuring the information of the population on the knowledge and application of civil protection measures; b) the transmission of signals to prevent the population about the danger of air attack, radioactive contamination, chemical or biological agents and other communiqués on the application of civil protection measures. + Article 56 The Ministry of Water, Forestry and Environmental Protection exercises the following tasks: a) perform meteorological, hydrological surveillance, radioactive, chemical and biological contamination and environmental factors; b) establish risk areas, in the event of flooding and other hazardous hydrotechnical and meteorological events; c) ensure the notification of local civil protection bodies, the Civil Protection Command and the alarm of the population downstream of dams or other hydrotechnical works of their own; d) establish methods and procedures for the decontamination of water and other environmental factors, as well as permissible norms for the use of contaminated water; e) establish rules of endowment, ensure, with the necessary equipment and materials, the network of control and surveillance of contamination of environmental factors and training of subordinate personnel. + Article 57 The National Red Cross Society of Romania exercises the following tasks: a) ensure the organization, framing and functioning of sanitary detachments and first aid posts, as well as the preparation of Red Cross sisters through the branches of the County Red Cross, sectors and the city of Bucharest, in order to participate to the action for the first aid to victims, as well as to the application of collective hygiene rules in the event of war or disaster; b) participate in the realization of sanitary measures, the evacuation of the population, as well as the help of sinister; c) participate in the preparation of the population through mass sanitary courses, for the first aid in case of war or disaster. + Section 3 Specific tasks of local public administration authorities + Article 58 The local council shall exercise the following a) approves the organizational structure of civil protection in the locality; b) assign and stagger funds for civil protection, with the approval of the local budget; c) manage, store, maintain and preserve the technique, equipment and civil protection materials; d) approve the modalities of notification and alarsea of civil protection in the locality, as well as the measures of individual and collective protection of the population, animal collectives and material goods; e) approve the measures proposed by the head of civil protection to remove the consequences of disasters or attacks in the air. + Article 59 The Mayor exercises the following tasks a) leads the subordinate inspectorate and civil protection activity locally; b) proposes to the local council the organizational structure of civil protection in the locality c) appoint in office, with the opinion of the county civil protection inspectorate, the city of Bucharest or its sectors, the head of the civil protection inspectorate; establishes the headquarters of the civil protection inspectorate and the place of the point the order; d) provides in the draft local budget the funds necessary to carry out the investment works, the endowment of the command points and shelters, the endowment with the technique and materials of civil protection formations, as well as those necessary to achieve the other civil protection measures; e) approves the operational plans and preparation of civil protection formations and proposes to the local council measures for the proper functioning of the notification and alarm system, maintenance of the shelter fund and protective materials Civil; f) take measures to prevent and limit the consequences of catastrophes, calamities, fires, epidemics or epizootic diseases, together with the specialized bodies of the state. For this purpose it can also mobilize the population, economic agents and public institutions in the locality, which are obliged to execute the established measures; g) participate in training summons, exercises, applications and other civil protection activities organized according to the law; h) ensure the implementation of civil protection measures established by the head of county civil protection; i) analyzes and periodically informs the local council about the state of implementation of civil protection activities. + Article 60 The county council and the General Council of Bucharest, through the subordinate specialized services, exercise the following tasks: a) ensure the distribution, together with the general direction of public finances and financial control of the county state and of the city of Bucharest, of funds for the realization of investment works, endowment and conduct of protection activities civil, on the basis of budget projects of each administrative-territorial unit; b) manage, store, maintain and ensure the preservation of the technique, equipment and civil protection materials and provide storage spaces for the necessary materials for disasters; c) provides the county civil protection inspectorate, the city of Bucharest and its sectors, as well as the civil protection formations organized by them, the logistics, equipment and civil protection materials for training and intervention; d) ensure the premises, organize security, fire prevention and security of material deposits, command points and premises of county civil protection inspectorates, Bucharest municipality and its sectors. + Article 61 The Prefect exercises the following tasks: a) ensure and control compliance with the provisions of the civil protection law, through the civil protection inspectorate, at all local public administration authorities, public institutions and economic agents within the administrative-territorial area; b) proposes the organizational structure, operative plans and preparation for civil protection, elaborated by the civil protection inspectorate; c) approve the conception and execution of applications, alarsea exercises and other training activities conducted by the civil protection inspectorate; d) respond, under the conditions established by law, to the implementation of measures to remove the consequences of attacks of the enemy and of disasters; e) presents to the administrative commission draft decisions on the completion of the system of notification and alarm of the population, the shelter fund, the material base and other measures to protect the population and material goods; f) is responsible for the alarm, protection and preparedness of the population in nuclear, chemical, biological or downstream risk areas of hydrotechnical dams; g) approves the list of economic agents, public institutions in the county, respectively in Bucharest, which provides the composition of civil protection formations at administrative-territorial level. + Section 4 Specific tasks of public institutions and economic operators + Article 62 Public institutions and economic operators, which produce, process, manipulate, store, use or transport toxic substances, radioactive substances or biological preparations, as well as owners of hydrotechnical dams, shall also exercise the following tasks: a) establish measures to prevent accidents, risk areas and the degree of danger to the population and to the environment, protection and intervention measures and provide equipment and specialized technical assistance in the affected areas; b) establish and carry out the civil protection measures of their employees and property; direct the intervention actions; c) inform the county civil protection inspectorates, the city of Bucharest and its sectors about the entry into the country, transit or storage of toxic or radioactive substances; d) organize and execute the control of radioactive, chemical and biological contamination of raw materials and finished products and carry out the decontamination measures of personnel, land, buildings and machinery; e) organize and ensure the participation in the civil protection training of personnel assigned to commissions, civil protection parties and employees; f) notifies persons and bodies with attributions in the field about the danger of disaster. + Article 63 Central and local public administration authorities, public institutions and economic agents will take measures to distribute and ensure the necessary spaces for civil protection activities. + Section 5-a Obligations and rights of citizens to carry out measures civil protection + Article 64 For the implementation of civil protection measures citizens have the following obligations: a) to participate in the preparation for civil protection, in order to acquire the knowledge and skills necessary to achieve this activity; b) comply with the rules and measures of protection against destructive factors of mass destruction weapons, conventional weapons, incendiary means and disasters; c) to carry out and maintain the shelters of collective interest or to arrange the sheltering spaces in the buildings or on the personal property land, according to the law; d) to provide personal means of protection, sanitary kit, food and water supply, other materials necessary to ensure protection and to participate in the execution of intervention actions; e) to participate in actions to limit and eliminate the consequences of enemy attacks, to locate and remove the consequences of disasters; f) to meet all the measures established by the civil protection bodies. + Article 65 Citizens participating in civil protection actions shall have the following rights: a) receive free medical assistance, medicines, hospitalization and pension for accidents or diseases that occurred during training sessions or participation in civil protection intervention actions; b) they are provided with means of transport and protection during the preparation or conduct of civil protection intervention actions; c) receive free food and accommodation during participation in actions to limit and remove the effects of attacks of the enemy or disasters; d) can be rewarded, by awarding diplomas, badges or other insignia, money or material goods, if it is highlighted in the framework of civil protection actions. + Chapter 7 Financial and financial insurance of civil protection + Article 66 The endowment and endowment of materials in time of peace and war of the Civil Protection Command, county inspectorates, subunits and military civil protection units shall be provided by the Ministry of National Defence on the basis of Endowment approved by the head of civil protection in Romania. + Article 67 The endowment of materials of inspectorates, commissions, civil protection formations, command points and population, in time of peace and war, is carried out according to the endowment norms developed by the Civil Protection Command. + Article 68 The coordination of insurance with specific technical and civil protection materials shall be carried out by the Civil Protection Command, on the basis of the proposals of public administration authorities and public institutions, as well as of economic agents. The contracting and supply of material goods shall be ensured by each beneficiary, for a fee. The technique and other categories of materials necessary for civil protection can also be provided through requisitions and sponsorships, according to the law. + Article 69 The bodies and authorities of public administration, public institutions and economic agents have the obligation to satisfy the orders of materials and technique necessary for civil protection, in full and within the deadlines established by contracts, in time of peace and, With priority, in time of war. + Article 70 The financing of investment and development objectives, at national level, for civil protection, shall be ensured from the state budget from the funds provided for in the chapter "Expenses for civil protection". The investment and development objectives are established by the Government, at the proposal of the Civil Protection Command. + Article 71 Funds for the realization and conduct of civil protection activities at national, county, Bucharest and its sectors, cities and communes shall be provided from the state budget and local budgets, as the case may be, from the chapter "Expenditure on civil protection", as well as from other legal funds established on the basis of endowment and expenditure plans, drawn up and approved in this regard. The objectives and money funds proposed are endorsed by the Civil Protection Command to be agreed with the strategy of development programs in the territory. The foundation of the plan figures is carried out in agreement with the civil protection committees, which follow and control how to spend the allocated funds. + Article 72 The money funds necessary to carry out civil protection measures at public institutions and economic agents shall be ensured from their own budgets and resources or from other legally constituted funds. + Article 73 The teaching materials necessary for civil protection, such as: films, diafilms, boards, manuals, brochures, leaflets and others are carried out and ensured, for a fee, by the Ministry of National Defence and broadcast to the public administration authorities, public institutions and economic operators. Public administration authorities, public institutions and economic agents, with the agreement of the Civil Protection Command, civil protection inspectorates can realize materials of popularization of civil protection, radio and television broadcasts, like other activities. The materials for the marking of fire, necessary to prepare through applications and exercises, ensure, without payment, the Ministry of National Defence. + Article 74 During civil protection training, courses or summonses with removal from production, exercises, applications and other forms of training for civil protection, participants receive the salary, money and transport rights. accommodation from the units in which they are classified, according to the legislation in force and the provisions of the collective agreement. + Article 75 The personnel of the inspectorates, commissions and civil protection parties, during the intervention, applications or training activities, wear uniforms with the insignia of civil protection, and the value of the uniforms shall be borne by public administration authorities, public institutions and economic operators. The model of uniforms and their port shall be determined by instructions approved by the Ministry of National Defence. Vehicles intended for civil protection shall bear separate insignia and shall be equipped with technical means necessary for links and warning. + Article 76 The storage, maintenance, repair and record of civil protection goods, as well as their duration of use shall be established according to the technical norms developed by the Civil Protection Command. + Article 77 The civil protection command and the county civil protection inspectorates, the city of Bucharest and its sectors keep the statistical record of goods from the endowment of civil protection formations and control the existence, quality, maintenance and use. + Chapter 8 Sanctions + Article 78 It constitutes contraventions and the following facts are sanctioned, if they are not committed under such conditions that, according to the criminal law, they constitute crimes: a) refusal to organize, endow and train civil protection formations, according to art. 44 44 para. 1 lit. a), k), m) and o); art. 58 lit. a); art. 59 lit. b), d), e), g); art. 60 lit. a), c), d); art. 61 lit. b) and g); art. 62 lit. e) and art. 69 69; b) failure to notify the authorities in law of disasters, according to art. 37 37 para. 2; art. 44 44 para. 1 lit. c); art. 48 lit e); art. 56 lit. c) and art. 62 lit. c) and f); c) non-announcement immediately of the discovery of the remaining unexploded munitions and failure to ensure the conditions of asanation and destruction of ammunition by specialized units, according to art. 41 41 and art. 42 42; d) the use of means and systems of transmission-alarm, technique, equipment, materials and civil protection equipment for purposes other than those for which they are intended; operating them, according to art. 29 29 para. 2; art. 35 35 and art. 53 lit. b); e) non-maintenance of means of transmission-alarm of command points and sheltering spaces, as well as of the technique for civil protection, according to art. 48 lit. j); art. 53 lit. c); art. 58 lit. c) art. 60 lit. b) and art. 64 lit. c); f) refusal to carry out measures to prevent and protect people, the environment and material goods, to participate in civil protection training or intervention actions, according to art. 21; art. 48 lit. a) and i); art. 49 lit. a), c), d) and e); art. 50 lit. b) and e); art. 51 lit. a) and e); art. 59 lit. f); art. 61 lit. f); art. 62 lit. d) and art. 64 lit. a) and e); g) non-preparation of operative documents for planning, organization, endowment and management, specific to civil protection, according to art. 39; art. 44 44 para. 1 lit. e), g) and h) and art. 62 lit. b); h) preventing, in any form, the control bodies to exercise their duties, according to art. 10 10; i) the issuance of civil engineering permits, without the opinion of the military bodies provided for in the law, 33. + Article 79 The contraventions provided in art. 78 78 shall be sanctioned, as follows: a) with a fine of 500,000 lei to 1,000,000 lei, the contraventions provided in art. 78 lit. c), g) and h); b) with a fine of 1,000,000 lei to 2,000,000 lei, the contraventions provided in art. 78 lit. a) and i); c) with a fine from 2,000,000 lei to 3,000,000 lei, the contraventions provided in art. 78 lit. b) and d); d) with a fine from 3,000,000 lei to 4,000,000 lei, the contraventions provided in art. 78 lit. e); e) with a fine from 4,000,000 lei to 5,000,000 lei, the contraventions provided in art. 78 lit. f); + Article 80 The finding of contraventions and the application of sanctions shall be made by the head of civil protection from the public administration authorities, as well as by persons with control powers, empowered by the commander of the Civil Protection Command. + Article 81 Against the minutes of finding the contravention and applying the sanction, the offender can make the complaint to the court within 15 days of communication. + Article 82 The regime of contraventions in this law shall be completed and updated accordingly with the provisions Law no. 32/1968 establishing and sanctioning contraventions. + Chapter 9 Final provisions + Article 83 On the date of entry into force of this Law, the Law no. 2/1978 on civil defence in the Socialist Republic of Romania, published in the Official Bulletin no. 24 24 of 27 March 1978, Decree no. 430/1978 on some measures for civil defence, published in the Official Bulletin no. 103 103 of 15 November 1978, Government Decision no. 531/1992 on the implementation of civil defence measures, published in the Official Gazette of Romania, Part I, no. 233 233 of 22 September 1992, as well as any other provisions to the contrary.
