Piatra Neamt until December 28, 2005, with the modifications and additions made by EMERGENCY ORDINANCE no. 193 193 of 22 December 2005 . + Chapter 1 General provisions + Article 1 Wild animals of hunting interest, contained in Annexes no. 1 and 2, referred to in the present game law, together with their biotopes, constitute the moviegoing fund of Romania. + Article 2 (1) The Romanian hunt, the renewable natural resource of national and international interest, is managed and managed for the conservation of wildlife biodiversity, maintenance of ecological balance, hunting and satisfaction other social-economic requirements. (2) The hunting is a public good of national interest. + Article 3 (1) The moviegoing fund of Romania consists of moviegoing units, called hunting funds, constituted on all categories of land, regardless of the owner, and thus delimited as to ensure as much stability as possible the game in their contents. (2) I take exception to the provisions of par. (1) the areas located in the intravilan of the localities, the surfaces of the national parks and the scientific reserves with total protection, during their existence. (3) The surface of a hunting fund will be at least 5,000 ha at the plain and in the Danube Delta, 7,000 ha at the hill and 10,000 ha in the mountains. (4) The minimum area required for a hunter member is: -150 ha in the lowland area and in the Danube Delta; -350 ha in the hill area; --400 ha in the mountain area. + Article 4 The management of hunting funds shall be assigned by the central public authority responsible for forestry to the legally constituted hunting organizations in Romania, to the administrator of the state forests, educational establishments and units of scientific research with kinetic profile in Romania, called, for the purposes of this law, managers of hunting funds. + Article 5 (1) The hunting organizations, established on the principle of free association of hunters, are non-profit organizations, have legal personality, distinct heritage and are affiliated, for the purpose of representation at national and international level, at the Association General of Hunters and Sports Fishermen in Romania. (2) The General Association of Hunters and Sports Fishers of Romania, legal person of public utility, ensures the performance of the tasks established by the central public authority responsible for forestry, for the purpose of sustainable management of hunting from hunting funds assigned to affiliated organizations, according to this law. (3) The affiliation of the hunting organizations to the General Association of Hunters and Sports Fishers in Romania is made according to the law and its statute. + Article 6 The pursuit of hunting is done for recreational-sports, didactic or scientific research, aiming at ensuring ecological balance and improving the quality of the game. + Chapter 2 Administration and management of the Romanian kinetic fund + Article 7 (1) The management of the hunting fund of Romania shall be carried out by the central public authority responsible for forestry. (. For that purpose, a separate body specialising in the field of hunting shall be established within the central public authority responsible for forestry. + Article 8 (. The central public authority responsible for forestry shall have the following main tasks in the field of hunting: a) elaborates the strategy on the hunting fund of Romania; b) determine the criteria for the award of the right to manage the hunting funds and the framework content of the management contracts; c) establishes the minimum rates for the award of the management of hunting funds and the level of minimum tariffs charged to Romanian and foreign hunters for hunting actions in Romania; d) develop the methodology for the evaluation of the game numbers, the calculation of annual harvest quotas and the regulations of organization and practice of hunting; e) establish the optimal hunting numbers and approve the annual harvest quotas, including those intended for hunters with foreign tourists; f) modify, in justified situations, the legal hunting periods for some species of game; g) approves the proposals for the popular hunting funds with new hunting species; h) establishes, together with the representatives of the relevant ministries, the necessary measures to maintain the agro-forestry balance and to prevent damage caused by hunting and hunting for agricultural crops, domestic animals and forest fund; i) keep track of the evolution of game numbers, the dynamics of crops and the record of game and medal trophies; j) ensure, from the hunting protection fund, the financing of actions to restore the hunting potential of some hunting funds; k) avizes the curricula for the subjects that have as object of study hunting and hunting and approve the scientific research programs in the field of hunting; l) control the kinetic activity at all levels; m) organizes directly and coordinates the activity of combating poaching; n) establish the information system in the field of hunting; o) establish the criteria for granting the operating licence to managers of hunting funds; p) grants the operating license to the managers of hunting funds; r) realizes and organizes, together with the Ministry of Justice, the attestation of technical experts s) attest to volunteer hunting inspectors; t) control compliance with contractual clauses by the managers; u) sets the breeds of dogs admitted to hunting in Romania; v) establishes weapons and munitions that can be used in hunting in Romania and endorses the approval of domestic manufacturing; w) initiate actions to popularize the kinetic activities and to educate the population in the field; x) participate in or support, as the case may be, the program of international collaborations in the field of hunting; z) adopt any other necessary measures, in accordance with the legal provisions on kinetic activity. (2) The attributions provided in par. ((1) lit. i), l), m), p), t), w) and x), as regards affiliated hunting organizations, shall also be exercised through the General Association of Hunters and Sports Fishers in Romania, and in the case of the other duties listed in the law the public authority the central will consult with the General Association of Hunters and Sports Fishermen in Romania. + Article 9 The National Hunting Council, approval body and consultation in the field of hunting shall be established, in addition to the central public authority responsible for forestry, composed of: a) President of the General Association of Hunters and Sports Fishermen in Romania; b) the head of the body provided in 7 7 para. ((2); c) general manager of the state forest manager; d) three representatives of hunting organizations in Romania, designated by the Congress of Romanian hunters and fishermen; e) two representatives of the body referred to in art. 7 7 para. ((2); f) two representatives of the state forest manager and, optionally, one representative of the administrations of the communal forests and private property forests; g) a representative of the Romanian Academy; h) one representative from the fields: higher education of profile, kinetic research, agriculture, finance, police, audio-visual, justice and parquet. + Article 10 The National Hunting Council has the following tasks: a) endorses the proposals of administrative acts of the body provided for in art 7 7 para. ((2) concerning: -strategy in the field of protection and development of the hunting fund; -the criteria and minimum rates for the award of the right to manage the hunting funds and the content of the contract model; -the modification of the hunting periods of some game species; -breeds of dogs admitted to hunting in Romania; -approval and authorization of weapons and ammunition that can be used in hunting in Romania; -the methodology for the evaluation of the hunting herds, the calculation of the optimal numbers and the annual harvest quotas, the regulations on the organization and practice of hunting with Romanian and foreign hunters; -the criteria for granting the operating licence for the management of hunting funds; b) proposes measures of popularization and knowledge of the kinetic activity, as well as of the strategy adopted in order to maintain the biodiversity of the kinetic fauna, the preservation of ecological balance and the rational exercise of hunting. + Article 11 (1) The National Hunting Council operates on the basis of its own organization regulation, adopted by the consensus of its members, within 30 days from the entry into force of this law. (2) The position of member of the National Hunting Council is honorary and entitles to transport allowance and per diem for participation in meetings. (3) The technical secretariat and the financing of the activity of the National Hunting Council shall be ensured by the central public authority responsible for forestry. + Article 12 (1) The award of the right of management of hunting funds, for the purposes of this law, shall be made by the central public authority responsible for forestry, in compliance with the right of pre-emption of the former manager, or by auction public. (. Public tender shall be organised in the case of hunting funds for which the right of pre-emption is not exercised and in the case of hunting funds for which the management contracts have ceased, for any reason, the validity before term. (. For the hunting funds thus awarded, management contracts shall be concluded for a minimum of 10 years. ((4) The hunting funds for scientific research and the educational process shall be established and assigned by order of the head of the central public authority responsible for forestry. (5) The allocation of hunting funds shall be made within 60 days from the date of termination of any previous management contract. (6) During the period from the termination of the previous management contract until the new management of the hunting fund under the new contract is effectively taken into account, the management of the hunting fund shall be ensured by the former manager. (7) For the duration provided in par. (6) the rights and oblibations of the manager are those provided in the previous contract. (8) The management of hunting funds may exchange the management of hunting funds for the purposes of merging, with the prior opinion of the central public authority responsible for forestry. (9) The hunting funds assigned to the legally constituted hunting organizations in Romania and left uncontracted for 6 months shall be assigned to the administrator of the state forests. + Article 13 (1) The hunting acquired under the law, within the limits of the approved harvest quotas, shall be capitalized by the hunting fund manager. ((2) The hunt resulting from illegal actions in which the manager is not involved, the game found dead and the horns denied by cervide belong to the hunting fund manager. + Article 14 ((1) Civil liability for damage caused by hunting of species listed in Annex no. 1 returns to the manager of the hunting fund, and for those caused by the hunting of the species set out in Annex no. 2 2, to the central public authority responsible for forestry. (2) For the damage caused by hunting of strictly protected species the compensation is borne primarily from the hunting protection fund. ((3) The damage is found, under the law, at the request of the injured person, submitted to the hunting fund manager and to the local council within a maximum of 3 days from the date on which the injured person found the damage, by a commission consisting of the representative of the local public administration, from the authorized manager of the hunting fund and the injured person, who conclude for this purpose an ascertaining act. (4) In case of failure to present the authorized hunting fund manager within 48 hours of its announcement, the damage finding will be done by the representative of the local public administration in the presence of two witnesses and the person Damage. ((5) The letters shall be settled by the courts. ((6) The damage caused by the game, those caused to the game by illicit acts which have as object the game, as well as the amount of compensation shall be surveyed by the technical hunting experts. The expenses of expertise will be borne later by the one who produced the damage. + Article 15 ((1) The holders, with any title, of the land on which hunting funds are aronded, natural or legal persons, are obliged to allow the pursuit of hunting, the application of the protection measures of the game, as well as the location of the installations and provisional hunting facilities, if the basic land use is not affected by those actions. (2) The owners of the land are obliged to take the measures provided by law for the protection of the game and its living environment and are responsible for the damage they produce through illicit actions. (3) The administrator of the state forests shall ensure, free of charge, in the forest fund, free land of forest vegetation for the cultivation, storage and distribution of complementary food of the game, in the area of at least 1 ha per 1,000 ha of forest in the mountain area, 2 ha to 1,000 ha of forest in the hill area and 3 ha to 1,000 ha of forest in the area of plain, ostroave, puddles, wooded fields and in the Danube Delta. (4) The pheasants in the system of the General Association of Hunters and Sports Fishers of Romania, existing in the forest fund, public domain of the state, on the date of entry into force of this Law, are exempt from the payment of tariffs and Rents. (5) For the fulfilment of the obligations provided in par (1), (2) and (3) holders of land on which hunting funds are aronded are entitled to benefit directly, in the case of properties equal to or greater than 100 ha, and indirectly, through local budgets, in the case of properties of less than 100 ha, of 50 50% of the amount of the annual allocation of the management of the hunting funds. + Article 16 ((1) The expenses of the central public authority responsible for forestry, related to the kinetic activity, shall be borne by the state budget and the hunting protection fund. (. The game protection fund shall consist of the following sources: a) income from the allocation of the management of the hunting funds, 50% of the award fee; b) 25% of the amount of compensation for damages to the hunting fund through illicit acts; c) revenues made from the collection of tariffs for the granting of the operating license for hunting organizations and commercial companies that broker hunting actions; d) donations and sponsorships; e) other income. (. The game protection fund shall be administered by the central public authority responsible for forestry and shall be used for: a) actions to restore the biogenic potential of some hunting funds, to combat some epizoots in the game; b) the organization and conduct of prevention and control activities; c) stimulation of persons who directly support the activities of combating poaching and those who detect the authors of such facts; d) organization, conduct and participation in scientific and representation at national and international level in the field of hunting; e) financing of projects, studies and research in the field of hunting; f) the financing of professional training actions in the field of hunting. (. The unused amounts of the game protection fund in a calendar year shall be carried over to the following year. + Chapter 3 Hunting protection + Article 17 (1) The management of hunting funds shall be obliged to ensure the sustainable management of the game, on the basis of expert studies, drawn up for each hunting fund, in view of the period of validity of the contract. (2) Studies will be prepared by specialists and will be subject to the approval of the body provided in art. 7 7 para. ((2). + Article 18 (1) The management of hunting funds shall be obliged to provide security and protection of the game. (2) Protection and security of the game shall be ensured by: a) specialized personnel; b) volunteer hunting inspectors. (3) The staff provided in par. (2) is equipped, under the law, with appropriate weapons and equipment. (4) The staff provided in par. ((2) is assimilated, in the exercise of his duties, with the staff who perform a function involving the exercise of public authority. (5) The number of guard personnel of the game, provided in par. ((2) lit. a), will be at least one for each hunting fund. + Article 19 (1) For the purpose of preserving the biodiversity of mammals and birds of hunting interest, including predatory ones, it is only intended for the approved harvest quota, in compliance with the technical regulations on the organization and practice of hunting. (2) Wild cats and dogs or stragglers shall be shot without restrictions and without obligation to compensation. + Article 20 In order to preserve the genetic background of a sedentary species, there shall be kinetic reserves, delimited and nominated by the central public authority responsible for forestry, in the area of at least 4% and not more than 5% of the area national kinetic fund. + Article 21 (1) In order to increase the numbers of valuable species of game, it may be established, with the agreement of the central public authority responsible for forestry, game farmers, intended for population, where appropriate technologies are to be kept their wild character. (. The production of the game, the production of which is intended solely for consumption, shall be established with the approval of the central public authority responsible for forestry. + Article 22 The population with non-existent game species in hunting funds is based on specialized studies approved by the central public authority responsible for forestry. + Article 23 (1) The capture of the live game is admitted, within the approved harvest quota and in compliance with the technical regulations on the organization and practice of hunting, by methods that do not harm the captured animal and only under the direct guidance of specialist staff. (2) The capture of the game for scientific research purposes and for restocking may also be done during the periods during which the hunting is prohibited or on strictly protected species, with the approval of the central public authority responsible for forestry. + Article 24 For the purpose of the protection and rational management of the game, the following shall be prohibited: a) the population of hunting funds with sick game, debil, degenerate or game breeders intended exclusively for consumption; b) unjustifiably disturbing the peace of the game in times of propagation and growth of chickens; c) grazing in the state forests, as well as the establishment, maintenance and harvesting of agricultural crops without ensuring the protection of the game; d) keeping wild animals in captivity, as well as the establishment of hunting and hunting complexes, including commercial interest, without authorisation from the central public authority responsible for forestry; e) the destruction or degradation of the hunting facilities of any kind, the indicator tablets and the crops for the game; f) free leaving or wearing, on hunting funds, of dogs, including those of security and leisure, other than on leash, unvaccinated and undehelmintized; g) the accompanying of herds and herds, on hunting funds, of dogs, without jujeu regulated by the central public authority responsible for forestry, unvaccinated, unhelmintized and in number of more than three in the mountain area, two in the hill area and one to the plain; h) moving, destroying or evading food intended for hunting; i) the burning of reed, scrub and stubble without the prior written consent of the manager of the hunting fund; j) damage to the nests or collection of wild birds ' eggs; k) appropriation, without the consent of the legal person who manages the hunting fund, of the game found dead, injured or sick and of the horns denied by the cervide; l) the naturalization of wild animals, the processing of game meat and other products of the game, for marketing purposes or as a service provision, without the authorization of the central public authority responsible for forestry; m) the removal from the country of the medals of medaliable game, without the approval of the central public authority responsible for forestry; n) the removal from the country of conventional non-alloy game trophies, without legal export documents; o) land storage or use in fighting plant and animal pests of agricultural and forestry crops toxic chemicals for game, without taking measures to protect it; p) leaving at large, for the purpose of wilderness, poultry and domestic animals; r) production, procurement, marketing and possession of races of any kind intended for the capture or killing of the game, without the approval of the central public authority responsible for forestry. + Chapter 4 Exercise of hunting + Article 25 (1) By hunting, as an action, it is understood the search, stirring, pursuit, hounding, injury, killing or capturing of the game or any other activity with the same purpose. ((2) The hunting is allowed in the game species, under the conditions, in the places, in the periods and with the means established according to this law. (3) In exceptional circumstances, motivated by the maintenance of wildlife biodiversity and the preservation of ecological balance, the central public authority responsible for forestry may establish the restriction or extension of the hunting period to some game species, as well as the limited hunting of strictly protected species. + Article 26 ((1) The hunt shall be exercised only by hunters, owners of hunting permits, targeted annually, and by permits issued by the hunting fund manager, within the limits of the harvest quota and the technical regulations on the organization and practicing hunting. (2) By exception to the provisions of par. (1), may exercise hunting, only on the basis of hunting authorisations issued by the hunting fund manager, the following categories of persons: a) students and students from the authorized educational units, in which they are studied as a discipline, within the training program, hunting and hunting; b) technical hunting personnel, employee of the managers of hunting funds, but only within the limits of their duties; c) foreign nationals who prove the quality of hunter in the country of domicile, as guests, on the basis of reciprocity or against cost and under the direct responsibility of the manager of the hunting fund, but only within the limit of the approved harvest quota and unsolicited by hunters in Romania. (3) Romanian hunters, foreign hunters, technical hunting personnel, as well as students and students who study kinetic in the educational process are obliged to possess insurance against accidents, in order to be able to practice hunting. + Article 27 (1) The hunting permits shall be issued by the hunting organizations licensed under the law of the applicants with Romanian citizenship who are domiciled in Romania and the residents in Romania who have reached the age of 18 years, have completed a year of The internship, took part in a practical training in a hunting shooting range and completed the hunter exam held before an examination committee, constituted at the county level, on the date set annually by the central public authority. which responds to forestry. (4) The hunting permit cannot be obtained by persons who, according to the law, do not have the right to a gun permit or those who, in the last 3 years, have been sanctioned for committing any misconduct provided by this law. (5) The hunting permit will be cancelled: -to the hunter who no longer has the right to a weapon; -to the hunter who committed an act framed as a crime of present law; -the hunter who has lost his membership of the hunting fund management organisation; -to the hunter who refuses to legitimize himself at the request of the staff with control duties in the field of hunting. (6) The withdrawal and cancellation of the hunting permit shall be published in the Official Gazette of Romania, Part III. (7) The forms of hunting permits are documents with special regime, issued and serialized by the General Association of Hunters and Sports Fishers in Romania, according to the model and regulations issued by the central public authority that responds to forestry, and made available to the hunting organizations that have been granted a license to operate. (8) The hunting permits shall be made available to the hunting organizations that have hunting funds under management. + Article 28 (1) The forms of individual or collective hunting authorizations are documents with special regime, issued and serialized by the General Association of Hunters and Sports Fishers of Romania and the National Forest Regia, respectively, according to the the model and regulations issued by the central public authority responsible for forestry. (2) The documents provided in par. (1) may be obtained and used by the management of hunting funds, under the conditions established by the regulations relating to the organization and practice of hunting. + Article 29 In the hunting grounds hunting and the capture of game species for the purpose of improving or reducing their herds may also be done during the periods during which hunting is prohibited, by prohibited means or on strictly protected species, with the approval of the central public authority responsible for forestry. + Article 30 (1) The boars that cause damage to agricultural and forestry crops may be hunted in and out of the legal hunting period, on the basis of the approval of the central public authority responsible for forestry. ((2) Bears, wolves, feral cats, otters, minks and hamsters may be hunted only with approval and under the conditions laid down by the central public authority responsible for forestry, in accordance with the provisions of the international conventions to which Romania is a party. + Article 31 The shot or captured game is transported accompanied by the documents provided by the legislation in force. + Article 32 (1) Outside the legal hunting period, the sale, purchase and transport of the game under protection are prohibited. (1) frozen hunting in the hunting season, as well as the one shot under the conditions of art. 29 29 and 30. + Article 33 For the purpose of exercising hunting in conditions of hunting and hunting ethics, they shall be prohibited: a) failure to achieve or exceed the approved harvest quota, without justified reasons; b) hunting on a hunting background other than that which the hunter is authorized to hunt; c) the pursuit of the injured game on another hunting background, without the agreement of its manager, or the passage on such a fund with the hunting weapon not closed in the holster; d) the use of stegulets and fences for conducting the game, as well as animal detectors; e) hunting of deer, deer, black goats, muflons, wild boars and bears, by using cartridges other than those with single projectiles, the size of which is provided by the technical regulations issued by the central public authority which is responsible for forestry; f) hunting rabbits, pheasants or partridges to feeders or during the sunset until sunrise; g) hunting of deer, deer and black goats to feeders, to salsaries, to goana or with gonitori dogs; h) hunting of bears to the lair and hunting at nada without the approval of the central public authority responsible for forestry, for each case; i) hunting of pudding birds near the water holes, during global frost, as well as hunting their unsmiling chicks; j) hunting with dogs other than those in breeds admitted to hunting by the central public authority responsible for forestry and authorized by the manager of the hunting fund; k) the hunting use of semi-automatic weapons with more than two cartridges in the shed, of weapons not suitable for the species that are hunting and unauthorised ammunition; l) the use as atrape of live, orbited or mutilated animals, electronic chemists, mirrors and other dazzling objects; m) the use of artificial luminous sources, of devices for the illumination of targets, of mesh devices comprising converters or electronic image amplifiers for night shooting, mirrors and other dazzling objects; n) hunting and pursuit of hunting in motor vehicles; o) the gasification and smoking of the dens, without the approval of the central public authority responsible for forestry; p) the use of odorivectors without the approval of the central public authority responsible for forestry; r) marketing, by individuals, of the game; s) the manufacture, marketing, possession and use for hunting of allicas with a diameter of more than 5 mm; t) hunting with foreigners in natural parks, in kinetic reserves and in hunting funds for scientific research; u) the use of electric current, electronic equipment capable of killing, explosives, races and unauthorized traps, poisons, narcotics and unapproved or unauthorized weapons for hunting in Romania. + Chapter 5 Liabilities and penalties + Article 34 Violation of the provisions of this law attracts liability, as appropriate, disciplinary, contravention, civil or criminal. + Article 35 (1) It constitutes a crime of poaching in hunting and is punishable by imprisonment from one year to 3 years or with a fine of 50,000,000 lei to 250,000,000 lei committed: a) without a hunting permit and legal authorization or, as the case may be, without legal authorization; b) on animals whose hunting is prohibited or during periods when, according to the law, their hunting is not permitted; c) by the use of greyhounds or greyhounds; d) by night, by the use of motor vehicles and headlamps or devices which allow to aim and draw in darkness e) by the use of electric current, explosives, poisons, narcotics, electronic equipment capable of killing, unauthorised traps, weapons other than held in the hand and weapons other than those authorised or approved, as the case may be, for hunting in Romania. ((2) The facts provided in par. (1) shall be punished with imprisonment from 2 years to 5 years, if committed: a) during the night, with the exception of game species to which hunting is permitted according to the regulations regarding the organization and practice of hunting; b) two or more persons together; c) a person with duties or public duties in the field of hunting, as well as representatives of legal persons who are in the object of activity protection of hunting or hunting; d) in kinetic reserves. + Article 36 (1) It constitutes a crime and is punishable by imprisonment from one year to 2 years or with a fine from 50,000,000 lei to 150,000,000 lei: a) the removal from the country of the medaliable game trophies or the live game without complying with the legal provisions; b) transport of hunting acquired under the conditions of art. 35 35; c) the issuance and use of permits or hunting permits under conditions other than those provided in art. 27 27 and 28; d) exceeding the approved harvest quota for each manager; e) the issuing of permits for hunting in kinetic reserves without the approval of the central public authority responsible for forestry; f) hunting of strictly protected game species without the approval of the central public authority responsible for forestry; g) hunting in special conservation areas in the territory of natural parks; h) hunting with foreign hunters in hunting reserves and hunting funds for scientific research. (2) The attempt is punishable. (3) Through the special conservation area, within the meaning of the provisions of paragraph ((1) lit. g), it is understood the area established and delimited as such by the zoning action of natural parks. ----------- Letter g) a par. ((1) of art. 36 36 has been amended by section 4.2 1 1 of the single article of EMERGENCY ORDINANCE no. 193 193 of 22 December 2005 , published in MONITORUL OFFICIAL no. 1.179 1.179 of 28 December 2005. Alin. ((3) of art. 36 36 has been introduced by section 2 2 of the single article of EMERGENCY ORDINANCE no. 193 193 of 22 December 2005 , published in MONITORUL OFFICIAL no. 1.179 1.179 of 28 December 2005. + Article 37 (1) The goods that served to commit the crimes provided in art. 35 and 36, including means of transport, shall be confiscated. (2) The hunting and hunting trophies which are subject to the offences referred to in art. 35 and 36 are confiscated. + Article 38 (1) The hunting permit of the one who committed one of the facts provided in art. 35 and 36 withdraw and cancel, under the law, by the unit that has the hunter in evidence. (2) The ascertaining agent is obliged, in such cases, to withhold the hunting permit and to transmit it immediately to the unit which concerned him. + Article 39 Finding of the facts constituting the crimes provided in art. 35 and 36 shall be made outside the prosecution bodies and by the staff of the specialized body referred to in art. 7 7 para. (2), by the salaried personnel, with duties of protection of the game, of the legal persons managing hunting funds, as well as of other specialized personnel empowered for this purpose by the head of the public authority Central responding to forestry. + Article 40 (1) It constitutes the following facts, if they have not been committed under such conditions that, according to the law, they are considered crimes and are sanctioned as follows: a) violation of the provisions of art. 24 lit. b), art. 33 lit. c) and o) and art. 38 38 para. (2), with a fine of 2,500,000 lei to 7,500,000 lei; b) violation of the provisions of art. 15 15 para. ((2), art. 18 18 para. ((1), art. 24 lit. e), f), h), i), j), k), l) and r) and art. 33 lit. a), d), g), i), j), k) and p), with a fine from 5,000,000 lei to 15,000,000 lei; c) violation of the provisions of art. 15 15 para. ((3), art. 18 18 para. ((2), art. 23 23 para. ((1), art. 24 lit. a), c), d) and p), art. 31 31 and art. 33 lit. b), e), h), l), r) and s), with a fine from 10,000,000 lei to 30,000,000 lei; d) violation of the provisions of art. 15 15 para. ((1), art. 22 22, art. 23 23 para. ((2), art. 24 lit. o), art. 32 32 para. ((1) and in art. 33 lit. f) and m), with a fine from 20,000,000 lei to 50,000,000 lei. (2) In all cases, the hunting permit of the one who committed one of the facts provided in par. (1) will be retained by the ascertaining agent and will be immediately transmitted to the unit that issued it. (3) The amount of fines provided for in art. 35, 36 and 40 and the compensation is reupdated by Government decisions. + Article 41 (1) The finding of the facts constituting the contraventions provided in art. 40 is done, outside the specialized staff referred to in art. 39, by police officers and petty officers. (2) With the finding of the contravention, the ascertaining agent also applies the fine. + Article 42 (1) Against the minutes of finding the contravention and the application of the fine can be made a complaint, within 15 days from the date of communication. (2) The complaint shall be settled by the court in whose territorial area the contravention was committed. + Article 43 (1) Persons empowered to find the crimes provided for in art. 35 and 36, as well as the contraventions provided in art. 40, shall be assimilated, in the exercise of their duties arising from the power of attorney, to the staff who perform a function involving the exercise of (2) Minutes concluded by the persons referred to in par. (1) shall be sent, within a maximum of 5 days, to the unit to which the ascertaining agent belongs, to its leader by returning his obligation to transmit them, in the case of crimes, within a maximum of 25 days, to the criminal investigation bodies. + Article 44 Contraventions provided for in art. 40 the provisions of Law no. 32/1968 on the establishment and sanctioning of contraventions *), in so far as this law does not have otherwise. -------------- * *) Law no. 32/1968 has been repealed by Government Ordinance no. 2/2001 , published in the Official Gazette of Romania, Part I, no. 410 of July 25, 2001, approved with amendments and completions by Law no. 180/2002 . + Article 45 (1) The amount of compensation for damages caused by acts constituting crimes or contraventions, for the purposes of this law, shall be established according to annexes no. 1 1 and 2. ((2) Compensation for the damage caused to the hunting fund shall be collected by the management of the hunting funds, directly or through the general directorates of public finances. ((3) The compensation received by the management of the hunting funds shall be used and distributed as follows: -50% are retained for the management of the game by the management who collect them; -25% shall be paid to the finding agents by the management who collect them; -25% shall be transferred to the central public authority responsible for forestry, in the particular area of protection of the game. + Chapter 6 Transitional and final provisions + Article 46 Wild animals in zoos, those held or used legally for artistic purposes, as well as those from authorized game farms shall not be subject to the provisions of this law. + Article 47 The updating of the delimitation of the hunting fund of Romania in hunting funds is made, under the conditions of this law, by the central public authority responsible for forestry, in compliance with the principle of continuity. + Article 48 Studies provided for in art. 17 will be drawn up by current managers within one year of the publication of this law *). -------------- * *) See Law no. 654/2001 , published in the Official Gazette of Romania, Part I, no. 749 749 of 23 November 2001. + Article 49 (1) The assignment of the management of the hunting funds shall be made within 60 days after the termination of the contractual relations with the former managers. (2) The patrimonial assets of the old holders, existing on the hunting funds, can be taken over, by purchase, by the new holders, on the basis of the protocols concluded for this purpose, under the conditions established between the parties. + Article 50 The General Association of Hunters and Sports Fishers in Romania will adapt its own status to the provisions of this law, but not later than one year after its publication in the Official Gazette of Romania. + Article 51 (1) For the purpose of administration and management of the hunting fund in a unified conception, the central public authority responsible for forestry shall develop and approve, under the conditions of this law, regulations, instructions and technical regulations. (2) The current regulations, instructions and technical rules on hunting and hunting, issued on the basis of Law no. 26/1976 , remain valid until their replacement, but no later than 2 years after the publication of this law in the Official Gazette of Romania. + Article 52 Annexes no. 1 and 2 are an integral part of this law. + Article 53 (1) This law shall enter into force 30 days from the date of its publication in the Official Gazette of Romania * *). ------------- **) See also the dates of entry into force of the amending normative acts.
