The Romanian Parliament adopts this law + Article 1 For 1996, the harvesting of a maximum volume of wood mass of 14.6 million cubic meters is approved, as follows: a) 13.8 million cubic meters, from the forests managed by the Autonomous Regia of the Forest "Romsilva"; b) 0.4 million cubic meters, from privately owned forests; c) 0.4 million cubic meters, from forested pastures, tree alignments and forests or land with forest vegetation, managed by legal entities, other than the Autonomous Regia of the Forest "Romsilva". + Article 2 The maximum volume of 14.6 million cubic meters, approved for harvest in 1996, will have the following destinations: a) 9.9 million cubic meters for economic agents, from the exploitation and processing of wood, including for the supply of urban population; b) 0.7 million cubic meters for the Autonomous Regia of the Forest "Romsilva", from which about 120 thousand cubic meters will be made for export, in order to provide funds necessary for the execution of forest car roads for accessibility forests. The exploitation and cutting in timber of this wood mass volume will be carried out through authorized economic agents; c) 4.0 million cubic meters for the supply of rural population with wood of construction and firewood, without right of remarketing in raw state. + Article 3 From the volume of wood mass intended annually for economic agents and approved for harvesting from the forests managed by the Autonomous Regia of the Forest "Romsilva" will be retained by this a quota of maximum 10% that will be exploited, debited in timber and capitalized on export. The funds obtained will be used by the Autonomous Regia of the Forest "Romsilva" for the construction of forest car roads, in order to continuously improve the accessibility of the national forest fund. The exploitation and cutting in timber of this wood mass volume will be carried out through authorized economic agents. + Article 4 The volume of wood mass coming from downing and rupture produced by natural factors, as well as that resulting from the abnormal drying phenomenon, other than the one initially considered at the date of approval of the annual volume, will be capitalized with priority, retaining an equivalent volume of the wood on the foot provided for the cutting. + Article 5 (1) The wood mass intended for economic agents from the exploitation and processing of wood shall be sold by auction. (2) The Autonomous Regia of the Forest "Romsilva" and its staff will not participate, directly or indirectly, at the auction. (3) The untapped wood mass through tenders shall be sold to economic agents through direct negotiation. ((4) The auctions shall be organized and carried out according to the regulation approved by Government decision. The wood scholarships, legally registered in Romania, are accepted among the competent factors to issue official proof of the offer to the industrialization units of the assortments of wood fit for the industry, without charging commissions. (5) The wood meal intended for the supply of the rural population shall be sold at prices determined in accordance with the legal regulations. + Article 6 The wood products prohibited for export, as well as the contingent ones, are established by Government decisions. + Article 7 (1) The unlicensed export of the quota wood products, as well as the export of wood products prohibited for export, constitutes crimes and is sanctioned with imprisonment from 6 months to 2 years or with a fine from 20,000,000 lei to 30,000,000 lei. (2) The wood products which have been subject to the offence shall be confiscated. (3) When the seizure cannot be carried out in kind, the confiscation of the value equivalent in foreign currency will be ordered, and when it can no longer be realized, it will be ordered to pay the equivalent in lei of the currency, at the rate of the day from the date finding the deed. + Article 8 Minimum and maximum limits of fines provided for in Chapter VI of the Law no. 26/1976 and Chapter VII of law no. 2/1987 , amended by Law no. 12/1994, doubles. + Article 9 (1) The commission of acts of internal trade, unlawfully, with wood material constituted contravention and is sanctioned with contravention imprisonment from 3 months to 6 months or with a fine from 5,000,000 lei to 10,000,000 lei, if the act, due to the circumstances in which it was committed, does not constitute a criminal offence. (2) Unlawfully marketed wood material shall be confiscated. + Article 10 The provisions of this Law shall be completed Law no. 32/1968 on the establishment and sanctioning of contraventions, except art. 25-27. + Article 11 The maximum volume of wood mass that will be harvested annually since 1997, as well as its distribution by destinations-economic agents and rural population-will be approved by Government decision until June 30 of the year. previously, within the limits of the possibility of forests, established according to forestry facilities and under the conditions of their sustainable management. + Article 12 Any provisions contrary to this law shall be repealed. This law was adopted by the Senate at its meeting on April 25, 1996, in compliance with the provisions of art 74 74 para. (1) of the Romanian Constitution. p.
