LAW No. 41 of 24 May 1995 for the approval of the Government Ordinance. 68 of 26 august 1994 on the protection of the cultural heritage of the ISSUING national PARLIAMENT published in MONITORUL OFICIAL NR. 105 of 30 May 1995, the Romanian Parliament adopts this law.


The sole article approving Ordinance No. 68 of 26 august 1994 on the protection of the national cultural heritage, issued pursuant to art. and (b). l) of law No. 72/1994 on empowering the Government to issue decrees and published in the Official Gazette of Romania, part I, no. 247 of 31 august 1994, with the following modifications: a) article 1 shall read as follows: "historical monuments pertaining to the State or administrative territorial units are declared under the law as part of the public or private domain of the State, administrative-territorial units, the law, upon the proposal of the Ministry of culture and the Department for local public administration."

b) article 9(a) of) shall read as follows: "the National Monuments Commission), Assemblies and Historical Sites is reorganized as the National Commission of historical monuments and scientific specialty is the organ of the Ministry of culture, scientific and advisory opinion on research, inventory, accounting, evaluation, protection, conservation-restoration, revitalization and value of monuments, ensembles and sites.
National Historic Monuments Commission works on the basis of the regulation approved by order of the Minister of culture and consists of the President, appointed by the Minister of culture, and of active and honorary members designated in accordance with regulation thereof. "

c) article 9 (c)) shall read as follows: "(c)) within the Ministry of culture is reorganized the direction of historical monuments.
Director of historical monuments is, in law, the Secretary of the National Commission of historical monuments ";

d) in article 9 to insert a new paragraph with the following: "after the date of entry into force of this law, shall be established by the National Institute of historical monuments, public institution having legal personality, subordinated to the Ministry of culture, involved in research, manufacturing and accounting authorizations for historical monuments.
The staff of the Directorate of monuments, Ensembles and Sites of historical interest, the transfer service, the Ministry of culture and the subordinated units through exemption from the provisions of art. 2 of the Emergency Ordinance of Government No. 1/1994. "

e) article 18 paragraphs 2 and 3 shall become paragraph 2, having regard to the following content: "Zones of protection of historical monuments have different shapes and sizes and are delimited topographically. They shall be established through studies, prepared by the Directorate of historic monuments, in collaboration with the specialized bodies of the Ministry of public works and town and country planning, the Ministry of Waters, forests and environmental protection and local government authorities. "

f) article 22 1 shall read as follows: "the work of conservation and restoration of historic monuments can be designed and executed only by the specialists registered in the register of specialists in the field of conservation and restoration of historical monuments and only on the basis of the rules for the preservation and restoration of the Commission, approved the National historical monuments. The financing of such work is done by the State budget. "

g) article 25 g) shall read as follows: "(g)) prohibit the use of heritage assets protected from organizing performances, as film props."

h) article 28 1 shall read as follows: "the restoration of cultural property of national interest protected is carried out by specialized laboratories and in compliance with the rules."

I) Article 31 shall read as follows: ART. 31.-the date of entry into force of this Ordinance, any provisions to the contrary are hereby repealed. "
This law was adopted by the Chamber of deputies at its meeting on 8 May 1995, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
