The Romanian Parliament adopts this law + Article UNIC The following ordinances issued pursuant to art. 1 lit. c) of Law no. 72/1994 on the empowerment of the Government to issue ordinances: I. Government Ordinance no. 36 36 of 5 August 1994 on certain measures for the organization of the activity of the Autonomous Regia of Lignite Tirgu Jiu, in order to continue the exploitation of the lignite in quarries, published in the Official Gazette of Romania, Part I, no. 225 of 19 August 1994, with the following amendments: 1. The title of the ordinance shall have the following wording: "Ordinance on certain measures for the organization of the activity of the mining autonomous regions of the Ministry of Industries in order to continue the works of exploitation in quarries and underground of useful mineral substances." 2. Article 1 shall read as follows: "" ART. 1-In order to ensure the continuation of exploitation works in quarries and underground of useful mineral substances, by the mining autonomous regions of the Ministry of Industries, the Ministry of Water, Forestry and Environmental Protection will issue, until the entry into force of the new environmental law, opinions and environmental agreements for the mining objectives contained in the development strategy of the mining industry, in execution. The autonomous mining regions will present to the Ministry of Water, Forestry and Environmental Protection global studies on environmental impact in the operating perimeters where the mining objectives for which the notices are issued are executed and the environmental agreements. " 3. Article 2 shall read as follows: "" ART. 2-The mining autonomous regions of the Ministry of Industries will annually develop programs for the execution of the rendering works on the agricultural and forestry circuit of the land laid off as a result of the termination of the mining objectives provided in art. 1, also ensuring funding sources. " 4. Article 3 shall read as follows: "" ART. 3-The lands acquired by the mining units before 1990, other than those with initial forestry use, made redundant from the mining activities, which were brought back to the agricultural circuit and registered in the register of the general land cadastre, will be made available to the local law enforcement committees no. 18/1991 from the affected localities, following them to reconstitute the ownership of land in favour of individuals, under the law. " II. Government Ordinance no. 49 49 of 12 August 1994 on the legal regime applicable to companies established under Law no. 15/1990, which shall be restructure by division or merger, published in the Official Gazette of Romania, Part I, no. 242 of 29 August 1994, with the following amendments: 1. Article 5 shall read as follows: "" ART. 5-Establishment of the company as an effect of restructuring by division or merger, under the conditions provided in art. 2-4, it will be authorized, under the law, by the competent courts, maintaining the two existing shareholders, namely the State Property Fund and the Private Property Funds, to which the companies established. " 2. Article 6 shall read as follows: "" ART. 6-The terms set out in Law no. 31/1990 on companies, relating to the opposability of the modification of the constitutive acts of companies, as well as those provided for in favour of creditors trade established by division or merger. ' This law was passed by the Senate at the meeting of February 20, 1995, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution. SENATE PRESIDENT prof. univ. dr. OLIVIU GHERMAN This law was adopted by the Chamber of Deputies at its meeting on February 20, 1995, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution.
