+ Article 1 (1) For the exercise by the President of Romania of the prerogatives established by the Constitution of Romania and other laws, the Presidential Administration, a public institution with legal personality, established in Bucharest, Cotroceni Palace. (2) For the purposes of this Law, the Presidential Administration shall understand the public services available to the President of Romania for the performance of his duties. + Article 2 (1) The compartments and functions in the structure of the Presidential Administration, their organization, operation and duties shall be established by the Rules of Organization and Functioning of the Presidential Administration, which are approved by the President Romania. (2) The maximum number of posts at the Presidential Administration is 260. The funds required for the additional number of posts shall be provided from the budget of the Presidential Administration for 2002 by redistribution from the title < > > to the title < >. For the additional number of posts, the principal authorising officer shall be authorized to complete annexes no. 3/01/08 3/01/08 and 3/01/09 approved by State budget law for 2002 no. 743/2001 . ---------- Alin. ((2) of art. 2 2 has been amended by section 1 1 of art. I of EMERGENCY ORDINANCE no. 176 176 of 20 December 2001 published in MONITORUL OFFICIAL no. 839 839 of 27 December 2001. + Article 3 (1) The specific leadership functions within the Presidential Administration are as follows: presidential adviser, with the rank of minister, and state counselor, with the rank of secretary of state. (2) The Presidential Adviser on Defence and National Security is a member of the Supreme Defence Council of the Country. + Article 4 (1) The appointment or dismissal of presidential advisers shall be made by the President of Romania. (2) The appointment or release from the other functions of the Presidential Administration is made according to the regulation provided in art. 2. + Article 5 (1) The personnel of the Presidential Administration shall be composed of persons posted, at the request of the President of Romania, from ministries and other public authorities, as well as from persons directly assigned to the positions or posts they are to Meet. (2) The staff provided in par. (1) may be classified only on the basis of the trust granted by the President of Romania and provided that a commitment of loyalty established by the regulation provided for in art. 2. The withdrawal of trust has the effect of revoking the classification, as well as the termination of the posting, the release or dismissal from office or the dissolution of the employment contract, as the case may be. (3) The provisions of par. ((1) and (2) shall also apply accordingly to the order and security personnel affected by the Presidential Administration. + Article 6 The presidential administration establishes relations with public authorities and receives their support in order to achieve the prerogatives and exercise of the powers of the President of Romania. + Article 7 The financing of the operating expenses of the Presidential Administration shall be ensured from the state budget and from extra-budgetary income, realized, administered and accounted for, according to the law. + Article 8 (1) The presidential administration, in addition to its headquarters, may administer other spaces distributed by Government decisions. (2) As of January 1, 2002 the Cotroceni National Museum operates in the spaces distributed in the old side of the Cotroceni Palace, as a public cultural institution, subordinated to the Presidential Administration. ---------- Alin. ((2) of art. 8 8 has been amended by section 2 2 of art. I of EMERGENCY ORDINANCE no. 176 176 of 20 December 2001 published in MONITORUL OFFICIAL no. 839 839 of 27 December 2001. (2 ^ 1) The current and capital expenditures of the Cotroceni National Museum are financed from extra-budgetary income and from allowances from the state budget. For 2002 the budget of the Cotroceni National Museum is approved by the main authorising officer. ---------- Alin. (2 ^ 1) of art. 8 8 has been introduced by section 3 3 of art. I of EMERGENCY ORDINANCE no. 176 176 of 20 December 2001 published in MONITORUL OFFICIAL no. 839 839 of 27 December 2001. (2 ^ 2) The maximum number of posts for the Cotroceni National Museum is 132. ---------- Alin. (2 ^ 2) of art. 8 8 has been introduced by section 3 3 of art. I of EMERGENCY ORDINANCE no. 176 176 of 20 December 2001 published in MONITORUL OFFICIAL no. 839 839 of 27 December 2001.
