LAW No. 12 of 7 March 1994 approving the maximum volume of timber, which will harvest in 1994 PARLIAMENT ISSUING published in MONITORUL OFICIAL NR. 65 of 14 March 1994, the Romanian Parliament adopts this law.

Article 1 the maximum volume of timber, which will harvest in 1994 is 14.5 million cubic meters, of which: a) 10.5 million cubic meters for the operators of the State-owned and private, as well as for the population of the urban area, the result after processing;

b) 4.0 million cubic metres to supply the population of rural areas.

Article 2 the maximum volume of 14.5 million cubic metres timber harvest will be as follows: a) 13.9 million cubic meters from forests managed by Autonomous Regia forest "Rnp";

b) 0.2 million cubic meters from privately owned forests;

c) 0.4 million cubic meters from wooded, alignments and trees from forests or lands covered with forest vegetation administered by persons other than Autonomous legal forest directed by "Rnp".

Volume of timber operation referred to in paragraph 1. 1 will be done in compliance with the technical rules of operation.
Violations of technical rules of operation shall be imposed with the withdrawal and the establishment of legal liability.

Article 3 the amount of timber from bark and tears produced by natural factors, as well as the one resulting from the phenomenon of abnormal dryness, other than that taken into account in determining the amount for 1994 will be capitalized with priority, neexploatându an equivalent volume of timber cutting on an referred.

Article 4 in order to meet the possibility of Woods during the period 1991-1995, the maximum amount of timber to be harvested in 1995 will be of 14.4 million cubic metres. Origin and destination of this volume will be established by law, according to the results of the feasibility studies to update and strategy in relation to the restructuring of the wood processing industry, approved by the Minister.

Article 5 timber intended economic agents with the State or private capital will be sold by auction.

Article 6 minimum and maximum Limits of fines laid down in chapter II. 6 of law No. 26/1976 and head. 7 of law No. 2/87 shall be increased by 50 fold.

Article 7 Committing acts of domestic trade, as a wrongful, with timber, constitutes contravention and shall be sanctioned with imprisonment for contravention of 3 to 6 months or with a fine of 100,000 to 500,000 lei lei, if the deed due to circumstances in which it was committed, did not constitute infringement.

Article 8 Classification and quantities of lumber, veneers and cellulose that can be exported are established by the Government, according to the insurance needs of the economy.

Article 9 it is forbidden to export, the quantities of products subject to quotas, laid down in the annex. 1, as well as the export of logs specified in annex No. 2 of this law.

Article 10 breach of art. 8 and 9 of this Act shall be sanctioned with contraventional jail from 3 to 6 months, or with fine of 500,000 to 2,000,000 lei, if the Act does not constitute infringement.
Woody and fibrous material that was the subject of the contravention shall be forfeit.
When confiscation cannot perform in nature, it shall order the confiscation of the equivalent value in foreign currency, and if this is not feasible, it shall order the payment obligation of the equivalent currency, the lei at the exchange rate at the date of establishment of the offence.
The discovery and application of fine evaluation is carried out by customs bodies.

Article 11 the provisions of this law shall be completed with the provisions contained in law No. 32/68 on the establishment and sanctioning violations.

Article 12 Any provisions contrary to this law are hereby repealed.
This law was adopted by the Chamber of deputies at its meeting on 21 February 1994, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.

Note *) quota ban does not apply if the goods are exported within a complex installation, construction-Assembly or as packaging for other finished goods.

Annex 2 products BANNED for EXPORT WOOD 1. Logs, rafters, mine, railway sleepers, manele balls 2. Fire wood for cellulose and 3. Oak timber and valuable essences (Walnut, cherry, maple, elm and ash) 4. Pallets, Euro pallets, box pallets made of oak.
