The Romanian Parliament adopts this law + Article 1 The maximum volume of wood mass to be harvested in 1994 is 14.5 million cubic meters, of which: a) 10.5 million cubic meters for economic agents with state and private capital, as well as for the urban population, result after processing; b) 4.0 million cubic meters for the supply of rural population. + Article 2 The maximum volume of 14.5 million cubic meters of wood mass will be harvested as follows: a) 13.9 million cubic meters from the forests managed by the Autonomous Regia of the Forest "Romsilva"; b) 0.2 million cubic meters of privately owned forests; c) 0.4 million cubic meters of forested pastures, tree and forest alignments or land with forest vegetation managed by other legal entities than the Autonomous Regia of the Forest "Romsilva". Exploitation of the volume of wood mass provided in par. 1 will be done in compliance with the technical operating rules. The violation of the technical operating rules is sanctioned with the withdrawal of the exploitation authorization and the establishment of legal liability. + Article 3 The volume of wood mass coming from downing and rupture produced by natural factors, as well as that resulting from the abnormal drying phenomenon, other than that taken into account when establishing the amount for 1994, will be capitalized with priority, not exploiting an equivalent volume of wood on the foot provided for in the cutting. + Article 4 In order to respect the possibility of forests during 1991-1995, the maximum volume of wood mass to be harvested in 1995 will be 14.4 million cubic meters. The origin and destination of this volume will be determined by law, depending on the results obtained by studies to update the possibility of forests and in relation to the strategy of restructuring the wood processing industry, adopted by the relevant ministry. + Article 5 The wood mass for economic agents with state or private capital is sold by auction. + Article 6 Minimum and maximum limits of the fines provided for in the head. 6 6 of Law no. 26/1976 26/1976 and the head. 7 7 of Law no. 2/1987 2/1987 is a 50-fold increase. + Article 7 The commission of acts of internal trade, unlawfully, with wood material, constitutes contravention and is sanctioned with contravention imprisonment from 3 to 6 months or with a fine from 100,000 lei to 500,000 lei, if the act, due to the circumstances in which was committed, does not constitute a crime. The illegally traded wood material is confiscated. + Article 8 The nomenclature and quantities of timber, vending and cellulose that can be exported are established by the Government, depending on the insurance needs of the economy. + Article 9 The export, over the quota quantities, of the products listed in Annex no. 1 1, as well as the export of wood products set out in Annex no. 2 2 of this law. + Article 10 Violation of art. 8 and 9 of this law are sanctioned with contravention imprisonment from 3 to 6 months or with a fine from 500,000 to 2,000,000 lei, if the act does not constitute a crime. The wood material and fibrous which was the subject of the contravention shall be confiscated. When the confiscation can no longer be carried out in kind, the confiscation of the value equivalent in foreign currency will be ordered, and if it cannot be achieved, it will be ordered to pay the equivalent in lei of the currency, at the rate of the day from the date of the finding Crime. The finding of contravention and the application of the fine shall be made by the customs bodies. + Article 11 The provisions of this law are supplemented by the provisions of Law no. 32/1968 on establishing and sanctioning contraventions. + Article 12 Any provisions contrary to this law shall be repealed. This law was adopted by the Chamber of Deputies at its meeting on February 21, 1994, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution. The quota ban shall not apply where the goods are exported under a contract of complex, construction-assembly or packaging for other finished products. + Annex 2 WOOD PRODUCTS PROHIBITED FOR EXPORT 1. Bulogs, rafters, mine wood, railway sleepers, balls-hands 2. Firewood and cellulose 3. Oak timber and valuable essences (walnut, paltin, cherry, elm and ash) 4. Pallets, europalets, box-pallets made of oak.
