Law no. 95/1993 , published in the Official Gazette of Romania, Part I, no. 5 of 12 January 1994, has been amended by Government Emergency Ordinance no. 3 3 of 4 January 2001 , approved with modifications by Law no. 368 368 of 10 July 2001 , published in the Official Gazette of Romania, Part I, no. 385 385 of 13 July 2001. + Article 1 The continuation of Romania's participation in the construction of the mining plant for the enrichment of acid ores with iron content from Krivoi Rog-Ukraine is approved. The conditions of continuation of Romania's participation in the construction of the objective will be established by the Romanian-Ukrainian intergovernmental protocol amending and adapting the provisions of the Romanian-Soviet Government Convention, signed Moscow. + Article 2 Ministry of Industry and Resources *)-as representative of the Romanian Government in relations with the Government of Ukraine-will aim to bring to fruition all the provisions of the Romanian-Ukrainian intergovernmental protocol provided in art. 1 1 para. 2. The Ministry of Industry and Resources will ensure the coordination and pursuit of fulfilling the obligations of the Romanian side to the construction of the objects of the mining plant enrichment of iron-containing acid ores from Krivoi Rog, set out in the Convention intergovernmental of 29 December 1986 and in the Romanian-Ukrainian intergovernmental protocol. The obligations and rights of the Romanian side from the participation in the construction of the mining plant for the enrichment of acid ores with iron content from Krivoi Rog are carried out through the commercial companies signatories of the contracts concluded in this purpose with the Ukrainian side. --------------- Note * *) art. II of Government Emergency Ordinance no. 3/2001 the duties and responsibilities of the former Ministry of Commerce, provided for in 2 2 para. 1 1 and at art. 3 3 of Law no. 95/1993 , are fully taken over by the Ministry of Industry and Resources. + Article 3 The Ministry of Industry and Resources will establish with the relevant bodies of the Russian Federation and Ukraine how to compensate the value of machinery and machinery delivered from Romania to metallurgical enterprises of the Russian Federation and other republics of former U.R.S.S., delivered as a share in the construction of the mining plant for enrichment of iron ore minerals from Krivoi Rog, which, according to the Intergovernmental Convention of 29 December 1986, was supposed to be paid by deliveries of pellets from the production of the plant. + Article 4 Funding expenditure to meet government commitments on the construction of the iron ore enrichment mining plant with iron content from Krivoi Rog shall be provided from the funds provided annually with this destination in the state budget, based on the foundation presented by the Ministry of Industry and Resources. For the financing, in 1993, of the supplies of machinery and construction-assembly works at the mining plant for enrichment of iron-containing acid ores from Krivoi Rog, the Ministry of Public Finance will contract a loan in the amount of 40 billion lei from a commercial bank that offers the most advantageous conditions, in which the National Bank of Romania grants a special financing line. The interest on the loan is borne from the state budget, the chapter "Interest on public debt". + Article 5 Revenues from the domestic or export recovery of iron-pellet ores, taken from the Ukrainian side to the account of repayment of its debt, shall be paid into the account of the Ministry of Public Finance, as their achievement, to be used for the reimbursement of domestic bank loans for the financing of machinery deliveries and construction-assembly works at the mining plant for the enrichment of iron-containing acid ores from Krivoi Rog, as well as for the payment of interest, commissions and other charges related to these appropriations banking. The remaining amounts after the refund of funds consumed for the construction of the mining plant for the enrichment of iron-containing acid ores from Krivoi Rog flows to the state budget. + Article 6 The internal settlement mechanism of iron-pellet ore is established by methodological norms developed by the Ministry of Public Finance, the Ministry of Industry and Resources and the Authority for Privatization and Administration of State Participations. + Article 7 The import of iron-pellet ore, taken into account of the repayment of the Ukrainian side's debt for the mining plant enrichment of iron-containing acid ores from Krivoi Rog, is exempt from the payment of customs duties and value tax. Added. Also, exports of machinery, materials and other products intended for the construction of the mining plant for the enrichment of acid ores with iron content from Krivoi Rog, as well as the import of iron-pellet ore, taken into account of reimbursement the debt of the Ukrainian party for this objective, are exempt from the payment of the commission of 0,5% for the provision of customs services Government Decision no. 387/1992 . ---------
