The Romanian Parliament adopts this law + Article 1 In order to cover the additional expenses caused by the cost of heating housing, from 1 November to 30 April 1994, the monetary aid for housing heating is established, which is granted to persons or, where appropriate, to families with Lower income. + Article 2 (1) The monetary aid established according to art. 1 is granted in the amount and under the conditions provided by this law. (2) Benefit from a monthly aid of 5,000 lei the following categories of persons or, as the case may be, families: a) holders of state social insurance pensions, military, I.O.V.R. and survivor, whose cumulative pensions, plus permanent rights according to Law no. 42/1990 for the honor of the heroes-martyrs and the granting of rights to their descendants, to the injured, to those who were detained from 16 to 22 December 1989 as a result of participation in the actions of the revolution, as well as those who participated directly, from 16 to 25 December 1989, to the battles for the victory of the Revolution of December 1989, Decree-Law no. 118/1990 on the granting of rights to persecuted persons for political reasons of dictatorship established with effect from March 6, 1945, as well as those deported abroad or constituted in prisoners, Law no. 49/1991 regarding the granting of allowances and bonuses to invalids, veterans and war widows, with their subsequent amendments, due for October 1993 or for a subsequent month, as the case may be, are up to 28,500 lei inclusive; b) basic pension holders established according to Law no. 80/1992, in the amount of up to 3,000 lei, in October 1993 or in a subsequent month and not cumulating other pensions; c) beneficiaries of unemployment benefits or support allowances, whose allowances due for October or for a subsequent month, as the case may be, are up to 28,500 lei inclusive; d) beneficiaries of social benefits established on the basis of pension legislation, beneficiaries of special monthly aid, who are not also survivor's pension holders, beneficiaries only of social pensions according to Law no. 53/1992 on the special protection of handicapped persons, the wives of the military within which they benefit from the aid and the beneficiaries of monthly money aid that are granted according to art. 14 14 of Law no. 23/1969 on the execution of penalties, if the amounts due with this title for October or for a subsequent month are, as the case may be, up to 28,500 lei inclusive; e) families or single persons, residing in urban areas, who do not fall within the provisions of par. ((2) lit. a)-d), which carried out in October 1993 or in a subsequent month, as the case may be, an average net income on a family member, respectively person, up to 28,500 lei inclusive. + Article 3 The monetary aid for heating housing, which is established under the conditions of this law, shall be granted to the person entitled according to art. 2 2 para. ((2) lit. a)-d) or a single aid is granted to the family entitled according to the provisions of art. 2 2 para. ((2) lit. e). + Article 4 (1) By family member, within the meaning of art. 2 2 para. (2) letter e), it is understood the husband, wife, other persons in their maintenance, according to the law, who live together. (2) The holder of the monetary aid for heating housing, granted according to art. 2 2 para. ((2) lit. e), is the husband or wife, or other major person in the family, designated by the holder. + Article 5 The monetary aid for heating housing, as well as the net income ceilings provided for in art. 2 is indexed by the percentages established by Government decisions, depending on the evolution of the inflation rate. + Article 6 The monetary aid for heating housing is non-taxable, stands out separately from the other rights and is not taken into account when establishing other rights and obligations provided by the legal rules in force. + Article 7 (1) The aids provided in art. 2 2 para. ((2) lit. a)-d) shall be borne by the same funds as the money rights constituting the basis for the calculation of the aid. (2) Establishment of rights for the families and persons referred to in 2 2 para. ((2) lit. e) is made at the request of the holder, on the basis of self-declaration. (3) If the rights of persons provided in art. 2 2 para. ((2) lit. a)-d), in relation to which the aid provided for by this law is granted, shall be established after 1 November, the payment of this aid shall be made from the month in which those rights have been established. (4) For families and single persons referred to in art. 2 2 para. ((2) lit. e), which meet the conditions of granting the monetary aid for the heating of homes after the entry into force of this law, the aid shall be granted from the month in which the application was submitted. ((5) The elements underlying the establishment of the average net income per family member, as well as the ways of granting the rights and administration of funds necessary for the payment of the aid shall be established by the Government. + Article 8 (1) In order to establish the funds necessary to pay the monetary aid from the state budget for heating housing, granted to the persons provided by art. 2 2 para. ((2) lit. e), Romanian citizens who travel abroad for personal or tourist interest pay a fee on each exit from the country of 10,000 lei and 5,000 lei to the small border traffic. (2) They shall be exempt from the payment of the tax provided in ((1): a) students and students studying abroad; b) the sick who travel in order to receive medical treatment, as well as the attendants to whom they are entitled according to the law; c) the surviving spouse, as well as the relatives, up to the fourth degree inclusive, of the deceased persons abroad, on the occasion of death. ((. The persons who are refused entry into the country of destination shall be returned, upon request, the amount of the tax paid. (4) The Government is empowered to update the level of the tax according to the evolution of inflation. ((5) The amounts collected from the taxes established by this law, which exceed, during the year, the amount of the expenses occasioned by the payment of the monetary aid for the heating of the dwellings, are made to the state social insurance budget and will be used to finance other social benefits provided by law. (6) The way of collecting the taxes provided in par. (1) is established by an order issued by the Minister of Finance, the Minister of Labour and Social Protection and the Minister of Interior. + Article 9 The Government is authorized to introduce the amendments resulting from the application of this law in the state budget, in the state social insurance budget, in the social insurance budget for farmers, in the budget of the Fund for the payment of unemployment benefits, in the budget of the Risk and Accident Fund for the Special Protection of Disabled Persons, approved for the year 1993. + Article 10 Holders of the monetary aid for heating housing, provided in art. 2 2 para. ((2) lit. e), have the obligation to announce the exceeding of the income ceiling to the bodies to which they submitted the application, in the month in which its modification occurred. The cessation of the payment of the monetary aid for the heating of the dwellings is made from the month following the one in which the proof of the granting of the aid was proved not to meet + Article 11 Failure to comply with the provisions of this law shall entail civil and criminal liability This law was adopted by the Senate at the meeting of December 6, 1993, in compliance with the provisions of art 74 74 para.
