LAW No. 58 of 10 July 1993 on empowering the Government to issue ordinances and authorization of commitment and guarantee foreign loans, and contracting of loans of issuing State PARLIAMENT Published in MONITORUL OFICIAL NR. 160 of 14 July 1993, the Romanian Parliament adopts this law.
Article 1 pursuant to article 6. 114 para. (1) of the Constitution of Romania, the Romanian Government is link settlement as from the date of entry into force of this law until the resumption of the work of Parliament in the fall of 1993, to issue decrees in the following areas: (a) the adjustment of the State budget) in the light of changes in the structure of income and expenses;
b) introduction of measures to encourage small and medium enterprises, measures concerning the restructuring of the companies, as well as measures of economic and financial recovery and settling cases of inability to pay economic agents;
(c) the procedures concerning the Organization) the regulation and conduct of public procurement;
d nebursiere with transactions) the regulation securities intermediary institutions and organisation necessary for this purpose, as well as updating existing legal provisions concerning the use of payment instruments and credit for strengthening financial discipline of economic agents;
e) update, depending on inflation rate, the following fees for services in favour of individuals and legal entities, which have been established by law in the amount fixed as follows: stamp duty in fixed amounts for the provision of services; fees for the issue of certificates of registration of cars and trailers and changing technical characteristics and use thereof; airport user charges; fees for licensing with a view to the possibility of gaming and entertainment; Customs import tariff of Romania; the audiovisual tax; tuition fees for foreign citizens; fees for commercials; fees for the issue of certificates, permits, identity documents and other charges in fixed amounts owed to the State in lei individuals and legal entities; tax on income derived by foreign consultants for work done in Romania;
f) updating the level of violations to legal rules on budgetary discipline, tax, financial reporting, as well as to the rules regarding travel by Metro, depending on inflation rate;
g) ratifying or approving financial and banking agreements to which it is party, where appropriate, the Government of Romania, the Romanian National Bank and posing the urgent; payment of contributions to the Romanian State bodies and international organizations;
h) granting of contributions from the State budget for personnel of the worship of the country and staff of Orthodox worship that forklift operating abroad.
Article 2 In article 41(2). 114 para. (3) of the Constitution until he resumes the work of Parliament in the fall of 1993, the ordinances issued by the Government pursuant to art. 1 of this law will be submitted to Parliament for approval, under penalty of termination of their effects.
Article 3 also authorizes Government and National Bank of Romania to contract and to ensure, in the course of 1993, foreign financial loans, subject to a maximum amount of $ 1.5 billion, in order to ensure the necessary currency resources supply with raw materials (fuels, energy, agricultural products, deficient and strict necessity and other goods for the relaunch of the economy), to finance investments and to increase foreign exchange reserves.
The Government will inform Parliament, quarterly progress loans according to para. 1, as well as the conditions of contracting such loans, credit guarantees given and use.
Article 4 authorises the Government to contract loans on behalf of the State's internal debt, up to the amount of 500 billion lei.
This law was adopted by the Chamber of deputies at its meeting on 29 June 1993, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
