LAW No. 55 of 9 July 1993 concerning modification and completion of the law nr. 52/1991 regarding the remuneration of the staff of the organs of the judiciary, the PARLIAMENT published in ISSUING the OFFICIAL GAZETTE NR. 158 of 13 July 1993 the Romanian Parliament adopts this law.


Article 1, law No. 52/1991 regarding the remuneration of the staff of the organs of the judiciary, as amended and supplemented, modified and completed as follows: 1. Article 8 shall read as follows: ART. 8.-For outstanding results in the work done, the staff can get a salary of up to 15%, applied to the base salary. Merit salary is part of base salary.
Persons who benefit from merit salary shall be determined once a year, usually after the approval of the State budget, in relation to the results of the work done. For new personnel-employee salary merit may be granted after a period of at least 6 months of employment.
Merit salary may be granted for a maximum of 15% of the total number of posts authorised in the functions of the institution, of which at least two-thirds will be used for execution. "
2. Article 9 paragraph 1 shall read as follows: "the gradatia immediately above, and setting the amount of compensation to be made driving once a year, for all staff, usually upon approval of the State budget, due account personal qualities, embodied in the results of the professional activity, denoted by the notation" very good "or" well. "
5. Article 12 paragraph 1 shall read as follows: "Persons paid under the provisions of this law shall be entitled to the basic function of a spore of the work up to 25%, calculated from base salary, corresponding to the actual time worked on normal working schedule, saying the cuts a percentage of basic salary-between 3 and 5 years 5-10 years 5-10 from 10 to 15 years 15-from 15 to 20 years over 20 years 20-25 ' 6. 7. Paragraph 2 of article 22 shall read as follows: "The judges, tribunals and courts of appeal, as well as to the public prosecutor's Office attached to these courts shall be appointed judges, public prosecutors, respectively, under the conditions provided for by law No. 92/1992 for the judiciary. "
8. In paragraph 4 of article 22 shall read as follows: "minimum Seniority required is determined by the present law, except for the provisions of article 7. 67 lit. a), b) and (c)) of law No. 92/1992 for the judiciary. "
9. After article 22 shall be introduced two new articles, 22 ^ 1 ^ 2 and 22, with the following content: "ART. 22 ^ 1. -Basic Salaries for judges of the Court of appeal, and prosecutors from the public prosecutor's Office attached to the courts of appeal are those corresponding to the professional ranks and discern slight motion, to which they are employed, increased by 5%.
Base salaries for management personnel at the appeal courts and the public prosecutor's Office attached to them are those corresponding to the functions set out pursuant to paragraph 1. 1, plus allowance for driving provided by this law for similar functions to the courts and the public prosecutor's Office, courts increased by 5%.
Base salaries for prosecutors of the Prosecutor General's Office attached to the Supreme Court of justice are those corresponding to the professional ranks and gradatiilor at which they are employed, increased by 10%.
Article 22 ^ 2. Judges retired for age limit, which are reincadrati, receive appropriate salary tool, and gradatiei laid down in relation to length of service.
The provisions of paragraphs 1 and 2. 1 shall apply accordingly to the notaries and forensic experts. "
10. After article 26 shall enter a new article 26 ^ 1 with the following content: "ART. 26 ^ 1. -Persons appointed on a temporary basis in a managerial post, where the holder is missing from the institution for a period exceeding thirty (30) calendar days and not receiving salary on the respective period, receive, in addition to the base salary of professional level or stage, in which they are placed, the corresponding compensation function of leadership which you take. "
11. Article 31 shall read as follows: ART. 31.-this law wages are gross and taxable according to the law. They will be updated in the light of indexarile granted in accordance with the provisions of Government decisions adopted after 1 January 1993. "
12. Annex 4. 7 section 1 changed and shall read as follows: "1. the military personnel who, for the performance of the incumbent, providing at least half the normal working time during the night, he is entitled to raise for the night work of 25%, which is calculated to result."


Article 2 appendices. 1-5 are an integral part of this law and replaced by appendices. 1-5 of law No. 52/1991.


Article 3 Wages and other rights provided for in this law shall be granted with effect from 1st of the month in which the law comes into force.


Article 4, law No. 52/1991 regarding the remuneration of the staff of the organs of the judicial power shall be in the Official Gazette, Rosca articles a new numbering.
This law was adopted by the Senate at its meeting on 30 June 1993, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
