The Romanian Parliament adopts this law + Article 1 Law no. 40/1991 on the salary of the President and of the Government of Romania, as well as of the staff of the Presidency, the Government and the other organs of the executive power shall be amended and supplemented as follows: 1. Article 7 shall read as follows: "" ART. 7. -The basic salaries of the positions in the management of the prefectures and local councils are set out in Annex no. 7 7. " 2. Article 8 (3) shall read as follows: " (3) The basic salaries for the management staff provided for in Annexes no. 8, 9 and 10-general manager, director, head of service and head office, deputies and assimilates thereof-are those corresponding to the execution function, degree or professional step and graduation held, plus a driving allowance. that is part of the basic salary, differentiated in relation to the responsibility of the management function fulfilled, with the size of units and compartments, as well as with the share of driving work compared to the execution activity they carry out. The tasks of the execution function shall be established by the ministries, the other bodies of the central and local administration, in the form of minimum obligations, by statute, regulations or own rules on fields of activity. The driving allowance shall be established annually by the head of the competent public institution, according to the law, in relation to the results obtained and the responsibility for it. 3. Article 8 (4) shall read as follows: " (4) The share of management positions, including those provided for in art. 9 9, may not exceed 20% of the total staff in the institutions set out in Annexes no. 8 8 and 9 and shall be determined by the minister or the head of the central and local public institution of the state administration. " 4. Article 10 shall read as follows: "" ART. 10. -(1) For outstanding results obtained in the work carried out, the staff may receive a merit salary, which is part of the basic salary. It can be up 15% applied to the base salary. (2) Persons who receive merit salary shall be established once a year, as a rule after the approval of the budget, in relation to the results obtained in the work carried out. For newly-hired staff, the merit salary can be awarded after a period of 6 months from employment. (3) The merit salary may be granted for no more than 15% of the total number of posts provided for in the institution's state of office, of which at least two thirds will be used for execution functions. " 5. Article 11 shall read as follows: "" ART. 11. -(1) The transition into the immediate higher graduation or the increase of the salary, if it is provided between the limits, as well as the establishment of the driving allowance, shall be made once a year, as a rule after the approval of the budget, on the proposal of the head the compartment in which that person works, with the approval of the institution's head (2) At the transition into the immediately superior graduation, the personal qualities embodied by the results obtained in the professional activity, noted with the "very good" or "good" rating in the previous year, are taken into account. Article 12 (2) shall read as follows: " (2) Exceptionally, for personnel with special professional value, the minister or head of the central and local public institution of the state administration may nominally approve the presentation to the competition for advancement in the degree or stage immediately superior professional, without fulfilling the condition of seniority provided for in the preceding paragraph. " 7. Article 12 (3) shall read as follows: " (3) Concrete establishment of minimum age for advancement in degrees or professional steps on functions, as well as other additional requirements for advancement-doctorate, postgraduate courses, knowledge of foreign languages, specializations, attestations and other-is done by the ministries, the other central and local public institutions of the state administration for their own activities. " 8. After paragraph 3 of Article 14, a new paragraph shall be inserted as follows: "Pensioners for the age limit who reengage in work, according to the law, benefit from the increase of seniority corresponding to the age in work, acquired after the date of retirement." 10. After paragraph 2 of Article 15, a new paragraph shall be inserted as follows: " At workplaces where the nominal duration of working time has been reduced, according to the law, under 8 hours a day, exceeding the working hours thus approved can be done only temporarily, in very special situations, being mandatory to compensate Appropriate free time. ' 11. After paragraph 1 of Article 16, two new paragraphs are inserted with the following contents: " Employees who work, according to the employment contract, only in isolated areas, benefit from an increase of 10-20% of the basic salary. The criteria for granting, the categories of personnel and the concrete size of the increase are established by Government decision. Article 24 shall read as follows: "" ART. 24. --(1) Within the limit of the fund for payment of salaries, approved by the state budget and local budgets, each ministry, central and local public institution shall breakdown the respective fund for its own apparatus and subordinate units. (2) The states of functions for the own apparatus of ministries and other central public institutions of the state administration shall be endorsed by the Ministry of Labour and Social Protection and the Ministry of Finance. " 16. " 17. Article 27 shall read as follows: "" ART. 27. -(1) Provisions of art. 17 and 18 will apply from 1994 onwards. For the year 1993, annual prizes will be awarded within a fund of 3% of the salary fund realized. (2) In cases where the main authorising officers of the budget make savings by reducing personnel expenses, they may award prizes, during the year, within the limit of 2% of the salary fund provided for in the revenue and expenditure budget. The individual awards are approved by the head of (3) Ministries and other central and local public institutions of the state administration which, according to the law, have the right to proceed with the confiscation and valorization of goods or to apply and collect penalties, may constitute a fund up to 15% of their value for boosting staff. Article 29 (1) shall read as follows: "" ART. 29. -(1) The settlement of appeals in connection with the establishment of salaries, the granting of allowances, bonuses, prizes and other rights that are established according to the provisions of this law is within the competence of the General Secretariat of the Presidency, General Secretariat of the Government, the board of directors of the ministry, central public institutions, prefect and county and local councils for their own apparatus. " 19. Article 31 shall read as follows: " ART. 31. -States of functions for ministries, other central public institutions and prefectures shall be elaborated in compliance with the number of posts approved by Government decisions. " 20. Article 32 shall read as follows: "" ART. 32. -(1) In the services of the Presidency and in the Government apparatus may be used the functions set out in Annex no. 8, which will be salarized with base salaries higher than 30%. (2) With basic salaries higher by 20% compared to those set out in Annex no. 8 the staff of the Ministry of Finance, the Ministry of Labour and Social Protection and the Ministry of Foreign Affairs, as a synthesis ministries, are also salarized. ((3) With basic salaries higher by 30% compared to those set out in Annex no. 8 the staff in the own apparatus of the Constitutional Court, framed according to this annex, are also salarized. (4) In the own apparatus of the Prefecture of Bucharest and the agricultural sector Ilfov and the Council of Bucharest, the basic salaries of the staff are higher by 10% compared to the level set out in Annex no. 9 9 to the present law. " 21. Article 33 shall read as follows: "" ART. 33. -The presidency, government, ministries and other central and local public institutions of the state administration will be able to include in the states of functions that apply for services in their own apparatus and, as the case may be, in the institutions they coordinate, and some functions approved to other sectors of budgetary activity, which prove necessary, by taking them from the budget units where the respective functions are specific. " 22. After Article 33, a new article, 33 ' 1) is inserted, with the following contents: "" ART. 33 33 ^ 1). -The criteria for granting salaries and levels in foreign currency, as well as other rights in foreign currency and in lei, for personnel sent on permanent mission abroad to diplomatic missions, consular offices and other official representations abroad of the Ministry of Foreign Affairs, as well as of the other ministries and public institutions shall be established by Government decision. " 23. Article 35 shall read as follows: "" ART. 35. -(1) The Ministry of Labour and Social Protection, together with the Ministry of Finance, as specialized bodies, endorses, at the proposal of ministries, other central public institutions and prefectures, the share of personnel who can be assigned to higher professional degrees, the use of pay levels, the equivalence of some functions and their conditions of employment by correlation with those provided for in this law. (2) The Ministry of Labour and Social Protection and the Ministry of Finance, as specialized bodies, control in ministries and other central and local public institutions and their budgetary institutions the application of legal provisions regarding the payroll and establish measures that are required to eliminate the deficiencies found and inform the Government. " 24. " 25. Article 38 shall read as follows: "" ART. 38. -The salaries provided for in this law are gross and taxable, according to the law. They will be indexed on the basis of Government decisions adopted after January 1, 1993 in the percentage provided by them. The new salary levels will be calculated and transmitted to the public institutions concerned, by the Ministry of Labour and Social Protection. " + Article 2 Annexes no. 1-11 are an integral part of this Law and replace Annexes no. 1 1-11 to Law no. 40/1991 . + Article 3 The date of entry into force of this Law shall be repealed: --Article 25 and Article 28 of the Law no. 40/1991 on the salary of the President and the Government of Romania, as well as of the staff of the Presidency, Government and other bodies of the executive power; - Government Decision no. 521/1991 on the granting of rights for the stimulation of financial guard personnel -any other provisions to the contrary. + Article 4 Law no. 40/1991 on the remuneration of the President and the Government of Romania, as well as of the staff of the Presidency, the Government and the other bodies of the executive power, with all the amendments, shall be republished in the Official Gazette of Romania, the names of the bodies or institutions with those provided for in the Romanian Constitution and Law no. 69/1991 and giving the articles a new numbering.
