LAW No. 33 of 9 June 1993 concerning modification and completion of the law nr. 40/1991 regarding the remuneration of the President and the Government of Romania, as well as staff of the Presidency, the Government and other bodies of executive power published in PARLIAMENT ISSUING the OFFICIAL GAZETTE NR. 125 of 11 June 1993, the Romanian Parliament adopts this law.


Article 1, law No. 40/1991 regarding the remuneration of the President and the Government of Romania, as well as staff of the Presidency, Government and other bodies of executive power change and completed as follows: 1. Article 7 shall read as follows: ART. 7.-Wages of the functions of the prefectures and local councils are set out in the annex. 7. "2. Article 8 (3) shall read as follows: "(3) salaries for management personnel provided in appendices. 8, 9 and 10-general director, director, Chief and Deputy Bureau Chief, and assimilated them-are those corresponding to the function, or professional degree stage and gradatiei, plus an allowance of driving part of base salary, differentiated in relation to the responsibility of leadership met with bin size and units, as well as to the amount of labor leadership activity execution done. Powers of execution shall be determined by ministries, other bodies of Central and local administration, in the form of minimum obligations, by statute, regulations or its own rules on industries. 3. Article 8 (4) shall read as follows: "(4) the share of managerial functions, including those referred to in article 1. 9, shall not exceed 20% of the total staff of the institutions referred to in the appendices. 8 and 9 and shall be determined by the Minister or by the head of the institution of local and central public administration. "
4. Article 10 shall read as follows: ART. 10. — (1) for the outstanding results obtained in the work done, the staff can get a merit, which is part of base salary. It can be up to 15% applied to the base salary.

(2) the persons availing themselves of merit shall be determined once a year, usually after the approval of the budget, in relation to the results of the work done. For new personnel-employee salary merit may be granted after a period of six months of employment.
  

(3) salary merit may be granted for a maximum of 15% of the total number of posts provided for in the State of the institution's functions, of which at least two-thirds will be used for execution. "
  

5. Article 11 shall read as follows: ART. 11.-(1) gradatia the next higher salary hike, or where it is fitted between the limits, as well as setting the compensation of senior management, are carried out once a year, usually after the approval of the budget proposed by the Chief of the bin in which the working person, with the consent of the driver.

6. In article 12 (2) shall read as follows: "(2) in exceptional cases, for professional staff having special value, the Minister or the leader of the local and central public institution of the State administration may approve the nominal submission to competition for advancement in rank or professional gear immediately, without fulfilling the condition of length of service referred to in the preceding paragraph."
7. Article 12 (3) shall read as follows: "(3) the establishment of minimum seniority for advancement in degrees or professional functions, steps and other additional requirements for advancement-PhD, postgraduate courses, knowledge of foreign languages, specializations, certificates and others-is made by ministries, other Central and local public institutions of State administration for their own activities."
8. 10. 11. According to paragraph 1 of article 16 shall introduce two new paragraphs worded as follows: "Employees who work according to the contract of employment, but in isolated areas, receive a raise of 10 to 20% of base salary. Criteria, categories of staff and the size of the bonus shall be determined by decision of the Government.
Which, according to staff working hours operates during the night from 22.00 6.00, receive, and for hours worked during that period, an increase of 25 per cent of base salary, if such time worked shall represent at least half of the normal work schedule. "
12. According to paragraph 2 of article 20 shall be inserted a new paragraph with the following content: "the rights referred to in paragraph 1. (1) benefit people used temporarily as employees in ministries and in other bodies of central public administration, prefectures and District Councils. The amount of the allowance is approved by the Minister or, where appropriate, by the head of the central institution of prefect or County Council President. "
13. Article 22(3) shall read as follows: ART. 22.-persons appointed on a temporary basis instead of a person with managerial post, which is missing from the institution for a period exceeding thirty (30) calendar days and not receiving salary on the respective period, receive, in addition to the base salary of professional level or stage, in which they are placed, the corresponding compensation function of leadership which you take. "
14. After article 23 shall be introduced two new articles 23 ' 1) 23 ' 2) with the following content: "ART. 23 ' 1)-Employees who pass in the same units, the fixed salaries or between limitations in features where wages are fixed on the gradations, will be awarded a number of gradations that you provide a base salary close to that.

15. Article 24 shall read as follows: ART. 24. — (1) subject to a maximum payment of wages fund intended and approved by the State budget and local budgets, each Ministry, Central and local public institution into the Fund for your device and subordinate units.

16. 17. Article 27(2) shall read as follows: ART. 27. — (1) the provisions of art. 17 and 18 shall apply with effect from 1994. For 1993 annual awards will be granted within the limit of a 3% of salary Fund.

(2) where the main budgetary credits shall realize savings by reducing personnel expenses, may grant awards during the year, to a maximum of 2% of salary Fund as provided for in the budget of income and expenditure. Individual awards shall be approved by the head of the unit.
  


(3) the ministries and other Central and local public institutions of State administration which, by law, are entitled to carry out the seizure and use of goods, or to apply and to collect penalties, may constitute a Fund of up to 15% of their value to stimulate staff. The levels of formation for each source and conditions for the use of the Fund shall be determined by the rules approved by the Government. "
  

18. Article 29 (1) shall read as follows: ART. 29. — (1) the resolution of complaints in connection with the fixing of salaries, grant gradatiilor, increases, awards, and other rights which are established under the provisions of the present law is a matter for the general secretariat of the Presidency, the general secretariat of the Government, the Board of Directors of the Ministry, the central public institutions, the prefect and the district and local councils for your device. 19. Article 31 shall read as follows: ART. 31. States of functions for ministries, other Central Government institutions and the prefectures with due regard to the number of posts approved by decisions of the Government. "
20. Article 32 shall read as follows: ART. 32. — (1) The services of the Presidency and the Government apparatus can be used and functions laid down in the annex. 8, which will be paid by the basic salaries of more than 30%.

21. Article 33 shall read as follows: ART. 33.-the Presidency, the Government, ministries and other Central and local public institutions of State Administration will be able to include the functions of States that apply for the services from your device and, if applicable, in that they coordinate, and some other functions approved budgetary sectors of activity which may prove necessary, by taking their respective budgetary units where functions are specific. 22. After article 33 insert a new article 33 ' 1), with the following content: "ART. 33 ^ 1). -Requirements for wages and levels of foreign currency, as well as other rights in foreign currency and in lei, for the staff of permanent missions sent abroad in diplomatic missions, consular posts and other official representations abroad of the Ministry of Foreign Affairs, and other ministries and public institutions shall be established by decision of the Government. "
23. Article 35 shall read as follows: ART. 35. — (1) the Ministry of labour and social security, together with the Ministry of finance, as the specialized organs, give consent to the proposal of the ministries, other Central Government institutions and staff share prefectures can be classified in the professional ranks, the use of wage levels, the equivalence of functions and their conditions of employment through correlation with those laid down in this law.

(2) the Ministry of labour and social security and the Ministry of finance, as the specialized organs, controlling the ministries and in other Central and local public institutions and institutions in view of their budgetary implementation of laws concerning measures of wage setting that might be required for the Elimination of deficiencies found and informs the Government. 24. According to article 4. 36 insert a new article, 36 ^ 1), with the following content: "ART. 36 ^ 1). -To maintain a balance between the salaries of all categories of staff in public institutions, the Government will take measures to ensure the growth and wages for the personnel of the other budgetary units, whose salaries shall be approved by decision of the Government. "
25. Article 38 shall read as follows: ART. 38.-Wages established in this law are gross and taxable according to the law. These will be the basis of Government decisions index adopted after 1 January 1993 in the percentage specified by them. New wage levels will be calculated and submitted by an interested public institutions by the Ministry of labour and social security. "


Article 2 appendices. 1-11 are an integral part of this law and replaced by appendices. 1-11 in the law. 40/1991.


Article 3 on the date of entry into force of this law are repealed:-article 25 and article 28 of law No. 40/1991 regarding the remuneration of the President and the Government of Romania, as well as staff of the Presidency, Government and other bodies of executive power;
-Government Decree No. 521/1991 concerning granting rights to stimulate financial Guard personnel;
-any other provisions to the contrary.


Article 4, law No. 40/1991 regarding the remuneration of the President and the Government of Romania, as well as staff of the Presidency, Government and other bodies of the executive power, with all its changes, is a Republic in the Official Gazette of Romania, with bodies or denominations agree with those institutions provided for in the Constitution and in law. 69/1991 and realizing a new articles are numbered.
This law was adopted by the Senate at its meeting of 31 May 1993, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.

Note: 1. Categorize counties, municipalities and cities shall be by decision of the Government.
