Article 1 For veneration and eternizarea memory to those who have sacrificed their lives for the victory of the revolution in December 1989, it establishes the hero-martyr of the Romanian Revolution of December 1989.
Title of hero-martyr of the Romanian Revolution of December 1989 shall confer on post-mortem: patent and the title shall be submitted, to the family of the person, decorated or parents as appropriate.


Article 2 as a sign of appreciation and gratitude for those who have been wounded in the fighting for the victory of the revolution in December 1989, is established the title of Fighter for the Romanian Revolution of December 1989.
The title of the Fighter for the Romanian Revolution of December 1989 and is conferred to those who have been detained during the period from 16 to 22 December 1989 as a result of participation in actions for the revolution, as well as those in the 16-25 December 1989, stood out by works in the struggle for the victory of the revolution.
The persons referred to in paragraph 1. 2 must prove the facts in fighting for the revolution and to be recommended by an association, a club, a foundation or a League of legally established fighters, until December 30, 1992.
For the purpose of recognizing quality provided for in this law, the issuance of the certificates of the evidence and the proposal referred to in article distinctions 1, 2, 3 and 4 of this law shall establish the Commission for veneration and supporting heroes of the revolution of December 1989. Comission, whose members are appointed by decision of the Government, shall be as follows: a representative of the Ministry of labour and social solidarity;
a representative of the Ministry of health and family;
a representative of the Ministry of public finance;
a representative of the Ministry of national defence;
a representative of the Ministry of the Interior;
a representative of the Ministry of Justice;
a representative of the Public Ministry;
a representative of the General Secretariat of the Government;
a representative of the Secretariat of State for Revolutionaries of 1989;
-8 representatives of associations legally constituted revolutionaries until 30 December 1992, rotating as stipulated by the rules of organization and functioning of the Commission. The Chairman is appointed at the initiative of associations legally constituted revolutionaries until December 30, 1992, by the Government, and Government employee. Secretariat of State for Revolutionaries of 1989 implementation of the provisions of this law and the execution of the Commission's secretariat and the archive. The General Secretariat of the Government will ensure the space and funds for the work of the Commission.
The deadline for the submission of dossiers for the purposes of recognition of the quality of fighter for the Romanian revolution of December 1989 or a participant in the Romanian revolution of December 1989 is 90 days after the entry into force of this law.
Supporting certificates will be made according to the methodology laid down in its rules of organization and functioning of the Commission for veneration and supporting heroes of the revolution of December 1989 and approved by decision of the Cabinet of Ministers), within 30 days after the entry into force of this law.

Article 3 establishes the title of Participant in the Romanian Revolution of December 1989 for those who participated in the activities carried out in the revolution of December 1989, other than those referred to in article 1. 2 (2). 2. the persons referred to in paragraph 1. 1 you must provide evidence of participation in the actions of the revolution and be recommended by an association or League of fighters from the revolution, uncountable until 30 December 1992.
The title of the Participant in the Romanian Revolution of December 1989 is Honorary. Beneficiaries of this title will receive separate patent, pursuant to article. 5 of this law.


Article 4 as a sign of appreciation towards participants in actions for the revolution to be set up Commemorative Cross of the December 1989 Anti-communist Revolution, under the present law.

Article 5 referred to in article Titles. 1, 2 and 3, as well as medals for each title is conferred by the President of Romania, at the proposal of the Commission pursuant to article 114. 2 (2). (4); the competence of the Commission, as well as criteria for the award of titles are given in appendices. 1 and 2 which are an integral part of this law.
Titles which have not been conferred under the terms of paragraph 1. 1 or where the beneficiary had no special merits are void.
Invalidity of securities may be recorded, ex officio or at the request of any interested person, the Committee responsible for veneration and supporting heroes of the revolution of December 1989, provided for by this law, by decision of invalidity. Decisions of the invalidity of the certificates can be appealed within 30 days, the Special Parliamentary Commission laid down in article 21. 7. Records of those who have acquired the titles referred to in paragraph 1. 1 shall be made ex officio or at the request of any interested person, within one year after the entry into force of this law, the Committee responsible for veneration and supporting heroes of the revolution of December 1989.
Where the Commission referred to in article 1. 2 (2). 4 will not complete the work for which it was established, the Government, through the State Secretariat for Revolutionaries of 1989, is empowered to make proposals to the Presidency of Romania for the release of securities referred to in article 1. 1, 2 and 3 using lists put forward by the Government of the revolutionary organizations legally constituted no later than 31 December 1992.
Lists proposals will be published in the Official Gazette of Romania, through the Secretariat of State for Revolutionaries of 1989, any dispute will be submitted to the Parliamentary Commission. 7, within a period of 30 days following publication.
Complaints will be resolved within 10 days of receiving them, and decisions will be communicated in writing to the Presidency of Romania and appellants.

Certificates shall be issued by the Commission for veneration and supporting heroes of the revolution in December 1989, the persons referred to in art. 1 and 2 and only on the basis of other supporting documents as referred to in art. 2.

The certificate will be expressly conferred on the holder of the rights; certificates shall be signed by the Chairman and by the Secretary of the Commission for veneration and supporting heroes of the revolution of December 1989.
Using existing certificates will be made after verification of the files within a period of 60 days.
The same regulation will establish, for the parents of martyrs, the heroes-a distinctive insignia, the reverential to wear it.
Distinctions laid down in this law shall certify by patent.

Article 7 is hereby established the Parliamentary Commission for monitoring of compliance with this law, the decision of the European Parliament.
The Commission will be composed of 5 members, senators and 6 according to the European Parliament's political configuration.


Article 8 the descendants or, where appropriate, the parents of the martyrs of the revolution Heroes-you will receive, together with the stamp provided for in article title. 1, and the amount of 60,000 lei.
The wounded will receive, revolution along with the title; 2, and the amount of 40,000 lei.


Article 8 ^ 1 (1) persons who have lost partial or full working capacity, the mutilated and followers of those who have died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989 shall be entitled to an allowance of repair.
  

(2) Compensation shall be established and shall repair grants monthly based on the multiplier coefficients apply upon the average salary per economy press release National Commission for Statistics for the month preceding the month in which payment is made, as follows: a) for 1.60-great mutilated;
  

b) for persons classified under 1.40-the degree of disability;
  

c 1.20-to persons) classified in the degree of disability;
  

d-0.85) for persons falling within the third degree of disability;
  

e) for each survivor 0.60-entitled to receive indemnity reparative.
  

(2 ^ 1) The amount of the indemnities provided for in paragraphs 1 and 2. 2 may not be less than the March due to the year 1999.

Article 8 ^ 3 people who have lost all or part of the capacity for work and the mutilated as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989, which were included in a social security scheme may be acquired prior to the date of contracting diseases or injuries, arising because of that disability, shall be entitled, in addition to the allowance of repair , and invalidity pension, irrespective of the length of time, work on the invalidity lasts, established under the same conditions in which the invalidity pension is granted to persons who have suffered accidents at work.
Invalidity pension under the conditions laid down in paragraph 1. 1 adjourn on time the person in question performs activity under an employment contract, except for the person placed in third degree invalidity and who performs a task with half the normal working schedule.

Article 8 ^ 4 provisions in the social insurance legislation, relating to the examination, review, suspend, resume, termination and payment of pensions, and applies for compensation rights established by this law of repair.

Article 8 ^ 5 are entitled to the allowance provided for in article reparative 8 ^. 2(a) e) children and surviving spouse of the person who died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989.
Children are reparative, allowance as follows: (a)) until the age of 16 years;
  

b) if they continue their studies in an organized form of education according to the law, until their completion, without exceeding the age of 26 years;
  

c) throughout the duration of any disability, whether it arose during the time they were in one of the situations referred to in points. or b) to).
  

The surviving spouse shall receive compensation if you were not reparative remarried, throughout his life, regardless of the duration of the marriage.
Compensation due to persons referred to reconstructive para. 1, under the conditions of paragraph 1. 2 and 3, shall be aggregated with the survivor. Article 10 (1) persons who have lost partial or full working capacity, the mutilated, wounded and followers of those who have died as a result of participation in the struggle for the victory of the revolution in December 1989, enjoys the following rights: and the hiring priority) and purchase housing from the State Fund;

f) free access to treatment and consultations in polyclinics and hospitals of the Ministry of Health, the Ministry of national defense and the Ministry of the Interior;
  

g) medicines free of charge;
  

h) granting free prostheses and major persons mutilated and have totally or partially lost his capacity to work;
  

I) free access to the spa and treatment bases belonging to the Ministry of health, the Ministry of national defense and the Ministry of the Interior;
  

j) free urban transport means transport belonging to majority-owned units and, annually, 12 rail travel first class, round-trip. People living in rural areas have the right to travel and to 12 per year, round trip, by train or by bus, the majority-owned units State, up in the capital city of the County.
  

These allowances benefit Grand companion of the maimed and the person falling in the 1st degree invalidity;

k) exemption from payment of fees and taxes related to land and buildings, to hycomat cars, mototriciclu and radio-TV subscription;
  

l) possibility of compensation with any other repairers;
  

m) free access to subsidized nurseries and kindergartens;
  

born free) of an autonomous means of transport appropriate international standards and exemption from customs duties for purchase from its import, for the wounded in the fighting for the revolution of December 1989, or in connection with the revolutionary events of December 1989, falling into medical criteria in force *);
  

a free legal assistance), granted by bar associations of lawyers in cases related to the subject of this Act;
  


p) retirement, reducing the age prescribed by law for five years, parents of persons who have died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989, husbands, and for the wounded of the revolution;
  

r) scholarships for pupils and students in educational institutions of the State, under the law, regardless of income, to the surviving spouse and descendants of persons who have died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989, as well as invalids or wounded revolution;
  

s) getting Bank loans not exceeding 300 million lei for productive investment, contracted character between banks and recipients, and subsidizing state interest from these loans at the rate of 50%, within the limits of the annual budget provisions approved for that purpose.
  

The Government will approve periodically updating the credit limit mentioned in relation to price developments;

It was, as a matter of priority to hiring) sellers remizieri within companies with majority state capital to people who have lost all or part of the capacity of working times, the hiring out of State small spaces available for production or provision of services; the granting of a small space, with rent, for commercial activities, production or provision of services without tender;
  

t) grant of land surfaces in accordance with the law of the Land Fund No. 18/1991, republished.
  

(2) the employment contract of the fighters for the Romanian revolution of December 1989, employed in establishments with state capital, cannot be opened except for reasons attributable to them.
  

(3) the rights specified in paragraph 2. and (b). f)) shall be granted only for the period during which beneficiaries retains the quality survivors, injured or retired for disability.
  

(4) the rights referred to in paragraph 1. and (b). a)-(f)))-m) and a)-t) benefit the persons referred to in art. 2 (2). 2.

Article 11 (1) persons who are Parents have died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989 shall receive a monthly amount equal to 50% of the allowance provided for in article reparative 8 ^. 2(a) e), throughout life.
  

(2) Repealed.

Article 12 (1) the surviving spouse of the person who died as a result of participation in the struggle for the victory of the revolution in December 1989 times in relation to the revolutionary events of December 1989 and that has one or more dependent children shall receive its monthly an amount equal to 50% of the allowance provided for in article reparative 8 ^. 2(a) e). (2) the amount referred to in paragraph 1. 1 shall be granted up to the age of 16 years old by the last dependent child or, if they continue their studies in an organized form of education according to the law, until their completion, without exceeding the age of 26 years.

Article 14 Prefectures and town halls will provide necessary assistance to persons subject to this law, in order to obtain housing, jobs, and for addressing other issues of societal and professional faced.


Article 15 the Board of Directors of the Foundation for the "Freedom Fund", set up pursuant to Decree-Law No. 124/1990, supplemented by one representative of 9 associations of the wounded survivors and heroes of the revolution.


Article 16 the provisions of this law apply properly and soldiers of any degree, as well as civilian personnel of the Ministry of national defense and the Ministry of the Interior, who have sacrificed their lives or were injured in the fighting for the revolution times in relation to the revolutionary events of 1989, and their offspring.
The provisions of this law do not benefit the people who organised, instigated or fought, by any manner, against the revolution of December 1989, as well as their descendants.


Article 17 the Government of Romania will bring to comply with provisions of this law, providing material and financial resources required, including supplementing foreign exchange funds made available to the Ministry of health, for the purpose of sending to treatment abroad, whenever it is necessary, to persons who have suffered particularly severe conditions in the battles for the revolution. It will also ensure the wounded foreign exchange resources for revolution availability of parts necessary for this category of persons.
The sums required payment of benefits referred to in article repairers. 8 ^ 1 and art. 11(2). 1 shall support from the State budget and in the budgets of the Ministry of labour and social protection, the Ministry of national defense and the Ministry of the Interior. The amount that shall be paid to the surviving spouse under art. 12 it supports from the State budget and is provided in the budget of the Secretariat of State for Revolutionaries of 1989.

Paragraph 1 (2) of article 9. 17 was introduced by EMERGENCY ORDINANCE nr. 17 of March 8, 1999, published in Official Gazette No. 102 of 10 March 1999.


Failure to comply with the provisions of article 18 of this law shall entail, as appropriate, disciplinary, administrative, civil or criminal liability of the guilty.


Article 19 the keeping, who were awarded the title of Fighter for the Romanian Revolution of December 1989 and that the date of 1 January 1990 had under 21 years of age, will be selected by the Government, according to the moral qualities, skills and training and advise to be employed in the local and central institutions and other budgetary units Depending on their jurisdiction and in compliance with legal provisions.


Article 20, Decree-Law No. 76/90, the provisions relating to retirement invalids as a result of participation in the revolution of December 1989 from Government decision nr. 1.065/90 *), and any other provisions contrary to the provisions of this law shall be repealed.

Article 21 this Act comes into force on 1 December 1990 *).

Annex 1 of the Commission'S COMPETENCE for veneration and supporting heroes of the revolution in December 1989 the Commission for veneration and supporting heroes of the revolution of December 1989 notice, ex officio or at the request of the parties concerned, the quality of the hero-martyr, fighter for the revolution of December 1989, deceased times hurt in connection with the revolutionary events of December 1989, as well as that provided for in art. 4, issue certificates to those supporting legal and proposes the justified granting. 1, 2, 3 and 4 of this law.
The competence of the Commission to support the veneration of heroes of the revolution of December 1989 shall be that provided for in this law and in the rules of organization and functioning of the Commission, approved by decision of the Government.
Documents required for issuing quality certificates are archive for veneration and supporting heroes of the revolution of December 1989.
The status of hero-martyr or hurt referred to in the preceding paragraph shall recognize those who died or were injured in the period 16 December 1989 to 10 January 1990, including those that have been injured during this period, died later from injuries sustained. Those who are injured in this range have suffered bodily injury which required medical care for healing or have produced any of the following consequences: loss of a sense or organ, the cessation of their officials, a permanent physical disability mental sluţirea times, abortion or entry in distress to a person's life. For the purposes of this law, are considered to be detained those who followed her in the fighting for the revolution, were transported and held at the headquarters of one of the former Ministry of internal affairs bodies, with or without the formalities prescribed by law.
To fulfill these tasks, the Commission is empowered to require any relations to the State organ, as well as from individuals and legal entities.


Annex 2 concerning employment applicants in GRID article. 1, 2 and 3 of this Act title of hero-martyr of the Romanian Revolution of December 1989 is conferred to those who have lost their lives for the freedom of the Romanian people in the period 16 December 1989 to 10 January 1990, and to those who have died as a result of serious injuries caused during the same period.
The title of the Fighter for the Romanian Revolution of December 1989 shall be paid to:-the wounded with or without the degree of disability, if they have taken an active part in the Romanian revolution of December 1989;
-detained between 16-21 December 1989, where they were detained in street demonstrations in connection with revolutionary activities and not for committing criminal offences, common law;
-persons who have participated in the revolutionary activities effectively in the period 16-27 December 1989 and stood by the facts.
Proof of disability and activity to merit their harvests through the following documents:-the minutes between the organizations represented;
-a certificate or other document;
-statements by the persons participating in the revolution of December 1989, recognized by the fighters, but in conjunction with other conclusive evidence.
The title of the Participant in the Romanian Revolution of December 1989 it confers on those individuals who, through contribution, directly or indirectly, contributed to the revolution of December 1989.
