Article 1 remuneration of the staff of the organs of the judiciary, the Public Ministry, from the State notary's offices, forensics Labs, General Directorate of penitentiaries and its units shall be made taking into account the importance and responsibility of the role, returning to each exercise functions, according to annexes II nr. 1-7, which are an integral part of this law.


Article 2 Basic Salaries for the positions of leadership and execution of functions in the Supreme Court of justice are set out in the annex. 1. Article 3 of the basic Wages and allowances for driving from the General Prosecutor's Office in addition to the Supreme Court of Justice and the Ministry of justice are set out in the annex. 2. In article 4 the Wages of courts, Prosecutor's offices, the State notary's offices, forensics Labs, General Directorate of penitentiaries and its units are contained in the appendices. 3-7. Article 5 military personnel from the Ministry of Justice, in the field of coordination of activity of the penitentiary institutions, as well as that of the General Directorate of penitentiaries and its units is paid according to the legal provisions applicable to soldiers from the Interior Ministry.


Article 6 basic Wages for the personnel are differentiated by function and, within each, by grade or professional steps. Base salaries for each grade or step are set on three or four gradations.


Article 7 basic Salaries for management personnel are those corresponding to the function, or professional degree stage and gradatiei as it is framed, plus an allowance for driving, determined annually, is part of the base salary, differentiated in relation to the responsibility of driving met and with the respective weighting of labour activity execution done.


Article 8 For outstanding results in the work done, the staff can get a merit up to 15%, applied to the base salary. Merit salary is part of base salary.
Persons who benefit from merit salary shall be determined once a year, usually after the approval of the State budget, in relation to the results of the work done. For new personnel-employee salary merit may be granted after a period of at least 6 months of employment.
Merit salary may be granted for a maximum of 15% of the total number of posts authorised in the functions of the institution, of which at least two-thirds will be used for execution.


Article 9 the gradatia immediately above, and setting the amount of compensation to be made driving once a year, for all staff, usually upon approval of the State budget, due account personal qualities, embodied in the results of the professional activity, denoted by the notation "very good" or "good".
Minimum seniority required for passage in the next higher gradatia is 2 years; exceptionally, it may be reduced to half. Make exceptions to these provisions employed as employees or interns, entry-level professionals, for which the minimum seniority for gradatia immediately above is 1 year.


Article 10 advancement of specialized staff, in the professional grades or steps, to do it through the exam, according to the law, in relation to the minimum length of the specialised, professional competence and results obtained. Employment to advancement is made in all cases at gradatia 1.
Minimum seniority in grade or professional gear for advancement in grade or step immediately above is at least 3 years. Exceptions from this provision provided for persons falling within the functions with the salary of debutante.
Exceptionally, for individuals with a professional competence, the minimum length of service referred to in paragraph 1. 2 can be reduced to half if the cause has minimum seniority in the specialty prescribed by law for the position, rank or step in advancement.


Article 11 professional activity shall be assessed annually with qualifiers: "very good", "good", "satisfactory" or "weak".


Article 12 People paid under the provisions of this law shall be entitled to the basic function of a spore of the work up to 25%, calculated from base salary, corresponding to the actual time worked on normal working schedule, saying the cuts a percentage of basic salary-between 3 and 5 years 5-10 years 5-10 from 10 to 15 years 15-from 15 to 20 years more than 20 years 20-25

Bonus for seniority of work shall be payable with effect from the 1st of the month following that in which he reached the age of the work.
The bonus for seniority shall be taken into account in calculating the pension and allowances for temporary incapacity for work.


Article 13 Staff from the Directorate General of prisons and its units benefit from indemnities for activities that require a very high psychological tensions or is carried out in special conditions of work.
Jobs categories of staff, the size of increases and conditions are set out in appendices. 6 and 7.


Article 14 laws relating to awards and other rights, set out for budgetary units, shall apply accordingly.
Where the Chief authorising officer carries out budgetary savings from personnel expenses, may be granted awards during the year, within a limit of 2% of salary Fund as provided for in the budget of revenue and expenditure, shall ensure that the work of the staff what items in the back who originated the savings.
The criteria for the award of the prizes is approved, where appropriate, by the Minister of Justice, Attorney general and the President of the Supreme Court of Justice.


Article 15 annual Award may be reduced or cancelled if the employees who, in the course of the year, held an occupation or inappropriate, or for misconduct that illustrious has been sanctioned to disciplinary action. These rights shall be cancelled in the case of employees who have illustrious acts in connection with the service, for which they were convicted, or that function on a necorespunzatori deal.


Article 16 the granting of increases and for awards by the central bodies referred to in this law, shall be carried out under the conditions determined by law for the staff of ministries and other central organs.


Article 17 in addition to the rights referred to in this law, salary, staff of the establishments referred to in article 1. 1 benefit of rights established by special laws.


Article 18 auxiliary personnel specialist at the Supreme Court of Justice and the General Prosecutor's Office attached to it is that laid down in the annex. 3 for the staff of the courts and of prosecutors ' offices.


Article 19 legal specialist personnel from the Ministry of Justice and the General Prosecutor's Office attached to the Supreme Court of Justice shall be fixed by the assimilation of its functions with the professional ranks of judges and prosecutors, in relation to the length of service and professional competence, by order of the Minister of Justice and the Attorney general.


Article 20 of the basic Salaries for the positions of leadership and execution, other than legal specialty and ancillary activity of the Supreme Court of Justice, the Ministry of Justice and the General Prosecutor's Office attached to the Supreme Court of Justice, shall be those laid down for the ministries and other central organs.


Article 21 *) employment of judges and courthouses to judges, prosecutors, forensic experts, notaries and bailiffs is done by order of the Minister of Justice and, where appropriate, the Attorney general, and other personnel from units of Justice, Prosecutor's Office and notary public, by the President of the Tribunal, the Chief Prosecutor of the County Prosecutor or Bucharest, head of the county clerk or notary of the municipality of Bucharest under the present law, and laws on the organisation.

Article 22 judges, prosecutors and notaries fall professional grade I, II, III, IV and v. To judges, tribunals and courts of appeal, as well as to the public prosecutor's Office attached to these courts shall be appointed judges, public prosecutors, respectively, under the conditions provided for by law No. 92/1992 for the judicial organisation.
Trainee judges and prosecutors, as well as hobbyists notaries, after an examination of the finished, are employed in professional grade V.

The minimum length of service required is determined by the present law, except for the provisions of article 7. 67 lit. a), b) and (c)) of law No. 92/1992 for the judicial organisation.


Article 23 of the basic Salaries for judges of the Court of appeal, and prosecutors from the public prosecutor's Office attached to the courts of appeal are those corresponding to the professional ranks and gradatiilor at which they are employed, increased by 5%.
Base salaries for management personnel at the appeal courts and the public prosecutor's Office attached to them are those corresponding to the functions set out pursuant to paragraph 1. 1, plus allowance for driving provided by this law for similar functions to the courts and the public prosecutor's Office, courts increased by 5%.
Base salaries for prosecutors of the Prosecutor General's Office attached to the Supreme Court of justice are those corresponding to the professional ranks and gradatiilor at which they are employed, increased by 10%.


Article 24 Judges retired for age limit, which are reincadrati, receive appropriate salary tool, and gradatiei laid down in relation to length of service.
The provisions of paragraphs 1 and 2. 1 shall apply accordingly to the notaries and forensic experts.


Article 25 Employment and remuneration of forensic experts shall be three professional degrees.


Article * 26) the appointment of judges and prosecutors in leadership positions at the courts and the public prosecutor's Office attached to these instances of Bucharest city, County and local governments are making of the judges and prosecutors of grade I-IV, depending on their professional and organizational qualities, by order of the Minister of Justice and the Attorney general.

Article 27 appointment of notaries in leadership positions at the County and notary of the municipality of Bucharest, as well as the local notary shall be do whatever their degree, depending on their professional qualities, by order of the Minister of Justice. Judges who are employed as a paralegal on the professional degrees may be appointed notaries heads from the time of enrolment.


Article 28 in the leadership of the central laboratory of forensic expertise and interjudetene laboratories, will be appointed by order of the Minister of Justice, forensic experts, regardless of rank, designated according to their professional and organizational qualities.


Article 29 People named in a temporary managerial post, where the holder is missing from the institution for a period exceeding thirty (30) calendar days and not receiving salary on the respective period, receive, in addition to the base salary of professional level or stage, in which they are placed, the corresponding compensation function of driving that you take.


Article 30 in the establishments referred to in article 1. 1 can be used, in relation to the specific nature of certain activities, and other functions, with wage levels prescribed by law for the budget.


Article 31 expert staff sent abroad, invited other organizations account or external partners, for scientific, cultural, artistic or sports, receive in the country of the rights established by Government decision for budgetary units.
As those sent abroad, according to para. 1, for a period exceeding one month, they may be engaged on fixed term, other people, according to the law.


The application of article 32 of this Act shall proceed to all staff on the new reincadrarea functions, and professional degrees and gradations, so that's the new salary should not be lower than the salary. The reincadrare account shall be taken of the professional competence reflected in the results obtained up to the date of reincadrarii, and the level of preparedness of each person.


Article 33 *) in connection with the implementation of the provisions of the present law, appeals may be made, where appropriate, at the College of the Supreme Court of Justice, the Ministry of Justice or the Prosecutor General, the personnel employed by these bodies, within 5 days from the date of the referral to the attention of the measure. Appeals shall decide within 20 days.
Appeals brought by staff employed by the management of the courts and the other units of the Ministry of Justice or of procuraturilor County and Bucharest can address the commissions established for this purpose by the Ministry of Justice and the General Prosecutor's Office; the provisions of paragraphs 1 and 2. 1 shall apply accordingly.
— — — — — — — — — — — — — — — — * Note) with effect from 1 July 1993, the Prosecutor-General of Gpo's gets near the Supreme Court of Justice, and the County Prosecutor and prosecution Bucharest, besides courts.


Article 34 of this law, Wages are gross and taxable according to the law. They will be updated in the light of indexarile granted in accordance with the provisions of the decisions of the Cabinet of Ministers adopted after 1 January 1993.


Article 35 *) personnel of the Justice Ministry's subordinated units external and Prosecutor-General's Office attached to the Supreme Court of Justice shall be approved by the Ministry of labour and social security and the Ministry of finance. Functions for these States units shall be approved by the Ministry of Justice and the General Prosecutor's Office attached to the Supreme Court of Justice.
State the functions of the Supreme Court of Justice, drafted according to legal provisions, approved by the permanent Court College.
States shall be drawn up within the limits of functions of workstations that have been approved, according to the law.

Article 36 the provisions of the present law shall enter into force on 1 April 1991), the date on which remain valid regulations relating to salaries in effect on March 1, 1991.
On the date of entry into force of the present law shall repeal the law. 14/1990 on the salaries of members of the Supreme Court of Justice and its apparatus, Decree-Law No. 140/1990 on the classification and personnel from units of the judiciary and the Prosecutor's Office, art. 7 of the Government Decree No. 987/1990 on the Organization and functioning of the Ministry of Justice, and any other provisions to the contrary.

Annex 6 civilian personnel from the general direction of penitentiaries and its units 1. Civilian personnel from the General Directorate of penitentiaries is paid under the conditions provided by law for device central ministries and other State organs.
Civilian personnel from units of the General Directorate of penitentiaries is paid according to the applicable legal provisions in the budget.
2. Salaries of specialized functions of the Directorate General of prisons and its units is done via assimilation with specialized functions the ministries and other central organs and budgetary establishments.
3. Civilian personnel from the General Directorate of prisons and of its benefits from an increase in the base wage by up to 25%. This increase is part of base salary.
4. auxiliary teaching staff and teaching staff, as well as medical and sanitary establishments subordinated to the General Directorate of penitentiaries shall receive an increase in basic salary by up to 30%.
5. Civilian personnel from Edmonton Penitentiary Department and Chilia Veche, Tulcea under Prison retain 20% allowance to base salary, for service provision in permanent fixture.
6. Granting of rights referred to in paragraphs 4 and 5 shall not preclude the rise of salaries of the basis set out in point 3.


Annex 7 INCREASES the result of military personnel by the General Directorate of prisons from the Ministry of Justice 1.
