---------- The Romanian Parliament adopts this law + Article 1 War invalids, war veterans and war widows are given an allowance as follows: a) war invalids: -148 lei monthly, for large mutilated and those assigned to the first degree of invalidity; -132 lei monthly, for those assigned to the second degree of invalidity; -112 lei monthly, for those assigned to the third degree of invalidity; b) war veterans: -92 lei monthly; c) war widows, if they have not remarried: -92 lei monthly. ------------ Article 1 has been amended by section 1. 1 1 of the single article of LAW no. 205 205 of 24 October 2008 , published in MONITORUL OFFICIAL no. 736 736 of 30 October 2008. + Article 2 (1) The invalids, as well as the war veterans receive, in addition to the allowances provided in art. 1, and an increase of 20 lei monthly for the first year of participation in the war, regardless of the duration of participation, plus 5 lei for each month of participation in the war exceeding one calendar year. ---------- Alin. ((1) of art. 2 2 has been amended by art. II of EMERGENCY ORDINANCE no. 9 9 of 29 April 2015 , published in MONITORUL OFFICIAL no. 299 299 of 30 April 2015. (2) The time of admission to hospitals or sanatoriums and sick leave necessary for the healing of wounds or diseases contracted on the front or occurring within one year after the end of participation in the front, but because of that participation is taken in consideration when granting the increase provided in par. 1. (3) It will also be taken into account the time spent in the prisoner, other than that provided in Decree-Law no. 118/1990 , amended and supplemented, as well as the time necessary for the healing of the contracted diseases during the prisoner or after him, within one year, because of the prisoner. + Article 2 ^ 1 The amounts provided in art. 1 and to art. 2 2 para. (1) is indexed by Government decision, depending on the rate of inflation. ------------- Article 2 ^ 1 has been introduced by item 1. 2 2 of the single article of LAW no. 770 770 of 29 December 2001 , published in MONITORUL OFFICIAL no. 14 14 of 11 January 2002. + Article 3 (1) Invalizations and war injuries, regardless of the degree of invalidity, retain, upon termination of their activity, the right to pension I.O.V.R. and if, according to the law, another pension is due both for the previous period and for the After receiving the pension I.O.V.R. (2) The war vaduvae, who have not remarried, have the right to receive the I.O.V.R. pension regardless of the period during which they were married. + Article 4 (1) The allowances and bonuses provided for in this Law shall be granted, upon request, from the date of its entry into force. -------------- Alin. ((2) of art. 4 4 has been repealed by art. 24 of LAW no. 44 44 of 1 July 1994 , published in MONITORUL OFFICIAL no. 172 172 of 7 July 1994. + Article 4 ^ 1 (1) Provisions art. 1 lit. a) and art. 3 3 para. (1) shall also apply to pensioners I.O.V.R. injured by war outside the ordered service. (2) The rights provided in par. (1) shall be provided from the budgetary funds provided for at the Ministry of Labour, Family and Equal Opportunities for 1992, in the chapter of expenditure "Pension I.O.V.R., military and other persons". ---------------- Name of the Ministry of Labour, Social Solidarity and Family art. 4 ^ 1 was adapted accordingly to JUDGMENT no. 381 381 of 25 April 2007 , published in MONITORUL OFFICIAL no. 287 287 of 2 May 2007. + Article 5 The allowances and bonuses granted under this law do not affect the income ceilings according to which rents are established for housing in the state housing fund, scholarships for students and students and social benefits. + Article 6 In order to apply the provisions of this law, the Ministry of Economy and Finance is authorized that, based on the documentation presented by the Ministry of Defense and the Ministry of Labor, Family and Equal Opportunity to modify accordingly financial indicators provided for in the state central government budget and the state social insurance budget. ---------------- Name of the Ministry of Public Finance art. 6 was adapted accordingly to JUDGMENT no. 386 386 of 25 April 2007 , published in MONITORUL OFFICIAL no. 304 of 8 May 2007, and the name of the Ministry of Labour, Social Solidarity and Family has been adapted JUDGMENT no. 381 381 of 25 April 2007 , published in MONITORUL OFFICIAL no. 287 287 of 2 May 2007. + Article 7 The Ministry of Defence together with the Ministry of Labour, Family and Equal Opportunities and the Ministry of Economy and Finance will develop the methodology for calculating, indexing and paying allowances and bonuses provided for in this law. ---------------- Name of the Ministry of Public Finance art. 7 was adapted accordingly to JUDGMENT no. 386 386 of 25 April 2007 , published in MONITORUL OFFICIAL no. 304 of 8 May 2007, and the name of the Ministry of Labour, Social Solidarity and Family has been adapted JUDGMENT no. 381 381 of 25 April 2007 , published in MONITORUL OFFICIAL no. 287 287 of 2 May 2007. + Article 8 -------------- Alin. ((1) of art. 8 8 has been repealed by art. 24 of LAW no. 44 44 of 1 July 1994 , published in MONITORUL OFFICIAL no. 172 172 of 7 July 1994. (2) The Ministry of Foreign Affairs, the Ministry of Defense, the Ministry of Labour, Family and Equal Opportunities and the Ministry of Economy and Finance will examine, on the basis of international conventions, in conditions of reciprocity with the interested states, the situation Romanian citizens who fought in other armies. ---------------- Name of the Ministry of Public Finance of the para. ((2) art. 8 was adapted accordingly to JUDGMENT no. 386 386 of 25 April 2007 , published in MONITORUL OFFICIAL no. 304 of 8 May 2007, and the name of the Ministry of Labour, Social Solidarity and Family has been adapted JUDGMENT no. 381 381 of 25 April 2007 , published in MONITORUL OFFICIAL no. 287 287 of 2 May 2007. + Article 9 The financial resources necessary to cover the additional expenses resulting from the application of this law will be distributed, under derogatory conditions, from the amount provided for art. 1 1 para. ((3) of Law no. 22/1991 , for the coverage of material and capital expenditures determined according to the evolution of the price indices. + Article 10 Art. 4 para. 2 2 of Decree no. 245 245 of 28 July 1977 is repealed. This law was passed by the Senate at its July 8, 1991 meeting.
