The Romanian Parliament adopts this law + Article 1 The President of Romania represents the state in international relations and, in this capacity, concludes treaties on behalf of Romania or can give powers, for this purpose, to the Prime Minister, to the Minister of Foreign Affairs, to other members of his government some diplomatic representatives of Romania. Based on the empowerment given by the President of Romania, the government is taking measures to initiate and negotiate international treaties that end on behalf of Romania. + Article 2 The government can negotiate and sign agreements, conventions and other international agreements at the government level. He approves the conclusion of agreements, conventions and other agreements at a departmental level. + Article 3 The negotiation and signing of international treaties concluded on behalf of Romania are made, on the basis of the empowerment given by the president, by the delegations approved by him. The negotiation and signing of agreements, conventions and other international agreements at the government or departmental level shall be made on the basis of the empowerment received by the delegations approved for this purpose. + Article 4 International treaties signed on behalf of Romania, as well as agreements, conventions and agreements signed at the level of the Romanian government, which refer to political and military collaboration, those that make it necessary to adopt new laws or review laws in force, as well as those involving a political or financial commitment or concern issues concerning the political and territorial regime of the state or the status of persons, citizens ' rights and freedoms or participation in international organizations, as well as those expressly providing for it, are subject to Parliament for ratification by law. Provisions of para. 1 on ratification by the Parliament shall also apply to the accession to the international treaties provided for in this paragraph. Denunciation of the international treaties provided in par. 1 and 2 follow the same procedure. + Article 5 Agreements, conventions and other international agreements which, by their object, shall not be included in the provisions of art. 4, are the responsibility of the government After negotiation and signing they will be subject to its approval. The Government informs the President of Romania and the Parliament of any agreement, convention or other international agreements which it concludes and which must not be subject to ratification. + Article 6 Agreements and agreements in simplified form, concluded by the Ministry of Foreign Affairs by exchange of notes or letters, may enter into force from the date of its performance, without being subject to further ratification or approval. Provisions of paragraph 1 does not apply to agreements, conventions and international agreements that, according to the provisions of art. 4, make a law necessary. + Article 7 The initiation, negotiation and signing of treaties, agreements, conventions and other international agreements, on behalf of Romania or at governmental level, shall be made, in compliance with the provisions of art. 3, by the Ministry of Foreign Affairs. They can also be done by the ministries and central bodies that have received powers and powers in this regard, in collaboration with the Ministry of Foreign Affairs, the specialized body through which the government ensures unitary coordination and policy in this Domain. The Ministry of Foreign Affairs presents to the government, alone or, as the case may be, with the other ministries, proposals on the signing, ratification, approval of treaties, agreements, conventions and other agreements or accession thereto. or for denouncing them. + Article 8 The powers to sign treaties, agreements, conventions and other agreements of a governmental nature are recorded in the full powers, which are issued by the Ministry of Foreign Affairs, being signed by the Minister of Foreign Affairs, according to international regulations and practice. The President of Romania, the Prime Minister of the Government and the Minister of Foreign Affairs can negotiate and sign treaties, agreements, conventions and other international agreements, without presenting full powers. + Article 9 Ratification or accession, respectively the denunciation of the treaties concluded on behalf of Romania, shall be recorded in the instruments of ratification or accession, respectively of denunciation, signed by the President of Romania, invested with the seal of the state and countersigned by Minister of Foreign The above-mentioned instruments are to be exchanged between the parties or deposited with the depositary, in accordance with the rules of international law and international practice. The approval of agreements, conventions and agreements concluded at the level of the government shall be notified to the other contracting party or depositary, by diplomatic means. + Article 10 The government shall take the necessary measures for the application of the treaties, agreements, conventions and other international agreements and control how they are carried out. The Government regularly informs the President of Romania and the Parliament about the problems posed by the application of treaties, agreements, conventions and other international agreements, in order to solve their operative, in full consistent with the principles of international law and the interests of the + Article 11 The laws for the ratification of international treaties and decisions for the approval of agreements, conventions and other international agreements, as well as their texts, shall be published in the Official Gazette. Parliament and the government, respectively, may decide that certain treaties, agreements, conventions or other international agreements are not published. The Ministry of Foreign Affairs ensures the publication in the Official Gazette of data and information on the life of the main treaties, agreements, conventions and other international agreements to which Romania participates, as well as their registration at United Nations. This law was passed by the Senate at its meeting on January 4, 1991.
