LEGE No. 30 of November 15, 1990 on the employment of employees by competence

The Romanian Parliament adopts this law + Article 1 Employment, under the law, of employees at state institutions, state administration bodies and any other budget unit is made only through competition. At autonomous regions, companies and any other legal entities, the employment of employees is made under the conditions established by them if, for the occupation of certain positions, by law it is not provided otherwise. + Article 2 Any discrimination in the employment of employees on political, ethnic, confessional, age, sex and material state criteria is prohibited by law. Violation of provisions of para. 1 attracts disciplinary, administrative, civil or criminal liability, as the case may be. + Article 3 Within 3 months from the entry into force of this law, the government will organize the attestation on the post, on the basis of examination, of the employees of the state administration. Posts become vacant as a result of testing will be filled through the competition. + Article 4 State administration bodies, autonomous regions, commercial companies and any other organizations employ graduates of a educational establishment, at their debut in the interest profession, for a trial period. The duration of the trial period shall be determined by the management body of the unit referred to in paragraph 1, but will not be less than 6 months and more than a year. The legal provisions concerning the internship are repealed. + Article 5 The legal provisions that condition the occupation of management, execution positions or any other functions, regardless of the field of activity, of seniority in work or in the specialty are repealed. Provisions of para. 1 does not apply to judges, prosecutors, doctors and teachers, whose criteria for employment and promotion on the basis of competence are established by the statutes of the respective professions. This law was passed by the Senate at its meeting on November 12, 1990.
