Law No. 4 of 29 June 1989 relating to insurance and quality control products and services ISSUING NATIONAL ASSEMBLY and published in OFFICIAL GAZETTE No. 24 of 5 July 1989 under the Communist Party's policy of socialist society multilaterally developed in our country, a target of major importance is the level and quality of technical products in accordance with the latest advancements in scientific-technical revolution, harnessing the upper part of raw materials, fuels and energy, all the resources of the country, increasing the landmarks of Romanian products.
For this purpose it is necessary to improving, in a unified conception of quality control and assurance products and services and the establishment of technical and organisational measures to be taken by the producer and beneficiary on all phases of their development, in order to respect strictly the quality conditions.
To increase accountability and strengthen the contribution of the Councils of the working people in enterprises, scientific research institutes, engineering and design, ministries, other Central and local bodies. To all personnel, in ensuring the quality of products and services, and to create the appropriate legal framework for this activity.


Chapter 1 General provisions Article 1 quality assurance products and services constitute a fundamental obligation of workers, instructors, technicians, engineers, designers and researchers of all working people, in their capacity as owners of the means of production and beneficiaries of estates, responsible directly to the realization of technical-qualitative parameters of the entire production, so that no product is not delivered, the undertaking If you do not meet the quality conditions.


Article 2 Management of enterprises, power stations, ministries and other bodies are obliged to provide technical and material conditions necessary for product quality in accordance with the provisions of the single national plan for economic and social development and the programme of the Organization and modernization of manufacturing processes.
Management of scientific research institutes, technological design and engineering are required to develop constructive and technological solutions, starting with the best worldwide, achievements conducive to obtaining products with a high technical level and quality.


Article 3 the increase in the quality of the products is carried out on the basis of the latest advancements in scientific-technical revolution, under the strict rules of classification in the consumption of raw materials, fuels, energy sources and the reduction of their raw materials, replacement and recovery of those deficient materials, reusable, reducing production costs, permanent growth of profitability of each product and labour productivity.
Labour people have the right and obligation to make proposals to reduce consumer rules, labour productivity growth, technological modernisation processes, typing parts, sub-assemblies and products.


Article 4 product quality parameters are provided in the standards, specifications, approved by the authority of law enforcement agencies, as well as in contracts, in accordance with the conditions of the quality laid down on products and product groups.
Normative technical documents referred to in the preceding paragraph, relating to the quality parameters as well as contracts are required for all scientific research, engineering and design companies, central banks, ministries, other Central and local bodies.


Article 5 shall prohibit derogations from constructive and technological documentation, as well as certified to the standards and specifications.


Chapter 2 securing and controlling the quality of products Article 6 in order to create all the conditions for executing highly technical products and quality assurance activities and organized quality control on all stages of realization of products:-researching, designing and developing technologies;
-testing, preparation of production and approval of the products and technologies;
-Contracting and material and technical supplies;
-execution and control of the manufacturing of products;
-packaging, handling, storage and transport of products;
-reception of the delivery, commissioning, use, maintenance, service and reliability of tracking products.
To this end, businesses and power plants are obliged to draw up programmes of technical and organizational measures to ensure and control product quality, as well as the plan of technical examinations and inspections on the basis of the framework rules, approved by the Council on the coordination of the activity of the branches, the opinion of the State General Inspectorate for quality control of products.


Article 7 to ensure the creation of conditions to ensure the quality and reliability to produce the corresponding units of importance and which are intended to operate under severe operating conditions and is subject to safety authorisation regime.


Chapter 3-duties and responsibilities of the producers to ensure and control product quality Article 8 Enterprises, power stations, ministries and other central organs are obliged to ensure the technical level and quality of products corresponding to the provisions of the single national plan for economic and social development and of improving the Organization and modernization of production processes at all stages of realization of products, starting with researching and designing and operating tracking.


Article 9 research institutes, engineering and design, as well as engine design, the units are responsible for the quality of technical solutions regarding the design and manufacture of the products defined in the documentation they have prepared, providing technical assistance to those recipient and establishments during execution, installation, putting into service or use of products. Researchers, practitioners, and other technology specialists who participate in drafting and endorsing technical documentations are responsible for making the production and exploitation of technical and economic parameters, quality and reliability designed.


Article 10 obligation of companies and power plants have to organize and execute your entire production for domestic and export, provided for in the plan, to the characteristics and technical performance and quality technical and normative documents and take measures for underwriting: a) development and implementation of programmes of technical and organizational measures to ensure and quality control, plans for technical examinations and inspections and programs of continuous improvement of technical level and quality of the products under conditions of reducing consumption of raw materials, fuels and energy;
  

b) ensuring and maintenance officers, machinery and installations at the parameters covered stands and measure and control apparatus;
  

c) entry into manufacturing of series of new or upgraded products after approval thereof and preparation manufacturing;
  

d) placing in the manufacturing process of raw materials, materials or other products made by cooperation, only on receipt, use interzicind to those who do not comply with the provisions of the technical documentation;
  

e) before the delivery of the products, all the samples for checking the technical and functional parameters as set out in documents and contracts;
  

f) organizing their own compartments for technical quality control and assurance of their officials, in all phases of realization of products;
  

g) product manufacture restriction where it finds deviations from design technologies;
  

h) systematic method of tracking behavior of products and measures for raising quality;
  

I) organizing training of staff improvement and quality control, training and periodic checking of knowledge;
  

j) ensuring compliance with stringent production prices and delivery, in close correlation with the quality of products, aiming, through the compartments of financial and accounting management, optimizing quality, compliance with the rules and regulations for financial costs of planned production.
  


Article 11 domestic and export products are delivered only accompanied by certificates of quality, warranty, analysis bulletins or other documents of quality certification, issued by establishments and the basics of material and technical supply.
Machinery, equipment, installations, appliances and other durable goods will be delivered from enterprises accompanied technical book.


Article 12


The workers are responding directly to the quality of our products and have the obligation to maintain and operate the machines, equipment and plants with whom he works at the level of precision and efficiency, to carry out operations in accordance with the technical documentation, verify, continuously, through checks, operations and products made to submit master fitter all parts and products in order to confirm the correctness of the execution, to be demanding and to refer the matter immediately to the driver of any deficiency concerning quality , published in the manufacturing process.


Article 13 other Leaders and rulers working formations responsible for ensuring the quality of the goods or works executed under working formations and are obliged to take measures for the proper organisation and conduct of the production process, strict observance of technological discipline by the workmen, to control the quality of operations, work and products in order to prevent any deviations from the specifications , to prohibit the passage from one phase to another of improper parts quality.


Article 14 heads of sections and workshops shall be responsible for the quality of the manufactured products and ensure each formation in technical matters related to conditions necessary material production process according to manufacturing technology, to provide technical assistance, to take the necessary measures to prevent the causes which may cause improper products quality.


Article 15 the control compartment of the quality required to conduct rigorous checks at all stages of realization of products, check the adjustment and accuracy of the means of production and to prevent the execution and delivery of products with quality deficiencies.
The Chief Technical Officer of quality control is responsible for the Organization and technical quality control throughout the manufacturing flow, to promote modern methods of control, raising the qualifications of Auditors of quality, delivery of products which do not correspond to quality.


Article 16 Directors and leaders of other economic entities responsible for carrying out the tasks incumbent on the establishment plan in the field of quality, ensuring all the technical and organizational conditions required for production in strict conformity with the technical documentation, execution of technical excellence of quality control in the manufacturing process and are required to deliver adequate quality products only.


Article 17 Committees for production quality and economic efficiency in enterprises are required to control and analyse the quality of production, quality control of products is carried out by the workers who run them, leaders and other leaders of the production process and to propose measures for the improvement of the technology and the business of insurance and quality control.


Article 18 Councils working people in enterprises and Central are obliged to take measures to ensure the technical and material conditions for the realization of products at the level of quality provided in normative technical documents and contracts, as well as for organizing and carrying out quality control on all stages of production by the workers, foremen, other leaders of jobs and technical compartments quality control.


Article 19 the General Assemblies of the people working in enterprises and are obliged to take measures to raise the level and quality of technical products, uptake of new products and technologies, promoting new technology in all sectors of activities and exploitation of the results of scientific research.


Article 20 other economic Ministries and central bodies responsible for the technical level and quality of the products, made by subordinate units for domestic and export, in accordance with the provisions of the single national plan for economic and social development programs for improving the Organization and modernization of production processes and special programs on products and product groups, as well as documentation, in which purpose are obliged to take action elaboration: (a)), in a unitary concept, framework rules and quality control to branches and subbranch of production;
  

(b) ensuring and monitoring the completion of) the plan and programmes relating to the technical and qualitative level of products by enterprises and Central;
  

c) ensuring barrier-free units with means of production, test stands, measure and control equipment;
  

d) activity for technical quality control at the level of the Ministry and subordinated units;
  

e) elaboration of studies for the assimilation of new products, as well as for modernization and raising technical and quality of products;
  

organisation of cooperation between f) establishments under such conditions as to ensure that the quality level of the products referred to in the documentation;
  

g) development and implementation of programmes of education and continuous professional development training to all personnel worker;
  

h) organizing in-service behaviour tracking products and taking measures to improve their quality;
  

(I) cessation of manufacture of all products) if they do not meet the technical and economic parameters set forth in the documentation approved in accordance with the law.
  


Article 21 boards of ministries and other bodies are obliged to analyse systematically how to ensure the quality of products and it infaptuiesc the tasks in this area provided for in the single national economic and social development and programmes for improving the Organization and modernization of manufacturing processes, establishing the technical and organizational measures for raising the technical level and the quality of all products.


Article 22 technical and economic Councils in enterprises, and central ministries are obliged to ensure that the technical solutions that lead to renewing and upgrading its products and endorse only those execution documentation that ensures products with functional characteristics, technical-economic and qualitative enhancement.


Article 23 Councils coordinating activity branches are responsible for carrying out the provisions of the single national plan for economic and social development programs for improving the Organization and modernization of production processes and social programmes relating to raising the quality of products and technical; establish measures as ministries and enterprises, power stations to ensure the level of quality of the products referred to in the documentation for the products to be implemented through cooperation.


Article 24 of the mass Organizations and public associations are obliged to take steps to mobilize and stimulate creative initiative of the entire staff, for use with the efficiency of raw materials and materials, correct operation and high efficiency of machinery and equipment, realization of products under the conditions laid down in the quality documentation.


Chapter 4 Obligations and responsibilities of beneficiaries relating to product quality assurance and control in article 25 of the beneficiary Units are obliged to control, as stipulated by law and contracts, during the execution of the works, products or how the supplier fulfil the agreed clauses units with respect to the quality, to indicate any deficiencies and to take the necessary measures to remedy them.


Article 26 the beneficiary Units shall carry out reception of products from suppliers according to legal provisions and contracts and take only those products which comply with the terms.


Article 27 the beneficiary Units are obliged to pursue a systematic mode of behaviour in service of the purchased products, analyse the results and to establish together with the suppliers technical measures for quality improvement.


Article 28 acquisition of goods intended for export shall be made on the basis of the reception, foreign trade enterprises by their own representatives or based on contract through specialized units.


Chapter 5 powers of Central and local bodies in ensuring product quality control and Article 29 of the State Planning Committee, together with territorial planning bodies, base and prepare lifting plan of technical level and quality of the products in accordance with the provisions of the organisation of training programmes and upgrading production processes and ensure all necessary conditions for the smooth operation of the manufacturing of products and systematic tracking of their execution at the appropriate technical level and quality of the tasks of the plan established on the central ministries and enterprises, in territorial aspect.


Article 30 of the National Committee for Science and technology is responsible for achieving the objectives of the scientific research and the introduction of new technology which ensures the Permanent lifting of the level of technical and qualitative products, advanced technologies and promoting generalization.


Article 31 the Ministry of Supply and material management and Control of funds and its territorial bodies responsible for material and technical supplies in accordance with the provisions of the plan and of consumer rules, operating, maintenance and repair of fixed funds corresponding to the regular filing quality assurance of products and equipments with stands trial.


Article 32


The Ministry of finance, banks and the State Committee for prices and their territorial bodies responsible for perfecting the management system of quality, ensuring the implementation and funding of all the products referred to in the single national economic and social development and in raising their quality to be in compliance with the standardized financial and material consumption and in the planned production costs; observe strict production prices and delivery, elimination of unprofitable products and improper spending and not credited products with qualitative versus misconduct provisions of contracts.


Article 33 the Ministry of foreign trade and International Economic Cooperation and foreign trade enterprises are responsible for the fulfilment of contractual clauses concerning quality, controlling over at enterprise how to realize the goods contracted for export of take-over of the products intended for export or import based on its own reception, as well as strengthening the control of border crossings.


Article 34 the popular Councils, municipal district, city and municipal services are responsible for carrying out the provisions of the single national economic and social development programmes of the Organization and modernization of manufacturing processes in territorial aspect, providing all conditions, for raising technical and quality of products by all units that operate in their territory.


Article 35 the Council of Ministers shall be responsible for carrying out the entire economy, the policy of the party and rule concerning raising the quality and technical level of production, in which the goal is to take the measures as other ministries, Central and local bodies, power plants and businesses to realize the provisions of the single national plan for economic and social development and of improving the Organization and modernization of manufacturing processes relating to quality assurance.


Chapter 6 General Powers and duties of the State Inspectorate for quality control of products Article 36 of the State Inspectorate for quality control of products and is responsible for carrying out the coordinates of a strict control of product quality at all stages of implementation, in which the following main tasks end exercise: a) ensure together with the ministries and other Central and local bodies to organize and control product quality , designing programs to improve quality indicators, determining what should be included in the five-year and annual plans;
  

b) controls the insurance business and product quality control in enterprises and ministries, following compliance with the production phases on the technical conditions of quality standards, specifications and contracts, interzicind delivery of goods which do not meet; it authorises staff and laboratories for technical quality control and initiates activities for the improvement of vocational training;
  

c) participate in activities of the type-approval of the products and give consent to or reject the proposals, setting out the measures to be taken if they do not ensure quality;
  

d) directs and controls the drafting quality control technologies, products, promote the use of modern methods of control;
  

e) controls, as stipulated by law, the insurance business of the quality of imported goods;
  

f) monitoring compliance with and enforcement of legal regulations in the field of metrology relating to equipping of production processes with measuring instruments, operation and maintenance thereof, so as to ensure precision levels referred to in the technical documentation.
  


Article 37 of the State Inspectorate for quality control of products with features prior to inform the central or local organs, stopping of manufacture, where it is noticed deficiencies in the process of production and technical control of quality.


Chapter 7 powers of the Central Council of workers ' Control of the activity of the economic and Social Council Article 38 Labour Central Control of economic activity and social controls applied by the ministries, other Central and local organs of the central economic units, and of the measures established by the leadership of the party and the State on the modernization of the production structure and raising the level and quality of technical products.


Article 39 the Board of Control of the Central workers ' economic and Social Activity and the General Inspectorate for quality control of products shall be responsible for organizing and carrying out a rigorous inspection of export goods, both in manufacture and dispatch them in accordance with contractual provisions.


Article 40 of the Basic Conditions of the quality of products and services, the conditions for authorizing the manufacture of products of particular importance, the liability of establishments of quality, the conditions of establishment of liability, as well as material facts constituting the violation and how to sanction them, other rules regulating the business of insurance and quality control, shall be laid down by the regulation approved by Decree of the State Council.


Chapter 8 final provisions Article 41 the provisions of this law shall apply to properly service benefits, as well as cooperative organizations and other public organizations.


Infringements of the provisions of article 42 of this law shall entail, where appropriate disciplinary, material, administrative, civil or criminal sanctions to those guilty.


Article 43 application of administrative sanctions for infringements of the rules on insurance and quality control of products and services do not preclude the application of disciplinary sanctions according to the labour code and other laws.


Article 44 the present law shall enter into force 90 days after its publication in the Official Gazette of the Socialist Republic of Romania.
On the same date shall repeal Law on product quality and services no. 7/1977 published in Official Gazette No. 63 of 9 July 1977.
