Within the policy of the Romanian Communist Party to build the multilateral socialist society developed in our country, a goal of major importance is to raise the technical and qualitative level of products in accordance with the latest conquests of the technical-scientific revolution, the superior valorization of raw materials, materials, fuels and energy, of all the country's resources, increasing the competiveness of Romanian products To this end, it is necessary to improve, in a unified conception, the activity of insurance and quality control of products and services and the establishment of technical-organizational measures to be taken by the manufacturer and the beneficiary the phases of their achievement, in order to comply with the quality conditions. To increase the contribution and strengthen the responsibility of the councils of the working people of enterprises, plants, scientific research institutes, technological and design engineering, ministries, other central and local bodies. Of all the working staff, in ensuring the quality of products and services, and for creating the legal framework corresponding to this activity + Chapter 1 General provisions + Article 1 Ensuring the quality of products and services is the fundamental obligation of workers, foremen, technicians, engineers of researchers and designers, of all working people, in their capacity as owners of the means of production and beneficiaries of material goods, which respond directly to the realization of the technical-qualitative parameters of the entire production, so that no product is delivered, from the enterprise, if it does not meet the quality conditions. + Article 2 The management of enterprises, plants, ministries and other bodies are obliged to ensure the technical and material conditions necessary to achieve the quality of the products in accordance with the provisions of the single national development plan economic and social and programs to improve the organization and modernization of production processes. The conductions of scientific research institutes, technological engineering and design have the obligation to develop constructive and technological solutions, starting from the best achievements worldwide, leading to the obtaining of products with a high technical and qualitative level. + Article 3 The lifting of the qualitative level of the products is achieved, based on the latest conquests of the technical-scientific revolution, under the conditions of strict classification in the norms of consumption of raw materials, materials, fuels, energy and continuous reduction of to them, the replacement of raw materials and deficient materials, the recovery of reusable ones, the reduction of production costs, the permanent increase in the profitability of each product and the productivity of work. Working people have the right and obligation to make proposals to reduce consumer norms, increase labor productivity, modernize technological processes, typing parts, subassemblies and products. + Article 4 The quality parameters of the products are provided in standards, specifications, approved by the bodies provided by law, as well as in contracts, in accordance with the basic conditions of quality established on products and groups of products. The normative technical documents, provided for in the previous paragraph, regarding the quality parameters as well as the contracts are mandatory for all scientific research units, technological engineering and design, enterprises, plants, ministries, other central and local bodies. + Article 5 Derogations from approved constructive and technological documentation as well as from the provisions of the standards and specifications shall be prohibited. + Chapter 2 Quality assurance and control of products + Article 6 In order to create all the conditions for the execution of products of high technical and qualitative level, the quality assurance and control activity is organized on all stages of product realization: -research, design and development of technologies; -testing, preparation and approval of products and technologies; -contracting and technical-material supply; -execution of products and control of manufacture; -packaging, handling, storage and transport of products; -reception at delivery, commissioning, use, maintenance, operation tracking and product reliability. For this purpose, enterprises and plants are obliged to develop technical and organizational measures for the quality assurance and control of products, as well as the plan of technical examinations and inspections, on the basis of framework norms, approved by the branch of activity on branches, the opinion of the General State Inspectorate for Quality Control of Products. + Article 7 In order to guarantee the creation of the conditions for ensuring proper quality and reliability, the manufacture of products of special importance and which are intended to operate under severe conditions of exploitation and safety is subject to the authorisation regime. + Chapter 3 Obligations and liabilities of producers on product quality assurance and control + Article 8 Enterprises, plants, ministries and other central bodies have the obligation to ensure the technical and qualitative level of products corresponding to the provisions of the single national economic and social development plan and improvement programs of the organization and modernization of the production processes, in all phases of realization of the products, starting with the research and design and up to their exploitation. + Article 9 The institutes of scientific research, technological engineering and design, as well as the design compartments in the units, are responsible for the quality of the technical solutions on the design and manufacturing preparation of the products, adopted in the documentation they have developed, the provision of technical assistance to the manufacturing and beneficiary units during the execution, assembly, commissioning or use of the products. Researchers, designers, technologies and other specialists who participate in the elaboration and approval of the technical documentation of the products respond to the production and exploitation of the technical-economic parameters, quality and reliability Design. + Article 10 Enterprises and plants have the obligation to organize and execute the entire production for domestic and export, provided in the plan, at the level of technical and qualitative characteristics and performances in the normative and contracted technical documents and take measures to: a) the development and implementation of technical and organisational measures for quality assurance and control, technical examination plans and inspections and programmes for continuous improvement of the technical and qualitative level of the products, under the conditions of reduced consumption of raw materials, fuels and energy; b) ensuring the operation and maintenance of machines, machinery and installations at the prescribed parameters, equipping with stands of samples and measuring and control devices; c) the introduction into the manufacture of new or upgraded products after their approval and of the preparation of manufacture; d) the introduction into the manufacturing process of raw materials, materials or other products made through cooperation, only on the basis of reception, prohibiting the use of those who do not correspond to the provisions of the technical documentation; e) the performance, before the delivery of the products, of all the verification samples of the technical-functional parameters, provided in the documentation and contracts; f) the organization of the own quality technical control compartments and the assurance of their operation, by activities, in all phases of realization of the products; g) the cessation of the production of products if deviations from the execution technologies are found; h) systematic pursuit of the mode of behavior in exploitation of products and the establishment of measures to raise their qualitative level; i) the organization of the improvement of the professional training of the execution and quality control personnel, the training and regular verification of its knowledge; j) ensuring strict compliance with production and delivery prices, in close correlation with the quality of products made, following, through the financial-accounting compartments, the optimization of quality management, the classification in consumer norms and financial normatives, in planned production costs. + Article 11 Products for domestic and export shall be delivered only accompanied by certificates of quality, warranty, analysis bulletins or other quality certification documents, issued by the manufacturing units and the technical-material supply bases. Machinery, machinery, installations, appliances and other durable goods will be delivered from enterprises accompanied by the technical book of the product. + Article 12 The workers directly respond to the quality of the products and have the obligation to maintain and exploit the machines, machinery and installations with which they work at the level of precision and yield provided, to perform the operations according to the technical documentation, to verify, continuously, through self-control, the operations and products made, to present to the foreman all the parts and products in order to confirm the correctness of the execution, to be demanding and to immediately notify the quality deficiency, arising in the manufacturing process. + Article 13 The masters and other leaders of the working parties are responsible for ensuring the quality of the products or works carried out within the working parties and are obliged to take measures for the proper organization and conduct of the production process, rigorous compliance with the technological discipline by the workers, to permanently control the quality of the operations, works and products carried out in order to prevent any deviations from the documentation, to prohibit the transition from one phase to another qualitatively inadequate landmarks. + Article 14 The heads of departments and workshops are responsible for the quality of the manufactured products and have the obligation to provide each working party with the technical and material conditions necessary to carry out the production process according to the manufacturing technology, to provide expert technical assistance, take the necessary measures to prevent causes that can generate inadequate quality products. + Article 15 The personnel of the technical quality control department are required to carry out a rigorous control, in all stages of the realization of the products, to verify the adjustment and precision of the means of production and not to admit the execution and delivery products with quality deficiencies. The head of the technical quality control department is responsible for the organization and execution of the technical quality control throughout the manufacturing flow, the promotion of modern control methods, the lifting of professional qualification of the controllers quality, stop delivery of products that do not correspond qualitatively + Article 16 The directors and other leaders of the economic units are responsible for carrying out the tasks of the unit in the field of quality, ensuring all the necessary conditions, technical and organizational conditions for the production in strict compliance with the technical documentation, the demanding execution of the technical quality control in the manufacturing process and have the obligation to deliver only qualitatively corresponding products. + Article 17 The commissions for the production quality and economic efficiency in enterprises have the obligation to constantly control and analyze the quality of production, the way in which the quality control of the products is carried out by the workers who execute them, the and the other leaders of the production process and to propose measures to improve the technologies and activity of quality assurance and control. + Article 18 The councils of the working people of enterprises and plants are obliged to take measures to ensure the technical-material conditions for the realization of products at the qualitative level provided in the normative technical documents and in contracts, as well as for organizing and carrying out quality control on all stages of production, by workers, foremen, other job leaders and technical quality control compartments. + Article 19 General meetings of the working people of enterprises and plants are obliged to take measures to raise the technical and qualitative level of products, assimilation of new products and technologies, promotion of new technology in all sectors activities and valorisation of the results of scientific research. + Article 20 The economic ministries and other central bodies shall be responsible for the technical and qualitative level of the products, carried out by units subordinated to the internal and export, in accordance with the provisions of the single national economic and social development plan, programs to improve the organization and modernization of production processes and special programs on products and groups of products, as well as documentation, in which purpose they are obliged to take measures: a) elaboration, in a unified conception, of the framework norms of insurance and quality control on branches and production subsystems; b) ensuring and tracking the fulfilment of the plan and programmes on the technical and qualitative level of the products by enterprises and plants; c) ensuring the endowment of units with means of production, sample stands, measuring equipment and control; d) organization of technical quality control activity at the level of the ministry and subordinate units; e) elaboration of studies to assimilate new products, as well as to modernize and raise the technical and qualitative level of products; f) the organization of cooperation between the producer units in conditions to ensure the realization of the products at the qualitative level provided in the documentation g) elaboration and realization of the programs of labor tuition and continuous improvement of the professional training of all the working personnel; h) organization of the pursuit of the exploitation of the products and the taking of measures to improve their quality; i) cessation of the manufacture of products if they do not meet the technical and economic parameters provided in the documents approved according to the law. + Article 21 The management boards of ministries and other bodies have the obligation to systematically analyze how the quality of products is ensured and the tasks in this field provided for in the single national economic-social development plan and programs to improve the organization and modernization of production processes, establishing technical and organizational measures for the continuous lifting of the technical and qualitative level of all products. + Article 22 The technical-economic councils of enterprises, plants and ministries are obliged to ensure the adoption of technical solutions that lead to the renewal and modernization of products and to endorse only those execution documentation that ensure the realization products with functional, technical-economic and higher quality characteristics. + Article 23 The councils coordinating the activity on the branches are responsible for carrying out the provisions of the single national economic and social development plan, programs to improve the organization and modernization of the production processes and social programs on raising the technical and qualitative level of products; establish measures for ministries, plants and enterprises to ensure the qualitative level of products provided for in the documentation, for products that are carried out through cooperation. + Article 24 Mass and public organizations are obliged to take measures to mobilize and stimulate the creative initiative of all working personnel, for the efficient use of raw materials and materials, the correct exploitation and with a high return of machinery and machinery, the realization of products under the quality conditions provided for in the documentation. + Chapter 4 Obligations and liabilities of beneficiaries on product quality assurance and control + Article 25 The beneficiary units are obliged to control, under the conditions provided by law and contracts, during the execution of the products or works, the way in which the supplier units meet the agreed clauses on quality, to signal any deficiencies and to participate in the establishment of the necessary measures to remedy them. + Article 26 The beneficiary units carry out the reception of the products to suppliers according to the legal provisions and contracts and take over only those products that correspond to the quality clauses. + Article 27 The beneficiary units are obliged to systematically follow the behavior of the purchased products, analyze the results obtained and establish together with the suppliers technical measures to improve the quality. + Article 28 The takeover of goods intended for export shall be made on the basis of reception, carried out by the external trade undertakings by their own representatives or on the contractual basis by specialised units. + Chapter 5 Tasks of central and local bodies in quality assurance and control of products + Article 29 The State Planning Committee, together with the territorial planning bodies, substantiates and elaborates the plan to raise the technical and qualitative level of the products in accordance with the provisions of the programs for the improvement of the organization and modernization of the production processes and ensures all the conditions for the smooth conduct of the manufacture of the products and the systematic pursuit of their execution at the technical and qualitative level corresponding to the plan tasks, established by the ministries, central, enterprise and territorial aspect. + Article 30 The National Committee on Science and Technology responds to the achievement of scientific research objectives and the introduction of new technique that ensures the permanent lifting of technical and qualitative level of products, promotion and generalization advanced technologies. + Article 31 The Ministry of Technical Supply-Materials and Management Control of Fixed Funds and its territorial bodies are responsible for the technical-material supply in accordance with the provisions of the plan and the norms of consumption, exploitation, maintenance and proper repair of fixed funds that condition the quality assurance of the products, as well as the endowment with sample stands. + Article 32 The Ministry of Finance, the banks of the State Committee for Prices and their territorial bodies are responsible for improving the quality management system, ensuring that the realization and financing of all the products provided for in the single national plan economic and social development and in the programs of raising their qualitative level to be done with the classification in the normal material and financial consumptions and the planned production costs; production and delivery, complete removal of unprofitable products and expenses qualitatively inadequate and do not credit products with qualitative deviations from the provisions in the contracts. + Article 33 The Ministry of Foreign Trade and International Economic Cooperation and foreign trade enterprises are responsible for meeting the contractual clauses on quality, controlling, at enterprises how the goods contracted to export, take over the products intended for export or import products on the basis of their own reception, as well as the strengthening of the control at border posts. + Article 34 The county, municipal, city and communal folk councils are responsible for carrying out the provisions of the single national economic and social development plan and the programs to improve the organization and modernization of the production processes in profile territorial, to ensure all conditions, to raise the technical and qualitative level of products by all establishments operating on their administrative territory. + Article 35 The Council of Ministers is responsible for the achievement in the entire economy, of the party's and the state's policy on raising the quality and technical level of production, in which it aims to take measures like ministries, other central and local bodies, plants and enterprises to realize the provisions of the single national economic and social development plan and the programs to improve the organization and modernization of production processes on quality assurance. + Chapter 6 Duties and responsibilities of the State General Inspectorate for Quality Control of Products + Article 36 The General State Inspectorate for Quality Control of Products coordinates and responds to a rigorous control of the quality of products in all phases of product realization, in which the purpose exercises the following main tasks: a) ensure together with the ministries and other central and local bodies the organization and execution of product quality control, the elaboration of programs for quality improvement, the establishment of quality indicators that are included in the plans five-yearly and annual; b) control the activity of insurance and quality control of products in enterprises, plants and ministries, aiming to comply with the production phases of quality technical conditions in standards, specifications and contracts, prohibiting delivery of products which do not correspond qualitatively; authorise laboratories and technical quality control personnel and initiate actions to improve its professional training; c) participate in the activities of the approval of the products and shall endorse or reject the approval proposals, laying down the necessary measures where the quality is not ensured; d) guide and control the development of product quality control technologies, promote the use of modern methods of control; e) control, under the conditions provided by law, the activity of ensuring the quality of import goods; f) controls the application and compliance of legal regulations in the field of metrology regarding the endowment of production processes with measuring instruments, their operation and maintenance, so that the precision levels provided for in technical documentation. + Article 37 The General Inspectorate of State for Quality Control of Products has, with the prior knowledge of central or local competent bodies, the stop of manufacturing, in cases where deficiencies are found in the production process and in technical quality control. + Chapter 7 Tasks of the Central Board of Workers ' Control of Economic and Social Activity + Article 38 The Central Board of Workers ' Control of Economic and Social Activity controls the application, by the ministries, the other central and local bodies, central and economic units, of the measures established by the party and state leadership on upgrading the production structure and raising the technical and qualitative level of the products. + Article 39 The Central Board of Workers ' Control of Economic and Social Activity and the General State Inspectorate for Quality Control of Products are responsible for the organization and conduct of rigorous export control, both in the process of manufacturing as well as their dispatch, according to the contractual provisions. + Article 40 The basic conditions of the quality of the products and services, the conditions for the authorization of the manufacture of products of special importance, the liability of the production units on quality, the conditions for the establishment of material liability the facts that constitute contravention and the way of sanctioning them, other rules on the activity of insurance and quality control, are established by regulation approved by decree of the State Council. + Chapter 8 Final provisions + Article 41 The provisions of this law shall apply accordingly to service benefits, as well as to cooperative organizations and other public organizations. + Article 42 Violation of the provisions of this law attracts, as the case may be, disciplinary, material, civil, contravention or criminal liability of the guilty + Article 43 The application of contravention sanctions for violation of the rules on insurance and quality control of products and services does not exclude the application of disciplinary sanctions according to the Labor Code + Article 44 This law comes into force 90 days after its publication in the Official Bulletin of the Socialist Republic of Romania. On the same date is repealed Law of product quality and services no. 7/1977 ,, published in the Official Bulletin no. 63 of 9 July 1977.
