Law No. 1 of 15 November 1985 autoconducerea, self-management of economic-financial and administrative-territorial units ' autofinantarea ISSUING NATIONAL ASSEMBLY and published in OFFICIAL GAZETTE No. 62 of 18 November 1985 under article 57 of the Constitution of the Socialist Republic of Romania sign and we have to be published in the Official Gazette of the Socialist Republic of Romania law No. 1 of 15 November 1985 autoconducerea, self-management and economic-financial autofinantarea administrative-territorial units.
National Assembly of the Socialist Republic of Romania adopts this law: chapter I General provisions Article 1 of administrative-territorial units In the entire economic activity, social-cultural and urban-gospodareasca popular councils and their subordinate units shall be conducted according to the principles of workers ' self-management, economic and financial self-administration and autofinantarii, which are carried out wide and direct participation of all citizens, in their capacity as owners, producers and beneficiaries at realization of the State policy of the party and the harmonious development and multilateral counties and localities.
By autoconducerea, self-management and autofinantarea administrative-territorial units shall ensure the continuous development of production forces and the local economy, harnessing the full existing resources, strengthen accountability, law and order and discipline in carrying out the tasks of the plan, mobilizing working people to the realization of the actions related to the progress of economic and social planning and settlements, their management, the rise of living standards of all citizens, raising the quality of life.


Article 2-local Councils of popular organ of State power-respond, in accordance with the provisions of the single national plan, developing and carrying out plans for economic and social development in territorial, organizes, directs and controls the performance of the tasks of the plan by all economic units, regardless of their subordination, ensure the proper management of communes, towns, municipalities and counties.
In the performance of their duties, popular councils are obliged to ensure participation of all citizens in the adoption of decisions concerning the development and accomplishment of administrative-territorial units, to take measures to stimulate their initiative in carrying out the provisions of the plan and self-management programs and territorial autoaprovizionare.


Article 3 the popular Councils have an obligation that, in applying the principle of self-administration of economic and financial, to ensure that both their own activities and that of subordinate units, use with maximum efficiency of material assets and the amount of money that they are entrusted to the permanent growth, profitability and increase their own income, participation of the population in the development of settlements and, on this basis, the increase in administrative-territorial units ' contribution to the overall development of society.

Committees and the executive offices of the popular councils are responsible for the proper conduct of the work of the collection, recovery and recycling reusable material resources in the administrative-territorial unit in which they operate, organize actions to raise the population to intensify the collection of scrap metal, household items, packaging, paper and other materials.


Article 5 popular Councils are obliged to carry out its tasks in the fields of economic, social, cultural and administrative-household, under the autofinantarii of each integral administrative-territorial units, coverage of own incomes thanks to all necessary expenditure and participation to the development of the whole society.
To that end, popular councils must act on a permanent basis in order to enhance its revenue base using mood about economy of means at their disposal, strengthening law and order, discipline and legality and commitment, rational management of local resources, increase monetary and material reserves. Where your own income level does not cover expenses, popular councils will restrict their volume at the level of revenue.

Popular councils shall be responsible also for the realization of the provisions of the single national plan on the development of housing from the State Housing Fund, pursuit of the activity of education and health, as well as other actions of general interest executind their local budget funding or from the republican budget, under the present law.


Article 7 in order to enhance the resources autofinantarii and autodezvoltarii settlements, in accordance with the tasks of the plan and the provisions of the local budget revenue and expenditure, the popular councils are obliged to act, mainly for: (a)) increased the efficiency of the activity of all economic entities regardless of their subordination, and overcoming thanks fulfilment of production plans, achieving complete financial indicators, reduction of costs and obtaining benefits a rigorous exercise, control over all activities of these units, strengthening accountability, law and order and discipline in the work;
  

(b) intensive development of agriculture), taking measures to ensure the full use, conservation, and improvement of the Land Fund, increased its production potential, obtaining high yields and stable cultural plans and the production and development of cattle breeding, increase supplies of farm products to the State and, on this basis, meeting, in accordance with the principles of self-management and autoaprovizionarii requirements of the population and the other needs of the national economy;
  

(c) carry out systematic programme) of the territory and urban and rural localities, aiming to restrict building perimeters of settlements to the absolute minimum, several areas of land as well as higher agriculture and rational use of land, modernisation, implementing all the provisions of the draft approved rezoning;
  

d) rational use of all water resources, including curative thermal waters or of local importance, proper water management, identify new sources, harnessing the waters for irrigation, fish farming, the production of electric power, as well as for other purposes, the value of other unconventional resources energy-solar, wind, biogas-to meet the requirements of the national economy and population;
  


e) efficient use of all raw materials and materials allocated by the plan, reducing the wastes and losses, increase the use of existing materials and energy resources locally;
  

f) full collection from the public scrap, non-ferrous metals, textiles, plastics, rubber, paper, glass and other reusable materials. The proceeds from this activity to constitute sources of self-financing in local budgets.
  


Article 8 the executive Committees of councils and popular of Bucharest are responsible for carrying out the good conditions of the plan and the budget of income and expenditure, as well as their own plans and budgets of incomes and expenditures of administrative-territorial units and components of the units subordinated to their creation and use of approved funds.


Article 9 popular Councils will promote strongly in the overall activity of economic entities and social-cultural construction of local subordination, as well as all other units from the territory of the communes, towns, municipalities and counties, economic-financial mechanism principles, thanks to the combination of unitary management of economic and social life, on the basis of single national plan, with wide initiative and retention of working people, the organic integration of the masses in the work of the Organization and management of production Strengthening discipline and social responsibility of every citizen, exercising supervision by people demanding labor over how decisions are taken.

Article 12 Proceeds to budgets of administrative territorial units shall ensure, in accordance with the law, from payments from benefits from economic units of local subordination, taxes and fees paid by these units and cooperative organizations, other public organizations and the population, as well as from other revenues are determined by law as resources of these budgets.


Article 13 local economic Establishments are obliged under the law to participate in the formation of budgets of administrative-territorial units belonging through payments from benefits, taxes and duties.
In order to continue their contribution to the costs of administrative-territorial units, local economic establishments are obliged to operate in conditions more judicious management of monetary funds and materials which they have been entrusted with, carrying out the duties of the approved plan, the development and diversification of the activity to meet the needs of the population.


Article 14 the cooperative craft, the Units of cooperative production, acquisition and disposal of goods and economic units of public organisations, local budgets of the spill from the Councils of the territorial-administrative units where operating income tax, other taxes and duties provided by law.

Article 15 the population is bound to contribute to the financing of revenue of the State budget and local budgets incomes through taxes and fees established in accordance with the law.

Article 17 executive Committees and offices of popular councils are required to take action under the law for setting, monitoring and full and timely collection of taxes, fees and other payments from the Socialist and by population.


Article 18 of the budgets of administrative-territorial units shall be financed according to the law, in accordance with the provisions of the action plan, targets and economic, social and cultural, expenses for maintenance and repair of roads and bridges, local household expenses, expenses relating to the functioning of municipal bodies of State power and administration and other expenses necessary for the units and the activities of local interest.


Article 19 of the republican budget is financed spending on housing construction intended for housing State after law, use of the local units, own sources; expenditure relating to the granting, the tax and social security contribution of their State and the scholarships granted under the law, for the educational units of local subordination; expenditure relating to the granting, the tax and social security contribution of related State for health activities of local subordination, as well as those relating to drugs what support by the State, in accordance with the law; rights of remuneration and allowances what is paid, according to the law, by State, for staff of agricultural cooperative units.
Financing of expenditure on education, health and agriculture referred to in paragraph 1. 1 ensure, where appropriate, through the Ministry of education and higher education, Ministry of health and Ministry of agriculture and food industry and by local bodies of State administration in the corresponding fields. Financing of housing construction, the republican budget, ensure through the executive committees of councils and city folk.

Article 22 Committees and the executive offices of the popular councils are obliged to ensure rational use of money and material means at their disposal, and the funds granted from the republican budget in terms of maximum economic and social efficiency, in compliance with financial discipline and a severe regimen of savings.


Article 23 in order to ensure full coverage of costs provided for in the budgets of local own revenue of each administrative-territorial units, popular councils are required to provide:


to complete the tasks) fulfilling their obligations from the single national economic and social development on the production, production, production of goods, neta services, production for export;

Article 24 of the annual surpluses of the budgets of communes, towns, municipalities, counties, sectors of Bucharest and Bucharest city spill at republican budget contributions to the General Fund for the development of the entire society, which shall be determined annually by the State budget law of the Socialist Republic of Romania. Annual surpluses from their own budgets, committees and executive offices of the popular councils, municipal, town, of the sectors of Bucharest, the counties and Bucharest city may withhold a revolving fund for self-financing, intended to cover the expenditure of the provisional approved before the planned incomes and for balancing their own budgets, as provided by law. The amount of the Revolving Fund for self-financing is established annually by the State budget law.


Article 25 popular Councils are responsible for carrying out the provisions of plans and budgets, their revenue and expenditure, as well as those of subordinate units, taking measures for the achievement of full revenue and expenditure while respecting the carrying out of the plan and financial discipline.


Chapter 3 Financial Contribution and in work for public interest works article 26 on the basis of the principles of self-management, you autofinantarii and administrative-territorial units, all citizens have the obligation to bring the contribution to the development, upgrading and beautification of the localities in which they live and work.

Article 28 public interest works which may be carried out through financial contribution and in the work of the inhabitants shall be established under the present law, citizens ' assemblies.

b) families with two members who work up to 700 million lei;
  

c) families with three or more members who work up to 1,100.
  

In cities and towns, for certain social and cultural objectives of particular public interest, popular executive committees of councils and Bucharest city may set yearly contributions with the urban nature-household, families, in relation to the income of their members.
Committees or executive offices of the popular councils may propose to the citizens ' assemblies where appropriate times may approve full or partial exemption from payment of the contribution payment facilities in its times for some categories of persons, such as persons with disabilities and other persons unable to work.
The financial contribution may pay in several installments, at the latest until 30 September of each year and shall be paid pecuniary contribution from financial bodies or territorial units C.E.C.


Article 33 proceeds from monetary contribution shall not be included in local budgets and may be used only for the approved works. These amounts shall be kept at the offices of the Bank at which units or executive committees of Councils have their popular base account.
Investment works are executed from the financial contribution of the inhabitants can be done only after the setting up of this contribution of funds badly needed in a proportion of at least 50 per cent of the value of the investment.


Article 34 Investment Bank may grant committees and executive offices of repayable loans, popular councils in annual ceilings limit approved by the single national plan, for the execution of the financial contribution, from, schools, boarding schools, kindergartens, nursery school, workshops, cultural and sanitary units and of social assistance.

The contribution of the work shall be considered fulfilled if the volume of the physical works set pursuant to paragraph 1. 1 and 2 was made entirely, regardless of the number of days in which it was conducted.


Article 39 of the economic Units that are established or operating in the sectors of Bucharest, the municipalities, cities, towns or municipalities are obliged to carry out public transportation with animal or mechanical traction they hold with any title-trucks, pickup trucks, road tractors with trailers and semi-trailers, dump trucks and auto trailers related contribution in work at the works of public interest established by the assemblies of citizens.

Article 40 individuals owning of means of transport and establishments referred to in article 1. 39 which of the means of transport, ensure the contribution during the performance of work fuels, lubricants, animal feed, as well as leaders of the means of transport.


Article 41 if not performing the work assigned, the committees and the executive offices of the popular councils will compel individuals and, where appropriate, to pay the sum of Socialist 100-120 lei/day for contribution in work of the inhabitants, 200-400 lei per day for contribution in work vehicles and 400-600 per day for contribution in work by public transport with mechanical traction.
The amount fixed pursuant to paragraph 1. 1 will be paid to residents or Socialist units, within 30 days from the date of receipt of the notification of the payment made by the Executive Committee or the Office of the people's Council.


Article 42 Committees or executive offices of the popular councils, assemblies of citizens can propose full or partial relief of making contribution in work for the disabled, the sick and other persons in situations, which may not make contribution in work.


Section III common provisions Article 43 Proposal to perform certain works through financial contribution and the work can be done by parliamentarians, standing committees, councils or public organisations Socialist units or a group of people.

Article 49 If, after fixing the contribution families income dwindles or other intervening causes which prevent execution of contribution in work, residents may require executive offices or committees of popular reduction councils or exemption from the contribution in money and in work. Committees or executive offices of the popular councils are obliged to resolve incoming requests and to communicate the outcome of the case, their decisions being final.


Article 50 on the basis of the decision of the Assembly of citizens or of the decision of the Executive Committee of the County Council or popular Bucharest whereby it was established amounts unpaid contribution, as well as the equivalent amount of labor incurred shall be levied according to the rules tracking revenues.
The equivalent amount of work incurred by Socialist units by public transport is executed by cashing out their account.
Amounts received as consideration for the outstanding work of committees and remain at the disposal of the executive offices of the popular councils and shall be used only for performing what is effected by contribution in work.


Article 51 with the approval of the works to be executed by the citizens ' Assembly, elect a Committee of citizens for any work to be performed, consisting of residents who participated in the drafting of proposals on these works, as well as from other residents with household spirit and initiative.
Citizens ' committees have the task to assure the knowledge by all the inhabitants of works approved contribution established, deadlines for payment, as well as keeping track of execution and receipt thereof.
At the same time, citizens ' committees and committees supporting the executive offices of the popular councils in receipt of sums, mobilizing residents to perform and in the resolution of complaints made by citizens.
Citizens ' committees operate under the guidance of executive committees or offices of the popular councils and submitted, together with them, on a regular basis, briefings in front of citizens ' assemblies.


Article 52


Works and establishment of contribution in cash and in the work of the inhabitants and of the municipalities, cities, municipalities and sectors of Bucharest, for the objectives of the County and republican interest, decide in compliance with art. 39, 43 and 44.
The Coordinator of the work objectives of interest to the Executive Committee of the County Council is popular, and the County of republican interest in the plan which envisages the work.


Article 53 Committees or executive offices of the municipal councils of the popular sectors of Bucharest, city and municipal services and, where appropriate, coordinating bodies of works mentioned in article 1. 52 answer records and judicious management of amounts collected and purchased materials, as well as the quality of the works performed from monetary contribution and in the work of the inhabitants.
For objectives with a high volume of works which are executed in direct, citizens ' Assembly may empower one or more of its citizens to supervise the execution of the work permanently.


Article 54 executive committees of councils and popular of the Bucharest executive offices and committees supporting councils subordinated to organize popular assemblies of citizens. We also provide guidance and support for permanent offices or executive committees of Councils of administrative-territorial units in which he approved the execution of works by monetary contribution and work, so as to ensure efficient use of local resources, funds and materials, the execution time and the quality of the work.


Article 55 pursuant to this Act, through the family means husband, wife, unmarried children, husband or wife, parents, and other persons, if the household together; by common means and suburban municipalities, constituencies and by means of electoral districts, towns, and municipal sectors of Bucharest.

Article 57 this law shall enter into force on 1 January 1986.


Article 58 on the date of entry into force of the present law shall repeal the law on the Organization of work and contribution to the making of works of public interest no. October 20, 1971, as amended, and any other provisions to the contrary.
