Pursuant to Article 57 of the Constitution of the Socialist Republic of Romania we sign and have to be published in the Official Bulletin of the Socialist Republic of Romania Law no. 1 of 15 November 1985 on self-driving, economic and financial self-management and self-financing of administrative-territorial units. The Great National Assembly of the Socialist Republic of Romania adopts this law: + Chapter 1 General provisions + Article 1 In the administrative-territorial units the entire economic, social-cultural and edilitary-household activity of the folk councils and their subordinate units is carried out according to the principles of working-class self-management, self-management economic and financial and self-financing, on the basis of which the wide and direct participation of all citizens is carried out, in their capacity as owners, producers and beneficiaries, when carrying out the party's policy and the state of development harmonious and multilateral counties and localities. Self-management, self-management and self-financing of administrative-territorial units must ensure the continuous development of the productive forces and the local economy, the full exploitation of existing resources, the strengthening of liability, order and discipline in carrying out the tasks of the plan, mobilizing the working people to the realization of actions on the economic-social progress of the localities, systematizing and managing them, permanent increase of the standard of living of all citizens, raising the quality of life + Article 2 The local councils-local bodies of state power-respond, in accordance with the provisions of the single national plan, to the elaboration and implementation of economic and social development plans in territorial aspect, organize, guide and control the performance of the plan tasks by all economic units, regardless of their subordination, ensures the proper management of communes, cities, municipalities and counties. In carrying out their duties, the public councils are obliged to ensure the participation of all citizens in the adoption and implementation of decisions on the development of administrative-territorial units, to take measures to stimulate their initiative to carry out the provisions of the plan and self-driving and territorial self-supply programmes. + Article 3 The folk councils have the obligation that, in application of the principle of economic and financial self-management, to ensure both for their own activity and for that of local subordination units, the use with maximum efficiency of material means and funds that are entrusted to them, the permanent increase in profitability and the increase of their own incomes, the participation of the population in the development of localities and, on this basis, the increase of the contribution of administrative-territorial general of society. The public councils are obliged by their own income to cover the expenses provided in the local budgets and to participate, under the conditions provided by law, to the establishment of the general development fund of the entire society for breeding Enlarged socialist. The committees and executive offices of the popular councils respond to the smooth running of the activity of collecting, recovering and capitalizing on the reusable material resources in the administrative-territorial unit in which they operate, organize actions to mobilize the population to intensify the collection of scrap metal, household items, packaging, paper and other materials. + Article 5 Popular councils are obliged to perform their duties in the economic, social-cultural and edilitary-household fields, under the conditions of integral self-financing of each administrative-territorial unit, ensuring the coverage of the own income of all the necessary expenses and participation in the development fund of the whole company. To this end, popular councils must act permanently to increase their own income base, the use of their means of economy, the strengthening of order, discipline and legality and the commitment of expenses, rational management of local resources, increase of material and monetary reserves. If the level of own income does not cover expenses, the popular councils will restrict their volume to the income level. All citizens, direct beneficiaries of working conditions and life in the communes, cities and municipalities in which they live, have the duty to actively participate, under the conditions of this law, to the establishment of the general development fund of the entire companies, to self-management of localities, to the realization of social-cultural, economic and urban-household objectives, contributing in this way to the self-financing of administrative-territorial units, to the development and embellishment of all localities. + Article 6 Each administrative-territorial unit-commune, city, municipality, sector of Bucharest, county and Bucharest municipality-operates on the basis of the economic-social development plan in territorial aspect, of the plan economic-social own and local budget that is adopted, under the law, by the popular council of the respective administrative-territorial unit, in strict accordance with the single national plan of economic and social development. The folk councils are responsible for carrying out the provisions of the single national plan of economic and social development, of the incomes provided in the state budget by all the socialist units regardless of their subordination, of the plans and budgets local, as well as self-driving and self-supply programs of localities and other special programs; take measures for the intensive development of industry, agriculture, transport, services and other economic branches, for making full use of local resources, making the most of capacities, increased productivity of labour productivity and economic efficiency in all sectors of activity, increasing the economic potential of each administrative-territorial unit. The popular councils also respond to the implementation of the provisions of the single national plan on the development of housing construction in the state housing fund, the conduct of education and health activity, as well as other actions. of general interest, executing their financing from the local budget or from the Republican budget, under the conditions of this law. + Article 7 For the continuous increase of the resources necessary for the self-financing and self-development of localities, in accordance with the plan tasks and the provisions of the local revenue and expenditure budgets, the folk councils are obliged to act, mainly, for: a) increase the efficiency of the activity of all economic units regardless of subordination, ensuring the fulfillment and overcoming of production plans, full realization of financial indicators, reduction of material expenses and obtaining benefits, the exercise of rigorous control over the entire activity of these units, the strengthening of responsibility, order and discipline in work; b) intensive development of agriculture, taking measures for the complete use, preservation and improvement of the land fund, increasing its productive potential, obtaining large and stable crops, making plans of culture and production and animal husbandry development programs, increasing supplies of agricultural products to the state fund and, on this basis, satisfying, in accordance with the principles of self-driving and self-supply, the consumption requirements of the population and other needs of the national economy; c) the implementation of the program of systematization of urban and rural territory and localities, aiming to restrict the buildable perimeters of localities to the necessary damage, rendering land areas as large as possible to agriculture and using rational of the earth, modernization of localities, realization of all provisions of approved systematization sketches; d) rational use of all water resources, including thermal or curative waters of local importance, judicious water management, identification of new sources, making the most of the waters for irrigation, fish farming, production of electricity, as well as for other purposes, the enhancement of the other non-conventional resources of energy-solar, wind, biogas-in order to meet the requirements of the population and the national economy; e) the efficient use of all raw materials and materials allocated through the plan, the maximum reduction of rebuts and losses, the increase in the valorisation of existing material and energy resources locally; f) full collection from the population of the old iron, non-ferrous metals, textile materials, plastics, rubber, paper, glass and other reusable materials. The revenues from this activity are sources of self-financing in local budgets. + Article 8 The executive committees of the county folk councils and the city of Bucharest are responsible for fulfilling in good conditions the plan and the budget of their own income and expenses, as well as the plans and budgets of income and expenses of the administrative-territorial units and the socialist units subordinated to them, the establishment and legal use of approved funds. + Article 9 The folk councils will strongly promote, in the entire activity of the economic and social-cultural units of local subordination, as well as all other units in the territorial area of communes, cities, municipalities and counties, the principles economic and financial mechanism, ensuring the combination of the unit management of economic and social life, based on the single national plan, with the broad initiative and material co-interest of working people, the organic integration of the masses in the activity of organization and management of production, strengthening discipline and responsibility social of every citizen, the exercise of a demanding control by the working people on the way in which the adopted decisions are fulfilled. + Chapter 2 Measures to ensure economic and financial self-management and self-financing of administrative-territorial units + Article 10 Each commune, city, municipality, sector of Bucharest, county and Bucharest municipality has the obligation to carry out its activity on the basis of the local economic-social development plan, as well as of its revenue and expenditure budget, through ensuring the financial balance and the maximum efficiency of the material and monetary resources of the respective administrative-territorial unit. + Article 11 Popular councils from all administrative-territorial units are obliged to carry out and develop their economic activity under the conditions of continuous growth of their own incomes, from which to ensure, according to the law, increased contributions to setting up the general development fund of the whole company and covering its own expenditure + Article 12 The incomes of the budgets of the administrative-territorial units shall be ensured, under the law, from payments from benefits from the economic units of local subordination, taxes and fees paid by these units and by the cooperative organizations, of other public and public organizations, as well as from other income established by law as resources of these budgets. + Article 13 Local economic units are obliged, according to the law, to participate in the formation of incomes from the budgets of administrative-territorial units to which they belong through payments from benefits, taxes and fees. In order to continuously increase their contribution to cover the expenses of administrative-territorial units, local economic units are obliged to carry out their activity in the conditions of the most judicious management of material funds and money entrusted to them, fulfilling the approved plan tasks, developing and diversifying the activity to meet the needs of the population. + Article 14 The units of the craft cooperative, those of the production, procurement and sales cooperation cooperation, as well as the economic units of public organizations, spill to the local budgets of the popular councils in the units administrative-territorial in which the tax on income, other taxes and fees provided by law. The units of the agricultural production cooperation pour to the local budgets the tax on the land they own, the tax on the retribution fund for the work performed by the cooperative members, other taxes and fees provided by law. Cooperative units are obliged to increase their agricultural production, industrial production and service supplies at all times, contributing to an increasing extent to the achievement of self-supply programs, to increasing their production. supplies to the state fund, to meet the requirements of the population. + Article 15 The population is obliged to contribute to the establishment of state budget revenues and incomes of local budgets by paying taxes and fees established under the law. Also, the population participates in the economic and social development of each administrative-territorial unit through the monetary contribution and in the work for carrying out works of public interest. + Article 16 In order to achieve full self-financing in each commune, city, municipality and county, popular councils have the obligation to take measures to increase their own revenue base, through the continuous development and diversification of production activities. of local interest, service provision and other economic activities, for the full satisfaction of the requirements of the population and socialist units, as well as for the increase of export production. The public councils also act for the full performance of the tasks provided for in the plan by all economic units regardless of their subordination. + Article 17 The committees and executive offices of the popular councils are required to take measures, according to the law, for the establishment, pursuit and full collection and the stipulated deadlines of taxes, fees and other payments from the units Socialist and the population. + Article 18 The budgets of the administrative-territorial units are financed, according to the law, in accordance with the provisions of the plan, objectives and economic, social-cultural actions, expenses of maintenance and repair of roads and bridges of local interest, communal household expenses, expenses on the functioning of local bodies of state power and administration and other expenses necessary for local interest units and activities. + Article 19 From the Republican budget, the expenses for housing construction for the state housing stock are financed, after the use, according to the law, by local interest units, own sources; expenses on retributions, tax and the related state social insurance contribution, as well as the scholarships granted, under the law, for the local subordination education units; the expenses related to the related state social security contributions, tax and social security contributions, for local subordination health units and activities, as well as those on drugs that are borne by the state, under the law; the rights of retribution and allowances that are paid, according to the law, by the state, for the staff of the cooperative agricultural units. Financing of education, health and agriculture expenses provided in par. 1 shall ensure, as the case may be, through the Ministry of Education and Education, the Ministry of Health and the Ministry of Agriculture and Food Industry and through the local specialized bodies of the state administration in the respective fields. The financing of housing constructions, from the Republican budget, is ensured through the executive committees of the county folk councils and the city of Bucharest. + Article 20 The rents that are collected, according to the law, for the buildings in the state housing fund managed by the committees or executive offices of the popular councils are made income to the Republican budget. The expenses of repair, maintenance and administration for these buildings are financed from the Republican budget. + Article 21 The tax on the movement of goods due, according to the law, by the local economic units, by the units of the handicraft cooperation, by those of the production cooperation, purchases and sale of goods, as well as by the economic units of Public organizations, it is fully submitted to the Republican budget. The tax on the total retribution fund due according to the law, by the cooperative units provided in par. 1 and the economic units of public organizations also spill over to the Republican budget. Tax on buildings and tax for the use of state property land, due by socialist units, as well as the peaks to the state budget from the benefits of the units of the House of Savings and Consemnations and from the insurance premiums of The State Insurance Administration, determined according to the law, is made entirely revenue to the Republican budget. The collection for the company due, according to the law, by the local economic units, the tax on the benefits of joint companies and on the incomes of foreign units, which operate in the Socialist Republic of Romania, as well the other income set by law, spills to the Republican budget. + Article 22 The committees and executive offices of the popular councils are obliged to ensure the rational use of the material and monetary means available to them, as well as the funds provided from the republican budget, in conditions of maximum efficiency economic and social, in compliance with financial discipline and a severe savings regime. + Article 23 In order to ensure full coverage of the expenses provided in the local budgets from the own incomes of each administrative-territorial unit, the folk councils are obliged to ensure: a) full fulfilment of the tasks assigned to them from the single national economic and social development plan on physical production, net production, production of goods, service supplies, production for export; b) increased labor productivity, reduction of production costs and especially of materials, reduction of circulation expenses, continuous improvement of the quality of products, services and works of construction, repair and maintenance; c) the timely commissioning of the economic and social investment objectives, the realization of the approved technical-economic parameters, the full use of the production capacities, the equipment and the existing material base, the household judicious of all local resources; d) increasing economic efficiency in all sectors of activity, placing the entire economic activity on the principles of profitability, increasing the money and benefits accruals; e) the use of funds for social-cultural activities in accordance with the degree of fulfilment of the planned actions and in conditions of continuous enhancement, according to the law, of the level of self-financing of social-cultural units. + Article 24 From the annual surpluses of the own budgets of the communes, cities, municipalities, sectors of Bucharest, counties and the city of Bucharest, contributions to the establishment of the general development fund of the the entire company, which is established annually by the state budget law of the Socialist Republic of Romania. In case of non-realization of the planned own income, the peaks to the Republican budget shall be made as a priority, at the planned level, from the realized incomes. From the annual surpluses of the own budgets, the committees and executive offices of the communal, city, municipal, municipal, Bucharest, counties and Bucharest municipality sectors can retain a bearing fund. for self-financing, intended for the provisional coverage of approved expenses, until the realization of the planned revenues, as well as for the balancing of own budgets, under the conditions provided by law. The amount of the turnover fund for self-financing shall be established annually by the state budget law. + Article 25 Popular councils are responsible for meeting the provisions of their own revenue and expenditure plans and budgets, as well as those of subordinated units, taking measures to fully achieve the expected revenues and carry out expenditure in compliance with the plan and financial discipline. + Chapter 3 The monetary contribution and the work for carrying out works of public interest + Article 26 Based on the principles of self-management, self-financing and self-management of administrative-territorial units, all citizens have the obligation to make their direct contribution to the development, modernization and embellishment of the localities in which they live and work. Also, the socialist units have the obligation to participate in the realization of works of public interest in the localities where they operate and to support the actions organized by the folk councils, with the participation of citizens, for good management of the localities. + Article 27 The inhabitants of the communes, towns, municipalities and sectors of the city of Bucharest contribute money and through work on carrying out works of local interest. The inhabitants of the communes, towns, municipalities and sectors of the city of Bucharest are also obliged to participate with money and through work on carrying out works of county and republican interest provided for in the development plans economic and social in territorial aspect of the counties and in the single national plan. + Article 28 The works of public interest that can be carried out through the monetary and labor contribution of the inhabitants are established, under the conditions of this law, by the assemblies of citizens. + Section I Monetary contribution + Article 29 The inhabitants of the communes, cities, municipalities and sectors of Bucharest are obliged to contribute money to the realization of the social-cultural, economic, urban and urban-household objectives set out in the annex to lit. In order to support the realization of works that cannot be carried out only from local resources, in the single national plan will be provided, on each county, the necessary materials, equipment and inventory items. Materials, machinery and inventory items are delivered at the prices in force for sales to socialist state units. The volume of investment and capital repair works, which is carried out by the popular councils of the citizens ' monetary contribution, is included in the national single economic-social development plan in global positions. Their distribution by counties and works is done by the State Planning Committee, the Committee on the Issues of the People's Councils and the Ministry of Finance, on the proposal of the executive committees of the county folk councils and the municipality Bucharest. The elaboration, endorsement and approval of technical-economic documentation for these works are made according to the law. + Article 31 For the investment works that are executed from the monetary contribution of the inhabitants will adapt type projects, which are provided by the executive committees of the county folk councils and the city of Bucharest, through the design institutes and other profile units under their command, and where necessary, and other design units under central organs. + Article 32 The annual monetary contribution shall be determined in relation to the value of the works and to the number of family members of work who earn income, as follows; a) families with only one working member, up to 400 lei; b) families with two working members, up to 700 lei; c) families with three or more working members, up to 1,100 lei. In municipalities and cities, for certain social-cultural objectives of particular public interest, the executive committees of the county folk councils and the city of Bucharest can establish annually contributions of an edilitary-household character, on families, in report with the income earned by their members. The committees or executive offices of the popular councils can propose to citizens ' assemblies or, as the case may be, to approve the total or partial exemption from the payment of the contribution or facilitation in its payment for some categories of persons as they are invalids or other persons unfit for work. The monetary contribution can be paid in several installments, at the latest by September 30 of each year. The monetary contribution shall be paid to the territorial financial bodies or C.E.C. units. + Article 33 The amounts collected from the monetary contribution are not included in the local budget and can only be used to carry out the approved works. These amounts are kept at the banking units at which the offices or executive committees of the popular councils have their basic account. The start of investment works that are executed from the monetary contribution of the inhabitants can be made only after the establishment of this contribution of the necessary funds in a proportion of at least 50 percent of the investment value. + Article 34 The Investment Bank may grant to the committees and executive offices of the popular boards repayable credits, within the limits of the annual ceilings approved by the single national plan, for the execution, from the monetary contribution, of schools, school boarding schools, Children's kindergartens, school-workshops, nurseries, cultural hostels, as well as health and social care facilities. To the bank credit granted, a similar interest rate is charged that they pay, according to the law, to state enterprises in the case of loans granted by the bank for investment activity. Bank loans shall be reimbursed from the monetary contribution of the population, within 3 years from the date of termination of the respective works. If the rates are not submitted on time, the payment amount is considered outstanding and, at all times as it is in this situation, it is calculated, according to the law, the corresponding interest. + Article 35 If, after the execution of the works established, unspent amounts or materials not consumed or for different reasons have remained the established works cannot be executed, they will be used for other works of the nature of those set out in the Annex to lit. A, according to the citizens ' assembly. + Section II Contribution to work + Article 36 All able-bodied residents of the commune have the obligation to contribute through the work to the execution of the urban-household works, the defense and improvement of the land fund, the rational arrangement and use of water sources, provided in the annex to lit. B. In cities, municipalities and sectors of the city of Bucharest, the able-bodied employees contribute through the work to carry out the works of public interest provided in the annex to lit. B point 4-6. + Article 37 The contribution to work is carried out by men and women from the age of 18. People who possess means of transport with animal or mechanical traction, except for cars, are obliged to perform work with these means. + Article 38 The contribution to work consists in the execution of a physical volume of works established on the basis of working norms-square meters of maintenance or repair of roads, cubic meters of excavations and earth fillings to white regularizations and consolidations of banks, cubic meters of extraction and stone breakage or ballast stacking and the like that must be carried out in 6 days annually, under the conditions and at the stipulated deadlines. The contribution to work of the owners of the means of transport consists in the execution of a physical volume of works, calculated in relation to the established quantities and the distances to be carried out, which must be carried out in 6 days annually with each means of transport, under the terms and conditions laid down. The contribution to work shall be deemed to be fulfilled if the physical volume of works established according to par. 1 and 2 was fully realized, regardless of the number of days it was performed. + Article 39 The economic units that have their headquarters or operate in the municipalities, the sectors of Bucharest, cities or communes are obliged to carry out with the means of transport with animal or mechanical traction that they hold with any title -trucks, trucks, road tractors with related trailers and semi-trailers, dumpers and self-tugs-contribution to work on the works of public interest established by citizens ' assemblies. The contribution to work of the socialist units consists in the execution of a physical volume of works, calculated in relation to the quantities provided and the distances to be carried out, which must be carried out in 6 days annually with each means of transport. The physical volume of works is established under the conditions of para. 2 of the committee or executive office of the municipal folk council, of the sector of Bucharest, city or communal. The scheduling of the means of transport for the execution of the contribution to work shall be made by the executive committees or offices of the popular councils, agreed with the management + Article 40 The owner individuals of the means of transport and the units provided in art. 39, holders of means of transport, ensure during the performance of the contribution in the work of lubricants, fuel, animal feed, as well as the drivers of means of transport. + Article 41 In case of non-performance of the assigned works, the committees and executive offices of the folk councils will oblige the individuals and, as the case may be, the socialist units to pay the amount of 100-120 lei per day for the contribution of the inhabitants, 200-400 lei per day for the contribution to work with the workshops and 400-600 lei per day for the contribution in work with the means of transport with mechanical traction. Amounts established according to par. 1 will be paid by residents or socialist units, within 30 days from the date of receipt of the notice of payment made by the committee or executive office of the popular council. + Article 42 The committees or executive offices of the popular councils may propose to citizens ' assemblies the total or partial exemption from making the contribution to work for disabled, sick and other persons in special situations, who cannot perform contribution to work. + Section III Common provisions + Article 43 The proposal to carry out certain works by monetary contribution and in work can be done by the deputies, the permanent committees of the popular councils, the socialist units or the public organizations or by a group of inhabitants. The monetary and labor contribution is decided once a year, as a rule during the first semester, for the following year. + Article 45 For the works that require the monetary or labor contribution of the inhabitants for 2-3 years, the citizens ' assembly can decide the total contribution to be paid by each family and the annual amount, as well as the physical volume of works to be carried out by each inhabitant and by means of transport. + Article 46 Decisions of the citizens ' assembly are mandatory for all residents of the administrative-territorial unit The Board or Executive Board of the People's Council shall be obliged to provide the communication, in writing, to each family, of the amount of the annual contribution in money and the physical volume of works, established by the citizens + Article 47 The executive committee of the county or county council of Bucharest is obliged, if it finds that the decision of the citizens ' assembly was not taken in compliance with the law, that within 20 days of the meeting guidance to the Board or Executive Board of the People's Council on the measures to be taken to ensure the application of the legal provisions. + Article 48 The resident dissatisfied with the decision of the citizens ' assembly by which he was established his contribution in money and the contribution to work can appeal to the committee or executive office of the municipal folk council, of the Bucharest municipality sector, city or communal, within 10 days from the date when he became aware of this decision.
