Development of property of all people, in conditions of improvement of the organizational framework of working-class democracy, of direct participation of masses in the management of economy, based on the principles of self-driving and self-management Further strengthening the responsibility of the working people, the collective management bodies, the management and the superior valorisation of all resources, the increase of economic efficiency, the increase of national income, the sole source of economic-social progress and lifting people's standard of living labor. To this end it is necessary that the patrimony of the socialist units be entrusted, on the basis of contract, to the working people of the units, who as owners of the means of production and at the same time of producers and beneficiaries of material and spiritual values, bear the full responsibility for the direct and effective management of each unit, for the proper management of all material and financial means entrusted from the property of all the people. The state, as the general manager of the property of all the people, ensures the achievement of the country's planned economic-social development policy, the control of the management of the heritage entrusted to the collective of people of work, so that all units operate on the economic principles of efficiency and profitability. For the regulation of the legal framework for the entrustment of the patrimony of the socialist units to the collective of working and strengthening people, on this basis, of the prerogatives and responsibilities of their owners, producers and beneficiaries, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 General provisions + Article 1 In order to strengthen the self-driving and economic-financial self-management, to increase the responsibility of the collective working people, to the collective management bodies of enterprises, plants, ministries and other central bodies, as well as to executive committees of the county folk councils and the city of Bucharest, in the development and defense of the property of the entire people, the judicious and efficient management of all the goods entrusted and the realization of the tasks the single national economic and social development plan shall be established, in the conditions of the present law, the contract + Article 2 The commitment contract shall be concluded between: a) State, as general manager of the property of the entire population-represented by ministries, central or local bodies under which the enterprises and plants operate-and the collectives of working people from these units; b) State-represented, from the empowerment of the State Council, by the Prime Minister of the Government-and ministries, other central bodies or executive committees of the county folk councils and the city of Bucharest. + Article 3 Through the contract-commitment between the state and the collectives of working people from enterprises and plants, the patrimony of these units-an integral part of the property of the entire people-is entrusted to the working staff, in order directly the prerogatives and responsibilities arising from the quality of the working people of the owners, producers and beneficiaries. The contract-commitment establishes the obligations and responsibilities of each collective of working people regarding the preservation and development of the entrusted patrimony, the proper management of the material and financial means, the realization of the tasks of the plan, in order to achieve a higher efficiency, to ensure full coverage of the revenue expenditure, the establishment of the unit's own funds, the participation to a greater extent to the satisfaction of the general needs of the economy. + Article 4 The contract-commitment between the state and ministries, other central bodies or executive committees of the county folk councils and the city of Bucharest, as administrators of the patrimony of the socialist units in subordination, establishes their obligation to act permanently for the maximum efficient use of the technical-productive potential in the respective units, the superior valorisation of resources, the assimilation of new products and the introduction of advanced technologies, the insurance production and production, efficiency gains exports, full and timely realization of plan tasks, defense and development of heritage entrusted to working people in the units. + Article 5 The councils of the working people of enterprises and plants are obliged to establish the necessary measures for the management with maximum efficiency of the entrusted patrimony, the application of the provisions of the contract-commitment, the insurance technical, organisational and economic conditions for the fulfilment of the plan in all sectors of activity. Periodically, with the debate in the councils of working people and the general meetings of the working people of enterprises and plants of the realization of the provisions of the single national plan and the revenue and expenditure budget, the way in which have been fulfilled the obligations and liabilities arising from the contract-commitment, establishing measures for the maximum efficiency of the unit's heritage. The executive office of the council of working people, as collective management of the assets entrusted according to the contract-commitment, ensures that the decisions of the council of working people are fulfilled and directly responsible for taking the measures necessary for the use of financial and material funds, in strict compliance with the destinations established by the plan and the revenue and expenditure budget, as well as the legal provisions. The director of the enterprise and, as the case may be, the general manager of the plant, chairman of the executive office of the council of working people, by individual commitment assumes direct responsibility of the management of the the application of the necessary measures in order to carry out the tasks of the plan, to strengthen the order and discipline at each job, to respect the party decisions and the laws of the country, to fulfill exactly all the obligations resulting from contract-commitment. The Labour People's Council, its executive office, the director of the enterprise, as well as the general manager of the plant, respond to the general assembly of working people, the supreme forum of owners and manufacturers, for the management of the patrimony entrusted and of making all the obligations of the collective of the working people of the contract-commitment. The general assembly of working people, based on the report of the council of working people, analyses the situation of bringing the provisions of the contract-commitment to fruition, setting out the measures for the firmer application working-class and economic-financial self-management, socialist principles of retribution, to increase economic efficiency. + Article 10 The working people, as producers, owners and beneficiaries, are responsible for the direct and effective management of the unit, for the preservation, development and defence of the entrusted heritage, its judicious management, as well as for economic results obtained. Every working man has the right and the obligation to rule on all issues that interest the proper functioning of the activity, its improvement, the work of the governing bodies, participating directly in the elaboration, adoption and achievement of the Decisions. The working people of new employment have the status of associate members of the collective, with the right to vote advisory. In relation to the participation in the performance of the plan tasks and the economic and financial results obtained the working people benefit from all the rights provided by the law for their work. The executive office of the council of working people has the obligation to provide the necessary conditions for the realization of the plan tasks, so that the worker staff can benefit entirely from the retributions and the other rights established according to Law. + Article 11 The ministry or central or local body that concluded the contract-commitment as a representative of the state is responsible for solving the general problems regarding the elaboration and realization of the plan tasks, as well as the guidance and control of housekeeping, by the collective of working people, of the patrimony entrusted according to the contract-commitment. + Section II Contract-commitment between the state and ministries, other central bodies or executive committees of the county and county councils of Bucharest + Article 12 Through the contract-commitment between the state and the ministry, another central body, as well as through the contract-commitment between the state and the executive committee of the county folk council or the city of Bucharest ministries, other central or local bodies, as administrators of the heritage of the subordinate units, as regards: a) the maximum efficient use of the technical-productive potential of all subordinate units, the management by plan of their economic activity; b) superior valorisation of material resources, assimilation of new products and introduction of advanced technologies, full use of production capacities, judicious management of resources, reduction of consumptions, increase of use of reusable materials; c) increasing labour productivity, improving the quality and competitiveness of products and services, as well as their profitability and export efficiency, in order to permanently strengthen economic and financial self-management in all subordinate units; d) rational and efficient use of the workforce, coordination of the activity of organization of production and work, of the insurance of the personnel and the improvement of the professional training of the working personnel; e) the organization and control in all subordinate units and the establishment of the necessary measures to eliminate the deficiencies found, to strengthen order and discipline in each unit. + Article 13 The management board of the ministry or other central body, namely the executive committee of the county or county council of Bucharest, in its entirety and each member, are directly responsible for fulfilling the obligations assumed by contract-commitment concluded according to art. 12. + Article 14 The minister, head of the central body or the chairman of the executive committee of the county folk council or of the city of Bucharest, through the individual commitment assumes direct responsibility for the performance of in the field of activity that he coordinates, the realization of the tasks of the plan, the strengthening of self-management and self-management in all the units subordinated to that body, the observance of the party decisions and the laws of the country. + Chapter 3 Final provisions + Article 15 The provisions of this law shall apply accordingly to state institutions. + Article 16 The working staff existing in the units on the date of conclusion of the contract-commitment will sign the individual commitment within 30 days from the conclusion of this contract + Article 17 The newly framed worker staff has the obligation to work in the unit at least 5 years, under the conditions provided for in the contract-commitment. During this period the working staff has the status of associate member of the labor collective. Socialist units have the obligation to ensure the professional training of the associated members and the improvement of their professional training in relation to the qualification and the rights provided by law. Associate members receive 50% of the amounts due from the fund to participate in the production, benefits and benefit-sharing, and the difference is recorded at the C.E.C. in their name, and will be released at the end of the period years. If the associate members leave the unit before the end of the 5-year period, on their own initiative, unjustifiably, or as a result of the dissolution of the employment contract for reasons that are attributable to them, they have the obligation to refund the expenses incurred by the unit with their professional training, as well as the other expenses of the unit they received free of charge during that period; also, the associated members lose the right to receive the amount recorded at the C.E.C. according to previous paragraph After the passage of the 5-year period, the associate members become full members, quality in which they will be able to choose and be elected to the collective management bodies; the management staff will be recruited only among the full members. --------------------
