Pursuant to Article 57 of the Constitution of the Socialist Republic of Romania we sign and have to be published in the Official Bulletin of the Socialist Republic of Romania Law no. 2 of July 1, 1983 on the basic principles of improving the system of retribution of work and the distribution of incomes of working people. NICOLAE CEAUSESCU PRESIDENT THE SOCIALIST REPUBLIC OF ROMANIA LEGE on the basic principles of improving the system of retribution of work and the distribution of incomes of working people The profound transformations that took place in the strong development of the productive forces, in the continuous modernization of the technical-material base of the economy, especially in the stage inaugurated by the 9th Congress of the Romanian Communist Party, ensured the necessary conditions for lifting up on a higher stage of economic-social activity and the continuous increase of the material and spiritual well-being of all the people, the ultimate goal of the party's The system of working-class democracy was established, the direct participation of the masses in the leadership of the economy, social life, increased the responsibility of the collective of working people in the establishment and realization of the plan, in the household judicious of the goods entrusted by the company. Taking into account the current state of economic and social development, the requirements of improving the economic and financial mechanism, the strengthening of the working-class self-management and the organizational framework of working-class democracy, it is necessary to improve the system of retribution of work and the distribution of incomes of working people, so that the socialist principle of distribution can be applied with all the decision according to the quantity, quality and social importance of the work, and the incomes to be directly determined by the work done and the work results. Working people, as owners, producers and beneficiaries, bear the full responsibility for the good management of the socialist property of the entire people, their incomes being closely related to the realization of production, the increase of productivity work and economic efficiency of the whole activity. Work is a duty of honor to all members of society. Every citizen has, according to the Constitution, the right and obligation to carry out a useful activity to society, which will provide him with the means of existence and spiritual development. The retribution and other income of working people reflect everyone's contribution to the realization of the production plan, to the development of material and spiritual production of society. No one can receive retribution and participate in benefits if they do not work. No one can have guaranteed income if they do n' t work, if they do n' t produce according to work obligations. The individual incomes in relation to the production are uncapped. Under the retribution system, the principle of equal retribution to work is firmly applied, creating conditions that, in relation to the work done, adequate income is provided for all working people. As production and labour productivity increase, product quality improvements, economic efficiency and profitability will increase, the incomes of working people will also increase. For this purpose, on the basis of the decision of the National Conference of the Romanian Communist Party of December 1982 and of the Program approved by the Central Committee of the Romanian Communist Party of 29-30 June 1983, on the firm application of the principles self-management of workers and self-management, improvement of the economic and financial mechanism, the system of retribution of work and the increase of retribution in this five-year, The Great National Assembly of the Socialist Republic of Romania adopts this law. + Chapter 1 Strengthening the self-driving and self-management, the responsibility of the working people for the management of the units and for the results obtained, the improvement of the retribution system + Article 1 According to the principles of working-class self-driving and economic-financial self-management, the collectives of working people are responsible for the preservation, superior valorisation and development of the entrusted heritage, in order to achieve maximum profitability, leading to full coverage of the expenditure, setting up the unit's own funds, increasing the labour income of the working staff, participating to a greater extent to the training of the necessary resources the general development of society. The working people, as owners of the means of production-goods of the entire people-, of producers and beneficiaries, are directly responsible for the effective leadership of each socialist unit, the judicious and efficient management of all material and financial means entrusted from the socialist property of all the people, the economic and financial results obtained in carrying out their tasks from the single national economic and social development plan. + Article 2 The Labour People's Council bears direct responsibility for the good management and development of the socialist property entrusted to the collective of working people in the unit and is obliged to take the necessary measures for the greater increase of labor productivity, full and intensive use of production capacities, superior valorization of all material resources, strict framing in consumer and stock norms, rational use of labor, lifting permanent professional training, the firm application of the provision on perfecting the retribution system, the mobilization of the entire technical-productive potential of the unit for obtaining increased, high quality productions, with the lowest possible expenses. The general assembly of working people debates and adopts decisions on the entire economic and financial activity of managing and continuing the socialist property entrusted to the collective of working people, exercising control permanently on the way in which the council of working people, its executive office, the management staff perform their tasks and act to carry out the provisions of the plan. + Article 3 The retribution of all working personnel is based on the socialist principle of distribution by quantity, quality and social importance of work, depending on the contribution to the development of material and spiritual production of the whole society, the results obtained at work. Work is the fundamental criterion of appreciation of the contribution of each person to the development of the unit of which it is also part of the progress of society, a necessity for the formation, affirmation and multilateral development of human Our socialist society ensures the right to work and creates the necessary conditions for everyone to have a job in the field of material production, technical-scientific and social-cultural activities, in relation to their skills and training and the needs of society development. + Article 4 The system of retribution ensures the material co-interest of those who work on increasing production, labor productivity and economic efficiency, as well as the fair distribution of income from work, an appropriate ratio between minimum and maximum individual income. The form of retribution in global agreement extends and generalizes in all economic units. In addition to tariff retribution, the worker staff benefits, as a variable part of retribution, of additional income, by way of the addition of agreement, participation in benefits, prizes and other incentives, bonuses, allowances and the compensation provided for by law. + Article 5 Working people are repaid in relation to the work performed and the results obtained. In case of exceeding the planned production the revenues increase accordingly and are not capped. In the event of an unrealisation of production or failure to fulfil the obligations of the workplace retribution shall be reduced accordingly, without ensuring guaranteed income. + Article 6 The retributions must be directly correlated with the increase in the productivity of individual work and the entire unit. The increase in labour productivity must be superior to the growth of individual incomes and to the whole of the unit, in all branches and sectors of the national economy, in order to ensure that the funds necessary to increase the income as well as resources to cover the state's general expenses. + Article 7 If there are no possibilities for coverage with production tasks of the entire capacity available to the units, measures will be taken to resize the staff, in accordance with the conditions for carrying out the plan tasks. Collective management bodies are obliged to retain only the working personnel necessary for the actual production and to redistribute the personnel available in other productive activities, repair, maintenance, construction or other activities in units of the framework of the same plant, the same ministry or other ministries. This staff will be repaid by the units to which they operate, corresponding to the works executed, according to the law. + Article 8 For the judicious use of the workforce in each establishment, all personnel, including management and functional personnel, regardless of the form of retribution applied, shall operate on the basis of rules and Scientifically based work normative, established according to the technical parameters of operation of machinery and machinery, the amount of work required, in conditions of superior organization of production and labor. The labor rules must thus be founded to ensure the saving of living work and the realization of the productivity of the planned work. + Article 9 The retribution of the staff is differentiated by branches, subdivisions and activities, depending on their importance for the economic and social development of the country. Within branches, sub-branches and activities, tariff retribution is differentiated by classification and function categories, corresponding to the level of qualification and degree of responsibility required by the performance of tasks, as well as the conditions in that work is carried out. The ranking coefficients of the tariff retribution networks for skilled workers shall be established between 1 and 1,355 in category 1 base and between 1 and 1,905 in the maximum base category, according to the Annex to this Law. + Chapter 2 Expansion and generalization of the global + Article 10 Starting with September 1, 1983, the form of retribution in global agreement applies generalized in economic units in industry, construction-assembly, agriculture, transport, scientific research and technological development, design and from the other sectors. The global agreement includes workers, maisters, engineers, technicians and other staff, including leading personnel in businesses, factories, plants, wards, workshops, brigades, yards, lots, farms, teams and other forms of employment. In addition to the direct productive staff, the global agreement is also comprised of the working staff in the repair and maintenance, tool, internal transport, doposites, functional compartments and other sectors of activity, which contribute to the realisation of the tasks of the company. + Article 11 In the form of retribution in global agreement, a collective of working people undertakes on a contract basis that ends with the unit and, as the case may be, with the superior hierarchical organ-to carry out a particular work or achieve a certain amount of products, under established quality and efficiency conditions, and the unit undertakes to ensure organizational and technical-material conditions corresponding to the performance of the works and to make the work performed with the amount provided in the contract. In the global agreement it is contracted: in the industry, the realization of a complete product or a work or, as the case may be, the planned physical production; in construction-assembly, a block of dwellings, industrial hall, bridge, road, electric line or other objects complete or a volume of works; in agriculture, a certain production of cereals, vegetables, meat, milk or others; in other branches or sectors of activity, planned physical production, expressed in specific units, such as drilled meters, tons of crude oil extract, cubic meters wood mass in the logging, tons transported. + Article 12 The amount of remuneration due to staff paid in the global agreement shall be determined in relation directly to the quantity of physical products made and their quality, without being limited, both in case of overtaking and in case of non-realisation of the plan tasks. The revenue of the staff repaid in global agreement increases as the productivity of individual labor and total unity increases. If the production tasks are carried out with a smaller number of personnel or additional production is obtained with the same number of personnel, it will, correspondingly, the money of higher incomes. Where the production tasks or the conditions laid down in the global agreement are not carried out, the income of the working staff shall be reduced accordingly. + Article 13 In relation to the specificity of some branches or activities, under the conditions provided by law, the forms of retribution on the basis of percentage shares, draw or tariffs are applied. In the activity of interior trade, food and tourism applies to all operative personnel and workers the form of retribution in the draw, expressed by odds at 10,000, 1,000 or 100 lei, or, as the case may be, services; in external trade undertakings and in compartments authorised to carry out external trade operations, the staff shall be repaid on the basis of quotas applied to the value of the export and import, and of the currency contribution made. + Article 14 For technical, economic, other and administrative staff, as well as for the other staff, not included in the global agreement, concrete work tasks shall be established, based on labour and personnel regulations, specifying the quantity and quality of works, execution deadlines or other such obligations, according to the work specification. The retribution of this staff is done in relation to the realization of the work tasks and the established conditions. + Article 15 Starting with September 1, 1983, the entire management and technical execution personnel, economic and other specialty, including ministers, from ministries and other central and local bodies, who coordinate economic activities, as well as the one from industrial plants, is repaid according to the average of achievements on the whole of the subordinate economic units, in relation to the degree of fulfilment of 2-4 indicators of plan-production of goods, export plan, labor productivity, production net or other specific indicators. + Chapter 3 Increase of variable part of retribution + Article 16 In the framework of the measures to improve the retribution system, the share of the variable part increases in the total income of the working staff, obtained from the planned retribution fund, especially by increasing the addition of the agreement, the participation in production, benefit and benefit-sharing, as well as to stimulate export, special achievement awards, material savings and labour savings awards and others. The variable part of the staff's income will represent, in 1985, 25 percent of the retribution fund, and the tariff retribution, 75 percent. + Article 17 Starting with September 1, 1983, under the terms of the plan, the fund for participation of working people in the production, benefits and benefit-sharing will represent 4 percent of the retribution fund on the economy. Within the average of 4 percent provided in par. 1, in establishments producing production for export, as well as in units delivering subassemblies, spare parts and other basic products, which shall be incorporated into the products for export, a higher participation fund shall be ensured, differentiated in ratio with the share of production for export in total production. At the other economic units will ensure, under the conditions of carrying out plan tasks, for the entire staff a fund to participate in the realization of production, benefits and benefit-sharing, which will represent 3.5 percent of the Planned retribution, and in mining and crude oil extraction units, 4 percent. Within the percentages provided in par. 1-3, the allowances in benefits for the establishment of the fund for the participation of working people in the production, benefits and benefit-sharing shall be established, differentiated, by ministries, other central bodies, executive committees of the County folk councils and the city of Bucharest, through the single national plan of economic and social development. Participation in the production, benefits and benefit-sharing is granted quarterly, in relation to the benefits achieved and within 50 percent of the funds planned for these periods. Depending on the annual results, the difference is given for the benefits realized under the plan and the amounts related to the benefits obtained over the plan + Article 18 Starting on September 1, 1983, the working staff from the social-cultural institutions, from the apparatus of ministries and other central and local bodies, as well as from the other state institutions, will benefit from annual awards from a fund of 3-3.5 percent of the planned retribution fund. + Article 19 Starting with September 1, 1983, the establishment share of the prize fund for outstanding achievements obtained by the personnel from the economic units will be 2 percent of the planned retribution fund. + Article 20 The amounts due to the working staff in the form of participation in benefits, export incentives, annual prizes, as well as other categories of prizes or rewards, are granted, under the conditions provided by law, in relation to economic results obtained and are not capped. The amounts that the management and administration staff may benefit from, as participation in benefits or prizes, shall be established at most in the same proportion as the amounts due to the other categories of staff in the establishment. + Article 21 The case for uninterrupted seniority in the same unit shall be increased and shall be granted in the following percentage shares of the tariff retribution: Tranches of uninterrupted seniority in the same unityFor the staff of all branches and sectors of activity, except for the one provided in lett. The worker staff benefits from the increase for uninterrupted seniority in the same unit, in the increased quotas provided in par. 1, from the date of increasing the tariff retribution in each branch or sector of activity. + Chapter 4 Increase of tariff retribution + Article 22 Starting with September 1, 1983, the tariff retribution of all the working staff is increased, staggered. The date from which the tariff retribution will be increased in each branch and activity will be determined by decree of the State Council. Given the complete use of working time, the fulfilment of the labor norms and the production plan, with the application of the increase of retribution in each branch or activity, the minimum tariff retribution will be 1,500 lei, and the minimum income, including the money rights included in the variable part of the fee will be 1,700 lei, monthly. + Article 23 The increase of the tariff retribution of workers is carried out under the conditions of maintaining, on the whole, the ranking of retributions by branches, which corresponds to the current economic-social development stage of the country The ratio between minimum tariff retribution and maximum tariff retribution on the economy will still be 1 to 5.52. + Chapter 5 Planning and issuance of the retribution fund + Article 24 The retribution fund shall be established on the unit of the product or on the work, on the objective, according to the working time, the quality conditions and the number of personnel required, based on the norms and norms elaborated corresponding to the level of Technical endowment and applied technologies, under the conditions of a higher production and labour organisation. In each unit must be ensured a strict correlation between the retribution fund and the physical production, the production of the sold and collected goods, the export plan, the quality of the products, the normal consumption of raw materials and materials, fuels and energy and other qualitative indicators of the plan. + Article 25 The retribution fund resulting from the summation of the individual rights of all the working personnel from the economic units, determined according to the law, shall be issued by the banks within the planned retribution fund, calculated according to the realization physical production, in close correlation with the increase in labour productivity, export plan, net production value, sold and collected goods or other indicators, as appropriate. + Chapter 6 Final provisions + Article 26 Conditions of application of the form of retribution in global agreement and other forms of retribution specific to branches or activities, the conditions for the establishment and distribution of the fund to participate in the production, benefits and the division of benefits, as well as the conditions for the calculation and release of the retribution fund, shall be established by decree of the State Council. + Article 27 The Council of Ministers, ministries, other central bodies and executive committees of the county folk councils and the city of Bucharest are obliged to take measures to apply exactly the provisions of this law. The organs provided in par. 1 and the collective management bodies of each unit bear the full responsibility for the implementation of the socialist principles of retribution, for the management and use of funds intended for both production expenses and the consumer. + Article 28 Any provisions contrary to this law shall be repealed.
