Law No. 2 of 9 July 1983 concerning the basic principles of improving the system of staffing, payroll and revenue distribution working people ISSUING NATIONAL ASSEMBLY and published in OFFICIAL GAZETTE No. 51 of 9 July 1983 under article 57 of the Constitution of the Socialist Republic of Romania sign and we have to be published in the Official Gazette of the Socialist Republic of Romania law No. 2 from 1 July 1983 concerning the basic principles of improving the system of staffing, payroll, revenue distribution and working people.
NICOLAE CEAUŞESCU PRESIDENT of the ROMANIAN SOCIALIST REPUBLIC law on basic principles of improving the system of staffing, payroll, income distribution and the working people who have Deep-seated transformations occurred in the development of the productive forces in the modernization of the technical-material base of the economy, particularly at the stage of Congress inaugurated the 9th century Roman, Communist Party ensured the conditions necessary for raising on a Centaur upper stage of social and economic activity and increase the welfare of materials and spiritual the whole people, the Supreme goal of party policy.
It was adincit the system of workers ' democracy, the direct participation of the masses in the management of the economy, social life, has increased the liability of collectives of working people in the establishment and implementation of the plan in the judicious management of the assets entrusted to the company.
Taking into account the current state of economic and social development, the improvement of the economic requirements of the financial mechanism, strengthening of workers ' self-management and organizational framework of workers ' democracy, it is necessary to improving staffing, payroll and revenue sharing working people so as to apply to all the socialist principle of distribution decision after quantity, quality and importance of social labour, and proceeds to be directly caused by work and work hard.
The people working, as owners, producers and beneficiaries, carries full responsibility for the proper management of the property of the whole Socialist nation, their incomes being closely linked to the realization of production, increasing labour productivity and economic efficiency of the entire activities.
The work represents a duty of honor for all members of society. Every citizen has the right, under the Constitution, and the obligation to carry out an activity useful to society, to provide the means of existence and spiritual development.
Remuneration and other income of working people reflect everyone's contribution to the implementation of the plan of production, the material and spiritual development of the production of the company. Nobody can receive retributie and to participate in benefits if they are working. Nobody can have guaranteed income if you don't work if you don't produce according to requirements in the workplace.
Individual income in relation to the production carried out are neplafonate.
Under the system of staffing firm applies the principle of equal retributiei at efala work conditions are created, as in relation to the work, to ensure adequate income for all people.
As production growth and labour productivity, improve product quality, increase economic efficiency and profitability, increase income working people.
For this purpose, on the basis of the decision of the National Conference of the Communist Party in December 1982 and of the programme approved by the plenum of the Central Committee of the Communist Party from 29-30 June 1983 on the application of the principles of farm workers ' self-management and self-administration, improving the mechanism of economic-financial, staffing, payroll system and increasing retributiei in this five-year, National Assembly of the Socialist Republic of Romania adopts this law.


Chapter 1 Strengthening of workers ' self-management and accountability Voluntaries, working people for driving units and for results, improving the system for rewarding Article 1 according to the principles of workers ' self-management and economic and financial self-administration, collectives of working people are responsible for the preservation, recovery and development of heritage, in order to achieve an effective and maximum rentabilitati, leading to the full coverage of costs , the own funds of the unit, increasing the income of the worker, staff participation in a measure of how much higher the training necessary for the development of the resources of society.
People working in their capacity as owners of the means of production of the goods of the whole people, and beneficiaries are responsible directly to the effective leadership of each Socialist units, judicious and efficient management of all material and financial assets entrusted to the Socialist property of the whole people, for the economic and financial results obtained in carrying out the tasks delegated to them from the single national economic and social development.


Article 2 the Council of working people to the proper gate direct liability management and the development of Socialist property entrusted to the staff of people working in the unit and shall take the necessary measures to increase labour productivity more sharp, full and intensive use of production capacities, capitalizing on top of all of the material, its strict rules of consumption and stock, rational use of labor force removal of permanent training, the application of the farm prevederitor concerning improving the system for rewarding, mobilizing the entire technical and productive potential of the unit in order to obtain greater yields, high quality, with spending reduced as soon as possible.
The General Assembly of the working people shall discuss and adopt decisions on the entire financial and economic activity of management and development of Socialist property entrusted to the staff of working people, exercise control over how the permanent Council of the working people, its executive management personnel carry out their duties and act for carrying out the provisions of the plan.


Article 3 all staff worker recovery works is based on the principle of distribution after quantity, quality and importance of social labor, depending on the contribution to the material and spiritual development of the production of the entire society, the results of the work.
The work represents a fundamental criterion for assessing the contribution of each person to develop the unity and progress of society, a need for training, and the development of multilateral affirmation of human personality.
Our socialist society ensure the right to work and create the conditions necessary for each to have a job in the field of materials, production activities of scientific-technical and social-cultural construction in relation to skills and training and development requirements of the company.


Article 4 the staffing System ensures retention of material for those who are working to increase production, labour productivity and economic efficiency, as well as equitable income derived from employment, an appropriate ratio between minimum and maximum individual income.
Form of remuneration in the global agreement expands and is generalizeaza in all economic units.
Besides tariff remuneration, staff worker benefits, as part of the retributiei variable, extra income, because of the agreement, the benefits, awards and other incentives, compensations, allowances and increases provided for by law.


Article 5 the people working are supported in relation to the work performed and the results obtained.
In case of overshoot of the planned production revenues grow properly and are not capped.
In remarks delivered production situation or the comunity at the workplace, remuneration shall be reduced accordingly, without to ensure guaranteed income.


Article 6 Granting must be directly related to the increase in labour productivity and on the entire unit.
Labour productivity growth should be in individual income and growth throughout the establishment, in all branches and sectors of the national economy, in order to ensure both the necessary funds to increase the incomes of working people, as well as general resources to cover the costs of the State.


Article 7 where there are possibilities of production tasks cover the whole capacity of the units will be taken for resizing, in accordance with the terms of the tasks of the plan.
Collective governing bodies are obliged to retain only the staff necessary for the effective production worker and redistribute staff in other productive activities, repair, iutretinere, construction or other activities in units within the same central Ministry and other ministries. Such personnel will be with the units that operate properly, works performed, according to the law.


Article 8


For the judicious use of labor in each unit, all categories of staff, including management and staff at the functional form of retribution meted out, operates on the basis of norms and normative work scientific advice, set according to the technical parameters for the operation of machinery and equipment, the amount of work required, the superior organization of production and work.
The rules must be such as to ensure that fundamental labour saving labour productivity and achievement.


Article 9 recovery works staff differentiates branches and subbranch activities, depending on their importance for economic and social development of the country.
Within branches, subramurilor and activities, tariff remuneration differ by type of employment and by function, corresponding to the level of qualification and the degree of responsibility required by the tasks, as well as the conditions under which the work is carried out.
To outlining coefficients remunerations networks charging for skilled workers shall be determined between 1 and 1.355 at category 1 and 1 to 1.905 at maximum category basis, in accordance with the annex to this law.


Chapter 2 extension and generalization of global agreement Article 10 starting date of 1 September 1983, resides in the form global agreement are applied in a generalised economic enterprises in industry, construction, agriculture, transport, research and technological development stiiniifica, design and other sectors.

Under article 11 of the agreement, global staffing, a collective of working people undertake contract is reached with the drive and, if necessary, with the upwards-to carry out a specific work or to achieve a certain amount of products in terms of quality and efficiency, and set the Unit undertakes to provide technical and organizational conditions and materials suitable to carry out the work and retribuie work with the sum stated in the contract.
The global agreement shrinks: industry, achieving a complete product or a work or, as the case may be, the physical production planned; construction-Assembly, a block of flats, industrial Hall, bridge, road, electrical line or other complete works volume times; in agriculture, a certain production of cereals, vegetables, meat, milk, or others; in other branches or sectors of activity, planned physical production, expressed in specific units such as meters, drilled oil extracted tons, cubic meters timber in forest exploitations, tonnes transported.


Article 12 the amount overpaid staff salary retributiilor in global agreement is set forth in the report directly with the quantity of physical products and their quality, without being restricted, both in case of overshoot, and in the case of remarks delivered by plane.

If the tasks of production is achieved with a smaller number of personnel or get an additional production with the same number of staff, it will baneficia, accordingly, higher income.
The tasks of production or the conditions laid down in the contract for global agreement is not achieved, the staff worker incomes shall be reduced accordingly.


Article 13 in relation to the specifics of branches or activities, as provided by law, shall apply to the forms of remuneration on the basis of cote percentage rates draw times. Variable part of revenue staff will represent, in 1985, 25 per cent of the salary Fund, and the tariff remuneration, 75 per cent.


Article 17 as of September 1, 1983, under the conditions to the completion of the plan, the Fund for the participation of working people to the realization of production, income and benefit sharing will represent 4 per cent of the salary Fund.
Within the average of 4 per cent referred to in paragraphs 1 and 2. 1, in carrying out the production for export, as well as in units that deliver parts, spare parts and other commodities, which are incorporated into products for export, ensure a higher participation differed in relation to the share of export in total production output.
Other economic units will ensure, in the conditions to the completion of the plan for the entire staff to participate in the realization of production, income and benefits sharing, that will represent 3.5 per cent of staffing, planned, and the mining and extraction of crude oil, 4 per cent.
Under the percentages specified in paragraph 2. 1-3, from benefits to fund the participation of working people to the realization of production, income and benefits sharing, differentiated, on other organs, ministries, central executive committees of councils and popular of the municipality of Bucharest, single national plan for economic and social development.
Participation in the realization of production, income, and sharing of benefits shall be paid quarterly, in relation to the benefits achieved and to a maximum of 50 per cent of the funds planned for these periods. According to the annual results, the difference shall be granted to the benefits achieved under the plan and the amounts of benefits over the plan.


Article 18 as of 1 September 1983, workman of staff social-cultural institutions, the ministries and other Central and local bodies, as well as other State institutions, will benefit from an annual prize fund of 3-3.5 per cent of the salary Fund planned.


Article 19 as of 1 September 1983, the rate of incorporation of the Fund for outstanding accomplishments achieved by the economic units will be 2 per cent of the salary Fund planned.


Article 20 Amounts due from staff in the form of worker participation in profits, export incentives, annual awards, as well as other categories of prizes or rewards, shall be granted, under the conditions provided for by law, in relation to the economic results achieved and are not capped.
The amounts of eligible staff and the Board, as participation in the benefits or awards shall be not more than in the same proportion to the sums due to the other categories of personnel in the unit.


Article 21 Bonus for seniority in the same continuous unit shall be increased and will be granted in the following tariff quotas: a percentage of the remuneration cuts uninterrupted in the same old establishment for staff in all branches and sectors of activity, except as provided for in subparagraph (a). Date of the tariff remuneration in each major branch and activity will be determined by Decree of the State Council.
In the conditions of use of work time, completion of work rules and plan production, with the application of an increase each retributiei branch or activity, remuneration will be tariff minimum 1,500 lei, while the minimum income, including money given in part the retributiei variable will be 1,700 lei monthly.


Article 23 the increase in tariff retributiei of workers must be carried out under the conditions of maintaining, on the whole, of any hierarchy or retributiilor branches corresponding to the current phase of economic and social development of the country.
Relationship between tariff remuneration remuneration maximum and minimum tariff on economics will still be 1 5.52.


Chapter 5 Planning and staffing, salary Fund Article 24 shall be determined per unit of the product or work on goal, according to working hours, conditions of quality and number of staff required, on the basis of corresponding rules and norms developed to the level of Government Emergency Ordinance Nr.77/2009 technique and technologies applied in conditions of a superior organization of production and work.
Each unit must ensure a strict correlation between Fund staffing and physical production, production of the goods sold and received export plan, product quality, regulated consumptions for raw materials, fuels and energy, and other indicators of quality.


Article 25 Fund for rewarding results from the summation of the individual rights of all staff worker from economic units, as determined by law, are issued by banks to the extent of staffing, planned, based on the achievement of physical production, in close correlation with the increase in labour productivity, export plan, the net value of production, production sold merchandise and charged or other indicators where appropriate.


Chapter 6 final provisions article 26 conditions under which resides in the shape of global agreement and other forms of rewarding specific branches or activities, the conditions for the formation and distribution of the Fund to participate in the realization of production, income, and the Division of benefits and the conditions for the calculation and issue of staffing, are established by Decree of the State Council.


Article 27 the Council of Ministers, ministries, other central executive bodies and committees of the District Councils and popular of Bucharest are obliged to take measures for the implementation of the provisions of this law very closely.
The bodies referred to in paragraph 1. 1 and the collective management body in each unit carries full responsibility for the implementation of socialist principles of staffing, the management and use of funds for both the costs of production, as well as those of the consumer.


Article 28 any provisions contrary to this law are hereby repealed.
This law was adopted by the National Assembly at its meeting on 1 July 1983.
